Well, good evening Mayor Julian Council members staff and members of the public. My name is Frances Romero I'm here tonight not because I necessarily want to be but I feel like I have a duty and an obligation when I see things and patterns trending with the city that remind me of the good old days prior to me being mayor Initially, I came to comment on the Sun article which was quite embarrassing actually. I felt regarding the meeting last time and the inability of city staff to be able to be accountable and transparent over the very basic things having to do with the budget for the Royal Theatre. Now while I understand that it's agendized today my concern is that if we are not capable of tracking this project, then what's happening with the budget?

We have a $8 million annual budget with a $1.7 million deficit which is a 20% hole. When I was mayor we had a $3 million annual general fund budget and this is just 14 years ago and we had a $750,000 hole which was a 25% hole So here we have a $2.9 million project, and we had another $700,000 of unaccounted for money. And when a council member asks staff for something, their job is not to tell them how hard it is going to be for them to find the information. Their job is to produce the information.

If I had been sitting in the mayor's seat, I would've had one simple thing to say, do your job. It does not elicit confidence when basic accounting principles seem to be lacking. I am glad to see that we have some additional professional help coming back, that I have some confidence in to help with the accounting transition. But this whole idea that grant money is free money It is not, it is taxpayer dollars and those taxpayer dollars should be precious and they should be accounted for. And they should be handled like you handle your own budgets how many people up here have a 20 to 25% deficit in their budget at home and then decide to go out on a vacation?

It feels a bit like that's what the city is doing as I see all of the great feel-good projects, the Royal Theater, the park. And I understand this is all grant money but I'm still focused on the $1.7 million deficit and what that does to this community, what it does to staffing, what it does to important functions that you're supposed to be responsible for like police, fire, wastewater I'll comment on item 7 about my concerns over some of those issues relative to the SCADA system.

Good evening, City of Guadalupe. My name is Phil Samuelson thank you for having me here tonight. If you're not familiar with Enterprise Fleet Management we are the sister company of Enterprise Rent-A-Car so we use enterprises existing infrastructure and help government entities such as yourself Lower total vehicle costs with data tracking. And I've been working with David the past few months to put together a plan to help your city lower your total fleet spend and apply data tracking to your vehicles in your city.

So in the presentation today, I'll give you a quick overview on Enterprise Fleet as a whole. And then we have some actual proposals to implement for your city to help you lower your total fleet expense. Before I kind of jump into what we do, always like to show who we work with. So we work with about 200 other government entities in California alone so you will not be the first, you will not be the last two important ones to note that are close by city of Grover Beach partner with us may have last year and then county of Santa Barbara.

Five years ago, started a pilot program with their police department to audit how we compare to their general services department. In January about two weeks ago they decided to open up our program to the rest of their county after their five-year pilot program. So at any point always happy to get additional references for other government agencies that we work with.

Benefit of working with Enterprise is we've already been approved and continually approved by Sourcewell, which is a cooperative purchasing agreement. So your city can piggyback off this existing contract. We've already been price audited and then you wouldn't have to go through some of the nutia of getting multiple bids for acquisitions, auctions etc. And then we can do everything from start to finish in terms of helping you manage your fleet.

A few I wanted to point out acquisition, so we can order vehicles directly from the manufacturer. So we can get invoice costs on your vehicles. No going to the dealer, paying MSRP and having to bargain for a specific pricing on vehicles. We would do all the license title registration for your vehicles. We can customize them with aftermarket however you see fit.

For maintenance we have two programs any vehicle you get with Enterprise is fixed budgeted inflation proof so no matter what you spend on maintenance Enterprise takes care of it for you. And then for all existing vehicles, we have a pay-as-you-go program. So you can go to our maintenance shops, we'd price check, audit all of your maintenance spend on those specific repairs.

For fuel programs via SourceWell the fuel card is free but our goal is to put a fuel card in every single one of your vehicles so we can track the MPG and the spending on each individual unit so we can figure out your total fleet spend as a whole at the end of the year. No, you're actually doing a great job guessing right now. And so unlike traditional dealership lease, we do call them leases but don't think of them as a dealership lease.

There's no wear and tear, there's no mileage restrictions. You own all rights of equity to the vehicle. So think about an open-end lease with enterprise as more as a finance at the end of the lease term, the vehicle is completely paid off and you own the equity in the vehicle Now this is a snapshot of what your fleet looks like today. So you have about 27 vehicles in fleet, you hold on to a vehicle about 17 years before it gets replaced at your fleet.

On average, you acquire about 1.6 vehicles per year. So the biggest thing in working with David was how can we start replacing your oldest vehicles and fleet without costing the city higher cash outlay than the first 12 months over a five 10-year span? So biggest note, when we start looking at replacing vehicles is those vehicles six and seven. I'm sorry 10 years or older about 12 different vehicles are 44% of the fleet is about 10 years or older main reason we want to replace those vehicles is for safety.

So majority of those vehicles don't have electronic stability control which is a big safety feature for reducing rollover on a vehicle. And then 14 of those vehicles predate standardization of the backup camera. So main goal in starting the fleet replacement is safety as a big factor. Now, we can help with any element of your fleet but the main thing we do for our government entities is helping you decide the optimal time to replace a vehicle.

So if you look at the left side of the graph it's cost bottom is time this kind of explains our philosophy in whole So if you look at the top light green arrow in the top left of the graph, if you run a vehicle like you're currently doing today over 17 years when you get to the end of the line, you don't have a lot of equity in that vehicle. You can maybe sell that vehicle for $1,000 at auction. At the same time your maintenance and fuel expenses start to double the older the vehicle gets. So what we do as a fleet partner is we look at can we replace that vehicle closer to the five year mark?

Where we can still sell the vehicle for $10,000 to $15,000. Maintenance expenses aren't too high and then we can use the equity of that vehicle sale to be applied to the next vehicle. So we put together two replacement plans to start refreshing your fleet. Option A involves replacing eight vehicles, six of which would be electric vehicles to help with the car

mandate Option B would be four vehicles year one and four vehicles year two. Benefits of both, but our recommendation would be option A for replacing eight vehicles year one. Main reason being is the sooner we start replacing vehicles till they get to the point of their worth a lot of equity so the more vehicles replace year one, the sooner we get to year five sell those vehicles while they're still worth a lot and start really driving down the city costs.

