Report on action taken in closed session
Yes, thank you Mayor. The City Council met in closed session to discuss the four items on the agenda. On items number 1, 2 and 4 there was no reportable action taken. On item number 3 the council voted unanimously to authorize the city attorney's office to file a complaint in one litigation matter and the details of that complaint and the topic will become public when the complaint is filed. Thank you.
Thank you Mayor Mozik. Councilman, I so appreciate you. I keep hearing my prayers all the time and not because have bad behavior because you need leadership from the one up above, right? And then I would say first and foremost to all of Lompoc, and if I'm on... I gotta stand back. That thing has really got a little echo to it. I wanna say to the city of Lompoc and everyone that's listening, and especially for you those that are here, I am so grateful to be able to, and it's an honor for me to pray for you I don't just do this because they pay me. As you do know, I do this because I want to do this. I haven't asked for any compensation yet but I might need to talk to Dean about that.
But no, I really do enjoy coming here praying for you, praying for our city. I wanna say a special thanks to Kevin Martin, Chip, our law enforcement. I really do appreciate it. Every time when I hear the emergency sirens, it could either be fire department chief, Chief Shea. I appreciate you. Appreciate your engineers, your officers. I wave. They probably say who's that crazy man?
Sometimes I try to do things so I can get pulled over by Lompoc police so that I could just say hi but I guess they already know my license plate. I want to say thank you Before I do this invocation, I want to tell you something about God's love. And it's part of my prayer because we can hardly go anywhere without it. We know that it says that without the Lord, the builders they build in vain.
Without the Lord, the sentinels, the people who watch our city, the people who run to our aid Whether it's a house on fire, an accident, someone locked in a car because of an accident. Jaws of life had to open it up. And sometimes we don't have that expression of appreciation for the city, for the people who work here. You guys come here every Tuesday, you sit and listen, take notes, got to answer.
You've been working all day and then you come here and And I want to say thank you. I want to let you know that I appreciate it. And so when I come to pray, it's personal. So as I get ready to do this vindication, think about this word love. The Greek gives us three kinds of love, eros, phileo and agape. OK? Eros is like when you're romantic. That's a romantic love.
Phileo is friendship. when we're friends. How many of you know we should be friends in here? Raise your hand, even if you don't want to just show your hands anyway. All right. But agape! Now that's the God kind of love. That love is the greatest love that we all get to partake when we come together here and we're trying to figure out things how to make the city work and then we turn it all over to God. That's why I'm glad that this platform For the person that does the invocation, I'm glad that it's here.
I hardly ever preach to you know that but I sense in my heart today that I need to let you know that for me this is a sincere moment. So father as we consider your love It is such a mystery that you would even want to continue to partake with us because sometimes we can be messy. And yet, you decided to jump in our messiness and try to help us sort out life and You give us leaders! I pray for the leaders Lord to have that insight, that revelatory insight on how to make this a better city And that you would bless our leaders that are in the fire department and the police department, Chief Shea, Chief Martin.
Our engineers, our captain, our watch commanders. Lord we all give it up to you and we ask that you would help us to be a better people because that's what love does. Love does not hold anyone accountable for their failures. He just says, I'm going to just love you more. The God kind of love says, I care for you even if you don't care for me and trust me, I know what that's about.
The God kind of love says, I am for you even to the very ends of the earth, I am with you. It doesn't force itself on us. You don't do that. You could withhold the rain You could cause earthquakes. You could cause the lights to go out, the water to stop flowing. You can stop the rain. You can say because they don't acknowledge me I'll just stop giving them water but you're not that way.
You give us rain, you give us water, you give us food and you take care of And so for this moment, I want to express an appreciation of thank you. So you can say that quietly to yourself. Thank you Lord. Help us tonight as we get through the business of our city. Lord, we give You thanks for everything even when we don't deserve it. I know I don't. I just misbehaved yesterday. I'm still asking God for forgiveness of my misbehavior. I dare not tell you what it was, just to let you know pastors are not perfect.
But I am asking God to forgive me for my misbehavior. So if you've been misbehaving even today, you can ask for forgiveness. So Lord in all these things we do thank You in Your precious name. Amen.

Presentation is presented elsewhere. October 16th, proclamations honoring the City of Lompoc Chamber of Commerce and Business Bureau Man and Woman of the Year were presented at the Takeda Weas Community Center. I'll bring this up to the City Manager's report. Thank you Mayor.
I want to invite everybody to participate in this year's National Make a Difference Day, Saturday the 24th. It's an opportunity to get out and give back to the community. Volunteers will be meeting here at City Hall at 9am on Saturday. They'll also have lunch at noon and encourage people to come out I also want to let everybody know that we are going to be doing the Dunkin' for Pumpkins event this Sunday.
The beloved community tradition transforms the Aquatic Center activity pool into a floating pumpkin patch. Participants can swim and pick up pumpkins, it starts at 330. They can go out and decorate them on the patio from 430-530. General admission is required It's $10 for general admission, children two through seven is 550. Back up, I'm sorry it's $ 10 for pumpkin and it's $6 for general admission, 550 for two through 17 and $2 for kids under 2 and seniors $5. I want to remind everybody that we'll be having the Christmas party Friday December 4th at 6 p.m., and registration for that is due November 16th.
I also wanted to let everybody know with El Nino coming that we have sandbags available at Station 51 on G Street and you can load it up yourself, you just drive through and there will be sandbags and shovels and everything there for ya. I don't know if you noticed, Chaplain Ron, thank you Chaplain Ron for the kind words that you always give us. I appreciate you. I don't know if you notice the microphone is very strong. We replaced it. You don't need to touch it so if anybody goes up and does a public comment just you don't need to go right down on it. It's very powerful. So I want to thank everybody for showing up for the employees luncheon.
We do it every other year and we had a great turnout and I was really proud of everybody And I want to thank the Employees Development Association for that lunch they put together and everybody that went. Also remind everybody that November 3rd we'll be skipping our meeting for the election, and we'll resume on Tuesday, November 17th. I also wanted to let everybody know about a company called Sparks Energy that's going around door-to-door Trying to give natural gas services.
I just wanted to let everybody know this is not affiliated to the city Make sure that you verify who you're talking to be careful to review those agreements it's a third party that will provide gas, but all the services will still be done by SoCal Gas and I don't know if our attorney wanted to pine in on some
Yeah, just to add to that I'm going to be taking a look at the city's franchise agreement with SoCal Gas just to make sure if there is any potential violations of that from this Sparks business that seems to be soliciting business in town. Additionally, I had some announcements or items to state about the consent calendar if I can go ahead and do that right now?
Please. Well first of all, item number eight on tonight's agenda is not the consent calendar but I just wanted to let the public know
Agenda Discussionitems moved / continued / pulled, click to expand
and let the council know that I will be requesting that we continue item number eight to the next City Council meeting on November 17th due to some...I need to finish up some work on organizing the discussion with regard to conflicts of interest on that item. And then on the
consent calendar, item number two is the city's check register. At least one of the checks from the city for approval on that item is from the City to the Lompoc Valley Chamber of Commerce. Lompoc Valley Chamber of Commerce is a source of income to Councilmember Starbuck, and he will therefore be recusing himself from that item. Since it's on the consent calendar, he can still stay in the room and he can vote.
And then on Item Number 5, our Management Services Director Bob Cross had an announcement on Item Number 5.
Thank you, City Attorney. After consulting with the city manager on this item The additional funds of $479,164 are going to be split evenly between Funds 424 which is the government building fund and 484 which is library impact fees. So thank you.
0:13 – 0:1913 turns
Back to the City Manager, several people contacted me about the Spark Energy. Do they have a business license to be operating in town?
We couldn't find it with the sparks name But we're gonna do some research on that and I was gonna say once Jeff's done with his research on the franchise agreement I will bring it back if there's more information that needs to be provided to the council note the community
Maybe you can put it up with the PIO. I know
Yeah, we could do
that
too.
The gentleman one of the people contacted me said they were very aggressive and It appears prop potentially promising things That they can't but I don't know there's It's interesting what's going on. If they're not acting appropriately, I think we need to open people's eyes and maybe help them do it the right way if there is the right way. Yeah, we will. OK. Something else for you as it's getting later, darker earlier, people are concerned about the lighting at the parking lots that we have on I Street I drove around there the other night and noticed two of the lights are out in the lot.
There's one out in the center on the south side of the old chamber building, and there's one on J Street on the north side. Maybe some bushes can be trimmed up to get some more light in that. Time change is coming soon.
Yeah we could look into those.
Okay. Did anybody else have anything else to say? I know I had one other thing, but I'll remember when it comes along. Was there one other thing? I don't know. All right. Very good. So we'll open up to public comment on consent calendar. These are on consent calendar items. Consent calendar item. We have approval of minutes, a Lompoc Council meeting and special meeting of June 23rd, 2026 and regular meeting of July 7th, 2026 and July 21st, 2026. Approval ratification of expenditures of payroll September 25th, 2026 at $3 million. A voucher from September 14th through 18th, 2026 at 1.367 million. Another voucher registered from September 21 to the 25 of 624,957.
Number three is adoption of resolution number 6852 to implement a state-mandated minimum wage increase effective January 1st, 2027 approved supplemental appropriations for the increase. Number four is adoption of resolution Approving an authorizing resolution for application statewide park development and committee revitalization program grant funds prop 4 round 5 for renovation of Johns Manville Park and Ryan Park And number five is award the library a For HVAC replacement project RFP number 3077 to JR Bardo heating amount of 591,182 adopters of resolution number 6855 parentheses 26 authorizing supplemental appropriations. If you have any questions want to pull any of those items?
