The next item is a moment of thanks appreciation condolences. Is there anyone that wishes to acknowledge that? We have 9-11 coming up and that's a sad time, but we'll get through this. Okay, we've got item four. Will you read this Judy please?

Agenda review at this time the City Council will review the order of business to be conducted and receive requests for or make announcements regarding any changes in the order of business

ElectedAriston JulianMayorProposed · by role3:26

Is there any council member wishes to change order of business? Good. All right, item number five is community participation. So I have quite a few so bear with me if I call you out of order or call you in order. The first one is Judy Wilson for Jeannie Mello.

UnidentifiedCity ClerkProposed · by role3:46

Good evening. Jeannie Mello reached out to me and asked me to speak on her behalf this evening because she could not attend. She wanted me to let the council and the staff know, especially Chief Cash that she attended the emergency preparedness meeting last Wednesday, September 2nd, and she would like to thank Chief Cash and Jose for their time and presentations. It was both informative and fun. She enjoyed it very much, and she recommended the City Council approve many more of these residents involved programs.

Thank you, Jeannie. The next individual is Frances Romero.

Well, good evening everyone. I wanted to personally thank the mayor for acknowledging the anniversary of 9-11 this week it is a real milestone and sadly only about a dozen of our states nationwide require curriculum that talks about the history of 9 11 so that is something that should be a nationalist issue but of course Congress can't really get out of their way to do anything so it seems Also, you know I won't get an answer tonight. But I am curious at first I want to say congratulations on the opening of Las Mojadas Park. That's quite a milestone, but given the cost of the park and I realized it was grant funded. I'm curious what the operating budget looks like and whether or not we are prepared to start putting money away to ensure that it is maintained at the level that it currently is now on opening day.

So that is a question. And I had one other random item. I didn't write anything down this week it was kind of a weird, weird prep time. Well I do want to say well i'll talk about you later on your report. But anyway, I think that's probably it for now. And again, I think it's really important that we are able to maintain the things that we put into operation and that those funds are protected to do that. Thank you.

Okay, I understand we're broadcasting. Okay. Estamos transmitiendo, traduciendo de la última semana. With the halting of the second generously funded Royal Theater project these public comments are an attempt to find a degree of clarity if possible. What roles did the council grant writer and contractors play in the events leading towards stoppage? The council lacking construction knowledge in this particular type of construction, URM retrofit and highly dependent on administrative process spent inordinate funds on initial design. Finally settling on a less ambitious option at rubber stamped inappropriate project supervision and inviolable Contractor bids and practices, two of numerous examples are the purchasing of new seats and the fabrication of a replica marquee prior to retrofitting the building itself.

Meanwhile, the grant writer's lack of cultural community connection as cited previously by members of the council and absence of construction knowledge was evidenced by an attempt to supervise from Sacramento using emails, Zoom meetings and drone footage. This irrationality has resulted in the uncoordinated construction currently visible through the theater's front windows.

Finally, contractors have thrown up their hands quickly citing the city's lack of funds but is that the only factor? Or has the project's distant and viable supervision resulted in it being placed on a low priority, in turn resulting in price gouging gross mistakes and knee-jerk abandonment. What would an overall accounting reveal regarding council mismanagement, grant rider detachment and contractor advantage practice?

At the very least a review of the structural plans would determine what retrofit is still required. Perhaps these in additional public comments can approach clarifying this royal dilemma. Now every project In every project, there occurs doubt. that every project has a period where there's a lapse of confidence. These comments are also proposal for throwing out there, a way to return to working together these three aspects that I mentioned.

CommentJohn HootenProposedself-stated10:14

Good evening. How you doing, sir? I'm doing well thank you for the invitation from both Council and staff. Kevin Walters sends his greetings he would be here but we're having our board meeting right now about 20 minutes that way so i get the pleasure of coming and saying not being in my board meeting for once which is really nice So thank you for having us.

I'm here, I'm John Hooten, Executive Director of College Advancement but I'm here as a volunteer, as a neighbor, as a friend and co-chair of the Yes on H Committee for a bond measure that's coming up. We know that the city of Guadalupe is also having two tax measures on their ballot and so we wanted to come say just a little bit about what this is going to look like and the need for it here at Hancock College.

Can I just give you a point is that okay. Okay, there we go. A little update on Hancock we have more than 17,000 students of one kind or another at Hancock 40% of all high school graduates in northern Santa Barbara County come to Hancock. That's a, that's a really big number by the way for community colleges. And of course we're still offering more than 200 degrees and certificates there at Hancock, we are continuing to grow our enrollments are finally back up to pre pandemic levels, which is great, pretty significant jump from last year which is, which Right here in Guadalupe, we have 533 students currently enrolled. I checked the numbers this morning in both credit and non-credit degree programs and programs. And that's a 31% increase since 2021.

We continue to offer community education classes here in town. And of course you have an elected representative from Guadalupe, Trustee Enciso who keeps your good interests right at the forefront of Hancock's programming. Perhaps most exciting for me is last year Hancock started offering some after school classes, college credit classes right here at the Senior Center.

We're going to begin offering those at the new school I believe in January and we're exploring offering classes in early childhood education as well as agriculture. So we're excited about those opportunities as well. Of course, we can't go anywhere without talking about our alumni. We have a proud alum, Carolina who graduated just this May. She's going on to four-year school plans to be a lawyer or go to law school but to work on public policy issues and I love the quotations we get from students. I would encourage students to learn about the resources at Hancock and actually use them because they really make a difference and that really sums up what Hancock is here to do. We talk about Hancock as changing the odds in our community But really it's to make a difference in the lives of students.

And when I think of students, I think of you know that the children are my friends or my neighbors or the kids down the street. These are part these members of our community over 90% of our student body is actually local from right here on the Central Coast. So we're actually a true Community College. But what does Hancock do if you don't have a kid? If you don't have a grandkid or sibling working at Hancock, how does Hancock benefit you? Well more than half of the nurses in the area came through Hancock College right. We have a waiting list with a bottleneck of Students trying to get into our nursing programs.

95% of those students are hired here in local hospitals before they may or may not move on somewhere else. So we were kind of that frontline of first responders in terms of our health care providers, and most importantly, we train bilingual and sometimes trilingual nurses, which you all know is absolutely critical in our communities. In addition, public safety training. If you've never been over to the Lompoc campus and seen our police academy or fire academy or EMT we have a top-notch facility over there that was paid for by the previous bond Measure I.

You talk to the folks down there who travel around the state they'll say this is the premier training facility if not in the state if not on the west coast possibly the entire state so We're really happy. We've done surveys on this as well over half of police officers and firefighters the area came through the Hancock program. So that's a little bit of news, you've probably also heard about the bachelor's education that we've secured at Hancock. We tried to offer our own degrees but then we thought you know what a Cal Poly degree would probably be a lot more valuable to students and so We graduated our first cohort just this year of Cal Poly students. This fall we added a business degree with Cal Poly, these are Cal Poly professors. Cal Poly degrees they have to pay Cal Poly tuition I'm sorry to say but that all happens right on the Hancock campus.

The problem is we got to have space for those folks right and for those students. We also have a new degree with Channel Islands, a bachelor's in nursing program for those nurses who want to move up into management and those kind of positions as well. So what does a bond measure do? Show of hands, who's been on the Hancock campus recently? Yeah, it's a pretty good looking spot right? Pretty looking good-looking place. If you talk to somebody 20 years ago they said it's kind of run down. It kind of looks like an old high school. You know the old 1970s and 80s buildings.

