Thank you, Mayor. Applications are now open for people who are interested in the 4th of July block parties. You can get some of the booklets at the Anderson Rec Center. It's also available online. I wanted to highlight that our big city celebration that we have planned for the 4th of July this year. You can join us at Ryan Park to celebrate America's 250th birthday. We'll have live music, food trucks, inflatables and it's free admission.

I'm also excited to let you know that we have some youth programs that the recreation is adding to their programs. It'll be free teen flag football program, it'll be for kids ages 11 through 18, practice will be between 530 and 730 at the Lompoc Community Track and Field. This program will run from June 15th to August 7th. I also wanted to let everybody know that they have free lunches at the Anderson Rec Center from 12-12.30 for kids under 18, and that's also in support with the school district. That will be Monday through Friday.

The library will also be doing a garden workshop for kids 8-12 That'll be on June 17th of Wednesday, and it runs from 2 to 3.30. And like the Anderson Rec Center, the library also has free lunches but that will be from 1 to 1.30 Monday through Friday. It will be available June 15th through July 31st. I want to take a moment and recognize the Waste and Recycling Workers Week.

We've got a lot of great people that keep our streets clean and everything, and I wanted to thank them. Next, let me see. And then I'd also like to remind everybody that Flower Festival is coming up. It'll be June 25th through the 28th, and it will feature carnival rides, games, arts and crafts, exhibits, food booths, commercial vendors, live music. If you want to get more information on that, you need to go to Lompoc Valley Festival Association webpage.

Finally, I wanted to remind everybody we have a couple of holidays coming up. This Friday will be a holiday. City Hall and the library and some other facilities will be closed. And that'll delay our solid waste pickup. Also July 3rd, we'll observe July 4th. We'll have the delays too and hope everybody has a safe and fun Fourth. And that's all I have.

I had another one that I'd asked you a while ago. Somebody brought to my attention they had closed one of their businesses in town with the cannabis fee and they were normally being charged, they didn't even open a business. They put an application in at a huge deposit and somehow the fee got changed. I think $3500 a year for somebody not even doing anything in business?

Do we need to bring that back, that fee back? Or is there some way you can fix those things or...

It was part of the master fee schedule that we would no longer be tracking because we weren't doing a very good job at tracking hours and times so we just did a study as far as the master fee schedule and we looked at how much time it normally took to do one of these approvals and reviews and all that and we came up with that fee but we can bring it back if the council wanted to I think that the $200 was because we weren't tracking our hours. It was just too cumbersome and hard to do, If the Council thinks that fee is too high, we can bring it back and discuss that.

Mayor? Yes. I need to make a couple statements for the record about the consent calendar. First is on item number two, there's at least one check in item number two for approval to the Lompoc Valley Chamber of Commerce In addition to that, Lompoc Valley Chamber of Commerce is a source of income to Councilmember Starbuck. So he will be recusing himself from any checks in item number two to the Lompoc Valley Chamber of Commerce and because it's on the consent calendar, he does not need to leave the room.

He can still vote on it. It's just that the recusal will be stated for the record. I had a discussion with me today about potentially having a source of income from one of the businesses that is involved with item number nine, which is the Lompoc Tourism Improvement District. Haven't had a chance to really look into it and confirm it yet but in an absolute abundance of caution Council Member Ball is going to recuse himself from item number nine due And that is the same thing. It does not need to leave the room because it's on the consent calendar.

All right, so I apologize for last time. Didn't have much of a voice, was a little under the weather. So I'm not going to be here to talk about Bridge at this point it's a moot point we need someone in his district to recall him you know if we can't get Scrooge McDuck however let's talk about the three stooges. Dirk Starbuck age 67-ish right? was penalized for a conflict of interest when he first became a member of the council.

Mayor Mosby is a self-designated code enforcement agent apparently, and was also the reason for the Council getting the Brown Act investigated on them. He's 62. Vega is age 70. He fell asleep and voted to raise our taxes a few months ago. He ran on stagnation of the local economy, only improving current businesses and not expanding to more businesses. The fourth member here, Mr. Ball, he is a photographer and a teacher and I just don't feel like he has many conflicts of interest. This is the first time I've even seen a strange conflict of interest with him which is Fair, and he reported it. So we need to vote better people in the end. That's the long of the short of what I'm saying. We don't really have a stunning show of people up here. We have a lot of landlords who refuse to tax themselves.