I had a couple quick questions could be answered on item number five Are the units being replaced? Do they have air conditioning in any of those five units? There's three on the roof, two in the basement. Is there AC on any of those? No AC on them. Okay so we're also doing an upgrade then it's not just replacement correct? Last week AC would have been nice right?
Yes, that is correct. We have not had air in the buildings or ventilation. The units currently there are over 25 years old.
Well I noticed the one you had a picture of was 2012 so it wasn't quite that old. The Resner up on the roof? I remember a couple 10-12 years ago when they did that but the ones in the basement are quite a bit older aren't they? Correct. Okay. Are you getting AC out of the basement or all three on the roof for AC?
It's four throughout the building, so I'm not entirely sure though.
OK. So another question with that, I noticed in here which it's not always customary that we do this but you have the $75,000 contingency in here to be approved currently at that. It seems kind of like we're anticipating and already go to the next level? You say the bid was for 591, but you're wanting to add the 75,000 on there currently at this time.
0:19 – 0:2923 turns
Yeah, because this is a time-sensitive project the grant expires in December. We just in the interest of time we'd like to have it all approved now if possible. Hopefully we won't have to use the contingency but we know it'll be if it's there if we need it that would help expedite the completion of the project.
I just noticed that when we generally put a contingency that a contractor has a tendency to make sure he uses it so I've just Make sure you give me the time sensitivity so I won't pull it off on that one or make the request to pull it off. Thank you, Mr. Cross. So I had one other question here on item number four and this is the authorization resolution for statewide Park development grants, you didn't have a dollar amount on there. Is there a dollar amount that you're looking for or what's the deal?
Then the grant is eligible up to $8.5 million is the cap so once we finish our meetings with the community and figure out what the scope of the project is it could be anywhere from 200,000 to 8.5 million per
park. Is there a reason why we're applying so early for it then?
The deadline for the grant is December 17th, so we have to have the resolution to be able to apply for the grant.
And at what time will you know the dollar amount that you're making the request for the grant?
That's why you're having your public meeting so you can figure out what you want to do? Correct? Yeah, we want to see what the public wants and seeing what can afford in that grand amount. So some people wanted the gopher wire but that might not be possible because that might push us up past 8.5 so we got to see what's possible and keep it under 8. 5 including the contingency money.
So you're trying to get a couple more meetings on this correct?
Yes.
And it's 8.5 for both parks or just one park? Per park.
Per application.
So you're doing two parks, one application?
No, one application for each park.
Okay. Yeah. Alright. So great opportunities. We need to get more people to come to those meetings and tell us what they need right?
Yes, sir. And then please check the social media and our website. We will have updates to those meetings.
I've been at two of them, and I think we've had 10 to 15 people at the event. You had free candy last time too so maybe we'll get more people there. Anybody else see any other questions?
Mayor. Yes? I just wanted to remind you to check the phone and Zoom for a public comment.
Public comment.
There is no public comment via phones or Teams.
Okay, anybody want to comment on this going once twice we're looking for a motion to approve with the modifications right of the funding source correct that was only thing
What's your motion, Council Member Bull? I'll make a motion to accept consent calendar with all the modifications mentioned. And seconded by Bridges. Go ahead and vote.
See it changes pretty colors. There you go. All right. Hope your AC works as well as the one in here. Okay, what have we got? Staff presentations. Announcements. Finance department staff provide a presentation on recent revised calculation of city Lompoc wastewater rates. Come on down Mr.
I was asked to bring back a review of the wastewater discussion that had been approved earlier this fall. It went into place in September. So just to recap a little bit, prior to 2022 usage was based on average usage during January, February and March of the last six years dropping the high and low year. In 2022 it's changed to a four-year average And we implemented a cap for the change until we could bring back a revision to the process. So, we were capping it at four units for residentials and ten units for commercial.
Then in 2026, the usage calculation changed to one year average and removed the cap that had been added in 2020-2022. Customers are now billed consistently based on their actual usage from prior winter. This goes along with utility billing principles of treating customers consistently, billing for electric water that is actually used Under most circumstances, we can't really make exceptions on one-off because once we do it for one, we have to make exceptions for all customers. So again, the main goal for Utility Billing is to treat customers consistently and whenever possible. So I want to go through some of the numbers that we've implemented it So based on, this is based on number of units. We had 1% who decreased more than five units. We had 19% decrease from one to five units which saves them about between nine and $46 a month.
40% of customers didn't change their bill from August to September essentially. 19% increased one to two units That would be an increase of $9 to $18 a month. And then 13% increased from three to five units per month, and 8% increased more than five units per month. So that's as of the original calculations. Now, of those, 891 customers whose usage increased They were at seven units previously. This is important because seven units is the base for a new customer. Whenever a new customer starts, they're put at seven units until they establish a winter average. So 11% of the customers were at seven units and then increased.
Some of them likely were new customers who once they established their actual winter usage They were increased to what their appropriate amount would have been. We had another 1,156 customers who are at the minimum five units. So they were at the minimum and then they recognized higher water usage so it was increased. A lot of those customers who were at seven also If they increased up to 15 or 20, I mean that's they would have only gone up four units at a time so under the prior system. So they wouldn't be paying 11 but other customers who are using 20 are paying 20. So that's the consistency we're trying to recognize. Everyone who is using 20 in the winter months is paying the same amount.
That was one of the issues with using the cap permanently. So since we implemented in September, staff has sent out about 50 letters to customers who experienced increases to determine if they had a water leak and we've already recalculated usage for 28 customers. We're continuing to look out for customers who experienced high increases determined if it was a leak We can look into it and we are adjusting based on leaks. We can estimate what their actual water usage should have been, and we are making those adjustments. We're encouraging customers to contact Utility Billing or Conservation to start that process but we're also sending out letters and trying to contact customers when the data shows that something happened there that was unexpected.
So again, the Wastewater Cost Service Study was presented in 2025. It's in the process of being updated. We expect it to be presented early 2027, March or April hopefully and this study will use the current calculation method and usage to determine whether rates need to be adjusted having this more precise method of billing, more precise method of determining revenues We'll go a long ways to determine whether we need to do any type of increase or decrease, or keep rates the same.
So that's what I prepared and I'm available if you have any questions.
0:29 – 0:3622 turns
One of the things I noticed is that the people who contacted me concerned it as Depending on the climate and the weather, if somebody happens to be irrigating their yard then it increases their water usage during that time frame. In many cases as they state 20-30% of the value of your property is your landscaping and when we have wet years people aren't. You're correct, your assumption is correct January, February, March you might not be irrigated but some years people go and start a little early either garden or otherwise And since we're not supposed to be charging more than cost of service, your equation you try to make it fit and for the most part it does.
In most part people remember January, February, March not irrigate when you had the multiple year averaging if somebody forgot one year he was averaged over 24 months now you're averaging over three months and leaks are affected as well as It affects the equation when you reduce down to just three of the measurements. And I don't know if there's an ability or a way to say, somebody, I want to do December, January and February. I don' t want to do March.
I'm going to do these other months because I'm going to grow my garden in March. Again, you guys want to make it easier and simpler but it's complicating And to be able to calculate the equation, likewise we don't want to undercharge them because they're being subsidized by others. But when you're overcharging them, you're not charging cost of service. I know staff has worked with them as far as the leaks and such go but if you could answer what people would do if they wanted to keep their lawn green in March and we didn't have rain?
Well, if they water a little bit it's not going to make a big impact. We do remind staff or staff we do write our December bills every year Thank you
Somebody choose maybe the months they wanted to, what three months. Like I said if somebody decided that you know December, I water a lot less in December than I do March especially when we get an early spring but anyway I'll let some of the people comment and then I am going to bring it up. We don't have public comment written down here but I'm gonna move towards that to let public comment on that but let's see what other people have to say.
So when did this go into effect?
The one-year average went into effect September 1st.
September 1, and so we used last year's for the basis.
Correct.
And we want to be consistent. I understand your consistency. If we offered to everyone the ability to not have their rates go up more than X units each year, would that be consistent?
What you would end up with is some customers using water but paying less, well using the same amount as other customers but paying less essentially.
But we'd offer it to everyone so it would be consistent correct?
You could but customers who are already at that level and aren't going up they would still be paying more.
That was true before as well right?
Yeah. Yes, the average and that's what we had would have customers who are at the seven they start out using 30 and they go up to 11 and then actually go up to 15 and there it takes a long time before they get up to where they're actually So I
can see where it's more accurate. But I have a lot of sympathy here for someone whose bill jumped a significant amount of money, what is the on your pie chart? That greater than five, I know it's 8% of the people. I don't know how many people that is but what does that mean in dollars and cents? Greater than five?
So five units would be $46. Some of them were higher than that but a lot of those are the ones we've reached out to so we're in the process of adjusting.
So when it could be $100?
There were none that were that high.
OK,
so what was the highest? The highest was about 30 in general and those were 100.
How can greater than 5 be 46 and the highest one be 30?
I'm sorry, five units is $46. There were increases in 30 units. People who were billed at 7, They're increased to 37 to 40 units. So that means they're paying, you know, at $9 a unit, they're paying like 300 dollars.
You've got to repeat that. That was too quick. Let me tell what I just heard you say. Was somebody got a bill out there that went up $300? Yes.
0:36 – 0:425 turns
Again, they were at the base.
