So our first item for tonight is the Proclamation Recognizing Women's Equality Day August 26th 2026 and so I'll go ahead and read the proclamation. I believe we have a few speakers who'd like to come up as well and then we'll also allow space for any council comments to add to that. So thank y'all for being here tonight.
Proclamation recognizing women's equality oh and also there'll be photos afterwards Whereas America is the only nation in the world based on an idea, the idea that all people are created equal and deserve to be treated equally throughout their lives. And whereas August 26th, 2026 marks the 106th anniversary of the enactment of the 19th Amendment to the United States Constitution which secured the right to vote for women. And whereas women now constitute nearly 50% of our workforce, majority of the students in our college and graduate schools, and an increasing number of primary breadwinners. And whereas women in the United States have continuously worked to gain full rights and privileges, public or private, legal or institutional as citizens of the United States.
And whereas women in every state work to secure women's right to vote. And whereas even with the gains women have made, work remains to be done in many areas that directly impact equal pay for equal work Mayor David Silva on behalf of the Buellton City Council do hereby recognize August 26, 2026 as women's equality day. ≫ Good evening, everyone. I'm Tracey Beard and I'm the deputy city clerk in the City of Buellton marking the 106th anniversary of enactment of the 19th amendment celebrating the achievements of women and recommitting to gender equality including equal pay for equal work and accelerating actions for the overall progress of women presented this 24th day of August 2026. And I'm really grateful to have some speakers here this evening so our deputy city clerk will be able
First I want to say thank you very much as a 15-year commissioner. We very much appreciate you recognizing Equality Day for all women in this community. It is important that we work with our nonprofits, make sure that all of our children, women are treated equally, that have fair housing, that have food, that have all the things they need for run a community and we thank you guys for making sure that your community runs correctly and that you have women at the helm. Good evening everyone it's a true, it's truly an honor to be here tonight as Women Commissioner for Third District to stand in support of this important proclamation recognizing women's equality I want to take a moment to recognize the people who worked hard to bring this forward. I know this proclamation did not come easy, and that makes even today more meaningful. Sometimes progress begins with simply the willing to say this matters and we need to recognize it. When something is important sometimes it takes courage persistence and people willing to speak up even when it isn't easy.
Women's Equality Day is more than a day on the calendar. It's a reminder of the women who came before us, who fought to have a voice, a seat at the table and the same opportunities as everyone else. Because of their courage, women today have opportunities that once were denied to us. But equality is not something we should ever take for granted. We have a responsibility to continue opening doors, lifting up one another and making sure the next generation of women and girls know that their voices matter and that they belong at every table where decisions are being made.
So tonight I want to thank everyone who stood behind this proclamation and helped make it happen. Your work matters, this recognition matters, and the message we are sending to women and girls in our community matters. As women, we do not have to wait for someone to give us a voice. We must continue to use the voices we have to make our community stronger for those to come after us. Thank you for allowing me to be here and stand with you in recognizing Women's Equality Day.

Hi, I'm Megan Deaton-Hoffer. I'm here on behalf of Supervisor Hartman, 3rd District County Supervisor and she couldn't be here but of course wanted me to come support the proclamation and say thank you for making it. And when I looked up when exactly Women's Equality Day was established and found it was in 1972 to commemorate the 1920 adoption of the 19th Amendment to the U.S. Constitution granting women in America the right to vote I was reminded of looking at that information in like middle school textbooks, and seeing the pictures of the women picketing and in their Victorian clothes and with the bows in their hair and holding their signs. And I remember feeling a real debt of gratitude even when I was young to them thinking it's because of them that we can learn and when I'm older vote.
And they did go through a lot to make that happen. In addition to picketing, they went on hunger strikes, they were arrested, it was a real battle and just to think that they did that like for me and us and themselves and really all of society because when women are more engaged in society the whole community is lifted up so we still have room for improvement as mentioned equal pay for women doing the same job as men would be great If the Equal Rights Amendment were ratified by all 50 states and the court cases against it dropped, and it were implemented in our Constitution. And women were recognized as real people under our Constitution that would be great but I'm hopeful we'll get there. I look at women Supervisor Hartman among them in leadership positions and what they give back to the community and how well they lead and offer mentorship to younger women.
I felt her mentorship and seeing women here in positions of leadership, and knowing we can all then like the earlier women who worked for us work for future women by supporting them and voting for policies that support them makes me feel hopeful for the future. And thank you to Buellton City Council for passing this resolution proclamation and doing your part to help women's equality.

to all of you and it means so much to really give the space for women to have a voice, so it's important that you're here and
I'm very, very grateful. And I'm also very grateful I think sometimes you can be a little sad about how hard we've had to work, but also the future can be very inspiring. And that's what I am when I think about this proclamation that I'm inspired for the future for all women everywhere, especially our young girls. So thank you again for being here.
Just thank you for being here and thank the City Council for being supportive of the proclamation and supportive of us in general as a team and we appreciate it.

You think it's so much farther away but that fact that the Brady Bunch is having that conversation. So I appreciate everyone bringing that to our attention and I just wanted to make a conversation about Marsha Brady. So anyway.

we'll move on to our next item which is a presentation previously unscripted so we're going a little off here right now but it's with the Buellton Community Garden and we'll invite Ms. Green up to speak on behalf of that.

All right, well thank you again for your continued support of the beautiful Buellton Community Garden. I just wanted to give you a quick update at how much the garden has grown this year and what your support has made possible if you can go to the next slide here This one here. So we now have this new covered compost area. We have a picture that's kind of hidden there, our new mulch machine.
This was our biggest physical improvement of this year. The new covered compost area is a dedicated workspace to process and reuse the material from the gardens. We've also added the mulch machines so we can turn more garden material back into something useful on site. We can go to the next slide here. I'm going to make this short and sweet. The garden really is growing every day. We've continued investing in soil, seeds, growing supplies and materials for improvement throughout the property.
A lot of the beautiful structural work you see is Greg craftsmanship. He's done an amazing job making these improvements not only functional but really thoughtfully designed You can go to the next slide here. Some of what you see reflects the city's support over many years, the work on the shed and other established improvements including our veggie washing station and the amazing beds. And this year we've continued building on that foundation making the garden more functional and productive.
And you can go to the next slide here We're growing a lot. So we've got carrots, potatoes, onions, squash, tomatoes, corn berries, green greens, green beans so much more. We also have all kinds of seeds that were currently jarring and we're organizing in the members shed along with soil and other growing supplies so they're ready for future plantings And this is just some of what we had. I mean, if you've been by, you see there's stuff all the time.
You can go to the next one here. One of the biggest changes this year is we've reorganized the way the garden is structured. So now beds 1 through 25 are now community beds. Before it was a little confusing and sporadic so now the first half of the garden as you enter is really designated for the community use And 26 through 46 are reserved member beds. We're going to make more of a line in the sand, if you will, so that people do know as they enter the reserved area to look but please don't touch.
But just to really empower people to come and join and have some berries, have some fruit from the garden. So we do still have some plots available for the community members who would like to participate just want to throw that out there as well you can go to the next slide here. The community beds allow us to grow Specifically for sharing as produce becomes available we put fresh food out on our community cart to enjoy. This is a little sample of what we had just some really bright heirloom fruits available, you can go to the next slide.
We've had a lot of fun community events and work days this year. We really want this to be a true community garden, not simply a collection of individual plots. We held at least four open community events this year along with member work days. We've had families and kids out here painted rocks and shared food and brought people together in the garden. And we can go to the next slide.
Education and community. We want to keep expanding that community piece in 2027, we plan to begin offering master classes so people can come learn whether they're experienced gardeners or new to growing. And you can go to the next one here. What's next? We know we still have work to do, our priorities going forward are better irrigation, perimeter fencing and maintenance and especially better signage. We have a new bulletin board and additional signage coming so it's gonna be much clearer how the garden works for anyone just wandering inside.
What areas are for community use and how people can participate? And we want to continue offering open community events. And we can go to our final slide here. And the garden really is changing and growing every day, and I hope you all get a chance to come walk through it. Our gates are open, and we'd love for you to see firsthand what your continued support is making possible.