I mean, we're geriatric up here almost. We got 60 and 70 year old people who, you know, obese overweight out of date. So I guess I'm gonna do what I can do about that. And I'm in district two which places me in a unique position to run against someone who is currently unopposed in the city council. So as of today, I'm announcing that I'm running for district two of the city council.

They deserve a place to learn, a place to create, a place to compete, a place to dream, a place to belong to.

When a city provides more opportunities to buy intoxicants than opportunities to build the future, something is wrong. I am here to ask a question. Are we investing enough in the next generation? Our city deserves progress. The mayor does nothing. He pushes a pen and sits down at the same time pushing our people to the side. He also gets mad at street vendors and records a person in our community nodding out on his bike instead of helping him, he called it the zombie apocalypse.

As a mayor he is supposed to help solve the problem not just point it out. I believe these actions were wrong and disgusting. He also was not present at our two graduations for high school which tells us he could care less about a big step in our youth's future And honestly, this city council has disappointed me as well. Except you, Bo. I came here last time. Victor Vega came out here eating a bag of Fritos and he's still eating the chips!

To me that showed a lack of respect for this council meeting and the people who took their time to come here. It was one of the most disrespectful and repulsive things I've seen in awhile. You are supposed to be respectful and honorable public servants. And you basically showed me what type of people you guys are. I would like to ask the people in this room, do these people deserve to be up there? Yeah they do. Yeah they do. I'm out of time but para la comunidad.

You led by example, or the people agree with you on every issue is not...

They know where you stand and know where you're willing to do the work. The people of Lompoc have been paying attention Mr. Ball. I am here as a part of the community that has been watching what is going on in our city government and we will continue to voice our concerns. I also want to thank the members of this council for agreeing to a public conversation about this situation. Like many of my fellow community members, I care about the integrity of our local government. I call the Santa Barbara County District Attorney out on the fact that they would spend so much time and energy investigating and prosecuting one of our council members when they ignore The suspicious death of Liliana Zuniga on the 13th of March, 2023.

Where's the investigation into that extremely suspicious death? And I also wonder why when The people get up here and talk before me how they're making personal attacks against the city councilman except for Jeremy, and then praising Jeremy. When you look at it from the inside out, you can see it's very partisan and lopsided. Yeah. Very, very lopsided. Also interesting, I would like to know from the district attorney's office because they prosecute all of the criminal charges that are brought in the Lompoc Valley by any law enforcement agency.

The reason why we're looking at them expending so much money on an issue like the city councilman's trouble and not on Liliana Zuniga. Thank you.

Whether those allegations are ultimately proven or disproven, the conflict is obvious. The appearance alone damages confidence in local government and while we're talking about public trust let's talk about leadership.

Our mayor continues to lecture struggling residents and spit at street vendors while the most visible symbol of neglect in this city sits right in front of all of us, the abandoned Texas Cattle Company property. It has become a monument to decay in the middle of Lompoc owned by our mayor. People notice things. People notice relationships. People notice who sits together on this dais. People notice who gets criticized and who gets protected.

People also notice that Lompoc has spent years talking about economic development while watching storefronts sit empty, buildings deteriorate and opportunities pass us by. The public deserves leaders who hold themselves to the same standards they expect from everyone else. So tonight, I'm asking for accountability. Councilmember Bridge should recuse himself from matters involving taxes and public funds.

And if he won't do it voluntarily, this council should seriously consider censuring him. The people of Lompoc deserve a government that looks less like a private club and more like public service. Only the people will save the people. Thank you.

Before I make a furthermore speech, I'd like to talk about the women criticizing our knowledge. As we are young, we clearly know that we are acknowledging council mistakes. There's no excuse for a woman to constantly make a death an excuse for her own political views. Continuing on my speech as there is a quote, you do not drive to Lompoc, you drive through it.

We are seen as a joke by everyone. As kids grow up, they'd rather leave Lompoc than stay in the motionless cycle of living just to die. As you said we lost population and you wonder why? Maybe it's the many dispensaries, bars, liquor stores and smoke shops that the mayor has accepted in the town. These businesses did not appear overnight. Permits were approved, licenses were granted, policies were adopted.

