In that house in my garage I punctured a wall in the garage and there's a steel plate on the ground of the floor. A foot and a half, about a year and a half ago or so, a foot and a half away from this steel plate is a shower in the master bedroom. Interesting the things that you hear in an inverted world and I'm wondering when you're going to take child abuse seriously because you take getting money very seriously? And you're good at it. But when it comes to child abuse, you let it perpetuate by your unwillingness to stop it when we have places like the Polinsky Center that are open and all of the juvenile detention centers where a lot of sexual abuse goes on. We sexualize children and that's grooming children.

And it's interesting when our mess becomes our message because You know, I didn't know that the five-year old me that was strong enough to report sexual abuse had to wait four years for it to stop. For a total of it going on for nine years and I never thought that 40 years later I would live in a world where it is ignored and brushed under the rug even more so than it was then. I actually had to call that man, I was brave enough to do it at 12 years old and get him to admit it.

And then I think about like that child and so I'm fighting for her and all of the other children who maybe can't come forward or maybe they do and nothing happens because even if it happens at a school It gets buried and other children can't come forward because they don't talk about it with parents, but they have like you can tell when something's going on.

When children are being sexual, when they are acting different and they don't want to go be near somebody. And it's like what are we telling them when we have places like the Polinsky Center where there are hundreds of cases and nothing is done? So I'm wondering when you guys are gonna do something about this and take it seriously.

Good morning, I'm nervous and my voice is probably gonna shake plus this is a very emotional subject for me. I'm Terri Best, a voter in District 1. I was recently at an expungement clinic where I volunteered alongside a local attorney with a new baby. This new mom had a baby sling at her hip and she ran the clinic like a boss feeding her child whenever she pleased and keeping her close.

Afterward, I told a friend it was one of the most revolutionary things I had ever seen. Then I attended the August 19th County Board of Supervisors meeting and had the privilege of seeing Tara with her new baby on the dais. It did my heart good. It was then marred by unkind words. I'm here to show my support to the women of this board and for Tara. This is a time when a newborn baby is very short and very magical I'm proud of you for bringing your baby here.

It is revolutionary and it is a turning point. Congratulations for paving the way, and thank you all for enduring.

Oh good morning this is Peggy Walker. I want to say that the more I watch this board in action the more I realize that the unincorporated area is the unwanted stepchild of a county That unfortunately seems to be because the majority of three decision makers don't live in or represent these areas favorably, while the two supervisors who actually represent the rural area are always voted down due to back country's detriment. There is the issue of payroll sexually violent predators who seem to end up in rural areas like Borrego Springs. There are health disparities and controversial industrial scale Energy projects such as solar and wind decisions that disregard rural quality of life.

Yesterday, there was condemnation of non-lethal electric shock gloves as cruel and unusual punishment that would quote damage communities but that makes me wonder then why do three supervisors think it's okay to impose high potency THC on communities that do not want a proliferation of product Proven to cause costly, damaging, even lethal outcomes. The county is already running a deficit. Will tax revenues destined for the general fund be enough and actually be used to address the significant regulatory costs of marijuana commercialization from code enforcement, environmental monitoring, planning staff, sheriff, fire, EMF, and legal costs Thank you. Good morning, Board of Supervisors. My name is Terri-Ann Skelly and I attend my county planning group. I work in public health and youth mentoring and tutoring programs. In my work, I often receive health alerts from national research and educational agencies I received six health alerts from American Lung Association. One was entitled Cannabis and the Lungs. The excerpt included, cannabis products have many more forms than nicotine does including vaping, smoking, dabbing, edibles, topical and juice.

When cannabis liquid oil or plant material is heated in a device an aerosol is released which is suspension of fine marijuana particles in a gas. These fine particles can damage lungs and cause heart disease because aerosizing cannabis can lead to decreased lung development, increased breathing difficulties, lowered defense against bacteria and viruses, and more frequent inflammatory reactions. The inhalation of harmful chemicals found in e-cigarettes where the cannabis and nicotine can cause or make Worst irreversible respiratory diseases.

I respectfully suggest that the county reinforce its goals to improve the health of its residents by reducing sales and promotion of all of these products. Thank you for hearing me speak this morning.