In addition, electric vehicles from manufacturers are starting to be not a priority. So like the Ford Lightning for example was canceled middle of this year in terms of availability so right now we're recommending doing this Chevy Silverado but we won't know what that's going to look like in 2026 for EV trucks So, this is what we did is we compared what you're spending today on your fleet versus what it would look like with an enterprise partnership.

Going through this graph, I can just look at the top section. The top section evaluates your MPG on your current fleet. It looks at how much your vehicle is worth today so current equity and it adds up your total operating expenses to give you a total of what you're spending on your vehicle. So the right side of the screen accounts for depreciation maintenance and fuel to give you a total operating expense of what you're spending today.

Now the bottom section of this screen shows if we were to replace those eight vehicles today with brand new vehicles, what would that cost be compared to what you're doing today? And if you look at the bottom it summarizes all these numbers together. So your total current fleet spend without enterprise is about $30,000. On average, you require about one vehicle a year. So that's about another 40,000. If you're buying a new one, you're selling an older one.

So that's $1,000 back in your budget. So total annual fleet spend is about 78,000 without Enterprise. Now if you were to get eight brand-new vehicles with Enterprise utilizing that open equity lease, the total is... Do you mind reading that number out loud? It's a little tough to see back here. On the new annual fleet spend your one oh here we go 93,000 so annual savings year one I would be about a $14,000 investment except we replacing eight vehicles compared to one vehicle that you're doing today.

Now where this program really makes sense is in 60 months when we sell these vehicles while they're worth a lot of money. you'll really start seeing the cost savings. Right now where the equity of your vehicles is very low, so we have about a $4,000 down payment on all these new vehicles. If we were to do the replacement in five years from now, we would have a down payment about $10,000 per vehicle which would be a cost savings.

So the sooner we can start replacing your vehicles at the Optimal Town, the sooner we can get to a point where we do have a cost savings One more note too, is the city has to transfer over to EV. So another reason there is an investment is we are upgrading to higher cost electric vehicles compared to some of the older gas vehicles that we're using today. And this is just a five-year cash outlay of what the cost would be over five years. So year one, we have about 91,000, year two 88,000 Year 388, year 488 and then year 588. You can actually jump to the next one here as well. Appreciate it. Thank you.

So this is what the cash outlay would be if you just do the four vehicles in year one. So you'd have about a $20,000 savings compared to what you're spending today. If you were to do four vehicles instead of the eight However, we would be replacing less vehicles this year. It would be slower to get to the point where we're replacing majority of your vehicles.

Now you can jump the next one as well. One more time. And so this is what the five-year cash outlay would look like for the four vehicle replacement. So as you can see at the bottom, year one would be less expensive. It'd be about $47,000 and then we jumped to about 94 through 91 years two through five. So it'd be less cost year one but we get to the optimal replacement time slower than option A.

Now, this is a partnership that's different than what you're doing today. So you'd have your own account manager in our office that would go over these analytics with you and your team every year. We are located in Sherman Oaks so our territory goes all the way up to Paso Robles. So we'd be meeting with you consistently as this would be a change but our main goal would be looking at how much are you spending on maintenance? How much are you spending on fuel? And how can we continue to drive down total cost?

I think we've been talking probably six months now in total trying to figure out how this would work with police without police if we should just do you know the operation side of the city or whatnot and then with the CARB requirements of the 2035 requirement for municipalities converting to EV where possible This seemed like a good way to get ahead of the curve. And then one thing to also take into account is they resell our vehicles, so we don't have to get on Craigslist or find auctions or anything like that it's all handled in-house with them and that would include additional fleet as well correct if I'm not mistaken? Like if police still wanted to sell vehicles or offload?

Of course but it creates Uh, like the vehicles that get sold create a city pot for future down payments versus. Uh, interdepartmental so that would be the different

So essentially we're just trying to see whether or not you think we should proceed with this on any level, whether it's because they can do gas and or diesel also. It's not strictly EV. The EV is just to get a jump on the car requirements so we can still work out a plan to replace with regular fuel. Right, and that would essentially lower our vehicle costs on the front end as well because gas vehicles are cheaper than EVs.

And then you know maybe year five we start to do the conversion to EV to get in that 2035 car brace.

Well on F I realize okay number one love trees I think that it's a great idea but in context and in looking at some of the verbiage in the plan and the executive summary it talks about this is a big step toward a healthier more vibrant more equitable city by planting trees But, you know actually most of us citizens would love to have a functioning downtown where we could actually go buy things that would make our city more vibrant because we'd have sales tax. And we would also be reducing our VMTs which is vehicle miles traveled How many of us have to go to Santa Maria for almost each and everything that we use? So all of the benefit that might be derived from these additional trees are going to be wiped out with the carbon footprint that's created by all of us having to constantly go somewhere else for basic goods and services.

I also wanted to mention or remind you that it seems to me that there aren't any trees planted at Pasadera, and that was a plan that the city reviewed and approved. So that's kind of ironic and sad all at once. And then again this is another grant funded project but what I see as an obligation for maintenance and staffing which costs money on page XI Roman small room in numeral XI Establish a debt number two under visions and goals, establishing a dedicated urban forestry budget and staff.

Also talking about having somebody that has an International Society of Arbiculture ISA certified expertise. Now a lot of these trees are going to be planted on private property is what I understand from the plan so again we have We already have a deficit in the budget, but we continue to take on projects that require care and feeding. And operations is the thing that follows all of these great grant projects. And I don't know that the city has a line item for this in the budget. I don't know what they're proposing to do about it.

I will say that regards to Item G, I am thrilled to death to see Annette Munoz coming back to help out

thanks for having me. Yeah, I did a presentation last city council meeting but essentially this urban force management plan is a strategic roadmap to help guide the city to better maintain and grow The urban forest, you know within Guadalupe. So taking better care of the trees you know looking for new opportunities for tree planting which I don't think are mutually exclusive with say development further development of the downtown area.

I would also say there are a number of tree plantings in Pasadena they're just young trees that are currently growing which also points to the importance of uh you know the city being able And so, you know, essentially the urban forest plan sets out a vision for the future urban forests over the next 40 years and provides a number of goals as well as recommended actions for how to achieve those goals.