Those decisions were made under the watch of city leadership. If the council has the power to approve growth, then it also has the responsibility to guide that growth. We cannot continue approving the same types of businesses while claiming there is no money, no vision and no opportunity for youth programs, family attractions and economic development. The answer is not endless complaints. The answer is action. We should invest in recreation, we should support family-friendly attractions, we should create events that bring visitors.

We should expand opportunities for trades, technology arts and youth development. Not our community should be supposed to do that. When families stay in neighborhoods, it becomes stronger. But seeing as everyone grows, they'd rather leave Lompoc than stay here because they know that staying here is survival.

I came here in support of my friends, of our community that I love Lompoc and I appreciate Mr Mayor and our City Council for the good things you do for our community. With this recent comments, it breaks my heart. I'm not a young person. I am an old person. I am a proud ally of the LGBTQ plus community who are often invisible in our community and throughout our country. I know it doesn't have to be this way.

In the Cape Cod area for 50 years, the people have lived in harmony and people who are LGBTQ plus can live their lives and be proud of who they are. And free to view the art without being labeled just enjoying themselves is the most happy place in the world. There's no reason Lompoc can't do the same. You know, we're all people, we're all humans. Isn't it supposed to be about love not hate? But there is right and wrong and some of the other comments are made this evening to the woman, to Karen.

Cause you might want to go spend some time sit down and talk with them find out what they do. They do wonderful work The people who have spoken tonight, we're all concerned. It isn't just about a situation that's come up and I agree that people are innocent to the proving guilty. I believe in the foundation of our government. It is the right thing to do to step down, or at least not participating in voting about the issues that were presented here this evening. This is the right thing to do.

We love our city. We're here because we love our city. We want to be part of it and I'm not a young person who was born yesterday. I'm a retired nurse, home health and hospice in this community for many, many years. I've nursed for 44 years I think we all need to reflect on our humanity. We're all going to die. As a hospice nurse, I can tell you that. What kind of life do we want to live here on this earth? We can make it better.

So item number 10 is a public hearing on city job vacancies in the city's recruitment and retention efforts in compliance with Assembly Bill 2561 which is also known as Government Code Section 3502.3 So our recommendation tonight is to hold the public hearing and to receive a staff report, and then listen to public comment.

So pursuant to Assembly Bill 2561 in the City of Lompoc's Vacancy Reporting Obligation, the city is required to conduct at least one public hearing per fiscal year or to report on workplace vacancies, recruitment, and retention efforts. So as of May 18, 2026 the city has 393 authorized full-time and part-time positions. And there are currently 30 vacancies that the city has. At this time the vacancy rate remains below 20% across all bargaining units so there's no bargaining unit that has met or exceeded the 20% vacancy threshold that would require additional reporting under government code section 3502.3 So and just to note, our overall vacancy for the city is at 7.63%, so we're performing pretty well there.

The Human Resources Department continues to coordinate recruitment activities to fill authorized vacancies in a timely manner. In 2025, the city conducted 72 recruitments with the median time to fill those of approximately 60 days. So that's everything from posting the position to the interview process to the background and medical and onboarding. And so recruitment efforts include targeted outreach through industry-specific job boards, professional associations and widely used employment platforms.

So there are some challenges. Despite these efforts certain classifications remain difficult to fill due to factors such as specialized skill requirements, market competition and our regional considerations. The City continues to support employee retention through a combination of workplace flexibility, professional development opportunities and employee support programs.

So while progress has been made in maintaining the staffing levels, recruitment challenges persist in certain classifications. Contributing factors include a competitive labor market, limited application pools for specialized positions and candidate follow-through during the recruitment process. So pursuant to Government Code Section 3502.3, staff has not identified any necessary changes to existing policies, procedures or recruitment practices that may hinder hiring.

