here Is there any reordering of the agenda tonight? Mr. Mayor we have no reordering agenda this evening All right so we'll move on to presentations and it looks like tonight we have one from our community organization support grant update with Veggie Rescue
Good evening, Councilmembers. I appreciate the opportunity to share an update on the impact that Veggie Rescues had with the support of the City of Buellton with grant dollars. Thank you very much. Because of the support of the City of Buellton, we've been able to directly impact the City of Buellton through the Santa Ynez Valley Community Outreach in 2025 with over 111,000 pounds of food rescued and donated to them to help with their food distributions, outdoor food pantry, meals on wheels programs affecting seniors, families and veterans alike.
Using the standard government metric, that equals $189,284 of savings directly to the Santa Ynez Valley Community Outreach that they would not have to spend on food otherwise to allow those dollars to be freed up for other program services. Outside of the city of Buellton, we also impact other organizations in the valley that are community-facing that I know take advantage of by Buellton residents. And we calculated that we have also delivered rescue produce to almost about 40,000 pounds of produce Community organizations serving the S.Y.V. Valley to a savings of about $65,000 that could otherwise be done. So the impact of the grants funding from the City of Buellton has had direct and significant impact on the City of Buellton and its nonprofits and the people who are accessing these services to allow them to get nutrient-dense food that they might not otherwise be able to get This last year, Veggie Rescue is also starting a organic farm just outside of Buellton.
I don't know if the address is Buellton or not. I'm not 100% sure. It's off 246th. I am not familiar with where the line is drawn but it's really close and we, it's a 20-acre farm that we are growing food specifically to give away only and we believe that this farm when fully operational will be able The city of Buellton has donated about 400,000 pounds of food across the valley but also specifically in a substantial amount in Buellton.
So yeah, those are some of the impact numbers and impact that the veggie rescuers had in the city of Buellton and in the little quarter of the valley there that has been a direct result

My name is Steve Palmer. I'm the president, presently the President-Elect for the Solvang Rotary Club but more importantly for tonight, I was a chairperson for this year's Solvang Fourth of July Parade, the committee within our club and I'm here first of all tonight to say thank you for participation. I believe we had 100% participation of the City Council here participating in the Solvang Parade. I think you may have beat the city of Solvagng in participation on the City Council so congratulations on that.
And also just in general for the support that City of Buellton has provided for Rotary Clubs in general and the community. So, but on behalf of the Rotary Club of Solvang I wish to present the City Council and the City of Buellton with a gift What we had done, we had a commemorative Declaration of Independence put together with no signatures on it. And we had it signed by all the members of the Solvang Rotary Club.
Also took her to the American Legion and the VFW post in Solvange and had signatures put on there. No included down here is at least one signature of a World War II veteran. I know Scott has been hugely So I say that's pretty much about it. I think it's oh, we wanted to read the inscription and put into the record. So July 4th 2026 Solvang California on this day July 4th 2026 marking the historic 250th anniversary of the Declaration of Independence. We gather to reaffirm our devotion to the nation's founding ideals We do solemnly pledge our commitment to the sacred principles of life, liberty and the pursuit of happiness. By our signatures below we honor the legacy of those who founded this republic and dedicate ourselves to preserving the unalienable rights, justice and equality that define the American spirit for generations to come.

Afternoon Council, A.J. Tarman here to speak about three things. Firstly meetings set on Mondays I'd like to see them sit on Saturdays so seniors can come out in a more convenient daytime. Second a short history lesson in 1908 the California reform governor Hiram Johnson said to avoid one-party corruption typical of East Coast cities Buellton City offices are supposed to be non-partisan.
Yet Mayor Silva outspent Mayor King 10 to one, $35,000 to $3,500. Silva's money came from 80% outside sources. The lion's share came from out of town Democrat PACs. We taxpayers are onto the goal of UCSB graduates to make this county a one party machine Our system is based on checks and balances. One-party systems, as per Hiram Johnson, lead to corruption and cronyism.
Red China operates like this as DSA crept into tiny Buellton. I call on David Silva to agree to a $10,000 campaign limit. That would level the playing field, not a 10-1 margin, to win by 100 votes. Thirdly, to consider a raise for City Manager Wolf is wrong. He makes $200,000 a year. The average Buellton household makes 67,000. This is for a one and a half square mile city Candidly, urban blight is up under the city's management. We had another traffic fatality, increased speeding on 246.
The historic piece of billboards are now eyesores. Mr. Manager for 2200,000 a year it would be up for me to go repair those billboards. I think it's really sad for all the people who've come to Buellton and seen those beautiful billboards and they're graffitied That's like our entranceway. And if you dare, walk across the street to the sheriff and ask the cycle officer what gives with all this speeding? And Waldorf School is an eyesore. So thank you for listening. Council Member Sanchez? I have one thing. We were invited over to Lompoc to visit the Lompoc Theater Project It's a big deal, the whole city block or most of the city block is where the theater is. And I grew up there and I used to go there as a kid so it was quite a treat for me to get to go back in the theater. And it's a big project. There was somebody in, I don't have the name Andy but from Montecito came in with $5 million and another million dollar matching fund It's a pretty high percentage.