Over the next 40 years, and again the city does have a current I say certified arborist now on staff that they can continue to keep their you know that certification and provide the technical. Guidelines and oversight for contractors that the city works with for tree maintenance. And essentially, you know our 1 of our main recommendations is for the city to continue to go after grants to help with the purchase of new trees and establishing those new trees in neighborhoods that currently don't have a lot of trees.

Um, so the current can't be levels for the city right now are sitting around 4%, which is pretty low. And so we really want to try to maximize the benefits that trees provide and or do that you need to take good care of them and you need to have a plan for growing them. So. That's essentially what this is and I'm happy to answer any other questions specifically about it.

So just to give a kind of brief overview what's going on with the Royal Theater right now as far as construction goes, they're still doing the earthwork. They were able to get through all the winter storm that came through last week. They're doing some reconstruction on the front wall, on the street side.

Due to extensive like fire water damage some of the header beam is kind of messed up but an issue that's coming up with that is because it's the damage is so extensive they have to Consult with the historical architect to make sure that any repairs don't violate the historical requirements so that we can maintain that historical prowess on it. They are doing some framing on interior walls, some shoring and bracing Just to enlarge the inside doors, they have to do some cutting and put in some footers and stuff like that.

So they're working on that. There is some issues with the marquee. I think I sent some pictures out there's a lot of extensive damage. So they're going to look at a way to either Essentially redesign it out of modern materials, keeping the same. I guess, like era design with the neon lights and you know the same shape and everything. So we're waiting on to meet with the designers that kind of go over what would be kind of be looking for as far as maintaining as much as possible with the design that was there. Let's see.

That'll be I think it's about 120 days of construction.

So that'll be going pretty good. They're trying to get in right now to do some painting on the facility by or within the next month so we can piggyback on the permit that Amtrak has so that we don't have to get extra delay anything And then we got awarded, I don't know the mayor's probably gonna speak on this also. The Community Cleanup and Employment Pathway Grant last Friday, Caltrans announced it.

It's a good grant. It kind of focuses on community cleanups, community outreach kinda that whole like community esprit de corps kinda thing you know? Additional funding for two positions as well. So that's something that we'll be able to look at, especially with our current climate with our budget being able to hire more staff better somebody else's pocket is kind of beneficial.

We started off with a poetry jam on the 16th, which is was the first one of the year we run it every other month. was really nice because we had people all the way from AG and Shell Beach and Grover. So it's nice to know that it is actually expanding outside of our community, but also with consistent community participation which is really nice at least for me personally just because I know how much of an outlet it serves myself as well as the other consistent community members so for it to be now growing outside of our community consistently.

It's just a wonderful thing to, you know, great outlet and next one is going to be on March 27 over at the Vets Hall at 6pm. Love to see anyone who would like to get out there we have coffee some sweets table. You don't have to recite you could just come hang out. You can recite your own things or your favorite poet encourage it all, or a song The next item, we had a movie night where you have run a monthly movie night. This one was on January 23 as well as what's special about this one sneaky Pico and GV pack were gracious enough to donate free hot dogs.

So on top of the free entry and free popcorn that we provide everybody got free dog. Which was really nice you know over at our movie night we like to keep it really affordable. We just dropped our prices, even more so on our snack bar which we only have two items on there that are $4. There's another two items are $2 and the rest is a dollar. So very affordable.

And it's nice when everybody, you know, gets something warm in their bellies. This has been consistent. We'd like your numbers to go a little higher so please come check us out. You know it's like I said very affordable and something free to do. Moving on, we had our last more headers park groundbreaking on the 30th. That was exciting great moment for this community to see that part being transformed yet again already I'm not sure if anybody's been out there but they've been hard at work and it's really cool to see that thing. Transform before our eyes, literally at this pace it you know it's exciting because I think we could all agree that, you know, things in Guadalupe especially construction sometimes are usually move slower than we'd like to.

Good evening, Mr. Mayor, council members. Food trucks are currently unregulated in the city. Right now it only requires a business license and I don't have an actual count for you how many business licenses there are specifically for food trucks but I know I've seen at least three or four in the seven years that I've been working here The health department permits are required and regulated by the county.

And food trucks, for the purpose of our ordinance are defined as also including food trailers but not the food carts we're going to talk about food carts another time. We're just going to keep this simple. So over the past seven years there have been attempts to bring an ordinance to city council. But this is the first time we've had an actual ordinance that's being considered The staff report says that we've worked with the Guadalupe Business Association, and I've met with them two or three times over the years as we kind of ramped up and then went backwards on going forward with this ordinance. The biggest issue that came up each time seemed to be how can we allow the food trucks to operate in the city without affecting the restaurants in town?

So in researching the food truck topic, we reviewed the ordinances of many jurisdictions and we found a new food truck ordinance from this last summer from the city of Lincoln which is up east of Sacramento. They too were concerned about impacts to the local restaurants and so we used this as the basis for our draft ordinance. I wanna say from the outset that their ordinance is pretty restrictive.

So if as we're going through this evening, you have any specific revisions that are supported by the majority of council, we can certainly address those tonight. One of the conditions to operate comes from Caltrans regulations that prohibit any vendors within the right-of-way on state highways. And so, that basically prohibits food trucks from operating on Guadalupe Street and also on West Main.

That regulation actually addresses the concerns for operating a food truck in front of our many restaurants that are on Guadalupe Street. The trucks would still be able to operate on the side streets though What I'd like to do now is highlight some of the ordinances provisions. Whether located on public or private property, an Administrative Use Permit or AUP would be required and that's processed by staff and approved by staff so it's not something that raises its level to the City Council.

Prior to approval, an applicant will have to have proof of a valid health permit A city business license will have to be issued and then they'll need to have proof of liability insurance for public right-of-way operation. As I explained tonight through some of the different examples of the types of operations that could happen, not all of them are on public streets or public right-of way so some of them may not need to have the insurance.

If a food truck operator wants to set up on a commercial property, that would be street or parking lot. There'd be a limitation which would be a maximum of six hours of operation also allowing for an hour to set up and an hour to clean up. And that would be between the hours of 7am and 10pm One food truck service would be allowed within a 72-hour period, and you'd not be allowed to be closer than 500 feet from another food truck.