I'm going to put my next hat on as president of the League of Women Voters for North Santa Barbara County. We have a forum on October 15th right here in this space over here in the Santianez Center right here at 246 and it's known as the Santianez Resource Center so we are there on October 15th from 6 to 8 o'clock for all the candidates. We've kind of informed our candidates and we thank every candidate for running for office because it's a lot to put yourselves out and run for office. We do have nine other forums around the county this year for North Santa Barbara County, and the league is trying to do their job to make sure that democracy is heard and to go out and vote so thank you very much and we appreciate your time

All right we're moving on now to item number seven
Item number seven. Thank you, Mr. Mayor and members of the City Council. Item number seven is consideration of Ordinance Number 26-07, an ordinance to the City Council of the city of Buellton, California readopting Chapter 8.12 of the Buellton Municipal Code pertaining to the 2025 California Fire Code as adopted and amended by the County of Santa Barbara. This is the second reading for this ordinance. This is also the public hearing As the city attorney noted last time, the public notice requirements for the adoption of an ordinance by reference is different than the public notice requirements that would occur if we were adopting our own ordinance. In this particular case, we have the County of Santa Barbara has adopted a fire code and we're adopting that by reference So we use this alternate public notice arrangement, where we had the first meeting last time as a business item and the second reading for the ordinance this time is our actual public hearing.
I will just for the record kind of repeat what i did the last time. The fire code updates occur every roughly three years. The California Fire Code as well as a number of other documents are updated We do have a fire department in the county. And that happens periodically, roughly on an every three-year cycle and when that happens then individual jurisdictions go through and adopt their fire code. In our case since we don't have a fire The latest version has just any number of small technical revisions to the fire code that come about through this every three year process. But in addition to that, the county has also implemented a new fee schedule to more accurately reflect The last time it's my understanding the last time this fee schedule was adopted was about 10 years ago.
So it was time for I will note that in order for the county fire protection district to continue to do its job properly, This is a public hearing so I would invite the mayor when it is time to open the public hearing, take any public testimony and following the close of public hearing then consider the adoption of this ordinance. And I'm happy to answer any questions as long as they're not too technical.

They are hoping to see if we could maybe have a proclamation inviting, recognizing all service that this gentleman had done for that and being involved with bringing the Vikings in to recognize a man who did a lot of service to our community. So I'm curious if the council would be okay with working with Pam Niko and that group to bring in some recognition from Mr. Nelson, if that's okay with our council?

And then the other item is there has been a lot of concern and chatter brought up especially with thoughts about forecasted super El Nino situations and disaster preparedness and certification, and I'm just wondering if ≫ Good afternoon, everyone.

≫ We have storm drainage facilities in the city and other facilities that are managed by other agencies. And we can identify those facilities and who is responsible for managing We have a motion to approve the floodplain

Thank you. Okay great thank you all okay moving on to written communications. Okay, I have two. Really quick we'll go one the Santa Barbara Air Pollution Control District just released an air toxics hot spot program that basically is tracking where there are identified areas primarily from industrial spaces and one of it did have a look at the Vandenberg Air Force Base so if anyone's curious about that information it's on the Santa Barbara Air Pollution Control District It's called the hot spot program annual report, but it's a good opportunity for you to just be aware of the monitoring that's taking place. As a reminder this is a hotspot that is designated based upon a specific assembly bill I can't remember which one it was at this time so it's not to say We had a discussion just again We are one of the last We're kind of an island who still has call boxes along the 101 in various locations.
And they actually are cell phones tucked in there on like a 3G network and stuff of that sort, so they're taking a look at this. We usually spend about $100,000 a year in just keeping them active if that could be used for better resources whether that could be a text to 911 program or things like I'm going to turn it over to you, Mr. Buellton. And that's all I got.
Moving right along, we'll now go to business items and now turn it over to our city manager because I forgot the order we're doing this in right now.
That's quite alright. As I recall, we're doing 9-10-8. Perfect, 9- 10- 8, okay. Alright. So thank you Mr. Mayor, members of City Council. Item nine is consideration and discussion of law enforcement service alternatives I'm going to get a little bit into depth. We've got a longer than normal report that accompanies this item. I'm not going to get into depth on all of it, I just want to kind of give some broad strokes here and open it up for the City Council's discussion.
What we're looking for this evening is not a decision on anything in particular. What I'm hoping that we can get from the city council is some general direction that you'd like to proceed We'll discuss that a little further as we go. As the council is aware, we have been served by the Santa Barbara County Sheriff's Office for law enforcement services since the city's incorporation.
This is a longstanding very solid relationship that we've had with the sheriff's office during this period of time. However, a number of years back there were some issues experienced by the City of Buellton as well as the other The first couple of years we were able to work The last year that this took place, which was I believe in 2023, was the year that the existing contract that we'd had with the Sheriff's Office had expired and so we were no longer working under the guidelines and requirements of the prior contract. We were essentially starting from scratch at which point we did see another substantial increase to costs In just as kind of a general guideline, we were looking at Sheriff's Department expenses when I first got here in 2019 of about $1.8 million per year.
Right now, we're looking at about $3.5 million per year for Sheriff's Office costs. Now the costs that are associated with this are frequently pointed out to be one There's a lot more to our contract than that. And there are additional services that come into play whether the city uses them or not, the resources are available and the services are provided when necessary Nevertheless, the last time this contract was put forward, the City Council had asked that staff continue to look for alternatives to law enforcement service provision to see if this wasn't something that we could obtain at a more cost effective level.
Staff had reached out at that point to a number of different jurisdictions, among them the city of Santa Maria, the city of Guadalupe, the city of Lompoc. We reached out to the California Highway Patrol looking for alternatives for one reason or another each of those agencies was unable to provide service at that time Earlier this year we were approached, meaning the city manager for Solvang and myself were approached by the city manager from Lompoc to indicate that there was a possibility that Lompoc may be able to provide the service to us. They were investigating whether or not that could be done in a manner which was both cost-effective and would provide The city of Long Polk and the city of Long Polk has been working on appropriate safety protocols to ensure officer safety should they provide service out in this direction.
Those discussions have proceeded, and at this point it appears from the city of Long Polk that they would be able to provide that service to us. We have a number of officers patrolling the city at any given time. We're going to look at a contract with the city of Long Polk based upon the numbers that we have right now, we would be looking at a cost somewhere in the neighborhood of $4.1 million per year for I'm going to go ahead and get started. So the first thing we're going to do is talk about cost issues that would also include two patrolling officers at any given time a community service officer It's not as simple as this one, this provider can give us what we're looking for for less money or this one can provide us better service.
For a similar cost there are trade-offs as there usually are when you look at situations like this. As the council is aware I've been rather Hesitant to get out in front of this issue until we have had some more discussions and some more firm numbers than we had a few months ago. We've been given these numbers now, although I will note that they are not still not final numbers and we would be unlikely to see final numbers until such time as we actually entered negotiations to start firming up our levels of service and what those might cost I will note though that a change of service provider, if the city were to change the City of Lompoc we would be looking at in addition to that whatever cost was ultimately negotiated to provide the service on an annual basis there would be some initial startup costs.
Those costs would be associated with Recruitment and training of new officers that would be required in order to serve a larger area. Equipment, the full range of equipment that police officers carry, vehicles, radios those sorts of things. And what we'd be looking at in that neighborhood would be somewhere in the neighborhood of $2 million, probably a little bit more than that. 2.1 to $2.3 million. But again those numbers are not real firm yet.
So that would be essentially a one-time cost for the city to go in that direction and then revert back to the standard operating costs We had a large number of Long story short, it's not too late for that already. This is a fairly complex consideration before the City Council at this point. It's not as simple as bottom line dollars and cents, at least from my perspective. It has much to do with the cost as it does to do with the city council's desire as to what kind of police services that you would like to see for the community.
And with that in mind, I've identified a number of different potential actions the council might take that might bring us in that direction. The first thing I would note is that our current Sheriff's Department contract expires in June of 2027 which means that negotiations with the Sheriff's Department would start fairly soon by maybe at the latest probably the beginning of 2027 However, the current contract we have right now offers three one year extensions with the mutual It's been a long time since we've had an agreement of both parties, the sheriff's department and the city.
And in order to fully evaluate this and not feel like the council is up against the wall trying to make a decision under under a time constraint it might be worthwhile We've seen more than a little bit of response from the public, both in local meetings as well as on social media. And it would be I think it would be. Perhaps beneficial for the city council to be able to gauge the public's opinion on this as well as to provide some education to the public on what these alternatives are, you know what we'd I would suggest that the council consider maybe direction to staff to start undertaking some public outreach efforts. We could do a town hall meeting where we have a representative from the sheriff's office, representative from the Lompoc Police Department come and describe I want to start by saying thank you to all of the councilmembers for their hard work.
The kinds of service that would be provided under their arrangement could describe what kinds of options are out there if the council wants And we might want to dig into that a little further. In any case, again the one-year extension would allow time for that to take place and for the council to try and draw on this information from the public. You may or may not wish to undertake that with or under the auspices of an ad hoc committee.
You certainly can but it wouldn't be required. That's something that staff could navigate for you. The issue at hand, though, is whether or not you'd want to have a noticed City Council special meeting every time you had one of these. Or whether it would be meetings where you would want the public to show up and get the information they were looking for without having the entire council in the room because as you're aware under the Brown Act we can only have two of you at a time and in a room that's not a We're going to investigate.
And then obviously, well I shouldn't say obviously it's obvious to me because I've been dealing with this for a while It's my understanding that the City of Wampoa would require the participation of both the City of Buellton and the City of Solvang for this to work. At least, that's been the discussion up until now. That may or may not be something we could work out if one or both cities were not interested in moving forward So I would suggest that we, in addition to discussing this more with the city of Lompoc, have some discussions with the city of Solvang.
With their...I've been discussing it with our...with my counterpart there but certainly the elected officials in Solvag might have a bit of insight that you'd want to share as well or that they would want to share with you as well. Again there are more moving parts here than I could possibly get into at this report but what I'm looking for right now is just some general feedback and some general direction We have with us this evening the Chief of the Lompoc Police Department as well as the ≫ Thank you. ≪ ≦ ≤