for the introduction stuff so maybe with the arts and culture committee we may do something that has something to do with theater in Lompoc too because it's quite a cultural center or going to become a cultural center and I just wanted to thank the Lompoc committee for inviting me over showing interest so we can show interest in them
I just have a couple of things. First of all, I wanted to thank the Buellton parks and rec department for putting on the barbecue. It was a great day. I'd like to also thank our public works department for putting on the inclusive playground workshop and all that attended. That was last Sunday. Next I just want to announce that Nature Track and Triumph Foundation, two organizations that we've had come and speak here. They're having an accessibility beach day at Avila Park on the 22nd of August from 1-3pm. It's a free event and anyone can sign up at naturetrack.org And lastly, I just would like to remind everyone about the movie in the park event. It's coming up on Friday August 28th or showing et you can go to solving cinema arts dot org to learn more and reserve your meal for that evening.

South County and North County have different funding sources planned through the Measure A funds that take place. South County puts more funding into Safe Routes to School and that programming than North County does, and there are grant opportunities available that require matching funds from local jurisdictions. So they were hoping to maybe come and speak before our council if there's consent for us to invite them back about a funding request that they'd like to see if we'd be interested in what that programming would look like to create a better program for getting kids I'm looking for consent for them to come and give a full

I would like to have them come back and give us a presentation so we can work on funding to create safer ways to get to school. I just have a couple of things. So this past week, I met with Congressman Carbajal and his district administrator Eric Reyes and basically the conversation was just basically to discuss federal grant opportunities for Buellton. So this idea of looking into more federal grant opportunities so as Buellton looks at their priorities hopefully some of these federal grants will help fund things like the S.Y.V. River Trail 246 I went to a community task meeting.
Basically, Vandenberg is reporting that there's going to be an increase about 800 jobs. This is our second meeting of this task force and basically how that impacts Buellton is we should be looking at the way this base is growing So looking at that and like there's many, many people involved in this conversations. That's it.

Thank you Mr. Mayor, members of the City Council our first business item is ordinance number 26-07 an ordinance of the City Council of the city of Buellton readopting chapter 8.12 of the Buellton Municipal Code pertaining to the 2025 California Fire Code as adopted and amended by the County of Santa Barbara this ordinance is brought to you this evening for introduction and first reading I am your staff contact so I will ≫ Good afternoon, everyone. My name is Dan Buellton and I'm the city manager for the county fire department. As mentioned this is the adoption of the 2025 fire code as adopted by the County of Santa Barbara. We are adopting the county's code by reference. Essentially what has gone on here is the county has incorporated changes from the 2025 revision to the California Fire Code the county to provide service for us, we need to adopt this by reference.
So there are multiple pages in here if you have questions on it I'll do my best to answer it but I am not an expert on the California Fire Code suffice it to say this is necessary to keep our fire protection services in line with what's being provided to us by the County of Santa Barbara

For the benefit of the public at home, Council Member Lewis announced in the room that she is feeling ill under the Brown Act provisions illness, the newer Brown Act provisions that have gone into effect over the last few years, communicable illness is a reason to be able to attend a meeting via remote access. She asked and we confirmed that she could in fact go home and continue the meeting by remote access. She asked us to please move ahead with the current item, and she will join by Zoom when she does her camera will stay on throughout the rest of the meeting. She will announce if anyone over the age of 18 is in the room with her and all I'm sorry all votes from here on out will be roll call even if normally they would just be raising hands consensus.
Moving to the item, when you adopt by reference it's kind of an inverted way to do it. On your consent calendar today you had a second reading of an ordinance When you adopt by reference, the first reading is kind of the second. It's a much shorter presentation and all your voting to do is have staff give public notice, schedule a public hearing at which things will be really gone through in a bit more detail. The public has a chance to opine at that point and then you have the major vote. So this is kind of a perfunctory item anyway so if Council Member Lewis doesn't get back in time for the vote she'll still have a chance to ask questions at the second reading. Back to you Mr. Mayor.