I don't feel comfortable with that to start with, and I feel like the pitch we had was that this was not going to be a significant pain point for a bunch of people. So yeah, I think at the end of this, we need to come up with some alternative approach that doesn't... That's enough money to break somebody. And I'm not interested in breaking somebody because The economy is a scale, I understand it's cheaper for the city. Understand the billing process is better.
I even think it's better averaging because you get immediate results if you try to save water but... I also gotta say man having somebody's bill go up 300 bucks we need to address that somehow in my one opinion up here.
Anybody else? public comment on this. This is on the presentation matter.
One of the fundamental issues that has come up is when people were watering in January, February and March they were under the old billing guidelines that only allowed a 4% increase. So if they were using 7 units January, February and March they knew their cap was at 11%. When this got passed after the fact in retroactive that cap went away so what they were told was you're capped at 4% of your usage so January, February and March that's what they knew when they did that. So they had a predictable billing increase so if they used a lot of water January, February and March they knew their bill would only go up to four units or $27 or whatever it came out to.
It was never intended, the way that it was pitched to us as well, to raise rates $300. I think the fundamental solution to this is to cap this year's increase to the 4% that people were expecting when they used water January, February and March and then maybe in the future there's a warning that goes out that there is no cap but for this year what people knew and what they expected was that there was a 4% cap on their usage for billing. Thank you.
Good evening, Mayor and City Council members. My name is Deborah Jewell and I own and reside at 412 North D Street in Lompoc. Effective September 2026 my sewer bill increased from $46.40 to $167.04 a 360% increase! A friend of mine that owns and lives on Cagney Way her sewer bill increased from 46.40 to 296 dollars And 96 cents, a 640% increase. At the last city council meeting on 10-626 I requested that this be put on the agenda which it was thank you very much. I requested that we got some figures which we did get some thank you for that but we still don't have the independent in depth financial impact study that has not been completed.
I reviewed the notice of public hearing to consider the adjustments calculation method for wastewater charges, and nowhere on this notice does it tell or explain that 40% of customers will see an increase in how much of one. So how could a customer know whether to attend the public hearing and or protest it when they were not informed of a potential increase?
I reviewed the wastewater winter averaging calculation dated 7-21-26, page 3 of 5 paragraph 2, resolution number 5863.13. Put in place a cap so that residential customer units billed could not increase by more than four units per month. Those caps are not able to be implemented in MUNIS software and therefore staff recommends removing the caps which they did.
Comment. So what can MUNIS software do? It can't average customer water usage for four years, and it can't apply caps. So Lompoc customers have to suffer and be gouged because the Munis software that the city purchased is unable to do basic math of averaging and apply a cap. I have another friend that owns and lives on Somerset Place. She is just too busy working as a full-time teacher and caring for her elderly father to print out her bills or come to the City Council meeting. Her bill went from $350 to $512 per month, the sewer amount being $157. And what I'm seeing is that customers who have irrigation sprinklers or a leak during only three months that you are averaging, are being gouged when the water is going into the ground and not to the wastewater plant.
I'm sure that all customers and residents are counting on you all to take the necessary steps to make sure we're being charged accordingly and fairly. FYI, I did not get a letter and neither did any of my friends that had these increases. And why didn't we get an estimate to reprogram Eunice to benefit the residents and the customers rather than just making it easier for the city to have to not
0:42 – 0:4715 turns
do it
manually? My name is Steve Kelly and I live on the north side of town. And my bill went from $55 a month for waste, wastewater. And this time I got it $120 that's $65 more than I was paying. That's 120%. I just don't understand why we weren't informed was going to occur until I got my bill. And when the bill stated we recalculated, we recalculated what? There must have been a percentage you charge per unit.
So I did my own calculation and the original one at $55 came out to 4.37 dollars per unit Now I'm paying an extra $4.91 and it's up to, let me see what everything, used to be $148 is up to oh my god, $315 so that's $9.28 per unit, when I used to pay $4.37 per unit. And the explanation was just, I recalculated it or you recalculated it? But no one said it was going to increase by a certain amount and that would be, excuse me, $4 and 91 cents per unit.
That's the highest entity on my bill $120 is higher than the electric. And it's just, there's no explanation as to other than we recalculated. It didn't say we increased the price of the unit and that's one of the things that really bothered me so pretty much that's all I have to say but thank you
Hello. Karen Hauenstein, lifelong resident. It seems like this is accounting mistakes that have been made and regardless of why they were made by software or by people it is the responsibility of our city manager Dean Albro to prevent these types of mistakes obviously he has not Maybe because he doesn't attend any of the commission meetings, maybe he's just not up on what's going on in our city when it's his job.
That's what he gets paid for. Thank you.
Anybody else? Anybody on teams or phones?
There is no public comment via teams or phones.
Okay, we'll go ahead and close public comment bringing it back. So a couple questions Mr. Cross The unit costs the one gentleman was mentioning is that We didn't raise unit costs. Was there
It was always $9.28, it's been that since 2017. Is
there
a miscalculation on the bill or
something?
There was likely a lower number of units on the original bill and when the units increased that's the increase you saw but I believe if he took his original Bill divided by $9.28, he would have his actual winter average that we were using before I suspect.
We don't have anything... What level of action would we be able to take on this?
You can request that staff come back with a future agenda item to consider whatever you'd like to consider in the future agenda. Whatever actions you'd like to take in the
future. Is there any other questions for Mr. Cronus?
Council Member Bull? I don't have any questions, I agree that this should come back sooner than later so we can address this and see what we can do. It's frustrating because I've been here long enough to know that Munis was supposed to be a net positive in many ways and I'm sure it is but some of these impacts are staggering.
0:47 – 0:5529 turns
Is it true that munis doesn't have the capability of the cap or 4%?
It's just, that's how...
You know we've been given that excuse before that the computer or the software is not compatible with everything that we wanted to do. We should be able to do whatever we want you know? Don't you agree?
In the past we had a product we could program this is not one we can program.
Is that something immunists could come in and redo it and add that capability?
They would charge for it. Well
of course, of course they're going to charge for it but can't we do that and ask them to come back? We
could ask.
Put another category or what would they charge to come back and whatever you
know? I don't know. We've never requested special programs before.
But I think we should do something like that because the answer is pretty clear that they don't have a cap anymore so I don'y know why the questions are even being...we're sitting here like we don't know the questions to ask but if the capability for the software can be We've never asked for any special programming before, but
I don't think it's a quick fix for them. They would basically, I don't know. I don't know for sure.
So if we did this and you guys would have to do a manual entry so we could actually change the policy to say we want it done they would have to put the cap in manually for every customer correct? Is that what you're saying?
We would have to look at those customers who increased or decreased by more than that and change those manually but
I think that's what we need to do, one or the other. Either get that thing changed where we have a cap or ask for the software company to come in Munis and have it adjusted so that we can actually have it changed to benefit the customers versus another meeting just to ask more questions. I think we can actually give a little bit of direction. Thank you Bob.
Well I want to start with, I don't think you guys made a mistake in the math or anything like that. And I think from here I'm probably as much at fault as anything in that I did not recognize when I approved that I eliminated the cap or when I was one of the folks that eliminated it so that's probably an error on my side. How were you doing it before? How were you doing the cap before?
We were calculating manually and entering the data into the 10,000 to 15,000 accounts.
So you ran out all the bills and did analysis and...
We ran reports, exported in Excel and then had a lot of complicated formulas to determine what the new amount should be.
Okay. Well, I think I agree with Councilman Vega that we need to go back and do it manually if we can't do the software. I do think we have some tools now available where you could automate some of that through a simple Python routine, have the builds pumped out in Excel running routine and you'd still have to manually correct it, but I think that we'd have to ask the lawyer when you know if the council decides this is coming back say whether that would be consistent or not. But I feel like we can justify if we're doing it for everybody that we're not increasing more than a given percent.
And maybe we start, we do a sliding scale until it goes away you know? It's a 4% the first year, it's 10 the next 25 and then that cap goes away some kind of
scale that gets us to a
solution. And just to clarify,
it's four units not... Oh whatever the... Because the four units can be in 20 or 30 percent. Okay. But still just to clarify.
Whatever metric you come back with, you could in my opinion put a sliding scale that over four years which was our normal averaging before. It's washed out and you've solved the problem but nobody gets this shock so I don't know if it's appropriate for me to make a motion or make a movement, but I'd like to see it come back and address those issues. Come back with a recommended cap that passes legal mustard and see if we can get through this and find some relief.
I think as you guys bring back information on what our choices are or something, I'm sure the last thing
you want to hear is from the accounting department. From the accounting department is manual entry, right? You're looking for ways to make it a little bit more seamless. So come back and be honest with us about okay this is the work that we'll take. We do it manually. This is the impact and if things need to be restructured so that you have a team that's willing to accomplish that we need to know that as well.
Again, it's not a state mandate. It's not a county mandate. It's like we have a software mandate to do it a certain way but it's impacting real people so know what our options are even if it's the hard way let us know what it takes. Thank you.
Do you have your council requests? No, no, you got it and then you're piggybacking on that and then Cesar Vega? Yeah
I just want us to take an action item. We bring it back. We've got the fix We don't need to have another discussion, but I would like Bob to bring back the information that would make it the easiest for them to implement it so that we have an averaging that affects all the people here in the shortest amount of time instead of having another discussion and another discussion. It can be fixed. It's going to take a little bit of a manual entry. It needs a little bit of an averaging capability there. And then plus you said it can be fixed by Excel or whatever. You're the expert, Bob. So maybe you could tell us exactly how we can do this to fix it for now? And then if Muniz can come back and add that capability to the software. But anyway, Jim, that's exactly what I was going to say.