All right, and before we bring up our representatives for adding further context with it I did want to just check in with Mr. Murphy if chance. Mr. Murphy could you also just help us qualify a bit of how best and most effective for us to stay in our lane on this discussion to make sure that we are abiding by the proper scope of this item so that we stay up and up?
Sure first of all I would have the representatives from each organization come up and speak Before you ask questions or comment I would then have any member of the public who wishes to speak, speak on the matter. Bring it back to the Council and at that point what the City Manager has asked for is kind of very high level direction. Essentially do you want to just continue negotiating with the Sheriff's Department as you have in the past? Or would you like him to explore these other options and begin to set things up?
In terms of exploration, he's given you a few items to consider. Talk about those talk about other types of administrative items how he could bring this to the community if it's a process that the five of you even want to go through By keeping it there, you're not making any ultimate decision. You're not even leading the public in one way or another about your ultimate decision. You're just focusing on process and tonight really is all about do you want to initiate this process? And if so then give the city manager direction and how to do that.

Good evening, Council Mayor. Appreciate your time here and the community. Wasn't sure if I was speaking tonight. I thought it was coming more for answering any questions that you may have but what I will share with you is this. Your city manager's correct when we were first approached about this a number of years ago there was no way that we could support expanding in the direction that we had not only for the full-time employee aspect of it but also for the technology side of it As of today, we went live on our new computer-aided dispatch records management and jail management system. And so far so good.
We were actually pleasantly surprised with the transition. That technology is a cloud based technology that allows us to now if we have an internet connection in your community, we can do all the work that we have to with our computer-aided dispatch records management system and manage the calls for service that we would undertake in your community. There is some hiring that needs to take place if you decide to go with the city of Lompoc.
We would have to hire an additional 20 officers to cover what would be needed for your community until we sit down and actually start having more serious conversations about numbers, The only time that those officers would ever leave your city would be if they were transporting somebody to our jail in law poke, and or backing the sheriff's department somewhere that should they need that.
So the difference for you now is probably a numbers thing with going to two full-time police officers. And the reason I say that is, unlike the Sheriff's Department, I don't have anybody close by. So if there is a call for service requiring two officers to respond, I need to make sure I at least have, for officer safety reasons, officers to back each other and that's why we're saying to both communities, both Solvang and Buellton, We would want to officers in each city with a supervisor and a lieutenant covering and managing your police services for both your communities.
So long poke has gone through a tremendous number of technology upgrades, I mentioned our cat RMS we're working through our digital encrypted radio system which should be going live by the end of the year. And for those that are aware of it, we did last week launch our drone as first responder in Lompoc. So all of our 911 calls and some of the other higher priority calls are now having a drone fly on each one of those. And we've already seen a huge success with that and calls that we normally wouldn't find suspects on, we are actually finding them on now. So my role as chief is to try and move this department forward and modernize it to what we have available to us today. And I think we're making huge movements in that direction. And the only way that we could do what we're talking about today is because of some of those technological changes that we made.
You have a decision to make. I have absolute respect for all the gentlemen behind me here, they've done a great job for your city and they'll continue to do a great job for your city. We were asked to give a proposal and we're giving it and we're letting you as a council decide which direction you choose to go so if you have any questions i'm available to you

Well, good evening everybody. Like the Chief I was expecting to take your questions. I don't necessarily have any prepared remarks tonight but what I will say is the Sheriff's Department has been partners with the City of Buellton since its inception 34 years ago and we are proud members of this community. We are proud partners with the city. I've enjoyed my time here working with you as the City Council, with your wonderful City Manager and absolutely you as stewards of the community, stewards of the taxpayers money have a I would say I'm biased because I think you absolutely are.
We're excited to be here. And when we look at the value proposition put forward by increasing the number of staff that you have in your community, I would say you already have that. When it comes to the members of the Sheriff's Department that work here in the Valley, whether it be from Lake Kachuma to Surf Beach to Los Alamos there are sheriff's deputies available 24 hours a day without fail to respond to the needs of the citizens of Buellton. While you the one thing I would like to get in front of and it's the only thing I've really had a problem with throughout this entire kind of narrative that's going around is the idea that Absolutely false. Not only do you get one deputy sheriff 24 hours a day, which actually equates to four deputies on the front end and back end of the week days and nights, you get the entire package that comes with the Sheriff's Office.
You are buying into the network that is the Sheriff's Office whether it be our forensics unit, our SWAT team, our detective bureau, our You are essentially contracting our services and whether it's the one deputy working late at night when there's not a lot of calls for service or in the middle of the day on a busy weekend, you have the entire suite of services the Sheriff's Department has at its fingertips. Just today as I was leaving my office to come over to this meeting, call that led to a bit of a perhaps mental health emergency that was going on at the same time. And responding to that call was not only our Buellton deputy, but our sheriff sergeant and our crisis intervention team from elsewhere in the county that came to support that need.
So the idea that you're only paying for one deputy is a fallacy. And when you need 20 deputies, you get 20 deputies. When you need one deputy there's always one available when the citizens of Buellton call for help and that deputy will have support 24 hours a day. They will not respond to a call by themselves. They will not be out on an island in Buellton trying to figure things out whether it be their surrounding county units, their supervisors, our support units, our specialty units we provide so much more than this idea that you're only paying for one deputy But regardless of what you decide tonight, like I said we have the utmost respect for Chief Martin and his wonderful managers that work over in Lompoc and the great officers that work there.
The Sheriff's Department is proud to be your police. We're looking forward to continuing through the life of this contract and beyond. And after public comment, I'm happy to take your questions but I really just wanted to get out in front of that one depth of narrative because I think that's being misconstrued in the public.