And the last bond measure that was successful was in 2006, 20 years ago Measure I. And you'll see a list there of all of the new buildings that provided for over 20 years Everything from industrial technology to fine arts to upgrades to the science building, as well as some of the upgrades that happened as well. Perhaps most impressively over the years we refinance those bonds and save the taxpayers $25 million very proactive in terms of how we how we stewarded those bonds. And so now, that funding is all but gone. And we're looking for how to finance the next 20 years of expansion at Hancock College and that's where Measure H comes in.

As I said you have a lot of great new buildings on campus but we still have original buildings on our campus that were built in the 1960s when we moved over from Santa Maria High School. Some of those are aging. Of course, the classrooms were built for 1970s and 1980s 1990s expectations and education Of course new technologies needed to keep pace but the real, the real focus is on not only upgrading those buildings but providing opportunities for the future. Let's have a picture up here, can anybody identify I'll give you five bucks if you can identify what that is Christina you can't answer this question.

Those are called oil switches. Those are electrical switches that were installed in the 1960s, we actually found that the plans for them about a third of Hancock's electrical infrastructure still goes through those switches. Why haven't we updated them? Well it's about $1 million upgrade on any one year and it'll close down the campus for awhile. We've actually had one of those explode. That sounds like an explosive going off for sure.

And so it's that kind of infrastructure that still exists, that exists outside of our normal operating budget that a bond like this would absolutely help us with. Go to the next. Here's just sort of a list of repairs and upgrades and new construction that will happen. Some highlights that I want to point out first of all is a new university center for all of those bachelor's programs are going to be coming to campus What I didn't say was that our agreement with Cal Poly will include four new bachelor's degrees by 2030. So we'll have four bachelor's degrees from Cal Poly offered exclusively on the Hancock campus and we're expecting that to be two, three hundred students or so. The problem is we're already maxed out with space. A new university center would help us keep those bachelor's degrees local, keep those students from going out of the area and keeping them right here.

Something else I learned just this morning our President Kevin Walters has been talking with, I believe the city or maybe the school district about the possibility of a community center right here in Guadalupe that would have a permanent anchor for Hancock right here in town. That would also be useful for the city as well a multi purpose building that could absolutely be used here. Some other things we would be looking at as a new nursing facility or expanded nursing facility or lab space is too small, and a variety of other buildings that are on the future.

So what are we looking at for Mr H, our request of our neighbors is to authorize 290 million That would be a maximum of $19 per hundred thousand dollars assessed value and property, not market value but assessed value. And that maximum wouldn't be coming for a number of years because that would be at the maximum of the allocations When you take the medium home value of Santa Barbara County at 425, that's roughly $80 a year at the maximum. And of course their Citizens Oversight Committee that ensures all the funding is going to what we say it's going toward all of Hancock's budgets are open to the public Of course our board meetings are open to the public and we have quite a few endorsers from our former citizens over oversight committee across the political spectrum who are endorsing this measure as well.

I believe that's the last one. What I will say is, our endorsement list is growing. We have all the major chambers of commerce on board the city, the mayor of Santa Maria is onboard econ Alliance, a number All the hospital administrators of course are on board. We have four of the five county supervisors and we're working on that fifth, we think we're getting close, but he's a notoriously hard nut to crack but we're getting close. But all that's to say is we do not Come to our neighbors with hat in hand lightly.

We know that Hancock is good stewards of the finances that we have in front of us, of the buildings that we have in front of us but also most importantly, of the students who we invite into our classrooms each and every day We know that we changed the odds, our data shows that. And I think when you look at our community, imagine a day without Hancock, without a place as local that's training our nurses, that's training our policemen, our firefighters, our accountants, our farmers, our welders, our auto shop technicians. You take that away from our community or limit them by old facilities, that has an impact. So that's why we stand tall asking for our community to support this.

We're not asking for the endorsement of this group, of course. But we may be asking for your individual endorsements at some point so thank you very much. Happy to entertain any questions from the dais.

I was looking, you mentioned 20 years ago that was there 58 years ago. And it's quite a change if you go in there today and see the, you know, the buildings have one individual request to speak Francis from air.

UnidentifiedUnidentified speaker 1Proposed21:58

Well, good evening Mayor Council members staff and members of the public. My name is Francis Romero. I want to start by saying that we are not anti education at our house my husband is currently wrapping up his doctorate degree. He has two master degrees we both have bachelor degrees and we both have the distinction of being law school dropouts. I will say, though that we spent 20 years paying off our student loans for our bachelor and we did start at Community College. We knocked out...I do not understand when people feel that they need to go away for four full years and pay top dollar. You know bottom line you ought to do all of your general ed and get everything knocked out that you can do at community college level first.

However, for 20 years we paid for our student loans. And that meant that we didn't travel like our friends were traveling. We didn't go on international trips. We actually just got our passports last year. So we made sacrifices to get our educations and that's not to say that we weren't eligible for different tuition reimbursements or other scholarships because we were both excellent students But I do have to say that I have neighbors who are retirees that are hesitant and won't even plug in the air filter that APCD provided for free, for fear of what that's going to do to their electric bills. And yes, we're looking at probably $8 a month for yet another bond. But as I pulled out my property tax bill before I came here tonight 15% of my property tax bill is going across seven different bond measures.

All for schools. And most recently, our city ended up paying for sidewalks for our school because somehow they managed to not figure out that they had to put sidewalks in as part of their budget so I guess that's a topic for another time. So anyway when people use things like technology something that changes roughly every two to three years Why should I be funding that over a 20-year bond? There's something called the technology fee, that a lot of cities charge in their planning departments and other departments to keep up with technology. Not everything can be free at community college because that means free to them means someone else is paying for it And while I do agree with the idea of crowdfunding, which is basically what bonds are, there has to be some accountability.

And I am very curious what percentage of the Allan Hancock budget is set aside annually for...I mean if you've known your electricity is 60 years old, your electrical infrastructure, certainly over the last 60 years there must have been some opportunities where you could have gone through and phased electrical improvements. So I, I just want to say that you know with with these asks and while they are very good stewards with what they do.

Again if you're spending 97% of your budget or 95% on salary wages and benefits and funding free stuff for students, I just need to know for myself where your maintenance budget is and what is your plan for capital expenditures. I did work for the Santa Maria Joint Union High School District for quite a couple of years as a grant manager. And at that time our budget had about 5% for capital and maintenance type activities. And that was about 20 years ago maybe things have trended differently and have changed But I think that with the asks, there comes responsibility not for just how you spend the money. But why are you in a position of not having kept up with infrastructure? Thank you.

Thank you. The consent calendar, a through F. The following items are presented for City Council approval without discussion as a single agenda item in order to expedite the meeting should a council member wish to discuss or disprove an item, it must be dropped from the blanket motion of approval and considered as a separate item, a wave the reading in full of all ordinance and resolutions Ordinances on the consent calendar will be adopted by the same vote cast at the first reading unless City Council indicates otherwise.

B, ratify payment of warrants for the period ending August 14th 2026. And August 21 2026. See, approve the minutes of the city council regular meeting of August 25 2026 d adopt on second reading ordinance number 2026 dash 532 amending section 8.8 0.030 A Guadalupe Municipal Code Chapter 8.80, Vacant Commercial Property Registration and Property Maintenance Ordinance regarding the annual registration fee.

Thank you Judy on the council side is there in the council member that wishes to pull any other items for discussion. I have a request by Ms. Romero before we move on any of the items with Mrs. Romero?

0:28 – 0:347 turns

UnidentifiedUnidentified speaker 1Proposed28:37

Thank you. As far as items D and E are concerned, I think those are both great things for you all to be doing having to do with vacant buildings that have been a blight in this community. You won't be falling for some of the stories that some of the property owners tell you. I know that some of those stories have been ongoing for the last 12, 14 years. E, adopting a resolution for appropriations limits. That's great to see basic business type things occurring here in the city.