In conclusion, this report is presented in compliance with Assembly Bill 2561 and the City's Vacancy Reporting Obligation Policy. The City will continue to monitor workforce vacancy trends, evaluate recruitment and retention strategies, and provide updates to the City Council as required to support operational need and maintain transparency. Good evening so we are here today to talk about the this is a public hearing to confirm the intent to levy the assessment as was previously described We're going to start with a little bit of history on this because in the past I've kind of run through this item because it happens every year and I wanted to touch on a little bit of the history of it. So back in the spring of 2002, the city had proposed the assessment. It went to voter approval and in August of 22 with 55.2% vote it was voted in and approved by the citizens of the City of Lompoc. This allowed the city to levy this special tax to collect money to pay the pool bond, as well as provide for a park ranger which was part of the ballot. And the remainder goes back to Park and Pools to do maintenance and other incidentals that happened in their areas.

So we started this one with a three-step process every year. So back on March 3rd, we brought it to council on consent and Resolution 679926 was passed which directed SCI consultants to prepare the engineer's report. In May I brought that back also in consent calendar with the preliminary engineer's report as well as the budget that was prepared using our budget numbers for 2627.

And then we are here now on June 16th for the public hearing and to assess the levy to the county tax rolls. Based on the annual increase for the Los Angeles CPI from January of last year to January of 25, so 24-25, I'm sorry, 25-26, the CPI increase was 3.02%. The assessment district isn't allowed to assess more than 3% annually, so anything remainder is carried over into future years for years where the CPI is lower.

So we assessed 3% this year and the uncaptured excess from prior years and the additional 0.02 added from this year takes our total for future years to 7.15%, that it's still not able to be assessed at this time. With those calculations, the single family equivalent was $34.52 per single family unit within the city of Lompoc for the special assessment alone. This does not include the general assessment.

So the estimated revenue generated by this assessment is going to be 406,596. Based on the budget, which will be on the next page. The total for installation maintenance servicing and incidentals for all of the parks not just the assessment part is 8.2 million to 8.25. The city is required to participate or cover at least 25% of the general benefit, which is $2,063,000, which is 70% of the total budget putting us well within the range that is needed for the special district.

It's hard to read, but here is the budget for this. Every item on here can be also found in the city's budget book for this year. This has all of the CIPs as well as the maintenance and repair costs needed for the parking pool. The only thing I want to, so you can see this SFE calculation based on 11,700 units. The one thing I want to bring up to this after these slides were produced and after the report was produced, the county which was voted on in number seven raised their collection fee from $1 to $2 per assessed parcel. So the amount on the incidental costs instead of being 27,000 will actually go up $24,000 to $51,641.

This doesn't change the SFE calculation. This doesn't change the estimated revenue, nothing on that changes. All it does is raise how much the city will have to contribute to meet that same budget. So tonight staff recommends that we adopt Resolution 6826 Parentheses 26 approving the engineer's report confirming the intention to levy the assessment and then sending the assessment to Santa Barbara County Auditor-Controller to add to the property tax rules for fiscal year 27.

So the zoning will change from PCD to R3 with a planned development overlay. So yeah, right here And these are the properties on East Ocean. And also, they'll go from PCD which is a commercial type designation to residential designation R3 with a per land development overlay.

So this is exempt from environmental pursuant to section 1506, 15061B3 for a review of exemption from California Environmental Quality Act. So the recommendation is to adopt resolution and ordinance amending the general plan land use map and the zoning map. And that concludes my presentation, thank you.

It's been 14 years since I've been back here. I'm Dr. Harris from Michael Harris Lompoc Veterinary Clinic. Totally don't think the zoning should change, I don't quite understand the traffic issues you're talking about because I deal with it every day. The police department and the fire department, the planning department everybody should be aware of what's going on there Nothing really changes.

I think I gave you guys a pretty concise letter, did you all read it? I don't think high density residential is a really good idea there. I didn't realize there was this bureaucratic trap that's occurred. Somehow that needs to be... That's your guys' problem and you need to fix it but that traffic right where I work It's pretty terrible, and I do not know what the police do.

My son is a policeman in Arizona and they enforce traffic. We don't seem to. I did not list every accident. Those were just three that I mentioned. Pretty incredible that nobody died. And we're talking about budgets. Do you have enough coverage in your insurance for a lawsuit because of a traffic incident, because of the policies that we have? I don't know. You guys know.

But a lot of bad things occur at that intersection. How that hospital got approved, I have no idea. But it was. Somehow people ignored the reality there And I mentioned in the letter that Crooked T Intersection was determined to be safe for the Cypress Court development. I disagree, I always have disagreed. I don't think that's true. We have a lot of pedestrian traffic, a lot of homeless people. We have tons of things happening there.