Good morning Board of Supervisors. My name is Becky Rapp and today I want to bring to your attention an important bill that Governor Newsom signed into law on August 31st just two days ago, and that's AB 2249. This legislation strengthens the protections California voters were promised when they passed Prop 64 giving cities and counties the ability to permit pot shops in our communities Voters were promised that safeguards would be put into place protecting our children and youth.

And clearly, Prop 64 was not clear enough as the industry was left to decipher what was appropriate. And we've seen this in advertisements and billboards and on packaging. The bill strengthens and clarifies those protections It specifically addresses cartoons and child-oriented imagery, candy and sweets and products that mimic goods primarily marketed to children. These protections are crucial and way overdue.

The California Poison Control System reports that cannabis related calls more than doubled between 2016 and 2024 and even more concerning cannabis exposure calls involving children under six increased by 445%. Most reported exposures in young children were unintentional and they were in the edible form of products. And that was in a vast majority of these cases.

These numbers remind us why the issue is not just about packaging, it's about real children and real families. And our city, our county must act now. Please support the implementation of AB 2249, educate local marijuana businesses about the upcoming requirements and encourage businesses to review their packaging and marketing now. This bill only works when it is enforced. Thank you.

Good morning Board of Supervisors, Anne Riddle here. I came to say thank you for the robust conversation regarding agenda item 19 yesterday regarding the placement of sexually violent patients within our unincorporated area. I appreciated the staff report that came out of Desmond's office regarding this item because it began to put on paper The many concerns we have here in our unincorporated areas that we are a dumping ground, but somehow because we don't have representation like we would if we were in a city that you could make decisions that affect us so dramatically.

I was very impressed by the equity impact statement noting that we have significant equity concerns in the unincorporated area because we face Huge economic and resource challenges, and I ditto that. Oh my gosh yes! And that several of the communities within our unincorporated area here in the county are on the list of most disadvantaged category as communities is a record kept by the University of Wisconsin School of Medicine and Public Health, and I appreciate that we have Organizations, particularly university organizations who are tabulating these sorts of things. Because we have disproportionate access to law enforcement and public services, particularly medical and an inability to get easily anywhere. I am particularly concerned about the lack of local law enforcement.

Hi good morning, Oliver Twist here. I'm asking this board to take a closer look at illegal marijuana cultivation in San Diego County's backcountry including the large operation discovered near La Posta a couple of months ago. These are not simply zoning or cannabis issues Illegal growth can involve dangerous working conditions, environmental damage, depletion of groundwater and water resources, unpermitted structures, water and electrical hazards, and potentially the exploitation of vulnerable workers. The county's own grand jury raised concerns about the continuing illegal cannabis market and ineffective enforcement while also noting that San Diego County has not comprehensively documented the law enforcement impacts of cannabis legalization.

So I'm asking, what do we actually know about the people working at these illegal grows? Were they being paid minimum wage? Were taxes being paid? Were workers' comp requirements followed? Were the workers free to leave or were they being coerced threatened or housed or exploited. I would specifically ask the board to refer this issue to the Office of Labor Standards and Enforcement for investigation and coordination with a sheriff district attorney in appropriate federal and state agencies And I'll leave you with a broader question. SB 54 was enacted on the theory that limiting local involvement in immigration enforcement would increase trust and public safety, but years later is that true? Could restrictions on immigration enforcement cooperation inadvertently make undocumented workers more attractive to criminal enterprises precisely because those workers are vulnerable and less likely to report exploitation?

It's not an accusation, just a question worth investigating. Legal cannabis should not provide cover for illegal cultivation, labor exploitation or human trafficking and it certainly should not put San Diego backcountry residents in danger. Thank you.

You guys in your traffic advisory committee and lowering speed limits so that you guys can get revenue from people speeding all of a sudden down a road that they used to drive down that was five miles an hour, ten miles an hour high or whatever. And cannabis this is just so interesting that it is the most taxed and regulated business where it went from people making 100% of their money pretty much down to 1% after you guys take it and after they got a pay cut because you can't even sell it for what it used to be sold for.

I mean, you can get an eighth for like $3. Those used to go for like 50 bucks. So it's just interesting when people want to be governed harder and how something like this can be regulated so heavily, and then we put sexually violent predators in our communities. And you're talking about a expansion of the sensitive buffer here from 600 feet to 1,000 feet. Yet we have pedophiles all over the place Right near children, ready to re-offend.