The next item is Item Number 7, Authorization to Reclassify the Recreation Center Coordinator to Recreation Coordinator and Adopter Advised Salary Schedule. Our staff contact for this is our Deputy City Clerk.
Good evening, Mayor Silva, Vice-Mayor Mayne and members of the City Council. Before you tonight is a recommendation to reclassify the Recreation Center Coordinator position to the existing Recreation Coordinator classification. The recreation center was established in 2007 and has grown significantly over the years. As the department has grown, the recreation center coordinator and the recreation coordinator positions have taken on essentially the same duties. This change will allow both recreation coordinators to work interchangeably, provide coverage for each other and give the department more flexibility.
The Recreation Center will continue to have one recreation supervisor and two recreation coordinators. The fiscal impact is approximately $2,570 and staff will bring back a budget amendment this fall to cover the additional costs. Therefore, staff recommends that the City Council authorize the reclassification of the Recreation Center Coordinator position to the existing Recreation Coordinator classification and adopt the revised salary schedule effective August 24th. That concludes my presentation and I'm happy to answer any questions!

moving on to item eight
All right, thank you. Item 8 is a discussion of potential future rehabilitation of city identification billboards. I'm your staff contact this evening so let me bring this forward here we'll At the June 25th meeting of City Council directed staff to return with an agenda item this evening. To bring back for discussion two items pertaining to city identification billboards.
One of these billboards exists within the city limits, I will be referring to that as the southbound billboard The other billboard is on the far south side of the city. It's actually three miles south of the city limits. And it is the northbound billboard, is how I'll refer to that because it faces the northbound lanes even though There are two different things going on here. The first issue has to do with the southbound sign.
On the southbound side, as was mentioned previously by our public comment is in a state of disrepair. It has been declining for some time while the property owner has been deciding what I'm going to go ahead and open it up for public comment on what the plans are to do with this particular sign. If the City Council decides to go this direction, it would require a change to our Municipal Code. The sign itself has been for some time and exists currently as a legal non-conforming sign with the purpose of city identification only.
And it holds a permit through the California Department of Transportation for that purpose. The permit was renewed, it had actually been revoked a few years back, was renewed I believe in late 2024 With the understanding that the renewal was for continued operation as a city identification sign, however if the City Council made changes to the municipal code which would allow for its use otherwise we would let the Department of Transportation know and they would change the permit appropriately.
So that is one question before the City Council this evening. Now the other issue has to do with Now, the northbound sign to the south of the city. I'm confusing myself. The northbound sign as I mentioned sits on about three miles to the south of the city on the west side of Highway 101. It simply says Buellton Three Miles. It's got an image of Happy and Pee Wee.
This is a sign that identifies the city of Buellton. It also is in a state of disrepair, although not to the same state of disrepair that the southbound sign is at. This sign belongs to the Chamber of Commerce and the chamber This is a Buellton-centric identification sign. It's a Buellton-centric The Chamber of Commerce is asking for funding assistance with that. So I'm happy to dig into this a little bit more, we have two different items on the agenda. We can go either direction with it whichever way you'd like to go as far as which one you'd like to hear first. I will dig into a little more and answer questions but I think we should probably take them one at a time to avoid confusion
I would
like to request that we do the northbound sign first, because that was the original when I made the request about the signs. The other one was added in. But this is something for funding with the sign and that's a separate thing but there's going to be a lot less things