I'm surprised there have not been a lot of death there. Well, I know somebody died on the bridge several years ago but So anyway, I mean we can argue. I don't really want to argue. I don't see how high density residential is going to make things better or safer. That was zone commercial and if it's done properly, I don t think there would be a better situation when it comes to public safety but you have a different idea. I tend to disagree but I'd like to see the studies because I don' t see any studies I don't see any, but this bureaucratic trap seems to be what's driving this.

He's very compassionate and he's somebody that is a definite asset to our city. As far as housing goes These things are zoned commercial for a reason. Go down to Los Angeles and see what it looks like when you go into a town and you see two- and three-level housing, four blocks or miles at a time.

Coming into the city I would like to see commercial Coming into the city at that intersection where there's constant traffic during the morning, constant traffic during the evening. To add multiple houses there, multiple cars coming in and out is foolish. The state may have ideas about how much housing we're supposed to have but at the entrance where there's a high volume of traffic at the entrance to a town, I don't think that's appropriate to have high-density housing. I can't think of anywhere on Ocean Avenue where there is real high density housing.

There's a couple of fourplexes or maybe an eightplex over there on about L and Ocean or something like that. All of our other high-density projects are off of the main drag. I don't think there's any on H Street either, so I would like to support Dr. Harris and I would like to see that kept commercial. Logistically, I know my family has two cars. One car breaks down, you jump in the other car.

One car doesn't have gas, you use the car that has gas. High-density housing is going to be problematic just by the number of cars. The mayor spoke about McDonald's. There's going to come a time when people park their cars and go in and order their food, and come back out. I don't know why they're not doing it now. And times may change when people don't patronize fast food. But the idea that you can't get out of your car to buy your food is ridiculous.

Okay? That's the measure. And so what's been happening around California is there's activists that are the pro-housing activists in Sacramento. And they're going and they're looking at and examining sites, and then litigating the municipalities because the sites don't meet that standard. And then you have to add additional units. So it would serve that purpose effectively Now or in the future, to give you that additional number that you would need in the event that you were challenged on other sites. And it's unfortunate we're in that quagmire but that's what the state is stepping on our neck with right now and that's what we have to contend with. I'm a firm believer in private property rights and I'll always advocate for the preservation of property rights but I also understand there comes times when You just gotta give on things.

They don't care if you did it mission style or not, per se. So our goal here is to retain and maintain control within the city as much as we possibly can while at the same time making really difficult choices. Is that fair? Right? Is that kind of where we're at? And the state, correct me if I'm wrong, the state has a lot of leverage over us in this regard.

I'm here to discuss some changes to our council meetings brought about by Senate Bill 707. Senate Bill 707 signed into law on October 3rd 2025 and is a major update to the Ralph M Brown Act Government Code 54950 And what it's doing is modernizing transparency requirements, expanding public access, strengthening accessibility and community engagement. So basically what I'm here to outline are just some of the changes that are going to be coming about. This law goes into effect on July 1st of this year 2026.

So the first change is in order to open up our council meetings to the public even more, we're going to start using Microsoft Teams and two-way audio communication for the public to participate in meetings. In other words they do not have to be physically here. They can log on to a Teams meeting. It will not be visual it will be audio only They will be able to raise their hand via the Teams environment, and they will be called on in order that they came into the meeting in order that they raised their hand during any public comment. And we will allow them to speak for three minutes.

They will be cut off and then it'll go to the next participant. Basically the mics will be muted if it goes past the three minutes and I want to emphasize that the visual feed will not be available during the teams. We're just doing audio only. The law requires us to do one or the other, either audio communication or visual due to our system we're going to go with the audio component.

The second change is if for any reason the team's two-way communication is interrupted, for any reason, any technical reason, the council meeting stops at that point. IT has up to one hour to assess and fix any issues and try to resolve the situation. If after an hour we cannot resolve the situation, then basically it goes back to council. Council resumes the meeting. They take a vote on whether or not they're going to postpone or suspend the meeting for that evening If the council votes that the public interest in continuing the meeting outweighs the public interest in public access, they may continue the meeting without the two-way communication via Teams. But that has to be a vote by the council.