Okay? We're on the same page.
You currently have some history now you've seen what happened. Give us some of that data and for the city attorney do you need more direction or is that enough direction?
0:55 – 1:0033 turns
I don't need more direction to do a legal analysis of any of those options.
Do you need more direction with what we're asking Mr. Cross? Do we have like a
hardship form that people can put in? Public assistance for electric.
Can we implement one of those for water and put some criteria so that people are really getting hurt here? We don't hurt them?
Yeah, I don't. The electrics funded through the public's benefits that is paid by electric tax. We don' t have a revenue source to use to fund that hardship.
Funding the hardship being we don't charge them?
Well, we offsetting their bill right now.
And that has to be funded?
It does get paid for. So the 2.85% they charge your electric public benefit account, we pay about $16,000 last year into electric rebates or electric benefit to people who are needing it at 16 bucks a month I think it is on that
one. 18.
18? So we don't have that. You'd have to implement a charge on the water Okay, I'm a dummy here but what we're saying is we were collecting all this money and it was sufficient at least through our latest
rate
study
And now something's happened that we instituted, and now we're collecting a bunch of more money. And somehow I have to fund it not doing that? That's what you're saying to me. I know that's a naive way to think about it but that's what I'm hearing.
Remember in this a number of people's bills went down. And they actually do have a rate study on this to calculate a potential rate increase. They've been known since 2017, correct? So we haven't raised wastewater rates since 2000. They were going to do it last year. We found they had enough money in the account to cover the capital projects that they didn't. You have a rate study coming forward? March or April hopefully. March or April currently
right now. Okay so are you saying... I just want to make sure I hear this correctly. After this change was made.
Council Member Bridge, you really need to be on your microphone.
After this change was made... You know the month before it was made you were making X number of dollars in the sewer system that money was coming in now if I go look at it the following month after this change was made based on what I just heard we're making less money now
No, the revenue increased some.
Okay so we do have more
revenue
and if we wanted to do a hardship and give some of that money you know decrement the bills
it
would still come out ahead but I got to fund it.
If we're going to a cap I don't believe our revenue will be increasing.
Well we're not talking about that caps gonna be a month from now I'm talking about people who just got 300 bucks or 500 bucks on their bill You've made more money and you're telling me if we wanted to do a hardship, you know, a three-month hardship to get the people over it when we get the system done that they could come in and do it. That we would not be able to afford it? I'd have to pay for that even though we're making more money.
No, we would probably adjust the bills to how they would have been.
So there's no extra money here then?
The people whose increase were more than four, we would probably adjust them back to what they... I don't know. We have to...we will address that when we come back but I think we will be...
Well is it coming back on November 18th then or whatever our next date is? You know, we're slow and we say we're going to bring something back in six months from now it comes back. But in the meantime these guys are paying so is there something we can do quickly that helps the people that are in pain? They've got to fill out paperwork they gotta bring it in and prove it but isn't there something we can do?
And it's probably not fair to address that to you. It's probably more fair to address that to Dean or
Jeff, I'm
not sure
but... I don't know without it coming back. We'll bring something back probably the next meeting, November meeting we'll bring something back. But I think that's the best way to handle it.
1:00 – 1:0513 turns
Yeah, Bob. I think the clarity for that would be a hardship if someone came in and they disputed their bill. I guess that'd be more clear to see what you guys can do for someone who says, hey, I can't pay it. There's been a spike here or whatever. From my standpoint, that would be nice to know what the policy would be if somebody had a legitimate complaint saying, hey, guess what? It spiked during this policy. How could you work with them so that they won't have to fill out an application or something till we get this resolved? I guess that would be more of the path that I would be thinking of, you know.
Is that something we can do or maybe a policy that you guys can implement to say hey how will we handle this when someone has a 380% spike and they say they can't pay it?
And that's going to be addressed when we bring it back on the
Senate. OK, because I want to make sure they're not going to get their utilities turned off or because they didn't fill out an application or didn't make a payment program maybe you guys can have some sort of a policy that said hey, can't afford it, we'll ramp the bill back till we sort all this out and then give them some sort of a schedule, you know?
Yeah, we can look at that.
Thank you.
Councilor Buol.
Yeah, just a quick statement. We've heard from people that have been hit with this. Unless you guys did, I haven't received any calls. No one's reached out to me to say hey my bill was cut in half or I got 60% off thank you so I'm curious like have we substantially cut bills for a lot of people? Or is it nominal? I
mean it was like 20 percent of peoples' bills went down by up to 40-50 dollars And a 40% didn't change.
Well, it'll be interesting to see what you bring back.
I think it's also important to note too that the waste water enterprise is the largest consumer of electricity in the city. I imagine it still is correct? Like 8-10% of total power consumption and with the increase of electric rates going up previous counts of 50-60%. It's a significant increase in the bill at the wastewater plant, which is one of the reasons why it's triggering a wastewater study to find out what's got... I think the revenues over expenses currently right now are...
We're waiting to see what this change did. But we're looking at a potential rate increase right now because you have $10 or $12 million worth of projects lining up at the wastewater plant right now. The public needs to understand it's a $105 million sewer plant that was built. It was very expensive but when is the bond up on that? A couple of years,
right?
Coming close to being up which would be a big savings for the community as well so when that rate study goes make sure that our partners are getting the Vandenberg Air Force Base and Vandenberg Village are paying Thank you Mr. Mayor.
Moving forward in a quicker fashion would be more beneficial to the public, so I appreciate that statement. One of the things I'd like to see from council is us taking the short road instead of the long road to making a decision when it comes out of senior citizens possibly fixed income people here that cannot pay this kind of money they just don't have that kind of extra income and the fact that we made a statement there about rates studies and they're going up I've never seen a rate study where it goes down, okay? So that's just a statement. All these people here know when they have a rate study or they have a fee study and you guys tell me when the last time it went down.
It's always going to go up so we have to control it regardless of the economy, regardless of the bond issue for the solid waste plant. We're here to minimize the effect on you guys because we have a large senior citizen population here. So we have to make sure that we're not just wasting money and sending it somewhere. One of my issues with money is when we give a rate increase or we give a tax increase, we never ask where it goes, where it's going to be expended so that we can explain to you where it's going to be spent so you can feel a little bit better about the outcome. So thank you so much. I just wanted to say that all these fee studies, all these rates studies, they're always going up. So that's not a new state. We all know things go up.
The people that are here are trying to control their expenses on a monthly basis and not get spiked. So thank you.
1:05 – 1:124 turns
I just wanted to finish with, again, I think what you've done here is in the interest of the city as a whole. You found a way to streamline the process. It's an accurate system. We just need to protect shocking... It was 8% of the people so it's maybe only 4% of them that really got hit and couldn't afford it but we need to protect those people in our community as well But I don't want to come across that, I don't disagree. We're going to have a rate study. Cost of service is going to be the cost of service and you guys are doing the best you can about that to manage it.
I just really am concerned about that other piece.
Anybody else? Very good. Thank you Mr. Gross. All right, this brings us to Oral Communications. General Oral Communications, three minutes.
In 1919 political machines were described as an organization that selected candidates for office conducted their campaigns and created a brotherhood of leaders that became a powerful oligarchy. That was written over 100 years ago but political machines never disappeared, they just changed. Today the machine can be money, it can be political parties, it can be algorithms, it can be connections and sometimes it can simply be people in power protecting other people in power.
And I'm tired of watching power protect power. Democrats protecting Democrats is wrong. Republicans protecting Republicans is wrong. Friends protecting friends simply because they're friends is wrong. Accountability should not depend on what political team somebody belongs to, how much money they have or who they know. Over the past several months I have interviewed candidates, attended these meetings, asked difficult questions and spoken about issues where I have agreed and disagreed with people on both sides.
Sometimes holding accountability means criticizing people who you respect Sometimes it means standing alone, and that's part of public service. I don't do this because I have something against one person, one party or one group. I do it because government belongs to the people. We should be able to disagree with someone we supported. We should be able to criticize someone who we voted for. And elected officials should hold their own allies to the same standards they hold their opponents.
Whether we're talking about ICE, housing, public safety, government or anything else, we should always ask three questions. Who benefits? Who gets heard and who gets caught in the machine's ears? Because Lompoc cannot become a city where connections matter more than accountability or where the people with the most influence are the only ones whose voices matter.
This cannot become a government of the ring for the ring with the people's money. This government does not belong to the most powerful people in Lompoc, it does not belong to a political party, it does not belong to a political machine. It belongs to us. Thank you.
Good evening. I couldn't agree with that more. Wrong is wrong, right is right, accountability applies to everyone. If you weren't aware we have a very important election coming up and part of voting as an informed electorate. Part of that is holding people accountable to the standard. Mr. Ball has repeatedly said elected officials should be held to a higher standard. I agree but that starts with meeting the minimum standards that are required of everyone else Mr. Ball has publicly operated Bottle Branding, his company since 2011 and incorporated as Humanity Creative Incorporated in 2017.
I requested a city business license, business tax certificates applications, renewals and home occupation permits covering the period of January 1st 2010 to September 2026. In regards to these businesses, it's one business just operates under two names. The city reported that they had no responsive business license records for Jeremy or Michelle Ball Bottle Branding or Humanity Creative Incorporated.
Lompoc Municipal Code 5.04.040 requires conducting business within the city to obtain a Business Tax Certificate and pay applicable taxes. Home businesses also require the applicable home occupation approval. If his business is operated here without paying the required taxes, 16 years, the city was deprived of revenue it was otherwise owed and depending on taxable receipts penalties and that could total thousands of dollars that the city could use.