And then also if you're gonna be in place for more than an hour, you can't be more than 200 feet from a bathroom in a wash station. So that's for the actual food truck operator if he came in for permit himself. You can also have a permit issued to a business owner on industrial property, something like Taylor Farms. They can obtain an AUP so that a food truck could actually operate on their property for the exclusive use of the employees as long as they had employees onsite. So if they had one shift, two shifts or three shifts, they'd be allowed to have the food truck present to support their staff.

It also allows for business owners within a commercial district to obtain an AUP, to locate the food truck on their property to work in conjunction with the business to serve the owner's customers. So an example of that might be Wine tasting facility that we have here in town, or any other use that might be served by having a food truck as part of their operation. They would be able to get a permit to bring that food truck to serve their customers.

And then it also allows another possibility for food trucks on residential property for private parties. And in this situation, the ordinance allows up to one event per calendar quarter. Staff is recommending that the AUP be renewed annually like the business licenses and also the health permits. Food trucks can't be left unattended at any time Or parked between 10pm or 7am unless they're at a designated location where the health department specifies. They have to have, when they get their health permit, they have to say where they're going to be parking and it's generally on someone's commercial property.

They have to have a commissary which is like a commercial kitchen that prepares their food so a lot of times the trucks are parked in those locations. Some exceptions are written into the ordinance that allow multiple food trucks to operate at special functions sanctioned by the city. And this could be for activities at city parks or something similar to what Santa Maria has for their downtown Fridays, where on town center west you might have seven or eight food trucks all in one area to be able to serve people.

The ordinance also addresses possible violations which could lead to suspensions of operation or even revocation of the AUP And the ordinance isn't perfect, but we recommend going forward with it. And then over time as permits are issued and the food trucks begin to operate, we'll get a better idea how it's all working. And if we have to make some changes, we can come back to council and make recommendations for that.

So I presented a lot of information. There's even more in the ordinance, I didn't hit all 27 points of the requirements and stuff but I think I highlighted the ones that are important. But I wanted to explain how this ordinance is gonna be working and I'm ready for any questions or any possible revisions that you might already have thought about before coming to the meeting tonight so I'm open for questions.

I'm going to try to be brief but at the same time this one is a little bit unusual little bit or unorthodox so I'm going to get just a little bit in the weeds on this one. Next slide please. Mr. Jeff, Jeff Vegas foraging land surveys representing Mr. Ernie Rodeas and Ms. Yolanda Martinez the property owners is requesting City Council approval of the tentative, the Air Force Mission tentative parcel map. The map would modify the lot lines between five existing parcels can result in four lots The co owners intend to each separately on two of the four resulting lots, and each control separate parts of the building.

Next slide please. The five parcels cover 0.8 acre at 87 acre. and are currently addressed as 868 Guadalupe Street. Actually, the building extends 868 to 878 Guadeloupe Street. The 0.87 acre site extends between Guadalupe Street and Olivera Street and has two zonings. The Guadelupe Street side is on the downtown mix, mixed use. The Olivera Street side is R3 high density residential. Next slide please.

Sitemap that's the parcel there obviously everybody's familiar with the area between Guadalupe and Oliveira. We'll get into more detail next slide please As noted, Mr. Rudeus and Ms. Martinez are co-owners of both the land and the building. This tentative parcel map would create four lots to be divided evenly between the two co-owners. And then it would adjust a lot line beneath the building to establish a separation point in which each co-owner would separately control their portions of the building. Next slide please.

That's the stores. How to do subdivisions and parcel maps. You'd always say, where does the map come from? And I do like this map. This is the map of the town of Guadalupe subdivided 1875 recorded 1880. And as you can see the sites highlighted there in that map this is lots nine 10 11 12 and 14 in block Six of that old town Guadalupe subdivision. Back then the lots were subdivided 50 feet wide, so fairly narrow.

Next slide please. This is the current map, again lots 9 10 11 and 12. And 14 of that original subdivision. And that's what the parcel map would look like as you can see what's happening there. There's a new lot line between nine and 12 they just kind of sliding it over three feet, just a slight modification to align with the what they call pony wall or the common lease line or lease wall between two of the suites.

Also down at the bottom there, between lots 11 and 14 of that original subdivision they're going to delete that lot line to make a bigger parcel which would result again in four lots. That's clear next slide please And again, so when they adjust that lot line, move it over just a little bit by a few feet. It would separate those suites and so there'd be a couple of the suites two suites on one side that would be managed operated and controlled by one of the owners of the building. Again this building is still in co-ownership. And then on the other side, the other co owner would manage and control and operate the other suites And we'll explain why this is a little bit unorthodox in a minute. But again, the lot line is under the building so this is just a graphic to depict where it would be but over the building would be theoretically subdivided not realistically subdivided if that makes sense next slide please.

That line is beneath the building. Obviously it runs in the land, would not legally subdivide the building after the four parcels of land are divided both parties would still continue to co-own the building itself. So there's the land and the building, the owners intend to enter into a private agreement to establish those parts of the building to be controlled by each owner. Next slide please.

And again that's kind of what the four lots would look like two to each owner Um, and again we talked about control and management of the building. I work with both lawyers representing the two owners. One of the first questions I have this is one building right. And when you look at the roof of the building ones white and ones gray so they've already been kind of operating separately, it's rare that you see a building Where you reroof it and you don't do the whole roof. So that's their objective is to kind of work separately in as long as they meet zoning and other regulations will support it but typically, next slide please.

Typically planning would delete such a light line beneath the building. And the reason why is we typically don't want two separate owners, you know owning land or building straddling two parcels where you got to separate owners if they can work together will support it. Typically we want a commercial condominium, a condominium or airspace map. A condominium map is provided by the subdivision ordinance would be the standard method to formally establish separate control rights and responsibilities for each owner But again, they want to do it this way. And we do recognize if they were to do a condo map, they might need a special lawyer who specializes in this kind of thing because again you'd have to do building inspection and figure out where are the utilities?