B, ratifying of payments of warrants. From what I was able to see we had almost $1 million of warrants for a one week period Now granted projects made up about $867,000 of that. But again your general fund is in trouble and I hope everybody's actually reading each and every warrant that's paid in the city And if adopting a resolution, approving a statement of investment policy for the city.

I know at one time the city under Mr Peralta leadership had started to establish a rainy day fund or reserve fund funds that are kept I'm assuming at this point that's all gone considering the fact that special and restricted funds have become the go to for financing up until our current city administrator and finance directors trying to straighten the ship out.

But I think we need to be concerned about finding out how much funds are lacking from each of the special and restricted funds. Investment is great, but you have items on the agenda later tonight about doing a wastewater study and there will be upgrades and improvements. And I think that your special fund balances show that you've not been very good stewards over that money. Thank you.

Is it moved, is there any, there's a second. A motion and a second. Any discussion? All those in favor of the motion say aye. Aye. All ayes. Consent item seven passes. Next item is management report city administrator Mr David Brio.

UnidentifiedUnidentified speaker 3Proposed31:12

Right. Good evening, Mr Mayor Council members city staff and residents visitors tonight. So for The Royal Theater, we are still waiting. We met with the contractor last week. They were supposed to get us their July invoice by the end of last week. We touched base with them again today. They were supposed to get it to us today. Still have not seen it. We have a meeting tomorrow so there will be more to follow on that.

The meeting we had last week, it seemed positive. It didn't seem like they were up in arms. They understood our position and the owner was in on the meeting so it was very cordial. They understood that the rumors going around are just that. So they were still willing to continue with construction. The final invoice for July and then giving us a cost estimate for the punch list moving forward, which potentially may happen tomorrow. So we're looking forward to that.

Obviously the Los Mojeres opened on Friday an amazing showing Based on, you know who was there at the groundbreaking I really didn't expect it to be as well as it was especially at noon. But it was great, you know, it was great seeing the various companies in the community showing up, you had a processing plant showed up give us some skateboards and stuff like that so that's really great.

We still do have the grass areas and barbecue pits blocked off Hopefully sooner than later, the barbecue pits will open up. We're just trying to get that ground compacted good enough to where we're not gonna have to worry about super a lot of erosion, especially if we start to get some rain like is projected so we want to make sure that that's all set up and ready to go before we open that part up. And then the parking lot also had some minor repairs around the trees and stuff like that, that we want to get done before we fully open that to make sure that it's safe for pedestrians walking through Amtrak is still in progress.

All the curbs and stuff are still poured. They're still doing some underground work. It looks closer to the actual Amtrak building, it looks like they're starting to put in some base. So that's good progress right there. And then what else is... I think there was something else but I can't remember.

You know, I noticed that regarding this is that net barriers. They basically plastic it's going to get in that you've probably seen that so it's gonna be hard to keep people out of there because they're gonna want to be on the grass. Yeah,

UnidentifiedUnidentified speaker 3Proposed34:25

you know it's You know, we could have done a fence like a chain link. But I mean people were breaking into the chain link to go skate so at least with that fence up it's easy to make repairs. It's you know it's easy to take down and then you know with the basketball court being open Somebody is going to throw an air ball, it's gonna end up in that grass and you have to go fetch it.

It is what it is. We're just...it's more of a deterrent than anything. I

was across the street Saturday and there was literally 50 people out there with kids on the playground, basketball, skateboarders so it was good to see. Any comments about David's report? I

UnidentifiedUnidentified speaker 5Proposed35:13

had a quick question in regards to Las Mujeres. I know that we have an ordinance for no smoking, but the waste cans had like a dish for cigarette butts. Is that something that there's no trash cans without that?

UnidentifiedUnidentified speaker 3Proposed35:29

Are you talking like on the, on top of the crown?

UnidentifiedUnidentified speaker 5Proposed35:31

Correct.

UnidentifiedUnidentified speaker 3Proposed35:32

It's just the way they kill them.

UnidentifiedUnidentified speaker 5Proposed35:34

Okay.

UnidentifiedUnidentified speaker 3Proposed35:34

I mean

UnidentifiedUnidentified speaker 5Proposed35:35

it was one o'clock and it was already like halfway filled in. I just feel like it kind of gives a message like smoking is allowed once you start seeing all those cigarette buds um just kind of piled up.

UnidentifiedUnidentified speaker 3Proposed35:48

Um I mean there's no way to like I mean, we could bend them or pound out the...

UnidentifiedUnidentified speaker 5Proposed35:59

I was just approached by a concerned parent and I totally hear it. I feel that if we have an ordinance maybe when we are buying trash cans, we keep that in mind because it's right in front of the skateboarding. And so as we have youth there and then you know, we see the cigarette butts piling up, I think it just gives a message that smoking is allowed here.

UnidentifiedUnidentified speaker 3Proposed36:21

Right, but you could also I guess to play devil's advocate. You could put it as something as the people that are going to break the rules and smoke in a park at least they have somewhere to put the butts versus throwing them on the ground. So I mean it goes both ways. I get what you're saying, but. Do you know too? To try, I don't know that there's anything we

ElectedAriston JulianMayorProposed · by role36:42

can do. The same thing happens at Ocala Park. The baseball field there was. And I work on the field a little bit, and there was a guy and a lady sitting there in the bleachers on third base side smoking and just throwing the cigarette butts out in the field. Don't smoke. You're not allowed to smoke here if you do, I was going to tell them to eat their cigarette butts but I didn't. But no that's a problem.

UnidentifiedUnidentified speaker 5Proposed37:13

I just wouldn't want them to get harassed by police officers if there's a message they're like oh your buds are here. It's either one or the other. When I'm reading the ordinance, it's not allowed and how can chief go in there? And we ask officers to enforce that when there is a place for them to throw them away. I just think when we are looking at design like designing our parks, we keep that in mind.

Okay.

ElectedAriston JulianMayorProposed · by role37:40

Any questions of David? I don't see any questions. So item nine, Director of Public Safety, Chief Cash.

UnidentifiedUnidentified speaker 6Proposed37:51

Thank you Mr. Mayor, Council, staff and our community members. You can see my report there's nothing major significance as far as for police but the only projects are kind of working right now is we're still trying to get the cameras up and going at the new park. There's still some connectivity issues that we're dealing with IT and the vendor, but that is ongoing.

And the bathroom is really outstanding. There are some things that we need to look at. You talk about design. I don't know if anyone's been in that bathroom? You know there's a syringe location in the back and so we're looking at something that maybe we could Not highlight that, but we can kind of deal with that. It might be by law. I don't know specifically.

But yeah, that was pointed out to me by a parent and so I went to go take a look at that and didn't have an explanation for her but I did appreciate the information. Working Talked with the superintendent and a board member from the school and the principal. We currently do not have any sections as far as muni codes dealing with helmets and some of the motorized scooters, so we're looking at that putting together a group to see So that we can kind of stay ahead of this with the helmets and scooters. And we did have citizens who also, Mrs. Romero brought it up about some of those scooters. So I've been looking for the last couple days different cities and what the California vehicle code and muni codes are. So, I'll be putting something together and eventually get it through our legal and to our city administrator so that we can stay on top of that kinda situation.

Other than that, that is my report.

UnidentifiedUnidentified speaker 6Proposed40:28

We're not harassing but go on.

UnidentifiedUnidentified speaker 5Proposed40:32

I did see the email from the principal from McKinsey, or the new junior high in regards to e-bikes.

UnidentifiedUnidentified speaker 7Proposed40:38

Yes.

UnidentifiedUnidentified speaker 5Proposed40:39

BC Centro is a nonprofit organization based out of Santa Barbara County. They are actually doing like an e-coalition, I think in regards because it's a big issue, e-bikes up in South County. So it might be they have like a Zoom link that community leaders are going to get on and talk about e-bikes and e-scooters So it might be something that they should reach out to BC Central because they do have a coalition moving forward.