It also requires a county fictitious business name statement because you're operating under a different name than your incorporation The county says your license was expired in 2022. We discussed this about six weeks ago and according to the county, no application has been filed to renew it. You also have contracts with Lompoc Unified School District as a contractor and while I don't have the actual contract that you have signed, I do have a independent contractor services agreement that all independent contractors with the school district sign.
And it says contractor represents and warrants that the contractor shall have in effect and shall maintain full force throughout the term of the agreement, all licenses credentials permits and any other qualifications required by law to perform the service into fully and faithfully satisfied terms set forth in this agreement. So I have to ask if you made a affirmation to the school district that you had all licenses knowing that you didn't have a business license or home use permit Is that intentionally misrepresenting yourself and your company to the school district and to the citizens of Lompoc?
Thank you.
1:12 – 1:198 turns
Anybody else?
Karen Hallenstein, lifetime resident. Permanent resident. So we have an election coming up and this is the last City Council meeting before election. I am going to be going over the investigation I've been conducting into the death of Liliana Zuniga in 2023 inside our Lompoc Police Station on my Coast Observers TV, public access television show on channel 25. It will also be posted on Coast Audits on YouTube this week.
There's a Public Safety Commission meeting tomorrow. I'll be attending that. I would encourage anybody who's Concerned about the public safety in our town, including the cameras to attend the Public Safety Commission meeting. It's very helpful for us to get involved But what we're dealing with in the first part of this meeting with us not having enough money To pay our firefighters and to support the wastewater And having to gouge people by accident or whatever Is a direct result of what the liberals like Joyce Howerton did to our town.
Not allowing us reasonable home, owned home expansion all the way to Bailey Avenue by now which was planned. If we would have reasonable owned home expansion to Bailey Avenue We most likely would have the momentum to have our additional bridges across highway, or bringing 246 into Central Avenue. And we'd have a lot of our traffic issues solved. So this is a direct result of us being stymied and stunted.
And I want those people if they're not here today, they showed up when I wasn't here Those people to be accountable, but they're not here. So we got to find solutions. Let's find solutions. Thanks.
Anybody else?
Hi, my name is Ruth Gary. I'm coming to talk about the drone as first responder program. I know everyone here mostly supports that I'm probably one of the only people who opposes it but I'm still going to come tell you what I found out so that you all can see my point of view. As we talked last week, the police chief came in and said that the drone is going to be going out anytime they get a call for service straight to the location address and back to the station in order to minimize privacy concerns of the residents. I went on the website that the chief said to go look at all of the data as the first responder, it says oh this is gonna be specifically used to reactively respond to emergency calls for service enhance our ability to serve you They want transparency, here's the software.
It tracks the logs of all the flights. You can check it out yourself." So that's what I went and did. It shows you 30 days so I was looking at September 20th to October 20th because I looked at it earlier today I passed these maps out or these screenshots. I have more for anybody who's interested in finding out what I did, but long story short the overview page said there was 103 calls for service.
It said in the past 30 days 12 for other disturbance 10 for checking the welfare 7 traffic stops five bike stops, four reckless drivers, five homeless incidents, four burglary alarms, four shoplifting, four problems with juveniles, three follow-up calls. All of that's great. I added all those numbers up 55, 55 so I'm like well it's 103 calls what were the other calls for? So I went to the flight logs. So I start tracking pages and pages and pages and pages of flight logs to find out there was actually 146 flights. So I'm like, okay well where is this discrepancy? So I started looking and there was something very glaring. 43 flights had listed no reason for the call or the reason for the call was something such as a test or a demo flight 27% of all of the events were these test flights.
So I'm like, okay well let me look at the test flights. When you look at regular calls, six flights lasted longer than 20 minutes out of the total 103 calls. Yet you look at the test and demo flights they're much longer and they roam all around the city. They don't go from point A to point B that's what that map is these are all of the test calls. These are the ones that they're roaming around in total there were 43 test flights 456 minutes, seven and a half hours of test flights in the 30-day period. 25 of those lasted longer than 20 minutes. In the past two weeks on October 15th there were five calls lasting five flights lasting two hours. On October 16th there were 12 test flights totaling five and a half hours. I don't know if those are being
recorded,
I don't know what
those are. Time is up. There's two more minutes to the end of the meeting so if you had more to say you can hold on until the end. Anybody else? Anybody on Teams or telephone?
There is no public comment via Teams or phone calls
1:19 – 1:262 turns
Seeing nobody else, we will close public comment or oral communications. Bringing back item number six, Public Hearing General Plan Land Use and Zoning Code Amendments for Implementation of the Housing Element Social Six-Cycle General Plan GP 2026-0003 TA 2025-0001 and a Potential Adoption of a Resolution 685426 The purpose of these amendments is to comply with state law and our housing
element programs. So November 19, 2024 the City Council readopted the housing element. It was certified by HCD on January 7th, 2025. In October of 25 we had our part one or first round of implementation items done if you recall some of those items were increasing density or height than MU and OTC zone. And then these particular amendments went to Planning Commission on September 9th, 2025 I'll go over a summary of the amendments that are being done.
The vast majority are because of state law, there are a couple of them that are specific to the housing element. So for example, to amend code sections regarding assisted housing requirements compliance and this is a specific item particularly to the housing element not necessarily state law. Adhere to requirements for low barrier navigation centers in manufactured homes Requirements for farmworker and employee housing and transitional housing.
Revisions to the State Density Bonus Law to be in compliance with that, allowing residential uses of commercial zones, changing reasonable accommodations procedures for subjectivity by removing them in the findings, replacement of housing units sites identified in the site's inventory. So saying that, in the meantime between when this staff report went out and this meeting we received comments and questions and recommendations from City Council Member Bridge and the city attorney's office looked into these requests and found that oh by the way it's the memo I'm holding here you should have received a handout And after the city attorney's office reviewed the recommended recommendations or revised recommendations, we were in agreement staff and city attorney's offices agreement with the recommendations that I'll go over them with you now.
So the first section is regarding deleting notes number four and five in the residential on the other zones table regarding a requirement in the health and safety code 17 0 21 point eight And deleting that comment in 17708.20 regarding or otherwise approved pursuant to health and safety code, and in the general plan section. And the reason for this is when you look at 17021.8 that is specific to properties that have a agricultural general plan land use designation It doesn't have any. When you look at our general plan map, you can see them outside of the city not in the city specifically between the city limits and the sphere so it's not inner-city and that's why we felt it was appropriate to remove that particular note.
Moving on to commercial zones allowed uses table. So currently the draft proposal shows single family residential in that table where various commercial zoning districts are And so the recommendation is to delete it. And the reason for that is because that particular code section in the state law indicates, doesn't say specifically single-family residential. It talks more about certain types of densities and usually with single family residential you don't get the quite highest densities as you would normally get with multifamily. So that's why we felt it was appropriate removing it from that particular table.
Then in a multifamily residential row, restore the not allowed. That's per our current code that shows it as a dash, not allowed. So restore that but have a note that indicates quote, not otherwise allowed except that a housing development project meeting requirements of government code section 65852.24 or section 65912.100 at SEC shall be allowed and processes provided in those sections.
So because of those reasons, we thought that was also appropriate. And then finally in regards to 17.308-040F and the parking exceptions section replace quote, in compliance with government code section 65863.2 With no, to the extent required by and subject to all exceptions of funds provided in government code section 65863.2. And staff thought that was a reasonable change as well.
So these were In terms of CEQA analysis, it was already covered under the prepared and certified document under the addendum for number eight and number nine. So based on that staff recommends adopting the resolution and approving the ordinance or provide other direction. Thank you.
1:26 – 1:3116 turns
Do we have questions for Mr. Stones?
I just wanted to thank you guys for looking at what I'd seen and for the other council members. The changes really were removing additional requirements that weren't as a minimum required, so I think that's kind of the basis of my approach was if we don't have to take some requirement away that we like why should
I know one of the things we battled years ago was the animal raising and keeping. And basically R1 was the only place you could do that, and a lot of it was because our code had so far away from how many windows and doors and offsets? But now it's being permitted by state, correct? Basically all zones. Is that what's going on?
Well, the animal reason in keeping is actually already in our code. It's just that we're stick instead of leaving it in the agriculture uses and animal keeping use type section, we're sticking it under the residential use type section. And
I think it was only an R1. I don't think you could have it in the other density zones. And now it's in everything MU as well.
When you look at the red lines, so currently we have it in RA, R1, R2 and R3. And now... And actually that's a... In the red line version that's a mistake there. I think there isn't supposed to be a blank there but now it's also an R1-R2-R3. I'm
What is P1?
The one is permitted, yeah. Permitted use on any lot containing a single family residence comma including illegal non-conforming single family residents provided the use complies with section 17.404 of 40 and that's currently in our code.
So why was P1 used on something that's R2R3?
If I may, I think what that footnote number one is saying is that even if it's R2 or R3, animal raising and keeping is only allowed if there is a single family residence on the property. So animal raising and keeping is not going to be allowed if it is an apartment building in R3 only if it is a single family residence.
That does the limiter that I was mentioning on the single family residence. Very good. Anybody else have any other questions before we bring it to council? I had one, I know it's in the other document that you have here but I was looking for it here real fast and that was daycares, commercial daycares. Really searching hard for daycares to go to other zones, other commercial zones. You have residential daycares, commercial daycares.