Where are the pipes? Could they actually subdivide it and actually have separate control of meters and all that kinda stuff. So in this case, we're gonna work with them and allow them to support this. It's up to the council but we'll support it. But again, typically you do a condo map. Next slide please. The potential complexity and cost to subdivide the building by a condo map planning department has expressed express support for the co co owners proposal, we've conditioned it condition number six. So long as the building remains in joint ownership any code violation identified by the city shall remain the full responsibility of both on reserve on record So it's kind of a reminder condition, you still both own the building that there's a problem with the foundation or the are there some sewer line that runs on one side and you're both responsible.

As far as the city is concerned again it's more of a reminder condition but again Any code enforcement or legal responsibility would remain with both owners as long as they manage things. And again, visually they seem to have operated very well and hopefully they continue to but again we just added that condition as a reminder that responsibility remains with both owners even if you separate the land beneath the building.

Next slide please Again, we always look at conformance to the city regulations. In this case conformance to the subdivision ordinance and this refers to the parcel map itself. The subdivision ordinance has a few standards. One is minimum lot size, the project meets the minimum lot sizes all lots will exceed or the minimum lot size required by the subdivision ordinance. The subdivisions subdivision ordinances all lots so have access be vehicular access to a street. We believe that standards met all lots will either front Guadalupe Street, or Olivera Street The subdivision ordinance says lots have an average depth of not more than three times the average width shall not be approved. That's not precisely met, the subdivision ordinance does not want in a standard zoning districts irregular shaped lots are not lots too narrow to build on so that regulation is there to prevent irregular Shaped or too narrow shaped lots.

In this case we will support it, we made a finding to approve the lot next slide please. One of the lots and that's a lot one at precisely 46.41 feet wide by 143.97 feet deep would not meet the standard of the lot depth to width ratio little bit too narrow but We found it's only off by 4.15 feet, which is less than a 10% deficit. So we might made a finding planning as a kind of a 10% rule something that doesn't meet the code by 10% or less.

We might make a finding to support and in this case for point one five feet isn't within the 10% rule. Just as a side note, we looked at an appeal a couple of weeks ago. That setback was about 30% off and we couldn't approve it. 10%, we can support under certain circumstances. Also the purpose of the narrow lot is to align the interior building wall as desired by the co-owners given the location of Lot 1 under a building that's not buildable in the near future We believe it wouldn't be detrimental to the welfare of the neighborhood. Lastly, it's not unprecedented lot 13 is similar in width, but lot 13 was derived for a parking lot next slide please.

So again, lot one is as far as the ratio. It's a little narrow but again it's under the building. Its intent and purpose is to align the wall, the pony wall to satisfy what the co-owners are trying to accomplish. If you look at lot 13 on the right, it's a little bit narrow and it was done again for a parking lot. So again those are the resulting lots so we looked at the original subdivision Lots nine, 10, 11, 12 and 14 of that 1875 subdivision would become upon approval and recordation of the parcel map. They'd become lots one, two, three and four. And again they could then be evenly divided by the two owners. Next slide please.

Terms of zoning conformance, the front on Guadalupe Street, downtown mix. The back along the other front, Oliveira Street, Zondar 3 High Density Residential. The general plan central business district that's the overlay there's a strategy for the Central Business District We think the building on the Guadalupe Street side meets the general plan and zoning. The current usage on the Alavera Street side does not exactly. Next slide, please.

Again that just shows the central business district and the site as well within that central business district there's a revitalization strategy under the general excuse me under the general plan for the central business district next slide please There's some stuff stored right there that doesn't in our minds does not meet the zoning and it does not meet the revitalization strategy, but stuff store. There's been a been there awhile. And again, in conformance with the general plan and they are three the zoning we believe it ought to be moved if we're going to proceed. Next slide please.

And in line with the revitalization from strategy for downtown there's a several sites we've looked at in the general plan that are, we call opportunity sites and we even believe the backside of the project site itself is an opportunity site zoned our three high density residential Future parking, there's a potential for units probably 300 units in that area. So those are opportunity sites and it's just all the more reason that we believe of course there's the Royal Theater which is being renovated at this moment. We're actually working with the Guadalupe Cafe next door to they have some issues that we're working with to get them up to speed for the future.

There's a lot of potential according to the general plan, a lot of opportunity and again we've conditioned... Next slide please A condition five as amended, 5A within six months. And that's paraphrased of if I may, I'm gonna give you a revised version. We had the condition there was an A and B and the landowner would like it modified so I'm going to show you the modification.

And we agreed. And so five area remains, excuse me gets tweaked slightly. Couple more you might pass to the city attorney and city administrator one for the city clerk as well just so everybody's aware. I, there's a heading there the heading is more. It just goes to conformance with the zoning in the general plan when you look at the subdivision or this it says that a condition typically conditions and parcel maps refer to improvements like curb guttering sidewalk, those kinds of things utilities Or the condition can refer to zoning in general plan. So the heading, the first part literally refers to the zoning and the general plan. The landowners have agreed to condition 5A. They disagree with 5B. We agree and we deleted 5B so that's all we're saying is we recommend that we support the condition as amended, as presented there.

Next slide please. So lengthy summary just to kind of reiterate. The parcel map would fulfill the owner's desire to each separately own two of the four resulting parcels, the building or to remain in co ownership under private agreement When the planning discovers a building that straddles the lot line, the lot line is usually deleted to preclude problems later when we have two owners owning two parcels separately with a building on top of them. But again in this case we won't delete the lot line. We support it. Next slide please.

The relocated lot line is only symbolic. Commercial condominium map is typically needed to officially divide the building where we're supporting the landowner's approach that they do this private agreement. Planning recognizes the potential cost for the owners to complete a condo map, next slide oh I'm sorry it has also recognized as a condition in this In this case, the building has existed for many years and the lot line is only being adjusted by a few feet.

More reasons why we find to support it. Next slide please For those reasons, planning supports the owner's proposal. Condition number six is a reminder that the building's legal and code compliance responsibilities remain with both owners on record. And condition five requires cleanup of the Aloe Vera street side in accordance with city codes and policies. Next slide please.

With that planning staff is recommending that the City Council adopt Resolution 20-2609 approving Tentative Parcel Map 29073-2025-053TPM, including an amendment to Condition No. 5 as we described in the Class V CEQA Exemption. That would conclude. We're available for questions. Thank you. I

The one thing I'll say is just to make it clear is this is one legal parcel currently consisting of five lots that were subdivided in 1875 The client my client and his co owner cannot divide this property amongst each other because we don't have legally divisible lots currently hence the subdivision, and that's the main purpose it and we try to make it as even as possible. There's a little bit of taking under the building that way that shared wall is on one owner side and on one owner side, the remaining commercial buildings.