Is that not weird to you guys? That like for you to fight the war on drugs you're gonna be drug deal regulators and then there's nothing we can do about pedophiles working in your own facilities. How is that not something that's highly regulated? In fact, we have legislatures who are trying to allow pedophiles to work in office and at schools and stuff. But not a rapist. Like if you rape an adult it's different.

You know? It's great isn't it? Isn't it cool that you guys get billions of dollars from people dealing drugs? And pedophiles run rampant! What an inverted world.

I know this gentleman was listening, this gentleman was listening but the rest of you are not listening to the people. We're not talking about anti-cannabis here we are not talking about Not taking care of people that were possibly harmed by breaking the law in the past, which is no longer the law. What we're talking about here is a little old lady that swallowed the fly. Remember her?

Tiny little problem she swallows a fly then she swallows a spider to fix that problem. Eventually she swallows a cow and she dies. You have a few hundred applicants for this cannabis program at this moment We have over 500,000 people in the unincorporated parts of San Diego that are not interested in having cannabis growing in their backyards or expanding retail around their schools and centers. And 1,000 feet is not gonna cut it.

I wish you all to go to Carpinteria, a great case study where they have had over 4,000 complaints Just about the smell. And that's in a population of about 10,000 or less. Imagine the number of complaints you will have and the administration in order to address all of that and the costs. Most of those cannabis farms in Carpinteria are not filing their taxes, they're not maintaining their equipment It smells, I was at a rose farm right next door and it smelled like pot.

All aboard, the ordinance is wrong right off the bat when it defines cannabis as including every quote derivative mixture or preparation of the plant unquote in section 1a by the way. Like regular medicinal practice you don't give a drug the same name as any of its components although some of the limits are good Politicians are good at taking advantage of the rename game.

Looking at the use matrix and ordinance, it's good that cannabis facilities wouldn't be allowed in residential areas but a defeat to purpose if you let that be sold in bars or restaurants or stores which could subject lots of people to secondhand smoke It could be a big fire hazard at gas stations. It's also a mistake to allow that funerals, there are too many kids in the place of worship same number of kids and not a good idea to communication services where those do disorienting and distracting or financial services where grownups often they're with kids The ordinance has too many big, huge defects to approve.

And you know as the previous speaker said this stench is disgusting. The water use is disgusting and you know if these people aren't paying their tax bills and violating laws all over place I mean Why even negotiate with them? As for the tax stuff, this time it seems good. Although I have...

Hi, good morning supervisors. I urge you to vote no on the cannabis program on item two here. The people who will have to live with the consequences of this program have come and spoken to you, I know you've heard them. And the majority of people still don't have any idea this is happening that it's going to affect anyone that I've spoken to about it is completely shocked, completely shocked that this is happening in our own county.

And residents have come forward with concerns about their communities, the environment, and most importantly, our children And yet, you're still trying to move forward with a program that expands commercial cannabis access into our unincorporated communities including retail businesses, cultivation, manufacturing, consumption lounges and cannabis events. Parents are not asking for more places where cannabis is grown, sold, promoted and normalized.

Children are not asking for greater exposure to an industry built around a psychoactive drug As elected representatives, you have a responsibility to listen to the people who live here and to consider the interests of the next generation. Not only to expand interest of industry when the concerns of families and children are repeatedly outweighed by the desire to expand access to cannabis that is not true representation.

Please listen to your residents and please protect our children and vote no on this item. Thank you.

Oh good morning Board of Supervisors, sorry about that yes my name is Terri Anskele I'm a parent a youth mentor and public health educator for my community schools. I call in to address item one and item two on the consent agenda first Item number two, I oppose the cannabis social equity cannabis program. I have participated in all county sponsored listening sessions planning group presentation and board of supervisors meetings regarding the SEGP staff conclusions do not represent the comments we provided all through the 2025 meeting so much for stakeholder meetings It seems very unfair that this board has decided to manipulate the stakeholder opinions, to create a false narrative form of authentic stakeholders. It seems very clear to me that supervisors were determined to provide financial and resource laden preferences to one very small group of people over the inhabitants of our unincorporated community.