The other thing I wanted to give you an update on is the translation services, that's another component of this Senate bill. So currently what we have is we've got through a company and a vendor called MediaScribe we're actually offering There will be a QR code that the public, anybody attending or at home can scan the QR code. It brings up an application that will actually translate everything into English and Spanish. It will be text-based and audio so you can select either one.

And that will be provided for the entire council meeting. We're also offering closed captions, we've got closed captions that we are embedding in the YouTube video that we're going to be posting after meetings. We are working on right now getting both English and Spanish and hopefully we will be able to also do the audio in English and Spanish as two selectable channels on the YouTube video as well.

So basically, what was attached to the staff report is a policy basically outlining all of these changes and I'm asking for council to review that and accept it.

That happening At least from an internet service provider, should not happen because of that redundancy. Now if it's something physical here basically what's going to happen is the city clerk will notify me or my system administrator. If it's something local then we will have somebody come out here within that hour period to try and fix something physically maybe wrong with the PC or something else.

I have a microphone. Let me explain the reason for the mic above the dais. It is basically to pick up ambient sounds within the room whenever we are broadcasting This meeting, if there's any lull or any period that there is no sound whatsoever. That service can be disrupted and it would terminate the service. And I'm talking about the live broadcast. So the ambient mic above you does two things. It picks up ambient noise and basically keeps the signal live.

The other thing it does is used in basically the data processing behind the scenes to acclimate to the room, the sound that the dais is hearing. In other words, it uses sound from that, it uses sound from the mics and it does basically processing behind the scenes to make it to where the dais can hear things without there being reverb from the back of the room or any other loud interruptions to that. So the mic is not intended to pick up quote unquote conversations or anything from the dais and we have actually lowered the volume on the mic in order to not pick up conversations from the dais while maintaining the integrity of the pickup feed.

Yes, thank you for introducing this item. At the May 5th meeting the City Council reviewed requirements regarding current residential flagpoles and permitting requirements. We also heard community feedback and got some feedback from the council We were directed to prepare a new ordinance to resolve the permitting conflict as well as to review current applications for possible refunds if the recommended ordinance language would guide that, cause that to no longer be an applicable permit.

And then the specific goal from the council was to have this solution in place before the 4th of July holiday. The policy solution that we've brought for recommendation is this new definition within Title 15 of the Municipal Code, which is the Building and Safety Code. I'll go ahead and just read it for the record. Ornamental flagpole, a flagpole that is not a structure regulated by this title characterized by one or more of the following, a multi-piece sectional design, a telescoping design, or an installation in a nonpermanent ground sleeve Intended for easy removal, such pools are considered decorative landscape features and are not subject to building permit requirements. Here are a couple of pictorial examples. These as you can see on the left one it's a telescoping example where they bolt together and they can be taken down and then on the right side you can see they get installed in a ground sleeve so they're not actually installed in a permanent foundation So practical impact, we went ahead and reviewed the current records for flagpole permits.

We found one and coincidentally I saw it actually laying on the ground this morning at the corner of College and H, I believe is at the conserved gas station there. It was getting ready to be installed so it is a 50-foot flagpole in this case that has a full foundation and is considered a permanent design This is an example of a flagpole kit. The permit would not be required. And so the application that we have in the system currently, which is pending issuance, we would notify the applicant that a permit's no longer required. In that particular case, the fee was around $400 but it had not been issued or paid yet, so no refunds would need to be issued.

And so the recommendation before you this evening is to introduce this amendment to Title 15 of the Municipal Code, adding this definition.

Good evening Council. I'm here to present this coming back. This was requested to come back in February. Originally in 2022, council approved the intent to issue tax exempt financing for the project at the solid waste landfill for the rainwater diversion In March 2023, the loan amount increased from $5 million up to $7.1 million and we changed the source of the loan from the electric fund to the water fund In February 2026, we brought the tax exempt financing to council.

Councilor requested directed staff to come back with an internal loan proposal instead a recommendation for transferring 5.1 million of the loan paying that back to water and finding another source within the city to cover that portion of the loan. So we are proposing to do the loan from the insurance fund, which is Fund 871. The Council initially recommended or proposed funds 424 and 429, which are both in the impact fee section.