There is being compensation for the taking since one owner is losing some square footage And one owner will be purchasing the entire Oliveira street lot that's going to be now a lot. It's currently 11 and 14, so the one bigger lot on Oliveira Street. So I just wanted to come here tonight in case there was any questions from The Wire or my client doing this kind of thing. Bill did a better job than I could have done laying it out.

Scott, thank you again Mayor and Council I'd like to think this one's pretty straightforward for a change but again this is a direct design review permit for an American seed company next slide please The applicant, Mr. Josh Gardner representing these the project architect representing Pan American Seed Company is requesting City Council approval of a design review permit.

The aforementioned design review permit the project would allow construction of two new greenhouses totaling 33,768 square feet The property is the eight acre industrial agricultural campus in the GI General Industrial Zoning District at 400 Obispo Street. Next slide, please. And again, aerial site plan that just shows the facility at 4th and Obispo. Greenhouse one you can see the kind of green area over there near Obispo Street and greenhouse to kind of centered between a greenhouses so the new green houses would just go in an existing row of greenhouses on the north side of the property. Next slide please.

Greenhouse one would be 22,512 square feet in size. Greenhouse two would be 11,258 square feet in size and again both with field vacant spaces between or beside existing greenhouses. The project provides additional growing area for the Pan American Seed Company also a new stormwater basin and landscaping would be installed next slide please And again, that's the site plan similar obviously to the aerial photo. And again, the two new greenhouses highlighted in green there. Again just installed in an existing row of greenhouses next slide please.

The new basin would remove one or two trees. There was no landscaping plan provided, so we added a condition number five to provide a landscape plan before building permit review and just briefly our objective and we worked long enough, we work with landowners, we work with developers, we work with builders We didn't say your application's not complete. We said give us the landscape plan later, we work with them. They were in a hurry to move and we moved and got it to council so that condition is how we addressed it. 10 new trees would be added priority planting along the street frontages, 10 species probably larger trees best suited for Guadalupe taken from the draft now it's adopted urban forest management plan.

Next slide please And that's, you can see next to greenhouse one where the stormwater basin would go. We'd lose a couple of trees there, one or two and next slide please. From this post street, you can see there's a tree on the right hand side too so obviously the basin would be up front in the greenhouse would be beyond greenhouse number one would be beyond. Next slide please.

Landscape plan, when they submit we look for places to plant new trees it looks like we could fill that gap with a few on the street side. Probably some along the fourth street side so they provide 10 new trees and again we'd feel spaces like that next slide please. So, based on the project size approximately 34,000 square feet. We had to prepare initial study, usually we can under sequel there's categorical exemptions meaning you meet a category exempted in this case we had to do an initial study so it's It's an exercise we did but when we prepared the initial study, it was concluded that it's an infill site. No change in the facility operations, no increase and use of fertilizers your pesticides, no new or significant air quality impacts no news noise impacts No impacts on the neighborhood again greenhouses are fairly what inert or unintensive uses and we still found the project to be exempt under a general exemption it's called a common sense exemption.

Next slide please. And the project meets all applicable zoning code standards pertaining to height setbacks landscape coverage etc. Again, no substantial into intensification of use compatible with the neighborhood provides additional tree planning and fulfills the objective objectives of Pan American seed company next slide please. And that city council adopt resolution 2026 10 approving the design review permit 2025 oh five eight dr and the secret exemption pan American seed company in their greenhouse expansion project. Again, this includes pretty straightforward project in our minds, and they were available for questions when I think the

And that's one of the very, that's one of the key points that I always want to really stress this aspect is only concerning fire suppression so only for a fire not what everything else at the Fire Department does.

So I want to really make that distinction when they talk about as far as how our rating came about This company, they do it throughout the entire United States. As far as doing surveys to different fire departments to see exactly where they rate and then insurance companies will utilize this information to see how they're going to do their rates for whatever specific community. There's only four areas that are rated you see at the bottom first page.

It's the needed fire flows Then also emergency communications, the actual fire department and then whatever the water supply is for the city. You can see in the PPC grading they grade from a one to a 10 and the lower you go is better grade that you have. Classification numbers, as far as the way that they're interpreted. Most are from a class one to a class eight.

They represent fire suppression systems that include most a credible dispatch center, a fire department and water supply. So pretty much if you have one of those three and you meet the minimum of what they need within those three, you can get a score at least from one to eight. A class eight be that special classification, it recognizes if there's some type of superior level of protection.

But it makes pretty much close to nine but it represents a fire protection delivery system that is superior, but you might lack a certain kind of water It's going to be at least have a credible dispatch center fire department, but maybe you don't have the credible. water supply to make it sufficient as far as their rating, to get that rating. But for a Class 10, what a Class 10 really states is that in one of those four areas you did not meet the minimum of what they considered as far as to get the proper rating for that particular section. So you could have a score that would overall make you compliant, but if you are missing something within one of those section areas then they will not count the score. They'll give you an automatic 10.

And you can see this by the 2027 countrywide classification, you can see where most of these cities have their classification. One is extremely hard to get before we were in a class four and this is the entire nation. And you can see where most of those came into a class nine and you can see where the class 10. So we were graded at a class 10 You can see on the page four, this was the copy of the report that came back to us.

And again it showed here that the rating is going to be minimum. We did not meet the minimum requirements. They said it was to have four firefighters responding to an initial alarm for all reported structure fires so What we had to do was send in all our timesheets and everything, and they looked at where there's any structure fires and how many firefighters were available to be able to respond to those type of situations. That's how they came about with that score.

You can see the areas that we were deficient in when we lost points, deployment analysis. And I'll explain really what that came about is We show we have two fire stations, one and two. We manned the one here at City Hall. They did not recognize because no one answered a phone over at the one at the Vets building. So that is being corrected. And then the company personnel, we only have two firefighters that are on duty.