We have so many needs for more law enforcement coverage, better roads and lighting school updates and access to medical care. We are abused by political party agendas of three of the supervisors which have only a small portion of the unincorporated communities under their purview. FYI it doesn't look good to the 33 percent of independent voters that live in the unincorporated communities The board has disrespected our decisions and opinions, and dictated to us instead. This is not transparent or equitable or fair. Thank you for hearing my concerns this morning.

Good morning Board of Supervisors. My name is Becky Rapp and I strongly oppose the socially equitable cannabis program. County planning groups, residents, business owners have all spoken unanimously against this program. The county's own secret review proved that the proposal was not sound land use decision The Planning Commission also expressed concern and did not find the ordinance to be good land use policy, but the board has chosen to move forward primarily because of social equity.

Social equity should not take precedence over responsible land use planning. This is ultimately a land use decision And it should be evaluated on appropriate location, environmental impact and the interest of the community. The board has a responsibility to make decisions based on land use not emotion, political pressure or moral obligation. I ask this board to reject the ordinance and prioritize responsible land use policy when it comes to our community in the back country.

As a public health advocate I urge the county should not move forward with this cannabis program due to the health safety environmental impacts marijuana businesses will have on their residents and the community. The county has not addressed the environmental consequences of marijuana commercialization growers use pesticides fertilizers that contaminate the soil and water resources Cultivation requires water resources often exceeding the traditional crops, leading to the strain on local water supply. The cultivation and processing of marijuana generates significant odor and packaging in chemicals that improper land use leads to pollution that harms our local environment.

Expanding excess will increase availability due to the perception of risk and encourage greater use, potentially increasing addiction, impaired driving, psychiatric illnesses and increased emergency visits. Our young people deserve better. They should not be led to believe high potency THC products are harmless. We have other marvelous opportunities at the county that we could provide instead. Perhaps we should pause this proposal until we examine other answers more efficiently and successfully. This is not the answer to a problem you want solved. You've identified the problem, come up with an answer that makes sense. This isn't it. It makes everyone in the unincorporated area feel dumped on Your planning groups to a planning group are against it. Why bring a business into an area or help somebody bring a business into an area that nobody wants them? How wise is that?

As you know, the county has five permitted pot shops and I think you know that one has folded. And it went out of business because they couldn't pay its employees, wouldn't pay maybe, or state and federal business taxes This is not a business that really could be useful to people. THC potency has increased dramatically and concentrates can deliver extraordinarily high doses. The health concerns are no longer hypothetical. The National Academies found substantial evidence of an association between cannabis use in the development of schizophrenia and other psychoses, and the greatest risk among frequent users. The CDC also warns about psychosis, schizophrenia, impaired attention, memory, and learning. So why would the government policy encourage expansion of this industry?

We spend enormous amounts of public money addressing mental illness, homelessness, substance abuse, educational failure and young people struggling to become productive adults. At some point we need to ask whether our policies are working at cross purposes. The larger human question is here every intoxicating substance carries an opportunity cost Hours spent impaired are not hours spent learning, building, creating, parenting, working or developing potential. Adults make their own choices but government doesn't have to promote every choice, subsidize an industry around it and call the expansion of it equity. It certainly also does not have to harm the back country again and again. Maybe true social equity is helping people reach their fullest potential, not making increasingly potent intoxicants

This balance sheet of benefits versus burdens is not equitable. However, it will never be worth the harm that is causing and the public trust you are destroying.

Nearby residents will receive for their part in the equity odor traffic groundwater concerns noise security concerns and changes in land use and enforcement impacts. The county has never demonstrated why this constitutes social equity and why it needs to put this program forward. Good morning, Chair Lawson-Reamer and Supervisors. I'm Sean Oberbauer with Planning & Development Services. Today I'll be presenting on item number three which is the appeal of the York Tribes Senior Living Project which includes 183 units of de-restricted senior housing. On May 8th 2026 the Planning Commission approved a major use permit and adopted the environmental findings for the project. The department is before you today recommending denial of the appeal in upholding of the Planning Commission decision of approval of the project.

The project site, identified by the red star, is located within the North County Metropolitan Subregional Planning Area on an approximately 4.27 acre property. The project site is located in a portion of the unincorporated county that is surrounded by incorporated cities and in a transit priority area. The City of Vista is located 1,000 feet southwest of the project site.