UnidentifiedUnidentified speaker 6Proposed41:03

Oh, OK. I appreciate that. Thank you. And I did send over the weekend, I think from Penn State, I'd sent an article to everyone about how they've prohibited those on the campus. So and I spoke with our city attorney who's absolutely correct saying the school can do certain things right now to prohibit some of those things. But we need to do something from the city. So if you can give me that other information after the meeting tonight, I appreciate it.

UnidentifiedUnidentified speaker 5Proposed41:31

And I also know that in McKinsey, Mr. Leimbach is hosting a CHP e-bike assembly. Maybe it's... Yes, I think it's this month. Maybe it's something that you... I don't know if somebody can assist or you get some information from CHP so we're having the same message with students. The students are going to hear it. I think it's fifth, sixth graders at McKinsey.

Okay, thank

UnidentifiedUnidentified speaker 1Proposed42:19

Well good evening. I wanted to, well it sounds like Chief you're going to have another meeting to go to. You're already up to 14 a month so what's another one right? I wanted to kind of talk about the theme in Guadalupe. If anybody's on any of the Facebook sites, there is a lot of angst and complaining about the police department because they're doing their job. There seems to be a real disconnect with what rules mean.

And I have to say as a former park commissioner for the county of Santa Barbara for 10 years and I was a recreation commissioner here in Guadalupe when we first moved here A rule not smoking at a park does not negate an amenity such as a trash can that comes with a spot where a cigarette can go. What happens for that rare person that shows up at the park smoking and they can actually read the sign, and they say oh I shouldn't have that here? They should have somewhere to be able to put it out.

For those who think, I mean if we dumb things down enough for our community and have no expectations you start doing things like oh well what do we do about that? Let's not have a spot for a cigarette butt because that's encouraging it. No people ought to be able to read the sign and follow the rule You know, the fact that our citizens are complaining because Guadalupe is citing people for their dark window tint. Their basketball hoops that are out in the middle of the street, their license plates that aren't affixed to their car and saying that instead Guadalupe PD officers ought to be crossing guards because people drive too fast through school zones Everybody that drives a car presumably has a driver's license and at some point has had to take driver education or a test.

The rules are there for a reason, they're not there for when it's convenient for you, they're not there for when it's inconvenient for you, they are there so that we can have civilized society. That's what rules and laws are for. So I think rather than trying to figure out how to dummy proof different things in this community, we just need to start holding people accountable to follow the rules.

It's really simple. The syringe box, what happens when a diabetic child is at the park and they need to take their insulin? They need to have a place to put the syringe. And for parents that look at that and say well that sends the wrong message perhaps they need better parenting skills. And all I can say is that everybody needs to follow the rules all the time. And that means you folks at the dais, you start out, that's your first job. It means stopping at that stop sign and waiting three seconds.

It means making sure that funding is used properly and that you're not stealing and that you're not doing things that are illegal with the people's monies. I think it's just time to start having expectations because if you keep lowering the bar low enough, then nothing matters. Thank you.

Finance director a preliminary I 2026 fourth quarter and year in financial report as of June 30 at 2026 with the cash position update through August 28, 2026.

UnidentifiedUnidentified speaker 8Proposed46:06

Mr Martinez. Thank you, Mr Mayor Good evening Council staff members of the public. This is going to be a preliminary and an audited your, your end results for fiscal year. FY 2526 as was stated in the, in the agenda obviously. I'm going to give you the highlights. I'm happy to answer questions about anything in the memo, I'm sure everybody read it. But just general rundown with respect to what what it says is that the amount that was reported on its face value on the reports Shows a deficit budget deficit of 10,900 that's incorrect I can tell you that there was things on the that are going to be reversed. The year has not closed. It's still open. It'll remain open until we catch up with our audits from 2022 23 all the way to the present.

And so, as such there is some accounting issues that need to get straightened out one of them was you know through the. Through the transition from moms to toddlers, there's growing pains and there will be growing pains. I would say with any transition in my experience it's a 10-year growing pain with adopting a new software. And one of those is getting the software to do what the software needs to do And sometimes when we get grant reimbursements back, the system doesn't accept reimbursements to go into the correct reimbursement account for whatever reason. We've started to straighten those out.

But originally $1.2 million was put into a miscellaneous account. Obviously that's incorrect. That's going to get reversed and put into the correct grant account Now that obviously overstates the deficit, because it shows us as a revenue in the general fund which it obviously is not. So after you reverse that then the budget would be 379,000 will call 379.9 worse than the adopted deficit.

Leaving the general fund at about $1.2 million deficit rather than the original deficit amount of 837,000 that was the approved budget in fiscal year FY 25-26. In addition to that If you look at some of the, on the positive side taxes finished 113% of budget that was good. Obviously building and planning revenues finished at 63%, a budget that's not necessarily the best news but you know, at the end of the day it wasn't with building and planning it's not necessarily something that the city can necessarily draw straight line to there's Nuances like whether or not construction happens and sometimes when it doesn't you don't get all the income right so transfer received were 20 25% of budget.

Enterprise transfers, some of the enterprise transfers were not made. And that was because we believe that's some of the budgeted transfers may not be necessary given that the money is already coming out of the enterprise accounts. So those were halted until we can investigate that in further audit and confirm With respect to the Water Enterprise Fund, that's showing a $291,000 surplus and the Wastewater Fund is showing a $695,000 surplus as of the end of the year.

I've also added in the report, and this is a little bit more up to date. And just so that the council can sort of follow the volatility of the cash and the velocity of the cash given some of the things are happening in the city. The city cash fell from 12.4 million to 9.95 million. Within the span of, you know, the quarter. And I can tell you right now it's it's lower obviously this also includes a, the $775,000 from the EDA and At this point, I can't tell you for sure whether or not those would be refundable or we need to return those funds. I don't know if David, do you have any updates on that? But otherwise at this point, we can call it cash that may or may not be returned.

So that's really in a nutshell the financial report for the quarter. I'll yield for questions.

Any

UnidentifiedUnidentified speaker 8Proposed51:29

questions from this side?

ElectedAriston JulianMayorProposed · by role51:31

Go ahead,

UnidentifiedUnidentified speaker 4Proposed51:31

please. Eli looking at your detailed information I had some questions on that section on what was budgeted and what the actuals are and so forth on let's see Page 2 of 25 that shows on the encroachment permits, some of this is kind of detailed and I just thought it was interesting to ask the question. It shows that year-to-date the budget was $25,000 for encroachment permits and the actual is $1,021 How does somebody, maybe that's a David question.

How can you budget for encroachment permits?

0:52 – 0:5826 turns

UnidentifiedUnidentified speaker 8Proposed52:28

So I can tell you how we did it this year and how most people will do it. They'll go back based off of the activity over the last three or five years and they'll budget a conservative number based on that activity I don't know how these numbers were calculated because that wasn't here. But certainly if you look at, if we were to pull up the activity in prior years, I think that could give you some better information. It's not on this report obviously

UnidentifiedUnidentified speaker 4Proposed53:01

so... I kind of thought that you would go back and look at it. And then on page three Under building, it's no public safety criminal fines and penalties. 6000 and then the actual is 24,000 24,500 just curious as to why the increase

UnidentifiedUnidentified speaker 8Proposed53:30

That's a good question. I mean, I would defer to Chief Caffney.

UnidentifiedUnidentified speaker 3Proposed53:34

That would fall under the same concept, right? So you base it on your budget based on the average and then if you exceed that average then it becomes a surplus.

UnidentifiedUnidentified speaker 4Proposed53:45

Oh no, I realize what a surplus is but... If they're

UnidentifiedUnidentified speaker 3Proposed53:46

writing more tickets

UnidentifiedUnidentified speaker 4Proposed53:47

or... Yeah, that's what I'm asking. What brought it up, Chief?