As far as for the way that we did this in 2017, is again I stated before we have the paid call firefighters. And as I stated before it's a cyclical type of hiring period right now, I think we looked there's over 40 firefighter opportunities within the county of Santa Barbara. And so they're really hard to find candidates Also with this report, you could see where the last report done was in 2017. So it's usually between seven and eight years that they do these reports. So that was something that became a challenge for us also and I'll speak to that as we go further.

Our training, it showed the fire department was not training up to speed at least as far as that report. And also it shows far as our water supply was insufficient This process took a long time. I had to go back and look at everything that we had turned in They transposed some of our numbers. A lot of this stuff, we were above what was compliant but as they transpose and so that was some of the issues where to go back and forth.

We were really compliant on a lot of things except for the number of firefighters. We have a great water system. We went above that and then our deployment and everything else. So you could see on this graph or this point Sheet on page five of 720 26, you can see our score here was they had 49.74 but for community risk reduction points for like water points.

Okay, the legend on this is this is how we compare. If you look at the bottom says comparing so this chart shows how we're compared to our peer groups that are around the area, how we're compared to the state and how we're compared nationwide. Guadalupe, we had a score of 4.23. So if you look at that kind of orange bar 4.23 the solid line shows what our peer group, I'm sorry yes that's correct what our peer group had a 2.3 the dotted line or yeah that was nationwide and you could see The one, the 401. That's what we look, that's what the groups from the state. So we were above all those as far as community risk and what we took care of.

You see for the water points you could see where at the 19.26 the straight line that was most of our peers they were at that low and then the other one would be Nationwide group. And then you can see where I guess, I apologize, I'm correct. The peer group is right next to us at 29. So we were above everybody else as far as for our water supply and how we deliver water supply.

You could see here in the fire department points that's where we came down and you could see that we were below everybody else Well, we also went back for the last couple years. We had to hand search and they also transposed some of our training points So we were well ahead of everybody else. They did not properly count a lot of our training points, so Pat and I had to go back page by page to kind of look at the 2017 and then everything that we had turned in they also had transposed that through the machine. So we will be up higher than that right now. And the emergency communication system you can see that we're at 9.2 That's better than our peers, better than the state and better than nationwide. That's from we just went through the emergency or the new fire dispatch center, and that put us over the top.

So you can see where Fire Department updates were we've been working on things for the last five years. Again, increased fire department staffing by 100%, hired three full-time firefighters. When I first got here we had three captains that was it. City Council approved Fire Battalion position Department, we institute a firefighter intern program. So we're trying to build a feeder program to give some kind of employment to some of our community members and so that they can get through the academy where working right now.

I met with the president of Hancock and we were now able to utilize the Hancock promise of those two free years to use that for... To go through the academy And then we could use here a scholarship type program to where the Hancock promise will pay for the academy, but for all the equipment for fire department what most departments do is they rent it out to a candidate going to the academy. Well if we use a scholarship program here We could provide the scholarship to a Guadalupe resident to go to the academy, but that scholarship money can only be spent back here in Guadalupe. So they would get the equipment, they will use their scholarship money to get the equipment. So bottom line we just get our money back and they would be able to go through a police academy or fire academy pretty much free and at least gives them different opportunities.

So the corrective measures, I think that's what the mayor had talked about as far as what's going on. Page six. This is what the proposed plan was. We were told to submit a detailed plan and documentation to meet the minimum requirements for four firefighters on duty, for fire structure response. Once the plans approved PPC can be adjusted to the final score and rating that we actually got. So after couple months of negotiation and talking with the representative here, we put the plan together I'll be utilized as far as those four, as far as that number. So the plan have one chief full-time employee, one fire captain, one fire engineer or firefighter and one volunteer paid call firefighter. And that would give us the four to make so that we would be in compliance and get a better score.

On Tuesday, February 23 we submitted it the plan was accepted. And we will now meet the minimum requirements for staffing of four firefighters. Once this is in place. The current estimated rating based on the data we received in 2020 24. With the proposed update to force staffing, firefighters will be receiving a class five. I spoke to the lady, the representative says that we'll go from a 10 to a five but if we can put both engines on the street on calls and we're working on that this is... We see that we can get back to a four. Her whole thing that she stated Is that as soon as we hire the person and I send the information to her, that they will expedite to change the rating and send that to the insurance companies. So, that now has been taken care of.

And with the help of HR and the fire everybody. Worked really hard, went to the academy and let's say that we did some serious recruiting. He finished his life scan this morning and I signed off on it so we will have a paid call firefighter. So he is pretty much in the door right now. Corrective measures in order to prevent a recurrence of a lower score for the ISO I talked to except for, I think the only fire chief that I was not able to reach was Carmen.

He's passed at least that's my understanding. Well everybody said that they haven't been able to get ahold of him but I talked to Jack and everybody and none of those had done the report They were, they didn't know really what I was talking about and they hadn't done a report. So because I was asking them does anyone have an archive of a past report so that we can find out what happened? They didn't. So I contacted prior police chiefs. So i got a hold of Mitchell and he's never done it.

And so Gary, Pat we had to dig. We went through the archives and Gary had done it back in 2017 but Hoving, Chief Hoving but there was no... It was never in a computer. It was done on a hard drive and all we had was a hard copy of the report so what we've done now is The way the measures that we're going to be doing, the Director of Public Safety will convene a Fire and Water Department ISO PPC review every five years or when a fire insurance related issue arises that could negatively affect rates. All ISO PPC related Fire and Water Department reports will be submitted, reviewed, and approved by the Director of Public Safety prior to submission to the Insurance Rating Agency All ISO PPC reported will be saved and archived on a department computer file folder accessible to management level employees, and City Council be notified by the Director of Public Safety when ISO PPC surveys are requested and officially submitted.

Any discrepancies or changes will be reported at the following city council meeting. That's one of those things that was done years ago. We've had a lot of changes and no one had any copies until we dug it up, but we now have something in place that is on a shared drive. So we copied the 2017 and this one here. And so with that, we have now corrected it and as soon Swear in, and I appreciate HR working very hard on this.

We can't use Santa Maria in our staffing numbers, and that's what everyone else gets around. I went online and I looked at the eight other cities that have a population that's more than us but close to us. And I looked at eight cities that were below us. And tried to figure out how do these other cities get a passing grade, and it's just us. Because there was only two other cities had six people on staff but everyone else there was one chief but they had 30 volunteers.