I think given the setting of it right now, essentially the Chamber of Commerce is asking for financing assistance. They estimate the cost of such repairs and preparation to be between $30,000 and $40,000. They would like the City to possibly come up with half of that funding. From the standpoint of a city expenditure this is something that falls in line with our economic development efforts. The Chamber of Commerce I will leave it at that. The price of the sign, there's a rent for the sign too is there? Yeah. What's the cost of having this sign?
We pay rent $3,000 a year sorry for that sign. This sign used to we used to partner with PSU Anderson so they actually paid a portion of rent on that sign as well for the land rent basically we rent the land and we own the sign we pay the utilities any maintenance land rent on the sign. So, Pea Soups used to pay a portion and it would go up each year a certain percentage but now they're no longer there they're not receiving that part of it at all they're just receiving our share of that rent so...
Um, yeah, we'd love to keep the sign and continue to have a built in message. I know they're iconic and I know everybody loved happy and peewee, but it's no longer here. And so it's just time to put a new face on Buellton and like, you know, make it happy in another way,
change the sign like you do the 1 on McMurray.
Yeah, it would be very similar to that. And so the monies is it goes towards refacing you can't use the face that's there. It's all plywood. It's old. It stated its rotting. So it has to be completely restructured. They come in and do a whole new face on that sign the same size it has to face in the rules with the county and the state has to face exact same way, same size we can't change any of those dynamics on it. It would just be something that we could then change the vinyl and will continue to maintain the vinyl pay the utilities the lighting It'll have new down-facing lighting on it. So, it's just updated and a new structure that we can then work within. It would be good for a long, long time to come but then new vinyls can go on with whether it's welcome to Buellton or so many miles to Buellton.
That sign is pretty much directional. So it would have to be like the one up north of 154 that's so many miles to Buellton and then we can still change the imagery on it or maybe list our exit numbers where they could exit in town We utilize those signs for that purpose, just to let people know there's other exits to use and try to move traffic around town.
That's what that would be used for. It's a directional sign. There's a whole lot behind these billboards. Some of them are welcome too, some are directional. There's just different uses and purposes for them and that one is so many miles to your destination. So that's what that is for. Thank you. This
is a one-time expense
for the council. Does this come out of an economic development pot that we have?
Just a couple with it one being is a 30 to 40,000 off of any written estimate or just kind of what usually goes for
not a written but I have spoke to the person that's kind of the ballpark it would be in. Okay and that's what we paid on the other one when we did it was about 37,000 I'm sure things have gone up a little bit since we did that so I'm saying 30 to 40 okay yeah
And then my other question was just, and this is just to confirm. So the chamber owns the structure? So you guys own the structure and the permit and all that so there's no issue with that okay. That's all I just wanted to make sure of that so you guys can, you guys have the full responsibility for
it. Yes oh absolutely yeah now we have the permit with the state and again we pay the utilities PG&E, we do the maintenance on it any of the vinyls, the graphic design, the printing of the vinyl, the installation of them, all that would fall on us. Okay perfect. Yeah it would just be the help with the structure itself and then I'm going to take it
from there. If this was approved tonight, do you have an idea of timeline that you're
expecting? I don't yet. I just have to get all the ducks in a row on that to figure it out but hopefully we could have it within the next couple of months or so depending on the builder and if they're available and what their time schedule is like but yeah sooner the better um if we could but again it's it's there it's standing it's okay it's holding its own

Yeah, there is one for long I've seen that too but that's not owned yeah we didn't own any that far north that was actually the restaurant owner operator he owned that billboard and so they changed it up they took pea soup off of that one as well and it's now um I can't remember they have umpteen restaurants crab is there a cracked crab or something like that I think I know I've driven by it but it's changed But that's their, that's their sign. We don't have anything to do with that one.

No more billboards are allowed in Santa Barbara County and in fact yourself, the city of Buellton prohibits building up new billboards. So any existing billboards pretty darn valuable that you have in Santa Barbara County, in California, anywhere. Next one. So our goal would be to do the same thing that the Buellton Chamber of Commerce is doing with their three billboards. We would just expand it out to the Santinas Valley, so it would still benefit Buellton but then also the other communities as well.
More of a reason to pull over, more of a reason to stop and if you don't stop now because you're driving by and you may not have the time to pull over but maybe next time you'll think about pulling over. And by the way, I'm in full support and thank you very much for supporting the Chamber of Commerce for redoing the northbound sign. All right. So a year or so ago, we agreed. I chatted with the Buellton Chamber several times and we agree that any wrap that we do will include Buellton next three exits. So no matter what we promoted, what town we promoted, what event we promoted it would always say Buellton next three exits. And then here's just a few examples.