Those two funds combined have about $7.5 million so this would take about 2 thirds of those funds The insurance fund currently has over $26 million in cash, so we feel it's much more able to handle a loan of this size. We're proposing a 15-year term payback on the loan. Any shorter would be difficult for Solid Waste to manage the payments and any longer would be more difficult for the insurance fund.

We're proposing a 4% rate in accordance with our debt management policy, it's the average LAIF rate which is one of the city investment pools that we're involved in. It's the average return over the last 12 months. So we're recommending we adopt Resolution 682826 to transfer $5.1 million dollars of the loan obligation To the insurance fund from the Water Fund. Based on the payment schedule that was proposed in the lease-leaseback, solid waste payments were going to be about $695,000 roughly per year for the next 15 years Under this, at 4%, they're going to be up $635,000. So solid waste will be saving about $65,000 per year from this.

We will begin immediate payments of $60,000 directly from the solid waste to water on the remaining loan balance so We'd amortize that at 2%. It's kind of a moot, because it's going from one ratepayer pocket to the other. But I'd suggest 2% we can defend.

And that would keep it in the ratepayer's pocket. We would add $2 per month surcharge to solid waste bills. But that would go directly to the principal. And that would kill the balance in seven to eight years at about 20K a month. Well, that would be for the service, the insurance fund. There's a couple of these that go to I'm going to get pushback on cost of service and we've got to do notifications and I understand all that.

We'd increase the water rates immediately by 2%, and we'd move out on the cost of service study on the water rate, which has been frozen since 2017. This immediately solves the real short-term bind of needing a couple million dollars for next year. It generates approximately $8,700 per month in new cash flow to the water which essentially is 1.1 million a year and that covers you and then you'll have your rate study. And it saves $1.8 million in interest and that money stays right in the rate payers It retires alone in less than eight years rather than 15.

And it addresses the root cause. The root cause of this problem is not the loan, it is not the money that water gave to solid. That was a cool idea, would have been nice if we were servicing it but the real problem here is the water rates are not covering the capital and the operational expenses. That's just a fact that the numbers bear that out. Are putting alone together Makes us all feel good, but it's not solving the problem.

So I know that's catching everybody flat, but I think that would be a much better plan than just going out and borrowing $7 million or 5 million in reallocating to so

So what we're asking for, it's a little more complicated. So we've got our fuel budget is about 1.1 million for the year that has four different components to it. We have transit fuel, we have all the oils and greases, we've got a certain red dye diesel and then the main portion is all the diesel and regular for all the city vehicles The portion that is for all the city vehicles is up against what they have left. Overall, the fuel budget in the red basically but the amount allocated to the general fund vehicles has very little remaining so we're asking to increase that part of the budget by a hundred fifty thousand. It's possible that because the other portions of the fleet are under, that we won't have to allocate you know when we do the end-of-year true up it is possible that the net won't be $150,000.

But if it is, the allocation that was in the worksheet is the share that each department would have to pay.

There's an unresolved discrepancy between the operating entity's actual corporate structure and the executed management agreement. So, the agreement describes VLA as a non-profit public benefit. It's actually a mutual benefit corporation. It is a business corporation. So staff should confirm the entity's legal name, type and good standing. Make sure we have the contract with the right guys.

The reserve reported 968-289 year end position but there is no visible justification. We should have been given something about that. It's grown substantially since the assessment rate rose from 2 to 3% in 2020. That's where it's come from, and that's what the mayor was referencing. The management directive plan delegates the reserve policy to the VLI board. That's what I was saying. And we have no such policy on that so we should have a policy for them that defines why they have 968.

It's supposed to be used for marketing. But they funded zero against that budget line this year, so clearly that's not what's happening. So we need that policy as to how they're operating their reserves. And these deficiencies should be addressed in advance of the district renewal which is coming up in about a year and a half. And I would ask the staff to return with a renewal process timeline ahead of that so we know how and when renewals are going to occur. Because typically they take 12-18 months, and at that point I think we can address the issue you were trying to address which is why are they keeping so much money?

I'd also like to make sure that if the renewal fails or it's not renewed with them, we should have a policy as to what happens to that $980-some thousand. That should be in their policy as well. So none of those stand to not approve the report so I believe we have to approve the report but those all ought to be actions I think it's important that we include in this motion and get recorded that we want those.