UnidentifiedUnidentified speaker 6Proposed53:54

I'm sorry could you state your question again now?

UnidentifiedUnidentified speaker 4Proposed53:56

No. I'm not sure what

UnidentifiedUnidentified speaker 6Proposed53:59

you're

UnidentifiedUnidentified speaker 4Proposed53:59

asking. On the line item of criminal fines and penalties, it was budgeted this fiscal year for 6,000. And then it shows the actual amount was 24,005. So that was a significant increase. And I'm just curious as to why the...

UnidentifiedUnidentified speaker 6Proposed54:16

Oh, the increase? From what I can tell usually it becomes a period that we're either because of tows And impounding of vehicles and tickets, especially during the summer. You know that does kind of because you have more people and then too because of the ADAs that are increasing in the city there are more parking issues so a lot of that is really mostly coming from parking and tows and impounds.

UnidentifiedUnidentified speaker 4Proposed54:48

Okay also to you Chief it shows public safety Maybe not on revenues. Cannabis revenue, maybe this is to you Eli, maybe I'm reading this wrong. It looks like it's in public safety? No, it's

ElectedAriston JulianMayorProposed · by role55:11

down under other, yeah.

UnidentifiedUnidentified speaker 4Proposed55:13

Okay, nevermind.

ElectedAriston JulianMayorProposed · by role55:14

Other revenue, yeah.

UnidentifiedUnidentified speaker 4Proposed55:16

Okay just a few more detailed questions I have. Let's see, on page – my note is on page 6 of 35 but it actually is in all the different departments where it shows that there was no budget for any of the departments for FICA and Medicare. And I just wondered why?

UnidentifiedUnidentified speaker 8Proposed55:43

The way and let me just make sure I'm looking at the right thing. So you're, you're looking at for example, 001-4105-0300. I'm looking at on just for example on page six of 35 under, I believe that's administration 4105 where

UnidentifiedUnidentified speaker 4Proposed55:54

his salaries and so forth. There is a budget for FICA and Medicare but there are no actuals. That's the question, there are no actuals?

not transcribed≈11s of audible speech the AI couldn’t make out▸ listen
UnidentifiedUnidentified speaker 8Proposed56:19

Yeah that's that's a great observation I think First of all, that FICA and Medicare number seems a little low obviously. And I don't know why there wouldn't be any activity in that other than to say that it was lumped into another one of the accounts. So I'd have to do some digging and see where that got...

UnidentifiedUnidentified speaker 4Proposed56:42

Looking at the different departments just kind of jumped out that there were budgets for it but no actuals. Okay, I just have one more. And this is on page six of the 35. The non-departmental department, which I've never understood but anyway. There's a budget for medical insurance. So first of all my question is what is non-departmental and as a call center, as a department? And then why is there a budget for medical insurance

UnidentifiedUnidentified speaker 8Proposed57:24

Yeah, so the first question I'll answer now it's a fairly simple non departmental is anything that is usually citywide that doesn't apply to only one department. So for example, We have citywide IT coverage support. And so instead of billing it to individual departments, I mean technically we probably could do it but instead of doing that it's lumped into non-departmental because it's covering the entire city.

UnidentifiedUnidentified speaker 4Proposed57:55

Okay but then that begs the question why would there be medical insurance budgeted in that? If the other departments have specific budget for medical insurance for the employees in those departments?

UnidentifiedUnidentified speaker 8Proposed58:10

Yeah, that's a really good question and you know I can't necessarily speak to why it was budgeted last year but... What's the

UnidentifiedUnidentified speaker 3Proposed58:16

number?

UnidentifiedUnidentified speaker 8Proposed58:18

4140-0400. It could also be

0:58 – 1:0729 turns

UnidentifiedUnidentified speaker 6Proposed58:35

If that don't fall under our general fund in general,

UnidentifiedUnidentified speaker 3Proposed59:03

Or even Todd at that time, that would fall under the whole city versus one

UnidentifiedUnidentified speaker 4Proposed59:10

thing. I don't think so.

ElectedAriston JulianMayorProposed · by role59:14

Prefers to get back to.

UnidentifiedUnidentified speaker 8Proposed59:19

ElectedAriston JulianMayorProposed · by role59:32

And you mentioned that 2223 audit, anything on any news on that?

UnidentifiedUnidentified speaker 8Proposed59:37

Yeah. We can tell you there's this probably good news is it's it's on its probably last two week cycle. So the auditors have confirmed everything's done. The only reason we don't have a report in front of you today is because they're working on other cyclical things that kept them from finishing our report. But between now and the end of the month, I think we should see a final report.

UnidentifiedUnidentified speaker 8Proposed1:00:04

UnidentifiedUnidentified speaker 4Proposed1:00:08

In line with that Eli once that is finalized the 22-23 audit Does that mean that 23-24 may go faster or not?

UnidentifiedUnidentified speaker 8Proposed1:00:26

It's that is the hope, that it goes faster. 22-23 was the year of the conversion from moms to Tyler so that's when we expect the most work to be done. That being said where you know we are finding a lot of balancing issues so while we're still hopeful I don't want to make any promises that it's going to be faster. That's the goal anyway right

ElectedAriston JulianMayorProposed · by role1:00:52

okay question from nice

UnidentifiedUnidentified speaker 5Proposed1:00:56

Yes, either I know that you mentioned that it's 10 years of going pain. Does that mean we're like halfway in because I was three to four years out.

UnidentifiedUnidentified speaker 8Proposed1:01:04

Well, look I was a general rule of thumb. I would say 10 years for any transition of major ERP systems because there's just issues that you don't know about and you find out later. And it might be the curve might be flatter for Guadalupe, I hope but the problem is that we don't know what we don't know until we run across it and we might run across it five years from now.

Because of a specific situation. So that's just, again, that's just the general rule of thumb I wouldn't put it in stone anywhere.

UnidentifiedUnidentified speaker 5Proposed1:01:40

Okay. I know that we've already seen some cost measures put into place. Are we seeing any through? Is there something that we should be looking at differently?

UnidentifiedUnidentified speaker 8Proposed1:01:51

I just want to make sure I understand your question in terms of cost measures. What specifically are you referring to?

UnidentifiedUnidentified speaker 5Proposed1:01:58

At the last council, we've done like some small measures to see if we can help our budget. Are we seeing any savings being produced or is there anything that we should be looking at it differently?

UnidentifiedUnidentified speaker 8Proposed1:02:13

There was a few things that to my recollection that happened in terms of cost measures one was layoffs Right, unfortunately to I think the seizing the construction of the Royal Theatre. And that was a huge thing for the city, I can tell you because of the cash position and so from those two fronts, I can tell you that's definitely making an impact. Is it resolving the budget situation? No, we still without the Royal Theatre And after the layoffs and after all the cost measures, you know, after the dust settles, you're still in about $1.5 million deficit.

And so we need to find a way to plug that hole. And so whatever the city needs to do with that I think it needs to happen because otherwise it might not be sustainable.

ElectedAriston JulianMayorProposed · by role1:03:16

We just have to stop digging a hole. Right. Any further questions from the guys? Please.

UnidentifiedUnidentified speaker 4Proposed1:03:24

In line with what Christine has asked on cost-saving measures and things like that, have the departments and the staff been advised of the financial situation from the standpoint of cutting down on purchasing Anything and everything they may have wanted as opposed to what the department needs.