Where is it? Is that residential or commercial? Okay, where's commercial daycare? And it was a big argument in the Bay Area, and I just thought about that as I was zoning through that real fast. Apologize for not...
Well we have currently our code in the residential section we have the family daycare home large and the family daycare home small but you're talking about commercial?
Yeah I know you have it in this book. Just as an
item of note, I think the ad hoc committee authorized daycare in both commercial and suggested authorizing. Not PCD? Not PCD but...
Where do you got it?
Yeah, the daycare comma commercial is shown in the commercial section
1:32 – 1:3928 turns
You're still not allowing a commercial daycare in the commercial zone?
In the commercial zone, a daycare comma commercial is already listed. And it's listed in the CC and the OTC. It's in OTC
and CC but not PCD.
Yeah, the CB and the PCD are not allowed However, as you know when you go to the section that talks about... I'm not finding it now but I was thinking of the section that pertains to requesting a use is not allowed with conditional use permit. But I'm not seeing that right now.
I just know that we had a lot of shortages of daycares around throughout the state. And don't know why, why are we not allowing daycares in the PCD? We have schools, we have arcades.
Yeah, PCD is a planned commercial development zoning district. what the rationale was back when we updated the code in 2019-2020. I
know there was a one time discussion you could have it but it had to be in the back door facing, not towards the highway or something?
Yeah that requirement's in the OTC zone.
We can have daycares in the OTC but you can't have it in the other PCD. I'm just trying to find the rationale as Again, you can have arcades. You can have ice cream places. You could have schools in the PCD. Some of the best buildings that we have, they'd qualify for daycares or in the PCD so I'm just curious as to why we didn't do that?
Yeah, I don't remember what the rationale was when we updated our code back in 2020
I just want to say, I'm with you 100%. Lompoc roughly, at least from what they told me, the average for child care access in the county is roughly 9%, and Lompoc's still sitting around 7. So to cut out any options that would give us the ability to provide child care is a little disturbing.
So you'd support me making that? Bringing them into the PCD? What do you got? Any other questions? Let's open up to public comment and bring it back for deliberations. Anybody on Teams or phone?
There's no public comment via Teams or phone.
All right, seeing nobody rise in the chambers we'll close public comment here and bring it back to the Council. He answered my thing with animals but I'd like to see it added that we had daycares at a PCD. Is that something? City Attorney?
I
think that would be fine. Did I miss anything else on the daycare aspect?
And again, daycare commercial, correct?
Yeah. What other kind of daycare is it? Well, we have... Activity for seniors and youth, correct? At one time when we were doing that, we had isolated out senior daycares. And that gets all the places, correct? Daycare commercial. So we hit daycare commercial with a CUP. Why are we hitting with CUPs instead of a permittable use?
I don't remember what the rationale was in 2020 for making it a CUP.
Let's see.
Jim just one suggestion yes, because we're the Ad hoc committee's got all sorts of red lines on that. It's coming back I think the 18th We could pick up a lot of these changes and some of them might think jerking Well okay
If you've got more they can go on down the thing I get it yeah But I think I think that that's a daycare. I think all the way across should be Committee of the City Attorney could go with an MUP instead of CUP. Do you know why we had CUP on daycares?
When you're asking the question there, what we found in the ad hoc committee is it was the best judgment at the time but nobody has what the rationale was. At the moment in time when they put the C there, it was what they thought was best at the time. But I don't disagree
with you. And the reason why I'm going is so we can have schools, public or private, they're permitted all the way across. Yet a daycare is a CUP, and only in two zones.
I agree with you. I have no problem with it. I'm just saying you're not going to get a rationale that we went through this ad nauseum. Why is
this that? I gotcha. I was just looking at what the state requirements were saying, hey, you guys need to get more daycares in. And Council Member Ball was saying along with that as well. So maybe an MUP so there's a minor review on those across those four zones. So I would, you already wanted to make a motion but if you'd add on your motion that you deal with an MUP on those four.
Yeah, I'll make a motion we accept staff's recommendation with the amendments that we discussed that I had submitted earlier and you provided the memo and have daycares across the entire spectrum of the commercial and you can make an MUP. With an MUP?
Seconded by Starbuck. Moving on. Anybody else need a discussion before we go to vote? So first by Bridge, seconded by Starbucks. Let's go ahead and vote. I'm trying buddy.
1:39 – 1:448 turns
That was violent. Well you
didn't. And that passes 5-0 I had it in your recommendations here, but you left it out. You made permitted, but you didn't make those other two zones. So this is...
Let me ask one real question. Greg, when you bring back the ad hoc make sure you have those improvements that have been made. Thank you.
So we're doing item number eight, no going to seven. That's introduction ordinance number 175526 prohibiting solid waste collection utility service outside of the city. Good
evening Council, Jeff Malavi City Attorney. At the last council meeting you requested that this ordinance come back at this meeting to prohibit the city from providing utility service to any property outside of city limits and also solid waste collection service to any property outside of city limits with the exception of service that is already being provided to certain, not just certain but any service that's being provided already outside the city.
That would be grandfathered from this ordinance so it's pretty simple. That's what the ordinance before you attach the staff report does In between the completion of the staff report and tonight, the billing staff did have a comment that didn't get incorporated into the staff report. And that was a little bit of an ambiguity in the exceptions for properties that are already receiving service outside the city. There was a question whether if say a property changed hands and there was a new owner close the old account and start a new account, would that new account be new service that would be prohibited or would it be grandfathered in? And I think the intent is that we would want that to be grandfathered in.
So in order to fix that, I needed to change the exception language in the two parts of the ordinance that are the exceptions for grandfathering in. So I'll just read that into the record Section 13.01.010B should say, this section shall not apply to any parcel outside the City of Lompoc corporate boundaries with existing utility service provided by the City of Lompoc as of the effective date of this ordinance provided that neither the type nor capacity of service to that parcel is expanded.
And I'll explain a little bit more about that. And then the exception in 8.04.190B, and this is for solid waste should say this section shall not apply to any parcel outside the City of Lompoc corporate boundaries with existing solid waste collection service provided by the City of Lompoc as of the effective date of this ordinance provided that the level of service to that parcel is not expanded furthermore nothing in this section shall be construed to affect The city landfills acceptance of solid waste from individuals or entities located outside the City of Lompoc. So what this basically says is anybody who's already receiving, any property parcel that's already receiving service outside the city will be grandfathered in not prohibited from receiving utility service as long as The type of service has not changed or their service level is not expanded.
So that concludes the staff report and I'm available for questions.
Any questions? Mr. Vega. Jeff, the intent of this as far as you know it what is the intent?
I don't have much more to say on that other than what I described in the staff report. Well,
you know the reason I'm asking is because we have a... We've got the Bodger property pending. We have Miguelito properties out there with Canon Will Serve letters and there has to be a reason because if we're advocating for I'm wondering if we have another line item here that says it doesn't with exceptions to what it could be because
1:45 – 1:4920 turns
If you wanted to make an exception for certain properties, I think that the Council should have a rationale for that exception. And particularly with the Bodger property, At the last meeting we entered into an MOU.
That's
exactly what I'm referencing, yes. We would intern to an out of agency service agreement to provide utility service if the property is not annexed. So
how
would
we do a line item here to make an exception so it doesn't backfire on that MOU?
Right because we have approved that MOU already for the Bodger property We could just make a line item exception if the council wanted to this ordinance that says except for APN, whatever the APN number is of the Bodger properties.
Yeah because we still have Bailey Corridor which we don't know what the outcome is at it's going to come back to a council so I'm not sure if we're shooting ourselves in the foot here as we're trying to expand or we're trying to grow. negative here but I'd like to know what we're doing you know because if you don't know what the intent is then I don't know what the intent is.
You know and it's not explained, I know somebody obviously made a motion to bring this thing back but there has to be a method to their madness that the public probably should know why? Because if they're trying to restrict growth okay Generally speaking, when we're charging, we don't necessarily get everything in the utilities and out-of-area service agreements.
And in many cases, what you see in review we are taking sewage but we're not getting any of the property tax aspects of it. So as an incentive, in order so that we can pump up the numbers, we hear everybody saying we need more revenue for this and this is that we are able to get and incentivize people And I understand that. It's for revenue.
I just think that we should all understand why we're doing it. If it's just for money, I get it.
One of the main reasons why cities formulate is to provide the utility services so we've put together and provided all these services and it's not really fair if somebody wants to pick and choose a utility and not be part of the whole team. Yeah,
but you know the expansion of Lompoc doesn't depend on utilities here on that part. You know what I mean? Because we're trying Bailey Corridor, we're trying the Urban Limit Line, we're trying to expand it and it doesn't reference how much money you make. It seems like it would be a negative to the incentive for growth if we're not going to provide the utilities so just... But once we
annex by law once your annexed into the city, the city must provide utility services
I understand the one and a half times for revenue. Once they're
annexed
in, you're
paying the same.
But there's no incentive to... My question is, there's nothing that's going to incentivize LAFCO to allow an expansion here on Lompoc based on this?
Well actually it will because we're not gonna be just running our utilities somewhere if they're not part of our team. So you're not going to get your utilities unless you're part of Lompoc.
And the other question, I'm just asking questions here because we have the resiliency group between the Vandenberg Air Force Base. Does that just do away with that group since we're not going to expand our utilities? We're over here expanding to see a Vandenberg Air Force Base or the prisoner whoever might need utilities so that we can partner up So I think Councilmember Vick is actually on to something.