Thank you and what a great way to capture an audience, our law enforcement. Again I'm Elena Alvarado, I'm a school board member at the Buellton Union School District. Just wanted to go over a couple of things as obviously it relates to the schools and to convey those interested parties so that they know either the current or potential We have a number of things we want to discuss as things get started.
I want to start by saying thank you to the city of Buellton for The importance of our relationship with law enforcement, again the current potential that may come into play. We do have concerns about blocking the streets and speeding, finding out that cars that are going through Oak Valley for example through the parking lot and then they exit on Via Corona just you know speed picks up so we would like to see some additional coverage on that side as well And we recognize, we know the importance of what's going on in this community. But then the increased appearances at the school beginning at the end and we're not talking about every day but it would be nice to have a little bit more presence We don't see this as much at a Haneda, although we do have a lot of students walking to campus.
So it'd be nice to have some just patrolling around that area again. I know those times of the day are not easy when things are happening throughout the day that involve law enforcement. Another thing I just wanted to note again for our audience as well School safety is just a huge part of our school agenda. We have regular safety meetings with staff, with students. We have fire drills and earthquake drills. We have active shooter drills. We are constantly looking at ways to improve our safety for our community or school community.
We do know that law enforcement comes to assemblies, those types of things. But we just want to take the opportunity to reach out and have additional We've had a number of meetings with our law enforcement. I want to start by saying thank you to all of our community members for the support that we need to be aware of. Again, as a community, not necessarily as a school community but as a community.
So again, greatly appreciate the presence and support that we get now. They're very responsive. We really appreciate their reaction in their time when we need them and they're there as quickly as possible so we do and look at additional coverage at our school sites at the beginning and the ending of the day, not just at the beginning of the school year but throughout.

You want to look at public outreach activities just some whatever direction you want to give me in that regard will give me the direction I need to move forward.

I had a question for this. Is there anybody armed at our schools? There's resource officers, sometimes teachers are... that's something everybody is supposed to know.
I don't have any secret information that isn't out in the public. There is currently not a school resource officer assigned to any of the schools in Buellton. Is anybody considered that or is that something? It is certainly something the council could consider. As far as our contracting, it's a menu item that if there was the appetite for it in the city of Buellton, something that we could add into future contracts by addendum or through a new contract.
I was thinking more having teachers armed than officers.
You know... I don't know that there's a specific program through the sheriff's office that qualifies that individual.

I just had one actually for Chief from Lompoc. It's more of just understanding on your end for it could you explain to me what makes you want to do something like an expansion of this? How has this been a fit for you, for the City of Lompoc? I'm just curious what would be your motivation for your organization?
Well so for us The department in and of itself, and the city in it of itself. It has a larger footprint in the law enforcement community in the county with more of a presence in both your city and the City of Solvang. You know, in Lompoc we roll anywhere between 35 to 45 thousand calls a year. I have a staff of 25 on patrol that handles that. It's a very heavy call volume that they handle.
One of the benefits that I saw in this was because of your call volume, it's much less. So I can assign officers here for a six-month rotation and there's like a decompression that takes place. It's healthier for them and healthier for their careers. They're still hardworking police officers are still going to be out there doing traffic enforcement You know, addressing any of the community problems that you're suffering with here.
And then there's those shared costs right? So as with the Sheriff's Department, you share costs with some of their leadership and some of things, some of the positions within the department. So the City of Lompoc benefits on that same level by engaging in this contract. And I think, you know, the biggest driving factor for me is that the health of my officers and having a location where six months out of a year we can rotate some people here to decompress a little bit before they're going back to some of the call-to-call-to calls days that we have in Lompoc.
But in the end it's really about how What you want, how you want it and how we can provide it. So based on whatever weeds we get into on that level if it moves forward in that direction and will address that but I think overall there's a cost share benefit there's a mental health benefit for my police officers and more of a presence in the county as law enforcement agency.
And that actually leads a follow-up question to Lieutenant Henderson, so I'm sorry to make you go back and forth like this. We should have just done mics out there, yeah. My question is as the police chief just brought up their six month rotations, I'm just curious in our current contract with law enforcement what is the rotation of deputies within Buellton? Is there a similar rotation schedule that is kind of moving around or do they stay here, are the four deputies we have, are they just always assigned here?
So Mr. Mayor, to answer your question, Deputies that move in and out of the Central Stations, which is the Central Stations Patrol Bureau is what I am lieutenant of. That encompasses the Chumash Reservation, the City of Solvang, the City of Buellton, the unincorporated area of Santa Barbara from Surf Beach to Lake Kachuma and just south of Los Alamos. So what you'll find is deputies are assigned to the central stations and they spend a good tenure here.
While they may move between the different beats where the Chumash car is a beat, the City of Solvang is a beat. The city of Buellton is a beat and then we have two deputies assigned to Lompoc that's a beat you may see some movement between there but what we do find is a lot of times deputies have the station they enjoy working at so you likely see the same people for cycling through the city car here in Buellton. We had a long standing deputy who worked in the valley for 10 years plus, who was the Buellton car? He only worked in Buellton. He lived in Buellton and he loves working in Buellton. And we find that with a lot of our beats that we do see regular people working those beats but we have no official rotation policy. There is no coming into Central for a deployment period and then moving on to another station.
In order to move to another station you have to get onto a transfer list and wait for your number to come up. So we do find deputies end up staying here in the Valley for quite a while but they do cycle through the beats. Thank you very much.
Seeing no further questions, I think what might be helpful at least is going through a round of each council member giving kind of their feedback or comments. You might generate additional questions that come from that naturally but maybe if we could go through a round of all five of us getting our opinions and thoughts out and then see after that if we need to do a revisit because it stimulates other conversation but may allow everyone a chance to finish their entire frame of thought if that works so Council Member Hornick do you want to start off?
Sure So just keeping it on agenda topic here, I think that one want to say heartfelt gratitude to Sheriff's Department. I think they do a fantastic job and know that a lot of them do live in the community and I see them regularly I do know from conversation with staff also that we've had contract frustration and financial hard points with our contract with the sheriff historically.
So for me, what I think is I would like to have staff consider talking to the sheriff about our contract and seeing what could be done about that. But I also think that there needs to be a lot of public outreach about this, because I know community members are going to be caring a lot about what happens regarding this and they're gonna want to have information. So if staff could do these town halls, I don't think we need an ad hoc committee for it but if they could set up one or two maybe at the school, maybe at Wilmington property, I think that would be a good idea to sort of get people's feedback and alleviate some concern there.
So that's what I think we should be looking at. Council Member Lewis?
Okay, I want to start by saying I think that in the conversation it's important to differentiate between the services that were being provided by the boots on the ground because there is not one issue that we have had with boots on the ground. We appreciate absolutely every single one. We love that they live in the community all of that. That being said you know as council member Kornick alluded to The interaction with the organization itself, with a contracting perspective have posed some issues and I think it behooves us as stewards of the city to look at the financial picture of that in the aspect. And I absolutely hear what you're saying. It's not one deputy and I appreciate you pointing that out. And I think we do need to ask for an extension and just review the options from a fiscal point of view and go from there.