UnidentifiedUnidentified speaker 8Proposed1:03:52

I can tell you, I can speak for my department. And so I'll speak for that and then maybe if you'd like to go around the table but you know from my perspective I can tell you that we've even cut the water down. I know that David's done some proactive things like ordering citywide paper and, you know, city wide things where we can get economies of scale on things, but we definitely have hunkered down in terms of what is a need and what isn't. We've cut, you know any cleaning service there's you know we're doing our own cleaning uh we've reduced we've reduced everything that we possibly can and just keep in mind you know these are these are while important they're very small things and so you can do a lot of small things that will add up but but you have to again and I mentioned this early early on you got to look at what's the biggest slice of the pie and in order to make a significant impact Thank you for the questions.

UnidentifiedUnidentified speaker 5Proposed1:04:54

When can we talk about that big slice of pie? Is that going to be at the audit, when do we have this conversation that is very much needed and how can we create that plan moving forward?

UnidentifiedUnidentified speaker 3Proposed1:05:05

So you guys approved the plan right so that plan was a three-year plan it wasn't

UnidentifiedUnidentified speaker 5Proposed1:05:12

Yeah,

UnidentifiedUnidentified speaker 3Proposed1:05:12

two month plan. So to try to be as forthcoming as possible you're not going to see results yet. You know we've issued a few layoff notices but you're not gonna see that Return until further on down the road, right? And then positions we didn't hire as cost-saving measures. Those are already factored into this, right? So things like the associate planner, the public works director, the recreation manager, those are already factored in so we're already seeing that and what that's doing is helping our cash flow because if you add that extra $50,000 a month between those positions Now we're probably sitting closer to 500,000 instead of 800,000 for revolving cash.

So you're seeing it with the cashflow process, you're just not seeing it fall off the budget yet. So that's a May, April-May question? That's a spring question before we can actually probably even forecast actual results

ElectedAriston JulianMayorProposed · by role1:06:25

One of the items to in response to that is that just like the Caltrans grant that we received for the workers. We basically, my understanding is we put a hold on that because you'd have to pay first and get reimbursed. So... Right so

UnidentifiedUnidentified speaker 3Proposed1:06:40

with that one I think we found a way to create staff. We're just not going to be able to do probably everything else that came with that grant.

ElectedAriston JulianMayorProposed · by role1:06:48

Okay.

UnidentifiedUnidentified speaker 3Proposed1:06:49

So a lot of the beautification efforts and stuff like that will probably have to take a backseat But as Francis has pointed out in the ops tempo changing with the new park, being able to utilize an individual will probably only go with one not two that it would afford. But again that's a cash flow issue and you know we're already putting so much stress on the enterprise adding more stress eventually it'll break. So we want to be sure that we manage that effectively.

1:07 – 1:135 turns

ElectedAriston JulianMayorProposed · by role1:07:25

Any further questions? If not, I have a request to speak by Mrs. Romero.

UnidentifiedUnidentified speaker 1Proposed1:07:35

Well good evening this is really the item that i'm most concerned about and I want to say to the people that are sitting there right now as you're questioning the budget and how the budget numbers happened you all were the ones that were here last year when this budget when last year's budget was put together It wasn't David. It was not Eli. So before I go any further, I want to be certain that I thank Eli for the effort that he's putting forth and David. I appreciate the two of you more than I can say. And that's probably the last positive thing I'm saying for the next 2 1⁄2 minutes.

We have two people sitting at the dais who wish to run to be mayor again and to become mayor. You folks have been complicit in the budgets since the 2021, 22, 23, 24, 25 all these years of working without audited financials. How many of you show of hands and I know none of you will balance your checkbook once a year? How many of you balance your checkbook every five years?

Why is it acceptable with city taxpayer dollars to be so cavalier to not once ask, all of you are experienced and some of you more than others. Why would you not ask why there is not audited financials? Did it ever cross anyone's mind during the course of the last four or five years No matter who your finance director was, it doesn't matter who your finance director is or who your city administrator is. It is your responsibility. You've got like two things to do budget and policy operations is not something you're supposed to do that's why you have professional staff.

You have a, again, a 25% structural budget deficit at this point. That's exactly the position the city was in when I became mayor we had a $3 million revenue and we had a $750,000 structural budget deficit so all that's happened is that The gap has remained at 25%, but the number is a whole lot bigger And I would assume by now that most of you saw my op-ed. I got it published in three different news centers.

This has to change, and it's not just a matter of showing up and complaining about you guys or venting on Facebook. This has to change. You guys are the ones that have made these decisions. You're the ones that have voted on these budgets. You're the ones that have allegedly reviewed numbers and made terrible decisions I mean, we still don't have a statement from Tom Bradenberry other than to trash talk the city and create rumors yet you still cut him a check this last set of warrants.

What kind of consultant does that? I've worked as a consultant for 25 years and I have never trash talked a client to the news. That's the quality of person you hired

ElectedAriston JulianMayorProposed · by role1:10:45

Let's see, Mira.

UnidentifiedUnidentified speaker 9Proposed1:10:56

Good evening. Thank you for allowing me to speak this evening. First up, I just want to say that last council meeting it was requested that the city administrator put a written report linked to the agenda and that did not happen this month. And I just want to say based on the response to that request, I just find it frankly unprofessional To not do that, because it's a really simple request. And if you had a written report in front of you there wouldn't be instances not remembering something that you want to inform the public up so I just want to make the request again it would be lovely If that report was written and linked to the agenda along with all the other reports that are provided.

In one of the reports, it was stated that there is a 1.5 million reimbursable funds that were found and I just want clarification if it's can be provided whether that includes the 750 approximate thousand but may or may not be reimbursable or if that's an additional 1. 5 million. And then again request that because it's been asked by community members over and over to have more information It would be nice if these reports had details that could be followed, that would allow people to really understand what's happening. And I also just want to say that I really appreciate what Councilmember Christina Hernandez and Amelia asked tonight about what are the future plans right you The financial report tonight just expressed that there's even more issues and I imagine that as these audits come in, those issues are just going to grow unfortunately.

And so I do think you know I appreciate that it's a three-year plan but a three year plan is not good enough right now and I don't think that the public has seen from this council or city leadership real actionable steps that the council is taking to A get more education if these numbers are confusing or if these reports are not easy to follow and it would help to have more insight into Ask the right questions and get into this. And I think that, you know, again there's two options right you either spend less or you increase revenue.

We are meeting, we're having conversations. We're putting focus groups together one that's focusing on how we reduce spending and one that's focusing on how you increase revenue but you certainly do not increase revenue by canceling projects that are going to increase your tourism in a downtown that already is really struggling so I think these are just important questions and I think it's really important that the council communicate to the city what action steps are you guys taking to correct this?

So thank you so much

Reduction of elected officials monthly stipends Recommendation that the City Council, a approval reduction of 300 per month and the stipend paid to each elected city official resulting in monthly stipends have 200 for each council member. The city treasurer on the city clerk and 450 for the mayor effective on the date permitted by applicable law. And B, direct the city attorney to prepare the legally appropriate implementing ordinance resolution or other action and to confirm the effective date and application of the stipend reductions. And C authorize the finance department to implement the revised stipend schedule upon the legally effective date.

UnidentifiedUnidentified speaker 3Proposed1:14:41

Good evening, Mr Mayor council members staff and residents. What this is is more of a conversation to see if Council would consider taking a $300 stipend reduction. This is being presented as a reoccurring cost. Reduction measure, not anything else. This is something that would equate to about 25k a year. You know it's not a lot but It's a step in the right direction you know it's getting everybody involved You know, the city is spending $2100 a month providing stipends.

And it's not because you guys don't do a lot you guys have a lot on your plate. Obviously we've seen tonight with the comments, but I guess you could say it's more filling the water to see if it's worth presenting something or moving forward with something how you guys would feel about it. As a way to, um You know, lead from the top down. Right?