1:50 – 1:558 turns
We might have an opportunity to work with Space Force Base to provide redundancy that does not yet include maybe electricity or water. LAFCO may never go our way, but Vandenberg Village might build a bunch of new homes. Are we saying we can't expand services to those new homes if they were built in Vandenberg Village because of this? Can we not have a relationship with the base and potentially share some of our resources? As far as I understand, Mr. Luther can maybe confirm, I don't think we're hitting the full capacity of some of our utilities that we're talking about.
So for me five years, ten years from now to take away the opportunity to make relationships, to extend our services, If you spend some time reading the service agreement
And I believe in a large part the people of Lompoc are subsidizing that area agreements and you're not getting 100% and that's why you do collect property tax. As an example, in the enterprise reimbursement where wastewater is being charged about $1 million a year for public safety support, the village never had a modification of that section that they're paying so the people of Lompoc are subsidizing 100% of that public safety support in the enterprise reimbursement account They're not paying any of that, yet their waste continues to flow here.
So it makes it unfair that the people of Lompoc are subsidizing people out of the area and that's the reason why I'm trying to tune this up if you want us... If they can expand in the village then the contract allows them to increase. They have a lot more capacity for wastewater but we're not stopping any of that. They're fully allowed to use what they're already using
And
again, if something happens... Personally myself, and I mentioned this a year-and-a-half ago, I don't think the City of Lompoc and the Lompoc Valley should be providing water service to the base. The base could do their own desal plant. They can coordinate in doing that there. The City of Lompoc, if we're going to be providing water to somebody, we sure as heck should be getting the property tax from them. They wanted a 36 inch straw in the middle of our valley.
You know what would happen with that. If we got into a drought situation, we would be conserving and they wouldn't. So I don't support that. We do already take their wastewater and they have, I forget what capacity right now, I think they're at 60% capacity from the bays? Currently it isn't enough. They have a bunch of capacity left for wastewater as they bought in our plant.
If you want to talk about electrical, it wasn't long ago we were having a very difficult time ourselves taking care of ourselves. We were short and you want to expand when we have difficulty fulfilling what we've got right here? So I do question whether we do things like that. I think we need to be Lompoc first and that's my concern is we need to make sure that we're taking care of ourselves.
If these other areas want to come in and be part of the city, be part of the whole circle and contribute fairer
I don't have any problem with that. I respect that, what I don't understand is you and I know that Vandenberg is never going to annex into the city and for you to say that no we're just Lompoc first and we should stay on an island when the base is seriously figuring out how to create a backstop of resources from one of the most important military bases in our entire country And when we have capacity and the ability to gather revenue from the feds or to get grants potentially from the feds that help our utilities, or help us rebuild a water plant, or help us create some redundancy.
I don't understand why we would just knee jerk something and say, I don't think they need it. Again
with
an ordinance
like this you can change it in the future but I don't believe what they need out there, they don't need us. When you read that document everything was about their mission. It was not about Lompoc. It was not about making Lompoc better. The multiple 30 days of Can I ask a question of staff? Mr. Alvaro, city manager, have we been in any discussions with the base over the last 10 years where discussions about our resources and shared interests have occurred
1:55 – 2:0218 turns
Well one of the things that we did as a grant was to study our infrastructure and see if we could become more resilient, and that was two grants. And there was a following grant on that, it was $2.2 million from the federal government for us to try and be more efficient in the city of Lompoc.
Has there been any discussions about potentially electricity or water or any of those issues with the base over the last ten years?
Yeah, all the utilities were studied. I know we talked about the diesel network but I think that was one of the things we looked at but it didn't come to fruition as a good idea. We're looking at other things that we could potentially do To be more efficient and and be able to if we've lost energy Electricity that we would be able to stay in our utilities for two weeks If something catastrophic like that was ever happened That's one of the goals of these kind of grants is to help us to be more efficient the city
So but they're trying to help us so that we might help them. Is that a fair statement in some way? I
Some of it was, you're talking about the intertie connection utilities. Some of those are yeah but it's also a two-way street I mean if they're going to invest 700 million dollars into their infrastructure and is there a way that we could intertie to them so if they had energy and we didn't could we utilize that? It's a complex study and it's not cheap, and it's going to take a while to get through all this. But they have been funding us to look at those kind of options and see what we can do.
Thank you for that. I still think that I don't understand who is going to change anything because of this? You're saying it creates an incentive but Who's going to move on that incentive and how is it going to change or move a needle?
So you understand that one of our neighbors to the north is in conversation to hooking up to our wastewater plant. I think if they want to hook up to our wastewater plant, maybe this should be part of the city. Why should we just take their wastewater and we don't get everything else involved with
it? What if they want to give us their wastewater but LAFCO doesn't allow that to happen for two or three decades? I
believe in the situation that you're looking at tens of millions of dollars to build the infrastructure, and so there is conversation that they would like to be able to tie into us for $2 or $3 million instead of saying hypothetical $40 or $50 million. And I'm thinking well if we're going to get something we should get everything. Again one reason why we formulate and establish a city is so we can grow and expand but all we are going to do is take The I appreciate that. But there is a lot of other things that we are doing and providing when the people are in this town, police and fire services or parks and rec.
There's a lot of the library services that we provide to the people who are... And we're not getting the whole package, and we should be getting all packages. I'm putting this down as an incentive if you want to bring us your wastewater let's bring you in so that we can take care of the other things that we're providing and not getting paid for.
Again, I think in theory a lot of that makes sense but it's a theory. And I think the moving pieces that you're not acknowledging is you can't just say here's an incentive and here's a carrot and then all of a sudden LAFCO and the people to the north just jump and a year from now things change. It may stay the same. LAFCO may never let us do some things even though we are on the same page sphere of influence bringing them in property taxes all of those things
And it might not, and a future council will have the opportunity to rescind the ordinance. This is to put it out there as they do, they say hey you gotta get this and we're doing this because of that. As an example, we were told don't put the Bodger property in our arena plan. All right? As it turns out if we had an arena plan, we could've used it as angle and argument to annex it, as they did in the south.
Galena did that and use that as part of her arena plan over in consideration we must annex. They're gouted. We didn't do that. Had we done it, it was another point of argument we could have used to do that. So these are lining all these things up going to all these LAFCO meetings and stuff seeing what we need to do so we need to take care of Lompoc first and align these procedures up so we can not saying no to them if different comes down the line they say hey we desperately need to do this we need to get this tie-in you got to get it done you come up here you get three people to rescind an ordinance and you move forward
I hear you and again, I think it sounds great. But I do question how serious the incentive is when you're grandfathering in all of the people that you're trying to incentivize. So again they are already grandfathered. No, not for the
other components of utilities so they are not.
We go to Council Member Vega
then
Council Member Bridge. Thank you, appreciate all the answers and the questions. Question for city attorney and city manager on this one. We know there's a potential for some build out here going out 246. I know there's been an ask so might as well ask directly save the bridge house to be specific if they need our utilities Do we need an ordinance like this to not serve that area? Or can the council create, or does the council have a decision or hand in making a decision whether utilities are provided to an entity just potentially. You know, we don't know that it's fact.
Or is that the city manager's decision to say yes or no to providing utilities to someone in the county? That's a
decision, that's an agreement that would have to be approved by City Council.
So it would have to go through City Council? It can't be just the city manager saying yes and we're going to do this okay because it's important I think people have asked me that question so that we can know if there is future expansion so I just want to make sure this wasn't the reason and there's another way to do it you know what I mean without an ordinance if we choose that we don't want that Expansion out in that area just as an example could be anything So it's good for us to know that would have to come to City Council, so thank you
2:02 – 2:1324 turns
Tessa bridge I Just want a clarification on what you just said or what? I just heard This ordinance passes then the Bridge House would have to have this resolution or ordinance somehow amended to allow them to come to the Council, right? Yes. Okay. I just want to make sure I heard that right. I think the base is a reasonable thing. I agree that we're never going to annex the base So I would have no hard part with that being an exception to this.
But I fully agree with the mayor, these developments that come around us and don't join us we're going to be the guys who are servicing them in fire and police. So that seems like a fair trade. If we're servicing you, then you should be on our utilities as well or vice versa however you want to see it. But I'd have no problem with adding that exception line to include the base because I agree it's never going to annex and we are trying to be a partner to the base so
So I guess my last question, and again Mr. Biggar brought this up too is, I haven't talked to them a lot. I've learned a little bit but they've communicated with the mayor and staff quite a bit but I had the folks that are representing the Bodger project reach out saying what in the world is going on? This has potential to have negative impact on our project and I thought up to this point we were kind of all on the same page moving it forward so Have we talked to them at all? Have we talked through this impact, have we played this through on any of those? I don't know.
Well my understanding is that this, the Bodger and I have also talked to him. that the issue we had to do the letter or the agreement, the terms was kind of a will and can and will. And I was, um, I believe informed at this Diaz that there were enough protective clauses in there that we could take that back so to speak in a non-technical term. Um, and so I don't see why this ordinance would impact that.
They were concerned about it, as I understood it, which is they have to do an EIR and they would prefer not to have it do an EIR without us because that would be significantly impact them and perhaps even Take it to the point where they couldn't succeed. So are we in communications with the County Planning Department? I don't know who would... Dean, do you know the answer to that?
I can answer that. Okay. I have not been in direct communications with the County Planning Department but I also have heard from the Bodger developer applicant and they were concerned that Although we did enter into that MOU at the last meeting, they were concerned that the county may see this as a repudiation or negation of that MOU because on the one hand saying we'll serve if you're outside the city and then we turn around and adopt this ordinance. The county may not see that as real and they may not proceed with the EIR They would
still proceed, they just would not be able to use us as a component.