And negotiate a little bit if something can be changed or change the price a little bit lower. I know we've only got 5,500 people but if the sheriff's cover around 100,000 people maybe that aren't in cities You know, they've just split it up. We're only a few people but I do appreciate all the hard work and think of the one sheriff in town, I always see more sheriffs in town and they're always running around. And I appreciate them being here all the time and I do like that the sheriffs are locals and you know the people, it's important.
And it's, I don't really want to start training new deputies or just start a new bank of deputies. And I also don't know if I want two deputies all the time. I don' think we need two deputies sitting in Buellton all the time. Luckily we have a low enough prime rate. So I'm going with working on the sheriff's contract for an extension and trying to negotiate the price a little bit I
would like to echo what councilmember Hornek and Lewis said. I agree the sheriff's department has done a good job but we do have a fiduciary responsibility to make sure that it is not just the final number, it is about the value of What are we getting? Like what's the biggest bang for our buck essentially. So I would definitely like to pursue looking at both the Sheriff's Department and Lompoc PD, I want to see what they can offer us per service wise whether we negotiate if the Sheriff's Department price can come down great! If it can't it is what it is but I'm just more interested in the value for our dollar because of I would like to see more research done into what the sheriff's department can offer us and does currently offer us.
And I agree with Council Member Hornick that perhaps we have to have this, if it's going to be a cost-sharing thing that obviously we need to have a conversation with other jurisdictions because I'm sure that Buellton can't do this on our own. So we definitely need to either talking to Solvang or one of the other jurisdictions in the area so that would be my takeover. Thank you
Okay, and yeah I think in looking at this the one thing that I would like to focus on is that when there is consumer choice the customer benefits from it. And so I think that if we have the great Sheriff's Department that is being present it is great that Lompoc PD is open and interested in this and I think that this is actually a better chance for us to reflect as a community. I don't know the last time that the community was engaged with really establishing what the values are they want to see in their law enforcement. I don't know when we've done public outreach, do we feel that the Sheriff's Department even knows what Buellton residents would like to see maybe differently done? Have we done that engagement with it? So I think that this is a chance for the community public outreach to not just be, is it Lompoc PD?
Is it the Sheriff's Department as a binary choice? It should be more about what is our community looking for in law enforcement I'd like to have discussions about de-escalation plans. In general, if we were to continue with the Sheriff's Department, that's good information for them. If we were to move forward with the Lompoc PD, that's good information for them to know what the community wants to see with that. I agree that a one-year extension is the only way to make this happen and we shouldn't be making a decision with the artificial timeline of June 30th so we shouldn't be rushing that. So I think community outreach, public forums, a chance to get a baseline of facts. I'm most concerned that we don't even know exactly how to explain our sheriff's contract And if we aren't able to explain that, then there's a disconnect with that right there.
And so I think the community having a shared pool of knowledge and understanding about those facts are would be great so that they can advocate in an informed manner as well. And then the other piece that I would say beyond all this human rights ones is I still have a concern, and I don't know how to establish this, of governance. And that's still the piece that sits with me most when this came up is I see it as the Buellton residents have a chance to vote for who the sheriff is. Buellton residents have a chance to vote for their county supervisor, who does financial oversight. As watered down as that can be with the size of Buellton there is an electoral element to that and when we talk about Law & Pope PD, I don't understand how that oversight structure works.
I know there's a vendor element with it but If I understand the Lompoc police chief is hired at the pleasure of the city manager of Lompok and the city manager of Lompoc is hired by three or more seats within Lompop PD. And so, I would be very also curious and this would have to be fleshed out more in this timeline of how does a Buellton resident feel that they have I'm not sure exactly how we can be a vendor that says, great.
So I think that would be very important for me to see, too. So that was a long winded answer for a lot of things there. Pausing to see if anyone else feels like we need to, they need to add further details to this for staff. I think you've got a lot of feedback so far. Anything else that's been generated or questions from any staff or council members? Do you feel like you got enough direction out of that?
I have enough to work with yes
My final one would just be, it sounds like there's a desire to, are we hearing not to form an ad hoc committee? Not to form an ad hoc committee. I'm curious, that's the one thing you had asked about.
Yeah, the rationale behind that was simply to provide some certainty for city council participation in these public outreach activities because short of having the ad hoc committee or making a decision on as needed basis when these meetings pop up where you're limited to two city council members at a meeting unless you notice it as a special city council meeting.
It does seem like there's some council consent about exploring the one-year extension on the contract at this point, so maybe with that in mind it can also be with that greater runway and space a decision that if the staff realizes there needs to be a scheduled special meeting that all five of us are present at then that would be a worthwhile thing to explore as we get further down the road there?
That does trigger a question for me. So if this is going to be a joint powers thing, though, does the one year extension sort of preclude that or cut that off? If we were going to
enter? The consideration of the creation of a joint powers type of an arrangement I'm going to start by saying that the current non-existent police department is going to take far more time than even a one or two or maybe even a three year extension. We could spend a year researching what would be necessary for I will note that we have more than one agency right But three years ago, we had one of the County Board of Supervisors indicating his desire not to serve cities at all.
Let the cities fend for themselves. And if that is the kind of an approach that were to spread amongst the Board of Supervisors, we could find ourselves needing to create our own department. So that's always something we'll be looking at whether that's creating a department strictly for the city of Buellton or creating something that's a little more far reaching and hopefully more cost effective in the form of a joint powers type of an approach to providing law enforcement.
So it seems like we should be doing that
anyway. And we are, I'll be having discussions but it will likely not be something to replace our current contract.
Do you need us to formalize at all? I know you mentioned about coordination and the discussion that needs to happen with the City of Solvang and us. Is there a need to be... I'm
just throwing it out there, if you have an opportunity to have some discussions with an elected or two on the Solvang City Council and find out, make sure that there's an understanding. I will be having those discussions with the city manager there as we move forward But as you're aware, you all have your own individual perspectives that are going to be different from mine. And so a little bit of discussion between the cities wouldn't be hurtful.

There's a really great opportunity that having two agencies willing to do public outreach, assuming that you've signed off on this, I realize no one's actually nodded their heads but assuming you before with it, it's a real value to our community to be able to understand and learn and I think that's part of what's so great value here is I would love the idea that Buellton residents get to have a say of what they want to look at, what their law enforcement look feels and the values part of that. So your willingness to engage in this conversation is a testament to your agencies and to the transparency and willing to serve the community. And I know that this is a higher calling for a lot people who get into law enforcement And so these are hours on top of already doing a tough job.
And so you being here tonight and then having us have this discussion and saying, and then we'll go talk to your residents means a lot that is a testament to your character. And I thank you both for being here tonight and look forward to having these discussions in a very civil calm peaceful and non polarizing manner but that's why a one year extension probably allows a little less pressure on everyone so we can do it right and make sure the community feels heard. Mr. Mayor, members of the City Council. Item number 10 this evening is the conceptual review of a mixed-use project at 560 Avenue of Flags. Our staff contact this evening is our contract city planner Irma Tucker
Thank you, City Manager and Honorable Mayor and City Council members. I would like to share my screen at this point. So if I'm...

go. Okay. Okay. Correct. All right, anyways thank you. So as we just heard this is the conceptual review of the proposed mixed-use project at 560 Avenue Flags and before I get started with an actual diving into the project description in the site plan I just wanted to give a little background on why the conceptual review is coming before City Council tonight The primary project for this site is, as I mentioned, 560 Avenue Flags and because this is a proposed mixed-use project the Municipal Code requires that City Council be the ultimate approving body for mixed use projects.
In addition to that, the proposal entails the use of some property on an adjacent parcel that could potentially become a portion of this project. The property, the project and the development that's located on that property is the Avenue Heights apartment which was approved by City Council several years ago. So because both of these projects, the decisions would ultimately fall under the jurisdiction of the City Council staff felt it would be appropriate for the City Council to hear and have an opportunity to present their preliminary comments on this.
Previously the planning team The commission has reviewed this conceptually on August 6th and their comments, summary of their comments are included in your staff report. And I'll briefly go over them later on in the presentation. So the property is located on Avenue Flags and I believe you can see my cursor pointing out the large parcel is the primary site.
This is a little over three quarters of an acre That would be the primary location for the entitlement for the mixed use project. There's a adjacent area right here just north of the site that they are proposing to use for parking, in addition to parking that's on their site. But this particular parcel belongs to the Avenue Heights apartment as you can follow my cursor around to the right. It wraps around here and these buildings are all the Avenue Heights apartments. These two properties are currently owned by the same owner, which is why this proposal was being structured the way that it is.
The property here is located in the Avenue Flags specific plan so that governs the land use for the properties. The underlying zoning is general commercial To the north of the property is the Farmhouse Motel. To the west of the property is the Avenue Flags and Median 2. To the south is Hotel Juguet, and to the west here are the Avenue Heights Apartments. The mixed-use project consists of a proposed four story building in Art Deco design style and there would be almost 3,000 square feet of ground floor commercial on the Avenue Flags frontage.
There would be 26 apartment units and support in common areas to balance at the site. For the parking 49 spaces are proposed and this includes 21 spaces on an open space portion of the adjacent apartment parcel Three spaces, three additional spaces which are all accessed from and partially located on the apartment's internal driveway. And then 24 of the overall spaces would be tandem spaces.
Access to the site is from Avenue Flags via an internal driveway that is shared with the Avenue Heights Apartments. That's how this site was laid out originally. The applicant is proposing to utilize the State Density Bonus Law in order to increase the allowable density and also to request potential concessions and waivers or reductions of development standards, and also to apply parking standards per the state law.
I would like to note here that the utilization of the State Density Bonus Law is subject determination of consistency in terms of what they're proposing, consistency with the state law. And this will be done once a formal application is submitted and fees are paid and staff can get into a much deeper review at that point. This is the conceptual site plan. On the left is Avenue Flags. In blue here is the ground floor commercial space.
Tucked behind it is ground floor I'm sorry, Ground Floor Residential in the lounge and lobby area. Coming in from Avenue Flags is the internal access driveway and this is the parking that's located on the project site and north of that is parking that they're proposing to use on parcel that's currently part of the Avenue Heights Apartments which is located to the right here These are the conceptual site elevations. The one on the top is the view from Avenue of Flags, and as you can see it presents a three-story building on the Avenue of Flags. They're proposing to do nice high ceiling heights for the commercial which is typical.
The elevation below is a side elevation from the south and what you can see here I'm pointing on the left side is Avenue of Flags which is three stories, but because of the site slope to the rear they were able to take advantage of this site sloping and topography to tuck in another floor on the bottom. So what you end up with is a four-story building but the massing doesn't really present as a larger four story building because of the way that the topography of the site is.
And here's view from the east, which would be the view that would be seen from the Avenue Heights Apartments project. And then this is a view from the north again also shows how the topography slopes down and the bottom floor is tucked below here Okay, so some of staff's preliminary comments are and I touched on this a little bit. So because this is a conceptual review staff has not reviewed these plans for compliance with the municipal code or the general plan or the specific plan or the design guidelines and as i mentioned the state density bonus law Detailed review will take place once a formal project application is submitted.
And the outcome of this review may result in potential changes to the site plan and project description. I would also like to mention that the staff will work with the city attorney at that point to determine the validity of the request for the state density bonus law waivers, and also just the overall consistency of how the request is using the state law. Based upon information in the applicant's project description, the following preliminary permits are anticipated.
We anticipate that a final development plan would be needed for the mixed-use project on the primary parcel. Also, a development plan modification would potentially be needed regarding the Avenue Heights Apartments entitlements on the adjacent project. There would also be a potential lot line adjustment or parcel map that may be required to incorporate the parking area on the adjacent apartment parcel onto the actual primary parcel.
And there would be other permits, ancillary permits that will be identified at the time the project application is submitted. As I mentioned, the project has gone before Planning Commission for conceptual review. And I included just a few basic comments, summary of their comments from the commissioners. Overall, the project was well received by the commission. They asked for clarification on some items and just confirmation that these in fact would be rental units, that the residential floors are on the second and third and fourth story, and the third and fourth story are essentially the same floor plan Generally the Planning Commission liked the color palette, they liked the Art Deco elements that was thoughtfully incorporated into the project and they appreciated the retention of true active commercial space fronting on the avenue rather than live work units.
Generally those were typical of the comments from the other commissioners, they liked the The design and the color scheme. Chair Reese asked for some clarification with regards to how the open space is being used and taken from another property. Those will all be looked into greater detail, and also had some questions about how the density bonus law would be applied.
Thought the design was well executed, effective use of the site slope to allow for four stories without having the building feel as tall or massive. And appreciated the thought put into the building's design and articulation. So the recommendation tonight is that the city council provide preliminary comments for use by staff as well as the applicant in I'm available right now to answer any questions the Council may have. And after that, I would turn it back to Mayor and ask for any comments or invite the applicant up to speak.