The Buena Creek Sprinter Station is located 1300 feet southeast of the project site, and State Route 78 is located half a mile to the southwest. The Inland Rail Trail and Buena Creeks Printer Station rail tracks are located along the southwestern boundary of the project site. Lastly, the Vista Gardens Memory Care Facility is located directly adjacent to the site to the southeast.

The project consists of a major use permit for 183 units 62 and up deed restricted senior living development on an approximately 4.27 acre property. The use is permitted within the zoning of the site upon approval of a major use permit. The project includes a four-story building that is approximately 46 feet tall with roof access structures reaching approximately 54 feet.

Each floor ranges in size from 34,000 to 35,000 square feet. The first floor includes 24 senior units, as well as a variety of on-site amenities for residents including a salon, library, communal kitchen, recreational rooms, fitness rooms, laundry services and a theater. The second, third and fourth floors include 53 senior units each. The remaining portions of the project site include an open courtyard, pool, spa, parking lot, landscaping and signage.

Road improvements for the project consist of widening and restriping York Drive to create a longer left turn lane onto South Santa Fe Avenue, as well as an all-way stop at the project entrance. The road improvements have been designed based on a traffic analysis for the project. The project also includes the replacement of a bench with a shelter at an adjacent NCTD bus stop along South Santa Fe Avenue And in accordance with the City of Vista Sewer Master Plan for the Buena Sanitation District, the project will result in construction of off-site sewer improvements approximately 600 feet south of the product site along and near El Valle Opulento.

The proposed offsite sewer improvements outlined in red on the slide are proposed within existing easements granted to the Buena Sanitation District where there are existing sewer lines located between homes. County staff and the Buena Sanitation District have previously met onsite with neighbors along El Valle Opulento in order to discuss the improvements.

No homes will be removed as a result of the sewer improvements But there are existing unpermitted structures within existing easements granted to the sewer district that will likely need to be removed or relocated as a result of construction and maintenance access. The appeal of the May 8th, 2026 Planning Commission decision has been submitted by a property owner adjacent to the sewer improvements.

Regardless of the project, the Buena Sanitation District intends to complete the sewer improvements due to ongoing development in the area. The request to appeal the project focuses on five main points The first and fifth points of appeal state that the project fails to adequately evaluate environmentally superior and feasible alternative sewer routes, as well as financial and quality-of-life impacts.

The project site offsite sewer improvements have been designed based on coordination with the Sewer District, as well as consistency with the 2017 and 2025 Buena Sanitation District Sewer Master Plan. The sewer line has existed within the easement since the 1960s. Any alternate route for potential improvements would require acquisition of new easements, development of new alignments and processing of permits that would result in additional costs and impacts on all residents served by Buena Sanitation District.

Regardless of the project, the residential properties contain an existing sewer manhole and sewer lines that need to be maintained to serve the existing residential properties as well as to connect to other sewer lines southeast of the residential properties. Lastly, any decisions regarding alternate sewer routes that deviate from the Buena Sanitation District Sewer Master Plan are set by the Buena Sanitation District and not by the County of San Diego.

The second point of appeal states concerns that the project relied upon a conceptual sewer master plan that does not include engineered construction details. The Sewer Master Plan is intended to be a guidance document that outlines short-term and long-term sewer infrastructure improvements. The Sewer Master Plan is not intended to include site specific construction details.

The construction details will be developed during processing of construction level permits after coordination with Buena Sanitation District. The processing of construction permits will require additional engineering and testing of unpermitted structures within easements granted to the sewer district in order to minimize impacts to the residential properties.

The third and fourth points of appeal state that the project will have potential impacts to sensitive biological resources as well as residential properties. The points of appeal also state that the project included inadequate environmental review under the California Environmental Quality Act, including concerns related to environmental impact reports, the Federal Emergency Management Agency or FEMA, and offsite infrastructure impacts.

The Biological Resources Report and Mitigated Negative Declaration for the project evaluated potential impacts to biological resources and coordination with outside agencies. The residential properties and sewer improvements contain floodways and floodplains, as well as a creek. The project includes mitigation measures in conditions of approval that will result in compliance with floodway and floodplain regulations and minimize impacts to biological resources.

The project is conditioned to prepare a construction plan delineating the final limits of construction and staging areas needed for equipment. The project is also conditioned for future coordination and permitting through outside agencies as needed, such as FEMA. Based on staff's analysis we recommend the board take the following actions. First, deny the appeal and uphold the Planning Commission's decision to grant a major use permit for the project and adoption of the environmental findings for the project which includes a finding that the project can be found in conformance with the California Environmental Quality Act through the adoption of a mitigated negative declaration.