ElectedAriston JulianMayorProposed · by role1:16:03

One of my one of

UnidentifiedUnidentified speaker 4Proposed1:16:10

I actually would recommend that. I agree that the stipend should be lowered, I would recommend that it be lower to what it originally was and that's 150 a month except for the mayor. So there's a gap that they may or have 300. It increases the savings again it doesn't Bring us current and flush but it. You can play the numbers anyway you want, but I think going back to the original with the exception of the mayor would be reasonable.

UnidentifiedUnidentified speaker 11Proposed1:16:46

So a different opinion and that's based on a couple things. Retired independently wealthy I mean there's a lot of things that we do but to increase the diversity of our council knowing that there's three open seats coming up, I would say we push this vote back until at least January. When we know the three seats that could be changing. They have the opportunity to vote i think that for the amount of work and the amount of work expected from us.

It's not very much, I mean you're not going to get the quality of people able to do this. If we don't offer incentive to be here especially for those folks that are working with children like some of us that are on the council so that's my opinion. It's not to not reduce the stipend but it is to push it back until we have the full Council that will be doing this for the next two to four years.

UnidentifiedUnidentified speaker 5Proposed1:17:52

And I said, I probably would have not moved forward had I given the big picture. So I would be personally okay with recommendation action one. With the what? Recommendation action item one, yeah.

ElectedAriston JulianMayorProposed · by role1:18:18

One of the things, I brought this up One of the things that, and it was talked about before when we looked at several years ago looked at a stipend increase that we actually were told that there was a reserve of almost $1 million. And so The thought was, well let's go ahead and because it took 37 years to increase from the 150 to a couple of years ago. So I haven't recommended to go across the board $200 including the mayor to go across the board in the reduction. I tend to agree with Whitney in the sense that we're talking three months perhaps?

Right. And I know it's not, you know, it really doesn't make a significant dent if we're in at one point something million dollars in the hole but it does to me is a sounding board that we do want to make sure that we were a player in this but I would agree with Whitney in terms of Right.

UnidentifiedUnidentified speaker 11Proposed1:19:31

Yeah, let's let the people that will be on council for two to four more years before I that's i mean that seems logical to me instead of doing it right before an election.

UnidentifiedUnidentified speaker 10Proposed1:19:41

Mr Mayor. Yes, if I can interject I think it's relevant to your discussion. I understand where Councilmember Furness is coming from that doesn't make sense but unfortunately the law in California requires that a sitting council cannot change its own salary up or down It can set it for a future council. So if you were to wait until January, or December when the new council members are seated and they decided to say oh let's eliminate our salaries they would have to wait two years before that would take effect So if you're going to reduce salaries to have an effect, or excuse me stipends salaries to have an effect on this budget cycle would have to be before the.

1:20 – 1:256 turns

UnidentifiedUnidentified speaker 11Proposed1:20:31

And I still stand by what I said, I don't think that we will get the quality people. The turnover on Council before I got here but which was right you know right when the stipend was $150 a month. I mean for working folks. That's, that's less than minimum wage for the amount of hours we put in so I just The people that are running for the council seats that are open may not have run, we may not have sitting council members that can give quality. And you may agree that we're quality or not but what we can say that we were here because we care but we may not be able to at that price. Half of us aren't retired, we don't have pensions et cetera, et cetera.

ElectedAriston JulianMayorProposed · by role1:21:22

Let's open it to the public. I have a question, Robert Diaz?

UnidentifiedUnidentified speaker 7Proposed1:21:36

Yeah, Robert Diaz citizen here in Guadalupe, a board member of the Guadalupe Community Action Coalition. Probably one of those three people that's going to be coming up sitting up there in the board seat. To be straight up about it I think you should move forward this year lower lower the amounts in my opinion as low as you can legally can. You know if that's going to be, you know, the reason why somebody or somebody doesn't sit up there Maybe that's for the best.

Um, you know we have to kind of take these opportunities where we can, although 25 grand in and of itself is really really just a drop in the bucket for the bigger issues that we have as someone who will be sitting in the seat next year potentially in a year after I don't know, I don't see any other options and this is just so minor it's just such a quick and easy thing to do.

You know, just to kind of show that hey as leaders were stepping up you know handling business doing what needs to be done when we get the city back on track, it flourishes Then we can look at raising those again. You know there's a lot of opportunities, and there's probably a lot of people that are willing to lead and come up here. There's other ways to get in there other than be elected.

And there's probably people that don't run simply because of that process so if there's opportunities to get qualified leaders that just didn't want to deal with that. Just kind of, you know, hope it works out that way. And if not, then whoever's sitting up there we put in that much extra work. I mean, I can only speak for myself in that regard if I'm lucky enough to be able to sit up there. So that's my comment.

UnidentifiedUnidentified speaker 11Proposed1:23:06

Yeah, that's good input. Thank you.

UnidentifiedUnidentified speaker 7Proposed1:23:09

Yeah, there's not really a running race. So just for anybody at home, just real quick, there are two candidates for city council and then the mayor spot of course. The two candidates for city council are gonna fill up the two spots most likely unless nobody votes at all, unless there's some other thing I don't know. But yeah so like I said, I'll probably actually be up there no matter what but I'm for it lower it as much as you can, as much as reasonable and I'm down to work still. So I just wanna let y'all know that.

UnidentifiedUnidentified speaker 1Proposed1:23:44

Mr. Diaz, so I feel a glimmer of hope as I come up here to speak. I served as mayor for two years and I got my $142.50 a month stipend because we took a symbolic 5% cut along with each and every other staff member. I was not retired nor was I independently wealthy. I worked full time. And something that most people don't realize, I had my actual employment where I made my living Threatened two different times because of my decisions that I made as the mayor of this community.

Once by my employer and once by an elected official because I wouldn't vote his way on SBCAG. So, um, I know that I spent 15 to 20 hours a week every week in addition to my full-time work schedule. Yes it was grueling but i think that the idea that somehow you get a better person because of a couple hundred dollars...I'm not buying that at all! You're either here you're in, you're in it for the hall and you know that there's going to be sacrifice and if some people choose to not do it over a couple hundred bucks then oh well.

Maybe that sounds a little cold but the reality is How do you, how do you save $1. You start one penny at a time. We've all had times in our lives where we've clipped coupons and probably still do you save where you can, and this is low hanging fruit and I'm glad to hear the city attorney weigh in on The state law because there's no time like the present. And I would even say that since it probably can't take effect till January, you can each voluntarily decide to make whatever cut that you wish to make and have that go back into the general fund. Thank you.

UnidentifiedUnidentified speaker 12Proposed1:25:42

I just want to talk on this issue, I think in at least as a member of the community. I think it's important that you take this cut as a symbolic gesture to the rest of our community that everybody is going And I would like to see all employees take a 5% cut. It's not because we like it, it's because we want to get out of this situation and we don't want to go back there.

So that is how I feel. I really hope that you will take the cut and the new people that come in I mean, I know all of you and I know you're here because you love Guadalupe. And I think that the next group of people or the next council seats that get filled they're also going to be loving Guadalupe. So yeah, I really hope that you will vote for this cut. Thank you.

ElectedAriston JulianMayorProposed · by role1:26:35

Okay back to the Council.

UnidentifiedUnidentified speaker 11Proposed1:26:42

Bill is that correct? That it won't take effect until January?

UnidentifiedUnidentified speaker 10Proposed1:26:46

That's correct.

UnidentifiedUnidentified speaker 11Proposed1:26:48

Then I suggest we cut it to zero.

ElectedAriston JulianMayorProposed · by role1:26:57

Across the board should be 300 across the board. That's me, a lot of opinions up there.

UnidentifiedUnidentified speaker 4Proposed1:27:06

I'll go back to the 150 for all with a reasonable gap with the mayor's stipend whatever that might be

UnidentifiedUnidentified speaker 10Proposed1:27:22

Right. You'll take action, the ordinance or resolution I forgot what brings it. I think it's an ordinance and then it takes effect with the next council.