Ms. Tucker would you mind going back a couple slides if you can to Commissioner Reese's comments about the ownership versus rental use of modern The potential issues she's flagged one is use of moderate income units for rentals as law may require these to be for sale ownership units to qualify for stacking provision proposed. We do not have clarity at this point, these are items that we will be looking into in greater detail um as I mentioned we will be working with our city attorney and taking a We're going to have a closer look at what they're proposing and how it aligns with the state density bonus law.

Thank you staff, good evening City Council thank you for the opportunity to talk to you tonight my name is Emily Ewer I am a senior planner at Oasis Associates And we're here on behalf of the property owner and applicant, Sea Ridge Limited Partnership which is managed by Joe Collins. Before I get started Mr. Collins has provided a short statement as follows. We want to be a part of the dream at the Avenue Flags in Buellton. We know that the avenue will be amazing and we look forward to being a part of its transformation Our architectural plan took several years to evolve and while Art Deco buildings can be prohibitively expensive, Aris has designed an elegant building that we can actually afford to build. We have noticed that there are several permitted properties in Buellton that have not been built but I want to commit to you this evening that we will build this mixed-use project as soon as possible so Joe is very excited to have a project here and is eager to go I hope you've had a chance to review the plans and the project description that were part of your agenda package.
That essentially is our intention on how our formal application will be submitted pending your comments and direction. Next slide We'll go into the details here since Irma's walked you through where we are. This shows the complete avenue of heights and again if there is the site plan, and the parking to the north is also owned by Mr. Collins so he has the ability to provide himself an off-site parking agreement shared parking.
We have control of both of those properties to do what we need to do for a shared property situation. If we go to the next slide, so this is the perspectives which I will bring up Mr. Jess to talk a little bit about the architecture.

Good evening, Tom Jess with Aris Studio Architects. Thanks for allowing us to walk you through this. So the design was really driven by the specific plan and we really embraced the Art Deco aspects that were dictated by that and I think that Staff did a good job of explaining kind of how this came about in terms of the massing. So, the site does slope where Avenue the flags is the high part as you go towards the adjacent apartments, the site slopes down so we were able to basically locate the commercial story at halfway between the 1st and 2nd stories. So we get the tall ceilings.
And then we did the step back at the top of that to kind One of the defining characteristics of the Art Deco, we have the color scheme. We have the tile accents. We have a really strong emphasis on the lines both horizontal and vertical lines through there but it's a very clean simplified version that we've taken through there. If you can go to the next slide please?
This is the view from the street you can see how we've activated that pedestrian experience there with tile accents, the light fixtures the awnings and the signage that's integral to the building rather than just kind of tacked on and looking like an afterthought. The architecture up above you can see with the pedestrian level where there's some accents that are brought from the top to the bottom.
And then the private decks there on the corner, where people will have views out and be able to experience outdoors here. I do want to just make a couple mentions, the building is fully accessible. There is an elevator that'll serve all the floors for There's an amenity space on the ground floor for the residents. It's really trying hard to put our best foot forward and do a really good job there, as Emily mentioned, Joe owns the apartments next door or Joe is the property owner client. So lots of lessons learned things that people like in this area that we've incorporated into this.
We've done a few little tricks inside that make the space a little bit more livable. By eliminating soffits and being able to keep the tall ceilings, and just little things like that kind of make a difference. And I think the next slide talks to some of the materials. You can see that, Andrea, the color scheme in your outfit. You're right on point so I appreciate that. Very typical color schemes for the Art Deco kind of flavor and character and really bring in the concentration down at the pedestrian level. At Avenue The Flag's elevation, that's really the focal point that we want to make sure that we enhance that pedestrian experience across the front and make those retail spaces successful and a positive contribution. So anyway, I think Emily is going to walk you through the rest of the presentation but happy to answer any questions that you may have.

you. Next slide please. So as mentioned the project is using the California density bonus laws. The base density for the property would be 13 dwelling units With the state law densities, we can achieve a 100% bonus for the total of the 26 units. Of that four of those would be affordable units. As mentioned during the planning commission hearing, we did take a re-review of the density bonus law which if you've ever had the joy and pleasure of reading that document There are sections that are applicable in different situations.
There is a section which we are not utilizing that moderate rate or specifically identified as for sale but the moderate that we're using is actually from a separate section that talks about moderate for both for sale and rental so Commissioner that there is a section of for sale but it's not the one Let's see, next slide. And then also as mentioned we are planning to request and utilize the provisions of that bonus density law for incentives concessions waivers as well as a standardized parking rate so those include a modification of the upper floor street frontage setback as noted in the Thank you, Mr. Chair.
We are also request will be requesting an elimination of the required commercial parking. That's mainly due to the parking efficiencies as well as being able to get commercial parking and an accessible path up that topography has proved challenging, so the accessibility would come from the street front. And then we also would utilize the state density bonus parking standard. So next slide.
So this just shows where those items are that we would be looking at those concession, incentive and waivers. So the first or the upper floor setback oh and also building heights at 47 feet that is above the standard 35 feets for the CR zone however in the specific plan there is provisions to allow up to 50 feet. So we are still within that envisioned heights but we would be utilizing the
considerations
to do so And I believe that concludes our presentation. Oh never mind, we have the on and off-site parking just as an exhibit and that is where we would be using the currently it's in open space and basketball courts, half court or the Avenue of Heights apartments. The tot lot still remains next door on that as well And I believe now that concludes our presentation. We are of course available if you have any questions.