The information is that the property is owned by Mr Williams. The sign had previously been owned by I'm going to start by saying that the property was purchased by the Chamber of Commerce when the land lease provisions kind of fell apart a few years ago. The Chamber of Commerce offered to remove the sign from the property and Mr Williams declined access to the property to do so, and then subsequently filed That from my perspective is ownership that's in dispute and probably not something the city necessarily wants to put its fingers in the middle of, but that's up to you.
Okay, so my feeling about this is that the sign cannot continue to look the way that it does. I think it's a really poor representation of Buellton and the incredible value we live in. I'm very much in favor of creating an ad hoc That is a very poor representation of our city and our area.
But that's two things, right? One is the beautification of the sign in Buellton in general and then two changing municipal code to put whatever we want on there, right?
I mean, to me they go hand-in-hand. As an ad hoc, we create an ordinance that says what we would like on that sign and then the sign owner has to follow Or like that's why I'm saying like this ad hoc committee can come together, figure out what we want. And then we basically pass that ordinance as a city council and then the owner of the sign follows the orders well if they want to remove removes the sign right or moves aside so that's where I'm at.

would, but they have that same issue now. Right? I mean like we have ordinances now right and the landowner is like chamber of commerce. No. But perhaps somebody else yes and then knew somebody else's saying change your ordinance to allow us to do what we want to do on the sign which to me feels a little bit like. I think at this point, and actually the reason for that is
You know, welcome to Buellton, but they could not do what Mr. Sim talked about in regularly changing sort of That's the one that's on the northbound side. So if you even if
That's true, but I guess I could ask staff. Do we have Chamber of Commerce's
input on this? Yes, I've spoken with the chamber on this a number of times and any direction or any movement forward on this would be done in consultation with the chamber because I'm going to go ahead and start by saying that the city of Buellton is not a private property. You know, they are our arm for the visitors Bureau is our arm for economic development in the business community so we And is claiming ownership of the sign structure and so we have, like I said there's a number of different options here.
You know some of them include changing the sign, some of them may include or changing the ordinance rather, some of them may include leaving the ordinance the same and trying to work something out with Mr. Williams. The other alternative is to simply say no we're leaving it where we're at and then we direct Mr. Williams to either refurbish ≫ Thank you, Mr. Mayor. I think we have a lot of stuff to unpack. I'm originally from New York, but by way of Arizona most recently and also Colorado. And I've worked with a lot of city councils churches schools really to build beloved community. So the 1 thing that I wanted to mention that I mentioned today, but any kind of lit up the city of Buellton is beautiful. And we don't have a slogan here and I think it would make sense to consider the possibility of calling it beautiful built in.
That could be on all the signs and then you've got a logo. You've got a motto cottonwood was doing they were the gateway to the wines, you know, gateway to the vineyards and things and they've got to vineyard school and all kinds of wonderful things but there's so much history here. But I fell in love with this place the first time I came through and it was because of the storm four years ago that we got stuck here. And I stayed at the multiple sex, and then I moved up to Anderson's and had the pool and the jacuzzi and really lovely people that worked there real hospitality. It was very impressed and I was there and I started to explore what was left The place that St. George purchased for what was it $4.7 million, whatever it was?
There's a building that is open and getting vandalized and there's a beautiful piano in there. With our Rising Star Academy we make a difference to music art and dance. beautiful community by celebrating and making it fun to be public speakers. And city council meetings could be really a blast, believe it or not when you add a little humor and a little bit of art.
I was very impressed with seeing the slideshow and hearing how you were speaking to each other is very impressive so I am out One second, so we'll leave it at that. There's a piano in there was covered in ketchup and it plays great only one note is missing. We want to see if we can get that donated to some kind of community event or member. It's from London. It' s a very special thing and that place should be closed down so nobody can get in. Thanks.

Thank you very much for I just wanted to share something very important with you because this is affecting our whole country not just here, not just in. I mean it's affecting everywhere and I have just moved over here 6 weeks ago from the state of Washington. Washington has adapted a wonderful to solve the homeless problem. And they are getting parcels of land donated to them around many areas, many different cities and so on and so forth. And they are building tiny house communities. It's almost like a big closet. You and I would be used to a walk-in closet that's about the size of it. But anyway, and they give them six months to clean up their life and turn it around. And if they, and it's a contract deal. If you don't or if you're still trying to they may renew your contract or they may evict you.
So anyway the other thing they do is it's like a community and out in the center is a garden where they grow all their own food. They have a very nice place that is So now they're building it, building these tiny home communities all over Washington. So just a thought, just an idea. But you know we got to attack, not attack I don't want to use that word but we need to help the homeless. Some are not there because they chose to be. They're there because of unfortunate situation and then some of them love it and want to stay there but whatever anyway thank you for the time and the opportunity i just spoke my piece i just oh and one other thing i wanted to add also I spoke to your chamber over here, but I have been in tourism for 40 years and I love helping cities.
And I was on the chamber in City of Texas because I'm from Texas. But I was on the chamber there and I love to help cities promote and encourage in your tourism. That is that's a start that brings people in. You want to you want to grab them at the side of town and you want to bring them in? So tourism, tourism, tourism, that's where your money is.