Second, require the applicant to enter into an agreement to defend and indemnify the county in accordance with County Code Section 86.201 in the amount of $800,000 and authorize the director of PDS to execute the agreement. This concludes staff's presentation and we're available for questions. Thank you.

My name is Kimery Wells, I'm an affected property owner and designated representative for the three property owners directly affected by the El Valle Opulento sewer improvement. We're not opposing necessary sewer improvements or responsible development. We're asking you not to approve environmental findings and assume an 18-inch master plan sewer improvement can be constructed through our residential properties when fundamental questions remain unresolved.

First, the project has not been sufficiently defined. Buena confirms the engineering surveys and construction plans have not been completed The improvement is only projected to remain within the existing easement. And construction and staging limits must be still identified. The construction footprint should be identified as it impacts evaluated under SECA before environmental improvement, not afterwards.

Second, the necessary property rights remain disputed. These are limited recorded sewer easements We dispute that they authorize materially increasing the burden on our properties for an 18-inch regional master plan improvement and permanent access. Those rights should not simply be assumed as part of this approval. Third, reasonable alternatives have not received comparable analysis.

We submitted a Santa Fe Robellini gravity alternative using Buena's own GIS data. The county and Buena have provided conclusions for rejecting it but not the underlying engineering analysis demonstrating why it does not work. Finally, BOINA acknowledges this is a sewer master plan improvement. If BOINA intends to construct it with or without York Drive, its independent authority to do so is a separate issue. That does not justify using York Drive's approval to commit to this alignment before these issues are resolved.

One of them is ours. This is not simply replacing an existing pipe with another pipe of the same size. The proposal replaces an existing 8-10 inch sewer with an 18 inch sewer.

The engineering materials anticipate excavation, shoring, bypass, pumping, construction access, staging and restoration. These are established residential properties. These are our houses, yards, landscaping, mature vegetation, walls. Other improvements surrounding the existing sewer easement. Earlier engineering information contemplated drivable access to the downstream manhole and acknowledged that homeowner improvements in retaining walls could require removal or relocation.

Excuse me. Brenna now says it is evaluating a lower impact maintenance access path That change demonstrates why the missing details matter. We still do not have completed construction plans showing where heavy equipment will travel, how wide the construction area will be, where excavation bypass equipment and staging will occur, what walls landscaping vegetations will be removed or precisely how the properties will be restored.

Brenna's recent response says the proposed improvements are only projected to remain within the existing easement. These aren't minor details that should be determined after project approval. They determine the actual burden placed on these properties and the people who live there before committing to this alignment, the board should require plans that show what will actually happen on the ground.

We're not against the actual senior living community we're against how and where they are putting the sewer which is literally right in our backyard The sewer runs through established residential properties, as I just said. And the creek is a riparian habitat are actually on our properties. The area is not simply a disturbed residential corridor.

The photographs being displayed show mature vegetation along the sewer corridor and how close the existing sewer manhole is to the creek. At the end of my speech here, I'll kind of go over each individual picture. The majority of the vegetation along the creek is naturally occurring volunteer growth, not planned residential landscaping and includes natural or mature California black walnut trees and coast live oak trees. Coastal California gnat catchers have also been regularly observed on the property along the creek corridor including adults feeding their young on our properties.

The environmental conditions matter because the biological assessment states that there are no mature trees and proposed for removal within the easement area. The actual construction footprint, like everyone stated is still not established which to us is so important because it's literally right on our yard that we want to know where they're putting everything and what they're doing during construction. It's literally a foot outside of my door, I have a son, I've got all my animals it's just not okay. Boina Sanitation's recent response confirms that the limits of construction and staging has still not been identified like i just mentioned. It also states that construction drawings will identify jurisdictional waters and wetland delineations and determine weather permits from Army Corps Engineer, Regional Water Control Quality Control Board or California Department of Fish and Wildlife are required.

That means important environmental questions still depend on the plans that have yet to be completed or shown to us at all. You cannot know which trees, habitat, creek areas or wildlife resources will actually be affected until you know where the excavation equipment staging and access will occur. The environmental review should evaluate the construction that will actually take place Not just the assumed footprint that may change after the approval. We respectfully ask you guys to require an analysis first of all of our optional ways, first just going right through our backyard.