And then thank you that's good to know. And then another question I had was a lot of what I talked to people about and their concerns about development revolve around infrastructure support, hence the parking question but also the traffic. Is there a traffic study that has been done would be done?
Has not been done today and that's I think something that we would coordinate with staff on
yes Yes, we would definitely look at traffic. Whether we would require a full-blown traffic study or not is going to depend partially on what level of CEQA review would be required for this project. But that would be determined once they formally submit.

As I think Irma and everyone here has mentioned, the state density bonus law is quite complex but it is something that if we would work with our city attorney on to determine the validity of the specific request. But if they do qualify and if it is determined to be consistent with state density bonus law there are very limited instances in which the council or the decision-making body would have any discretion not to say that they do not exist but again it's something we'll work with our city attorney on as the project progresses
And the amount of parking is that also a concession and.
That can be a very common concession that's requested
if we have businesses, there's no place for the businesses to park to get deliveries or anything because. And what's going to happen with the trucks come up to drop?
I don't necessarily believe that the state density bonus law addresses like unloading, loading and unloading spaces for commercial establishments. So I think you're referring to basically the commercial establishments loading and unloading product or deliveries etc. Most projects are in most cases if there is a commercial component depending on the square footage we would require a loading zone which would be separate from the parking standard
And we're not requiring that because...
So in this case, yeah. That is if they are under 3,000 square feet of commercial the municipal code does not require a loading space but if they did go over that threshold we would.
Was that what determined your commercial? Because of the...
No, not necessarily. What dictated it was the amount of area that we had available across the front of that site for commercial space and it happened to be under... I mean, it's just not a big site there and the way that we did it was we broke it up into smaller spaces and that's on a demand basis. It seemed like the smaller spaces are more in demand so we're trying to build to the market and just cumulatively it was just shy of 3,000 square feet
I will say that even if we cannot require a dedicated loading space for the project, we can work with the developers on delivery hours. The project could potentially be conditioned for hours for delivery or try to work with the property owner on best locations for deliveries as to not... It is a tight site so it's something that we would have to look into.
I just don't like there's not enough parking because what's going to happen is and there's these tandem Have you ever had a tandem parking area?
Yeah, we've used tandem parking quite a bit and it's proven to be very successful. So the way that that works is they would both be assigned to the same unit so that you can't assign tandem parking to two different It's one of the ways to meet the parking requirement. The reason that the State Density Bonus Law was created in the first place was to address a severe housing crisis, I mean in the state and in general as well. So it's created the incentives of concessions as a way to motivate people to build this housing and the affordable housing that's being provided is not something that It is significant. There's going to be two units for the very low-income residents, and that's deed restricted for here until essentially the lifetime of the project.
And that's going to provide housing for people that are in desperate need of housing. And then the same thing with the moderate income. Like I said, we're taking lessons learned from the adjacent project and the unit mix that we're providing is what's proven to be in demand. The two and three bedroom units because it's families. It's people with more than one person in the household and we're finding that that's something that's desperately needed in this area so that's what we're building too. The parking We're providing just shy of two. We're providing 49 spaces for 26 units, which is ample parking There's some ability to share parking between the two of them and they're very open. The owner obviously wants what's best for all the tenants as well, so
thank you. Because there's not enough parking where it is. So they're on the street and around the corner that I just, that's why it's concerning with enough parking but if you're going to also be able to use some of the other parking. That'd be nice.

be roughly 35. Is there any thought to, because we definitely want to make this like a walkable accessible. So basically this commercial property is there going to be space for bike racks? Is there going to It just doesn't look like it's going to be inviting at night, like if it was open at night. So I was just curious could you tell me could you just talk about the vision for the commercial space a little bit more and how that is going to be something that draws people to the avenue which is what we want to be doing?
Yeah, no, absolutely. And I think we're showing a daytime photo here if we were to show a nighttime photo, I think what you would see is we have envisioned that each of those recesses where the signage is going to be would have some recess lights that would shine on there and we really want to emphasize The pedestrian experience. I think I mentioned that in the presentation, so that's where we've done the enhanced materials with the tile with the tall windows and then if the businesses are open at night there's going to be light coming out from the businesses it's going to be very well lit at that level but all of our lights are down lights right? We're not violating the nice sky ordinance or anything along those lines but we do want that to be a nice bright inviting area across the front there
Okay. Do you think there's space for like a bike rack?
Oh, 100%. I'm sorry, I skipped over that. There is secure lockable storage for the residents for their bikes and then there would be short-term bike racks available for the tenants and I mean for the commercial space. And then the thing I'd like to do is pick up off of what we're already doing in the median with the Art Deco railings which are really nice and do some fun bike racks there not just a regular U-shaped bike rack but let's have some fun out there.
Do you know if these apartments are going to be pet-friendly?
100 percent.

you. Would these be all electric or we usually have gas? All electric yeah I'm opposed to that because it's for safety We have power outages, and I still don't understand the affection for no gas and no carbon. I just don't get it.
No, understood. And we have a client that made all his money in oil and gas, and he really doesn't like this either. But that's not this client. That's a different one. So on this one, what is going to be dictated on this and some of your concerns are addressed in the new version of the building code and some Hybrid heat pump water heaters that we have on these are incredibly efficient. They use the extra heat from there to help boost the heating of the space and so forth, and then the other thing that they have, so the whole system's very efficient in the HVAC units each rooms individually air conditioned so you're not heating and cooling the whole space through the mini split type of system. And then for a project like this, we would have solar on the roof but in addition to solar, we'd also have a battery backup So that it can power the building in the sense of a power outage, you'd have to power it for a certain amount of time.
So those are starting to be addressed throughout the Title 24 conditions and I will say that a lot of people really likes the gas ranges but people are, the electric induction ranges have been really come a long way and so we haven't gotten any complaints from tenants about the all-electric but I understand your concerns.

So basically under the current specific plan, the max cap is 360. And that was what was analyzed for under CEQA for the specific plan. The council always has the option to open that back up but if they were to increase the number of units allowed per the specific plan, that would also open up the CEQAs and it would require a specific plan amendment and would potentially open up the CEQA aspect of that as well.

Thanks. So the only thought I have and I'm not a design person but can you go back to one of the other pictures of it? I really love what you did. First of all, it's a beautiful building. No no like the front of the building that faces the ABBA flags. That one right there yeah that one this one is perfect. So I really liked the way that you kind of capped that middle section right there kind of looks like the best way you know and I think.
If we really wanted to bring like, just like make the building stand out a little bit more that you could do it on the other two pushouts. Just because then the art it would just like really then it would be very obvious I think that whole front of that building is commercial and it kind of really separates it from the residential but obviously I'm not an architect but that was just my thought. I just really love Art Deco and in conjunction with that I would actually love to see a nighttime rendering just to see a little bit more of what you do have in mind for that open inviting commercial space and you can put your bike rack your art deco bike rack on that picture too, but that would be great. But yeah other than that it's very nice thank you so much appreciate it
yes I think that this is a really responsible rendering I think oftentimes uh Art Deco can be really construed into dramatic statements and this feels very purposeful and thoughtful but yet in some ways reserved and like um restricted a little bit in a good way with it so I think that you are really setting a tone for how the rest of this ≫ Good afternoon, everyone.
I hear what Councilmember Sanchez is saying with the parking concerns with it. So being mindful of that ingress-egress, I live in an area that was intended for parking and garages and there's led to a lot of bleed over to it so I know that as you're going through this just being aware that the community will give you great feedback about concerns on parking. So you explained the way you just did up here. You've gone above and beyond should be at the front of your presentation. I think you're underselling the accommodations that you're providing for us The only other piece that I would say in building off of Councilmember, or sorry Vice Mayor Mead is that in the integration of your commercial space We are, I love what you've done. Outdoor seating if you look at that, I know so that's not integrated into it.
So if you're looking for there being an element of like restaurant dining, I think that outdoor seating would be something that people would like to see and possibly if that's a space where I don't know how that would work with it but you may want to just be mindful about if you plan on having eateries of some kind the outdoor seating would be a good option and viable place for you in that one.
And I do wanna be mindful too as we look this is diagonal from where we're looking at median three correct? And that is where we're putting a, in theory, the Planning Commission's reviewing a project that has an amphitheater right across the street. Correct?
We have conceptual design plans for Median 3 that will be coming back through the process here that include sort of an outdoors venue of some kind.