ElectedAriston JulianMayorProposed · by role1:27:33

Okay. Oops. You still can talk.

UnidentifiedUnidentified speaker 10Proposed1:27:37

Yeah well then

the next council can decide

UnidentifiedUnidentified speaker 10Proposed1:27:39

to

ElectedAriston JulianMayorProposed · by role1:27:45

All right we have any motion?

UnidentifiedUnidentified speaker 5Proposed1:27:48

I will make a motion for staff recommendation on action item one.

UnidentifiedUnidentified speaker 11Proposed1:27:57

To do a reduction of

UnidentifiedUnidentified speaker 5Proposed1:27:59

$300 per month across the board?

UnidentifiedUnidentified speaker 11Proposed1:28:01

That's from five to two, correct?

ElectedAriston JulianMayorProposed · by role1:28:04

Yes. Is there a

UnidentifiedUnidentified speaker 10Proposed1:28:07

second? Just to clarify, the recommendation also keeps the mayor salary higher. Is that your motion Council Member Hernandez?

UnidentifiedUnidentified speaker 11Proposed1:28:17

I think it takes it all down, wait.

UnidentifiedUnidentified speaker 10Proposed1:28:20

Well she was talking. She had expressed support for the- All across the board, my apologies. Okay. I'm sorry, I still don't understand if it's $300 across the board reduction of the current rates or is it 200 for all council members per month? One that keeps the salary at 450 for the mayor and 200 for the council members. I just want to know if that's your motion because I don't want there to be any confusion on the record.

Yeah, okay. No, I just wanted to make sure because she said 300 across the board. And and the mayor had mentioned earlier about

UnidentifiedUnidentified speaker 11Proposed1:29:07

so it's reducing it from 500 200

UnidentifiedUnidentified speaker 10Proposed1:29:10

perfect

UnidentifiedUnidentified speaker 11Proposed1:29:10

and so $300 reduction and then it's reducing the marriage from $750 to $450 correct

UnidentifiedUnidentified speaker 10Proposed1:29:17

that's that's motion thank you.

UnidentifiedUnidentified speaker 4Proposed1:29:20

That's not option one then it

UnidentifiedUnidentified speaker 10Proposed1:29:22

is option one.

UnidentifiedUnidentified speaker 4Proposed1:29:23

Am I

UnidentifiedUnidentified speaker 10Proposed1:29:24

looking at a yeah one. It

UnidentifiedUnidentified speaker 11Proposed1:29:27

is a recommended action

UnidentifiedUnidentified speaker 10Proposed1:29:31

Oh, okay. On the agenda it's a we need to

UnidentifiedUnidentified speaker 11Proposed1:29:34

oh I'm

UnidentifiedUnidentified speaker 5Proposed1:29:35

reading the staff report

UnidentifiedUnidentified speaker 10Proposed1:29:35

yeah sorry

UnidentifiedUnidentified speaker 5Proposed1:29:36

so I did have questions clarifications when we first approved this, it was that the mayor would get more money because he was doing more stuff. Because I think that was why we approved for the mayor to get a bigger stipend, was because he was going to do more stuff.

UnidentifiedUnidentified speaker 10Proposed1:29:56

That's well it's correct they're in the code additional duties the mayor has okay

UnidentifiedUnidentified speaker 11Proposed1:30:02

correct administrative duties that we don't do

ElectedAriston JulianMayorProposed · by role1:30:04

UnidentifiedCity ClerkProposed · by role1:32:46

Consider adoption of the new travel, expense reimbursement and vehicle use policy. Recommendation that the City Council adopt resolution number 2026-46 approving the new travel, expense reimbursement and vehicle use policy and authorize non-substantive administrative updates necessary to maintain consistency with law, adopted rates, labor and employment agreements and grant requirements.

ElectedAriston JulianMayorProposed · by role1:33:15

Thank you. Mr Trujillo.

UnidentifiedUnidentified speaker 3Proposed1:33:18

All right, good evening Mayor Council members staff and residents. So what this is. is, it's essentially an update. The last policy that the city had was from 2012. So what we did is went in updated all the current laws and codes and put in all the verbiage for per diems and IRS rates, all those kinds of things that should be in the policy. And then what it really hits on the big kicker pretty much because of where our current budget is Is it's section 5.11 or Section five number one, and it's essentially just all travel and expenses must have a clear and documented official business purpose and must be necessary reasonable and with within an authorized budget that is the main important part of this.

It's because we have to make sure that you know we haven't established budget We haven't been able to maintain a budget for a long time. And some of the reason being, notwithstanding any kind of financial issue or anything like that is that for a government agency we have zero policies in place. We had a four-year-old procurement policy. We don't have a credit card usage policy.

We didn't have a travel policy that was up to date. So it's almost unfathomable that a government agency could The ability to spend money but not have any policies in place to restrain how you can spend that money. There's gee whiz information in here, like you should

ElectedAriston JulianMayorProposed · by role1:35:02

not

UnidentifiedUnidentified speaker 3Proposed1:35:04

buy alcohol and expect to get reimbursed, things like that. But even then for some people that maybe travel for the first time on a government dime, maybe they don't know that kind of information. So it goes through we have there's verbiage in here That finance human resources risk management city attorney, you know they can replace attachments. And what that primarily refers to is the current federal per diem rates again your IRS tax rates as they go up for mileage throughout the year.

You know, every I don't know if it's September for them but annually the IRS doesn't update maybe it's April. I mean that would make sense to whatever the current rate is for you know mileage reimbursement and things like that. And then it does touch on you know Um, if people are going to be leaving the area to get permission. Who do we get permission from? Who you know written permission needs to be from whether it's myself chief a council member that's going on a trip or whatever just so that we can get our hands around where this money is going because if we don't we're not fixing anything right we're just it's a circle Tighten the reins on that circle a little bit. Give it some direction, let people know who to contact if they're going to be doing things.

Make sure that there is money because it would Yeah, I think it would be unpleasant if somebody takes a trip and then the city doesn't have money right. So essentially that's what we're asking for just if Council would approve the updated travel policy vehicle use policy. It does have a lot of what was in the 2012, because 2012 didn't have bad stuff in it. It was just outdated and that was put together by Mr. Ness. He was a sharp dude.

So yeah. Is there any questions? Okay.

I attended the monthly meeting on pesticides that was Wednesday August 26th and that was to continue the discussion on If pesticides are being used here beyond a certain barrier to the schools and things like that, as well as The Times. And there'll be another meeting next month. The individual who coordinates this meeting she did meet with the Ag Commissioner on August 30th to talk about the concerns that the residents here have on the issue of pesticides.

I went to the emergency prep meeting that Chief gave at the Senior Center, I agree with the comments that were made, that was very well done. I had to leave halfway through because they were late starting and I was then late for another meeting But it was very well done, and I like the fact that Josue was there giving it. It wasn't just Chief up there talking.

I would also encourage The chief and Josue and whomever else to be able to put on a community emergency prep for an hour. What was given in this training was very basic information, and when you heard it, you said it's common sense but you needed to hear it first to understand. It was very well done from that standpoint, and it was very well received. It was full.

The center was full. Senior Center was full. I was at the food bank on September 3rd again, and also was at the ribbon cutting for Las Mujeres. I went walking this morning and I was able to go back to my initial route and come back through the park. And I looked for graffiti or anything else. What I did see were about 10 empty Soda bottles and water bottles on top of the skate park. When if you turn so many feet, there's a trash can right there.

But it was clean. It was nice to see that it was clean. I also want to mention that the Day of Hope that was a week or two ago, Charlene? Yeah. That the Guadalupe team raised rounded up $1,700. And that goes to Mission Hope.