move to Item 9, selection of vendor for drone show during Winterfest event.
All right. Thank you, Mr. Mayor and members of the City Council. Another referral from June 25th with the city council directed staff to come back with a discussion about a drone show potentially to be held at the Winterfest event in December. At the time, the City Council requested that staff reach out to the Chamber of Commerce and discuss this with the chamber as they put on the drone show or excuse me, they put on Winterfest to ensure that they were the addition of a drone show would be welcome. I did meet with Kathy Breeland and we discussed this and she was enthusiastically in support of this, I think it's fair to say.
There are a number of bids that have been, or proposals that have been received here from the city regarding the drone shows. They range in price and the number And you can kind of see this, I put it in a little matrix down at the bottom of the first page of your staff report here. What staff is looking for this evening is direction on a number of different items here.
We would like to know whether or not the City Council wants to pursue a drone show and wants to enter a contract for a drone show with the proposals that we have, I'm going to go ahead and start by saying that we do not have time to engage one of the vendors here to provide a drone show. We should probably do that relatively quickly so we have time to do the planning that's required before December.
which started about 100 drones and go up to 400 drones. Think of this as a TV screen or an image on the computer screen, the more pixels you have, the more resolution you get in the more detail you can see in the show. So a 100 drone show would be relatively simple images whereas a 400 drone show would be much more complex potentially animated images that sort of thing. So you've got a range.
that's listed in that matrix from 100 to 400, with steps in between. And then the prices also range from the low of about $15,000 for one of the 100 drone shows up to... For the 400 show, 400 drone shows right around $40,000. There is one for a 300 drone show that runs a little over 52 thousand dollars. So they're kind of all over the board here. So that's what we're looking for. Do you want to have a drone show? If you do, how many drones do you want and then let me know which vendor you think ought to be, we ought to pursue based upon the proposal prices that we have here. We just have to, you know, that's why... What show are we looking for? Well, that's what we need the next several months for to do some planning. It should, I'm guessing it should be holiday themed The other questions that we have here are, do we want and we discussed this previously. Do we want to have sponsorships? Do we want to talk about some brief little advertising images throughout the show to help pay for it? All of these things can be done by the various vendors. We just need to be able let them know.

the next item is Item Number 10 which is Progress Report and Request for Disbursement of Second Installment of Funding Approved for the San Ynez Valley Children's Museum. As the council is aware, the city council back in April of 2025 authorized funding-

Okay that was just a recording from the Zoom. Thank you, Mr. President. That amount of funding was to be split into three separate installments. The first installment of $500,000 was for fiscal year 25-26. The second installment was for 300,000 for fiscal year 26-27 and then the last installment of $200,000 was for fiscal year 27-28 and was conditioned upon on a matching basis so The $200,000 was conditioned upon their ability to raise $200,000 as a match and if they weren't able to do that the match would be limited to whatever they were Conditions of the contract were that each subsequent installment of funding would not take place until the spending on the prior funding had occurred.
That was to ensure that they were actually proceeding with the project along the way. As the Council is aware, over the past year the Children's Museum has undergone some organizational changes, reorganization. Let's put it that way. They've also made as a result of that have made changes to the proposed design of the Children's Museum and the focus in terms of the information or the curriculum to be supported by As such, some of their processes have been delayed.
And those changes have resulted in a delay of the conditional use permit being issued. So we currently are anticipating hearing before the Planning Commission in September or possibly October, depending upon how things move here. But the Children's Museum is requesting the funding of the second installment at this point. I informed them that we were unable to do that unless they could demonstrate that they have expended the funds that are available or that were made available through the first set of funding. They have not formally expended those, however those funds have been committed for certain projects which cannot proceed until The first item on the agenda is The City of Buellton will not be able to open this facility until the conditional use permit is issued.
However, they can and in order to make sure that this facility opens in the near future should begin work on the second installment and therefore they are requesting that. So the question before the City Council tonight their, their books essentially the what they've spent so far what is committed and what is waiting to be spent I believe as part of this as well.