The other part they had they were in districts fire districts Like you have Royal Grande and the five cities. Well, we can't do that because your assistance has to be able to respond within four minutes. Even Cal Fire, it's on paper they're eight minutes away and Santa Maria code three is at least 15. So we couldn't put that into our numbers because we're kind of isolated.

That hurt us to a certain degree even though it's great but that hurts so having the training and Being honest, because I live here really does kind of make it easier. But with this new captain coming on he is really going to kind of help to kind of make things happen and we got to be realistic of what we can afford.

So with this program, we're now gonna try to build in a feeder program just like college football into the pros is using that when we talked with the college and the academy, now we can have a way for them to go And really for free.

And then two is, we got a couple that I look at this because some of my staff were concerned is well they get through the academy everyone's going to leave because you know you can get more money in Santa Maria, but if we get some of the 1819 year olds. You can be a firefighter at 18 and 19, but a department's not gonna hire you until you're at least 21. So I'm saying we get those 18 and 19 in the feeder system, they will be a PCF here for two to three, four years.

And by the time they leave, we've made our money back and we've had them. And this gives a lot of our young people in Guadalupe additional job duties, job experience, and it gets them to college. And then after that, then they can kind of spread. So I look at this as part of our youth program that was a priority from council. How do we deal with our youth? I look at this as employment program. I look at this is not going to hurt us in our budgeting because of the monies that we do have and plus because of grants, not only just grants but state money that comes to the police department.

We're kind of blessed because we have public safety If it was just fire, we wouldn't be able to do this because they're public safety. I have funds in police but it is for public safety and I can utilize that to bring some of this for training for some of these young people and to bring them along. So look, we are actually looking toward the future with employment, with training and giving our young people opportunities. And then to keeping our fire department ready so when we do have openings, we already have young people from Guadalupe, but a lot of them they want to stay and we can feed them into our program.

The total expenditures were $1,098,179 and some change. So what I did with, that was actually one two three four five six fiscal years. So I divided it into all those invoices into fiscal years just to show what was spent for each fiscal year. So you could see at the beginning 2021 that's when it just first started so there really wasn't much just the provenience group was the historical Designation and then Taylor and Siphon, I'm not sure some kind of consulting firm but that was it. And then after that it started to ramp up in 21-22. And then 22-23 kind of took a little bit of a break but then went back up again in 23-24 24-25 almost met where we were at 21, 22.

And 25-26 again we're only through February so we still have some months to go and so that $150,000 is probably going to change. So just keep in mind that this is a it's a work in progress because 25- 26 isn't done yet also Yeah, so that's really it. And then you can see on that graph just how it's changed for each of the fiscal years and unless council has any questions on anything I'm here for any questions.

When the two groups, the previous capital campaign committee and the GC AC got together there was about 10 of us, two different groups.

And everybody has a little bit to add to the conversation and to help in ways that they can. Certain people are good at PowerPoints. Certain people are good at graphic design. Certain people are good at finance. It's to take help not oversee per se. So I still stand firm that we need a agendized, you know, oversight committee that can come ask the questions bring their insight from their outside experience. You know, project management, social media, et cetera, not necessarily to just make sure you guys are doing what you're supposed to but to ask the questions that you wouldn't necessarily ask if you're just kind of In a vacuum chamber.

What do they have? What do they bring to the table and what you would want is somebody bringing it to the table that experience they may have. And back in that I was looking at some reports from he was a city administrator Carter in front of Royal Theater talking about it's gonna cost about two million dollars to just the theater part and then we went out and got these resources from the feds and also from the state you know to do this big deal And we need to look forward to say what's going to make this happen instead of questioning, you know.

And I don't believe that the whole community says that they don't trust us and if they don't trust us then there's upcoming elections starting in June and going all the way to November probably in September. If they don't like the way we're operating I think that, uh. Some of us vote us out some of us. But I think that I agree with this that. This group needs to feel comfortable with what the city is doing so I don't have any problems when creating a committee just so we're looking at what's going to cost We can't even figure that out now What's it gonna cost for staff to be present But I want to get beyond some of the heat that we have right now. Just say, OK, let's move this forward and get down to the action in terms of where we're at because we've got to go find some money.

We have to look at, you know there's some individuals say that they can raise a couple of million dollars and store a bit of time. Okay let's do that then. Let's focus on where we're at. And we're finding just like the marquee, we're finding that it's gonna cost additional money. There's some structural issues that we have to deal with them. I attended a SPCAG meeting last Thursday and they're planning out, we have good staff. Our staff representation with Jeff Van de Kaap, Jeff our engineer that goes to the SPCAG meetings when it comes to all that's happening within transportation What the plan is now, it's regional planning goes all the way from now to 2060. So they're doing not only transportation issues but they're going at arena numbers so they're looking at our numbers now Now in 2060 what that's going to look like.

For instance Santa Maria is going to be 30,000 population more. Ours could be another 5,000 in addition to what we have. SBCAG has committed to coming to Guadalupe to talk about the specifics related to Guadalupe in terms of the population size, the projection of the kids now that we have. Now what the birth rate is, what the employment is, what the housing's gonna be but they're gonna break it down. They broke it down and was quite impressive. They broke it down to all the Santa Barbara counties each city.

We were ranked 86% of our population as a minority So it's a high priority in terms of social justice, which is our general plan requirement that we have to look at the social justice side of what we plan to do in this community. In the next several months they want to come down and give us specific information about Guadalupe, how that fits into our general plan, how that fits into our housing.

And it's quite interesting, again I won't be here Maybe it will, but by 2060 there's a lot of what we need to do though is like planning now. What do we do? Do we need to increase our sphere of influence? Do we need to like Flower Street, do we need to go beyond that and bring in some more land next to the school McKinsey You know, we know if you drive there, you only have one lane and that property belongs to Tomoka. That should, to me, it should be in our sphere of influence to where we can actually expand to what's gonna be projected in the years out. So they're willing to come and I'll keep you posted on...

And there's so much data on what's going on, including transportation. And they also will bring in The specifics to the transportation, our project on the positive side is still moving forward. That's still going to happen. Caltrans says as mentioned that because of all emergencies and disasters They had to spend about a billion dollars on projects throughout California that pushed a lot of these projects way, way on out but not this particular one.