If you can show picture number one. Okay so picture number one Thank you. You know, set there by any means. And that tree is approximately 30 feet tall and 65 inches in diameter. Literally if we take out all these trees we will have nothing back there. Number three is a black walnut tree that is about 58 inches and 18 inches in diameter. Picture number four are the trees on the easement looking west to east along the easement path, literally right there is where they're proposing the road goes and you can't see my house but my house is right next to it And then picture number five is the manhole at the end of the easement from the top of the creek. Based upon that information the owners calculated approximately 1,585 feet of sewer required improvement along the alternative when the When the purpose, El Valley, when the proposed El Valley Opulental Phase One Improvement and its future master plan extension are considered together their calculations approximately 1,520 feet.

In conclusion this project delivers far more than new housing. We identified the need for this sewer project and unfortunately That corridor has been there since 1965. That sewer has been there, it's always been a trunk sewer. It was there when the residents bought the property, the easement is there and it's bound by horizontally and vertically that's where the sewer goes so there's not a whole lot of opportunity to relocate it but we did look at all those alternates All those alternates ended up being orders of magnitude of like three or 400% the cost, or trenching the depth of this room in a major intersection, that type of thing. So where the sewer needs to be is between those homes and as far as the impact there is a 15 foot wide sewer easement between those homes.

That's where the impact is going to be so it is not designed out to a construction level of detail like you would see on a full public improvement plan but we know that it has to go through those homes At a depth of, I want to say eight to 12 feet. And so there will be some trenching and some shoring and then part of that that I feel was the real point of contention with the neighbors is that we have to maintain access to all of the manholes for the event of emergency in the event of an emergency like a sewer spill into the adjacent creek or blockage being that it is going to be an 18 inch sewer which is a relatively large chunk line that serves all of the Buena Sanitation District In addition to emergency access, it's routine maintenance too.

So there will be some sort of... It's not a full public road or paving or anything like that. It's just a gravel access path to get to that manhole with our equipment. I believe it's slated for 10 feet on the plans, yeah. Okay, and is that to get a vehicle down there? Is that primary... It is. The primary goal is to have a vehicle go through there. He got 350 days in jail and five years probation for the first one. And he got eight years for the second one. His victim got a life sentence. And the Superior Court judges that grant parole, and in this case, Phillips wrote a self-serving petition for conditional release at Judge Iyer...I can't pronounce his last name. Granted, that man should be removed from office because he clearly has a lack of compassion for SVP Dickens and an utter lack of common sense.

Okay, no it's fine. From the Water Authority again the last meeting we executed a long-term agreement to sell the city of Burbank excess water believe it or not we got excess water in San Diego County primarily because you have to order it like 10 years out and we actually ordered more than our citizens are actually using because of cutbacks and everything else and landscaping so we're doing a great job But unfortunately we've got this excess water that we are responsible for, that we still have to pay for. So the City of Burbank is going to be taking some of that off our hands and also previous to that we had in Riverside County eastern and western municipal water districts are also purchasing water.

I doubt rates are going to be going down, but it's gonna help stabilize some of the infrastructure costs at the Water Authority. And just real quickly on another topic, it was in yesterday's meeting that I would have liked to brought up during the Tijuana River for the new treatment plant. There is technology out there that can reuse this sludge and turn it into energy. So I guess in this feasibility study, I'm just asking and I know we can't put in this or anything else But just putting out there the fact that during this feasibility study, if we can make this a kind of a holistic approach is not only do we treat the sewage. We get you know not putting it into the ocean but if we can transform it and turning into energy and maybe make money off it or something like that so as part of the feasibility study looking at ways we can kinda make this whole whatever sustainable process going forward instead of just right now the sludge from the current plant is just going back over to Mexico But I've looked at technologies out there that can actually turn that sludge into...

into electricity. I don't know how, but if we could just look at that as part of the overall feasibility study going forward.

I think that's a great idea. I would just also put a caveat there We will be hopefully looking at treatment of chemicals and heavy metals. So that needs to be considered as well. Was that enough? That's how Carlsbad does it, right? They generate their own electricity to keep their treatment plan going. It's 100% closed loop. That's great.