I have a question on what is Falcon?
There was a proposal that was put forward as part of the initial request for funding, and that involved a number of different exhibits that they were proposing to build with that first installment. I want to start by saying thank you
to the board of
directors for this year's funding. As I mentioned, somewhere over the past year, the decision was made by the board of directors that those exhibits did not fully align well enough with school curriculum to be able to entice schools Those types of curriculum items. So in essence, what was being looked at previously no longer exists as far as the different exhibits that were proposed. We have new exhibits and the representatives here from the Children's Museum can describe those for you.
Thank you for having me. I'm Jillian Knight representing the San Ynez Valley Children's Museum. Mayor Silva, Vice Mayor Mead and City Council members, I appreciate your time. One of the things I wanted to let you know is obviously in the packet you saw the financials we provided as Scott explained. We're showing what our expenditures are through June 30th as well as our committed expenditures which we can commit to some degree right? We do have bids on certain things. We do have some quotes on certain things however we can't get full bids The first grant that you all gave us was for phase one, which is all pre construction. So anything you see that has already been spent reflects that which is all professional fees surveys engineering structural engineer was a big fee most recently.
And so that's included in that expenditure report. And then on the secondary part of that is we want to move into phase two, and so the reason we're requesting this funds, the next disbursement of funds of $300,000 is because of phase two. We want to move out of phase one and actually get to where when the conditional use permit is approved power of intention here with the planning commission that we can then move forward with going through the prevailing wage processes as you know it's time consuming and we don't want to delay that transition from phase one to phase two at all if possible.
And then within that, you will still get monthly updates on finances and expenditures as well. As far as what Scott mentioned on the redesign, what we did was completely redesigned that to be STEAM education code to follow California Education Code which allows for grant organizations to fund the museum as well as a sustainability plan. Before that it was sort of a play park and so this has really changed the sustainability that we think will This is the first time that we've been able to allow for this to be here for many decades. With the insight of the council members that we met with, as well as the planning commission suggestions, we added a larger area for the riverbed that will be there, as well as moved our entrance to be at the opposite end of where we had it so that 95% of So if you have any questions for me, let me know.

Yes, hi. So pursuant to City Manager Mr. Wolf's comments, so we have the play area that was no more and now we Water and Earth Science Zone, Turf Hill, Human Power Tech Systems, Sustainability and Ecology Zone, Nature Arts Zone etc. Are those with the second round of funding now going to be built or do we have a list of exactly what's going to be built with the second round of funding?
Yeah, so again yes and no right? Parts of that will be built. As we know cost is an issue with any type of bill this is prevailing wage. So we do not have bids yet until we get approval with a conditional use permit then we can go through the process of a general contractor bid as well as the contractors available public works. This is also an issue with timing right? We do not know when these public works contractors will be available. So any city project that you've ever been involved in timing is never known The hope is that we can jump on this quickly because we have the funding available, but when they are available, we can book them and get them out there. What will be built with this funding in this next stage of phase two is restroom, fencing, pathways, and then we want to make sure that our priority is some of the exhibits which the riverbed, the live riverbed being one I'm going to turn it over to you, Mr.
Buellton.