It's like the end of a saga.
Select, well the subject of this is selection a vendor for drone show during Winterfest event but it's a little more than a selection of a vendor. Should the City Council even decide to whether they want to see a drone show at the June 25th meeting? Sorry, at the August 10th.
I'm sorry we might want to stop sharing too. I
realize you're still sharing the old project. One of these days okay there we are All right. At the August 10th meeting, the council considered a series of proposals to provide a drone show to the city's Winterfest event in December. The matrix that's at the bottom of the first page of your staff report gives an idea of what the cost range would be for different values or different Levels of a drone show that could be provided ranging from a small show of about 100 drones up to large shows of 400 drones.
A question was provided to staff, or requested of staff that we give some sort of visual indication of what the differences in the number of drones might be. The staff report includes several pages of photos We're going to be looking at a number of different types of drones. So we hope we've given you a sufficient range of ideas to what looking for there. The matrix at the front page itself gives you three different vendors, each with three different proposals and the price limit or the prices associated with those.
What staff is looking for this evening is a determination by the City Council as to whether or not you would like to see a drone show In conjunction with this Winterfest event, and if so what level would you like to see in terms of the number of drones? And if you've got a preferred vendor based upon the price list we've given here then that would be done. be helpful direction as well. If we can get that from you, then staff will enter into an agreement with the selected vendor at the selected level at the selected cost and then begin to work with our chamber to put this together.
So I'm happy answering questions you have but otherwise I'll await direction.

We're looking at it is very hard to discern the difference between This 200 drones and 400 drones and 500 drones on the images that we've been given, right? So it just seems to me to be concerning to establish what is very likely going to be an annual budgetary line item based on limited information. And that's my concern. And I don't have a lot of experience with drone shows so it could be that a small drone show done by droneshow.com is fantastic I don't think we have the information which would almost double the price. I don't think we have the information here to really appropriately say what would be a good spend.
There's nothing stopping us from recouping some, if not all or any of the costs of hosting a drone show. If we were to do things like sell sponsorships or do some other type of thing that would allow us to recoup funds is there have we decided that is not a thing that we're looking at?

But anyhow I mean it's definitely you know not I'm not saying it can't happen there's definitely businesses who we have a leadership circle within our chamber and it kind of It's different levels that businesses can come in and be a member, and it includes different levels of sponsorship sometimes for events.
And we can maneuver that and work with them. I have a bank that doesn't prefer to buy a table at something but they'd like to be a sponsor of the snow at Winterfest instead. So, I mean, we can definitely massage and move things around if our members want to. But I'm not saying there's business... Businesses might definitely wanna come in and say, I'm all-in, right? I'm not saying that's not available or not an option.
So Solvang's Fireworks, that's Rotary sponsored. Is that right? Okay do we reach out to Rotary at all to do this?
This wasn't my thing I'm just here to support it as Winterfest so I know it was kind of brought to us from the City Council say would you like it could we do this and I'm totally on board with it I love the energy behind it I think it's fun but yeah Rotary has I don't believe has been asked for any donations for it yep

So for city staff are we was the goal to have the chamber kind of pay? Here's the money. Can you get this done or was it kind of going to be a city thing?
No, the way this is set up was if the City Council wanted to do this, we had to placeholder budget amount established in The City Council wants to move forward with this, then the recommendation would be to authorize me to execute an agreement with the drone show company of your choice. And then we would work with them to put together a show and that we would likely work with them in conjunction with the chamber in terms of what that show should look like. I'm not the person you want designing a themed drone show.
But any of these companies, they have professionals that would help with the creation and design of this. But it's important to get feedback for what we would like to see. So I think about a council member or two who'd want to work with the chamber to kind of work through that, that would be great. But no, we wouldn't be... The intent was not to saddle the chamber with another duty.
Perfect. And what is the bandwidth of city staff to look at, look into or go after sponsorships of any kind?
That might be a little more tricky. I mean we could certainly put something out there much more passive. Hey if you're interested in sponsoring let us know but if you really wanted to have somebody go out and pound the pavement and track down businesses we're probably not in a position to do that.

15 minute deal and it costs a lot of money. So whatever you want to spend on it, I mean that's but but with this go under Christmas decorations budget because Christmas lights, we'd have lights for a whole season. I guess my point is you're going to spend a lot of money for a short amount of time but if you do that, that's your vote.
And would this be a one night show or would this be just for the lighting and all that?

Yeah I mean I just think that it would be a fun event to have. I think the people in Buellton deserve to have fun things happen in Buellton. I mean that's just how it goes and It's it would be really exciting drone shows bring a lot of people. I'm sure that the chamber could work to, I mean their job is tourism just like SYV is like all of it. Like this could be a huge event like Goleta gets thousands of people to come to their own show and you can see it from basically anywhere. And so I think that We're thinking very microcosmically about it just being a small show, just right here and right now. But the reality is if we have a drone show, we'd be the first one here in the Valley to have one. We actually have an event that competes with Solvang Fireworks which we don't know are massively popular.
These are more eco-friendly and they're safer. They aren't going to light anything on fire. They're safer for animals. And I just think that Buellton is the city that we push the envelope here. We want to be the city that does things first, we want to be the city that is like hey look at us, we are doing incredible things and so I think that the drone show is a really good way for us to do that and really bolster what the chamber has built with Winterfest and bolster what the Botanic Garden has already done with their winter lights. And so I just think that It would be a great opportunity for Buellton to really invest in the people of this city, to have something really incredible. I really do.
Yeah, I would agree with that. To me this seems like an opportunity. We get feedback a lot that Buellton needs an identity, Buellton needs to take pride, Buellton needs to not just be a gas station town. We just had a conversation that we're not just pea soup anymore either and so I think that our community members have asked for amenity building and a sense of civic pride and this is an opportunity and I hear concerns about financials of anything but I mean I don't know how much we would say a firework show lasts much longer than 15 minutes And I don't know how much we would say about a number of things that we spent money on that not everyone gets to enjoy. This is a free event for people to have, that I also think has economic benefit. It would make our Buellton Winterfest more successful.
It wouldn't be more people coming to support the businesses and the vendors who are at The We're trying to increase Buellton's visibility. So when I look at this, I think a reasonable midpoint for me is I come in at the Electric Sky 29,500 300 drones. That seems to be the most midpoint entry that we can do. I believe Electric Sky is also one that's worked locally in the area and they seem to have some good reputation with it and I think that we should give our community members a chance to have something to look forward to.
Winterfest. We already take the Sunday night one. Buellton was charged last time I hear too, we're the locals. We're the ones who have the locals who come to it. It's not the Los Olivos lighting, it's not the Solvang lighting, it's when Buellton does it. That's when the people come home and they go to their local community tree lighting. And I think that this is a good way to reward that level of local pride. So that's what I'm looking at right now. I think that it'd be great for us to partner with the chamber, I think that we have two council members who already are charged with being partners with the chamber and I think that their voice is being involved with ensuring that this doesn't feel like no brought to you by insert 17 corporate slogans would take place but I think that with our council members having some input in this we take responsibility and we make it successful so that's where I'm coming out 29 500 300 drones electric sky don't know if anyone has further feedback
I go with the 40,000 400 drones. You're going to spend 30,000 muscles and 40,000 you're gonna get people to come in and make it big. I love that. That's the dynamic went from no drone show to all drone show. You don't spend that much money and then you're gonna have a make

Authorized the expansion of library hours to include Sunday hours and that should take place sometime in September. We're in the process right now of recruiting a librarian to fill the spot, and then one or two other positions that need to be added or adjusted in order to make sure those library hours can be covered so that should happen sometime in September if there is an update with that I will keep you all posted The only other item I have for this evening is, I think I've called it to your attentions already. But for the benefit of the public out there, I'd like to announce that with the retirement of Paul Smith from our Recreation Department we have a new recreation supervisor as of this morning and that would be Allison Fiery who has been a recreation coordinator with us for a few years now and she has jumped into Paul's seat We'll continue to keep her busy and if you've got any grand ideas, please throw them her way.