We don't issue the second round of funding. What can you get done with the initial round?
Legally, nothing. The first round of funding was phase one only so that means there is no building allowed and we get this question a lot right when are you opening when are you breaking ground your contract with us for phase one funding meant no construction no build So we are limited to allowing for phase two with the second set of funding, which then allows for us to do things like manufacture something that doesn't require a prevailing wage or allow for us to order and commit to that funding without having the permit in place yet.
It limits obviously the future of that but without that funding we could not break ground. I don't think any of us
could Council Member Sanchez. Yeah, the
set of school rating or The curriculum is a school geared.
Yeah, so originally this was and you all saw the original permit that was submitted back in I think it was November of last year before we made major changes. We added 7 board members. We created a planning and facilities committee and we decided through that that we would actually change the way that this was done which originally it was a fairy land dig site There was a mud pie zone, a garden. And there was not a sustainability plan for schools to be able to attend through what we go through Planet Bids for a lot of the schools. Santa Maria School District, for example, I use that for other nonprofits. So going through Planet Bids you have to check the boxes. Is this educational? Is this something we already have on site?
Most of the schools here have a garden. Most of the schools have a sandbox, most of the schools have a playground. They're not going to take a field trip to go and do that off site especially with their limited funding for field trips at this point so we would then have grants funded to bring those schools in I do that for another program I work for that provides grants that pays for school children built-in school kids are included in your grant as we've agreed to as a board to include all Buellton schools kids to come through the school programs. And so that allows for a plan of action for us to sustain this program, meaning not only can we apply for grants for that, schools can then attend but also everything on site follows California Education Code.
Does it include homeschooling?
Yes, absolutely. Homeschool also follows California Education Code. So
there's a tie-in
at what you can
do where... Absolutely yeah. So the planning commission, is that what's holding you up right
now? Two things. One is funding because we are stuck in phase one until we get phase two funding and number two is planning commission. And planning commission it was really because our structural engineer came back and said as many of you have been on that site and you've seen that container building, It was deemed absolutely uninhabitable. We cannot use the building itself and so that limited our scope of what we, again you'll see in our redesign how we redesigned that. We are removing one of those containers so it doesn't look like a container storage site and then we will be putting a standalone shade structure for that entire area as well as fencing it in so there's areas for disabled children to and younger children to have We do that at other programs so there's a sort of containment if that makes sense for those who need caregivers.
I'll be careful with that. We cannot use any of it and all has to be torn out. None of it was permitted.
And that cost to us?

That was not...no funds from the city were used for that at
all.

And who's going to tear it down? Is that our
we will know that everything on site is our responsibility. And I believe we've discussed having the city owns those containers, that is the city's land and so that I think the city was going to maybe take that container back. Yeah I was just going to ask that if they could refresh my memory as to why we structured the agreement uh as the way Ms. Knight um relates us just because where i'm going with this is I would feel much much better if we could release the remainder of phase one get something actually built and then move on to phase two. I don't know if that's possible legally
but... We would need to amend the contract with them. That contract amount and structure was arrived at through negotiation with the Children's Museum organization or through request for the Children's Museum organization who put forward those figures at the timing that they did because that's what they felt would be needed in order to to move forward with the project.
Obviously, things have changed since then and the entire project site I think has become much more construction intensive but was originally covered essentially a shade cover and then what the rest was more or less outdoor play area has become very focused We have a lot of work to do on the construction side. With quite a bit more requirements for construction. The
only thing that concerns me about it is looking for a penny per pound. It sounds like we need $800,000 before we get something built.

Mr. Mayor, members of the City Council, the next item up is Item No. 11, Resolution No. 26-23, a resolution to the City Council of the city of Buellton, California approving the Sixth Amendment to the City Manager Employment Agreement and updating the salary schedule. And our staff contact on this is our City Attorney Greg Merck.
Thank you, Mr. City Manager for the benefit of the public on July 9th of this year the City Council met in closed session at a regular meeting and completed a successful annual review of the city manager's performance at that time and consistent with state law saying that Thank you, Mr. Chairman. Thank you, Mr. Mayor and members of the public. We have a motion to approve an amendment to the California state law that must be approved in open session.
The amendment allows a cost-of-living or COLA increase that is equal to the 3.2% provided Next slide, please. To the extent in the future, the City Council provides a COLA increase to regular staff that will automatically apply to the city manager unless it exceeds the consumer price index for this region and that For the third time, it's consistent with state law that says that such provisions with an automatic mirroring of the rest of staff are legal as long as they don't exceed the CPI. Moving on to the City Manager's Report.
Thank you Mr. Mayor, Members of City Council very quickly August 12th which is this Wednesday is the closing date to file for candidacy for the District 1 City Council race If that's going to happen, if anyone out there wants to do it you need to contact the city clerk's office tomorrow and start that process or there will be no hope of getting that done. And secondly August 24th meeting I just wanted to give the council a heads up about couple of items coming up here they will obviously be more than this but a particular note. I want to present to the City Council a preliminary report We're going to be looking at a number of different things. The first one is on what I'm going to call right now alternative law enforcement options as we approach the end of our initial contract with the sheriff's office next year, we need to start looking The second item coming up next week, or the next meeting two weeks from tonight will be a revised contract with the City of Goleta for library services.
After much turmoil and wrangling because of a number of different issues over the past year and a half or so we have come to an agreement on I just want to give you a heads up on that.