They'd have to analyze
self-service. I was probably the lone guy who was against the MOU because I just feel like we're walking down a path Where we get to LAFCO and they go, oh well see you've got a Ken and Will. And so you don't really need to be annexed here. So I'm in a conundrum here because I certainly don't want to halt the Bodger and I don't want to cost them any more money.
But I also do not want Bodger developing on that end of town and not be part of our city. We will be doing the police department, we will be doing the fire department and there's going to be a sit down at least if I understand this process right where the county is going to try to keep as much of that to them as they can And it just seems blatantly unfair that we jumped through our tail and got our housing element done, and the county failed. And so the project that we have been in support of for as long as I can remember But that LAFCO has repeatedly said we can't do is now being done in the county. That just irks the hell out of me, so that was a little bit of event I apologize but back to my compromise I'd be more than happy to support Vandenberg being as an exception but I can understand why we got on this path of an ordinance it says okay We've got this cannon well.
We've got all these clauses, but we're going to add this other piece of paper that tells you were serious. I don't know what the impact until somebody from county planning stands up and says if you do that, we're going to do this. I think we call their bluff personally. That's just my two cents.
That was one of the objectives as well, but they did talk to representatives from the Bodger said would probably affect them and delay. And we know how they like to delay, so before I go to public comment, because I'd be willing to add the existing MOU which is them and then Vandenberg into this since you've got that. So adding those two on there into that but let me, Council Member Baldwin.
Yeah no just I mean fairly agree. The issue with the EIR is if we're going to put this in stone, it's basically saying as they make their assessment of how they're going to receive services, it's basically next to impossible. How are they going to self-serve when it comes to a lot of the things that they need utility wise? At least from their side, these still are 100% annexations so I guess I'm asking you or anyone where are we getting the sense that the county wants to keep it and wants us to please them for free. We're
getting this sense from 20 years of experience with them, and 20 years of experience with LAFCO. They just have played this game over and over again so... And I have to from a development standpoint have to say I don't think even when they're done with the EIR that it's going to make any difference of them wanting to come on because it will cost them lots of money not to want to come to us and if we've got it established, hey the only way this is gonna happen is you're annexed.
You're gonna have a pretty good tab at the table Otherwise, we got nothing. Every time we go down this path and listen to the state and the county and you know all these agencies, we end up coming to the table with nothing. And they go well
tough, we're not going to do it. I certainly respect that and I think history does speak to a lot of this but the only thing that we don't have 20 years of experience with this type project is builder's remedy This is not it. The county doesn't want this. This is a builder's
remedy issue, this is a LAFCO issue.
I understand but how it came about and the way that the county had to allow this to happen as a result of the state's mandates...
Yeah that's why they didn't do because we wanted to. They didn't do it because it was the right thing to do. They didn't do it because Lompoc's dying with
low-cost housing. Now that they have to do this, they have the builder's remedy And they're fighting you. But why do you think that they want to keep it versus have us annex
it? It all comes down to the almighty dollar and power.
That's what it always comes down to. I'm just curious, would we be providing police and fire for free? Or how would we create relationships or new agreements with
that? Do you think we're going to not answer the call if it comes in? Do you think we're going to get reimbursed by the county appropriately? Are they going to come to our schools? Are they going to come to our hospital? Of course they are! They're going to be wonderful people and they're going But they're going to be in the county, just like Mission Hills. I probably hear at least once every month how come Mission Hills doesn't get to vote on what you guys and Lompoc are doing? Well they can't because they're not in it.
You know we know that Mission Hill's water district or sewer district is probably going to have to deal with some problems soon and come to us but there will be county and we will have to help So yeah, I'm cynic and I just, I am still burned on RINA because they led us down that path. Oh this is just paper, this is just paper. Just go ahead and then you've seen what's happened in the last two years based on RINA so... I don't want to come across as a jerk about it all but I don't have any faith that LAFCO is going to be fair. And if we don't have something to bring to the table they're just gonna ignore us like they have all along
Well, I don't disagree about us potentially annexing the village and Mission Hills. Full agreement that we're missing out on that property tax and what goes to the county doesn't normally come back to us. But if I was the county servicing that property at Bodger is next to impossible without us. And so I just some point I think that we should have agreements in place but I still don't necessarily buy that they don't want I don't understand that part,
but
we do this regional
dispatch thing and we provide it for free. So okay let me go to public comment and then we'll come back for final deliberation so open this one up to public comment yes
I'm sorry thought that there is someone a representative of bodger on the teams i don't know if they'll speak during public comment but if you need to ask questions
yeah public comment this item

Just, my name is Deborah Jewell. I'm just listening to this and I was here last council meeting about the annex thing and so there's two things that are popping up in my mind that aren't clear after listening to everybody talk. One is wouldn't the MOU still be in place even if the ordinance was passed? And two, I keep hearing, I heard it two or three times about the bridge house. So I'm thinking maybe the bridge house isn't part of Lompoc And it is the homeless shelter. And if that's what you're talking about, if the ordinance passes does that mean that the bridge house cannot get utilities unless it's approved by the city council?
So those are my two thoughts. Thanks.
Good evening Mayor and City Council. I've heard these arguments back and forth about the county in this city. I've had talks with officials here about the county holding back, but I just want to...I'm here today as a concerned community member regarding agenda item seven and its potential implications for the Bridge House shelter. I ask you to look beyond this ordinance for a moment and consider the human lives that may be affected by this decision.
Bridge House provides an essential service to people experiencing homelessness, utilities and waste collections. And they're not luxuries. They are necessities for maintaining a safe, sanitary and dignified environment. We cannot assume that we know someone's story by looking at them. Homelessness is not simply about drugs or person's willingness to work People can experience devastating loss, financial hardship, family crisis and circumstances that leave them struggling to find their footing again.
And today we have working people and families in our community who are suffering to keep a roof over their head. This is why Bridge House matters when people are going through some of the hardest times in their lives access to shelter and basic services can provide stability, safety and opportunity to begin again. So I ask this council could this ordinance affect Bridge House shelters access to essential utilities or waste collections?
What protections will ensure that the shelter can continue serving the people who depend on it? I understand the city has responsibilities but we must also consider the human consequences of our decisions Homelessness is not just a housing issue, it's a human issue. I respectfully ask you to clarify the impact of this ordinance and ensure that essential shelter services are protected from unintended circumstances because how we treat our most vulnerable neighbors reflects who we are as a community. Thank you.
Anybody else?
Karen Hauenstein, lifelong resident. I'd like to respond to the last speaker because the Bridge House should not be expanded at all. Lompoc is not a repository for the homeless people in the rest of the state Like it has been a repository for Section 8 housing individuals who come here from other states like Tennessee and Kansas, Texas. I've met all of them over there in Santa Rita.
We're housing people from other parts of the nation in our own housing. Now Joan Hartman has led us down a primrose path And she wants to expand the Bridge House, which is already being run by dubious Good Samaritan organization that is expanding and becoming a nice little money crunching monster. They're big huge budgets and they don't seem to do anything.
And she wants 400 more beds. Joan wants 400 more beds. The Bridge House? I say no any way we can. But on this council, we should not have any individuals at all who are making excuses for LAFCO. It's shameful how Democrat-run LAFCO, Salud Carbajal's daughter runs LAFCO and she has cut us out Cut us down, prevented us from sustainable growth so that we can have goods and we can have services in our city without having to make mistakes and gouge people.
This is the effect of those few people. Remember, Salud was a county supervisor, right? This, this is horrific what's happening. We can't make excuses for LAFCO. We have to be demanding fairness and consideration. We have to be suing them if we have to. Why are we sitting here and saying oh well we might not get what we want from LAFCO we may just have to wait?
No that's not what we need
2:19 – 2:269 turns
Can I do one public comment?
My name is Janice Keller. I'm a resident of the City of Lompoc, unlike the previous speaker who is not a citizen and resident of the City of Lompoc. I wasn't going to address this issue tonight but the Bridge House issue did come up and What I don't know, since I don't have this full ordinance in front of me, is if the council is aware of what the exceptions are.
Because as the city attorney said, the exception is for those currently receiving services. Does the council have a list of who that is or what entities those are? I don't have that list and I think it would be a good idea for who's already accepted from this. Before you even vote on it, I think that would be a really good idea. I was under the understanding that the Bridge House is getting services from the city trash collection and utilities but if not then that's something to consider.
There's a lot of loose trash around our city anything we do to prohibit solid waste collection is only going to increase that problem that we're already having. So not because of Bridge House, but other places surrounding the city. So that's what I have to say. I think you should send it back. Oh no there was one other thing and I think the mayor alluded to this. There's also this amendment, this ordinance can be amended to include something like to There's an exception like the ones that are receiving and existing MOUs can be an exception to this ordinance. But I think it needs to go back and have more work done on that.
Anybody else? So when I meant one public comment, that's per item so other items you'd still be allowed to comment on right? Do they wish to speak on
Yes, Mr. Mayor. Ginger Anderson with Bodger is on Teams. I'm going to go ahead and unmute her now. Ms. Anderson you are unmuted and you should be able to speak.
Good evening. I am Ginger Anderson with Brownstein representing the Bodger Project this evening. Thank you for the opportunity to speak. I do want to again express the project on behalf of the project that 100% we want this project to be annexed to the City of Lompoc. We think it meets all the rules and intents of LAFCO's desires for orderly development and efficient provision of municipal services, that is entirely our intent We are concerned that the ordinance, the appearance that the ordinance would seek to maybe invalidate that MOU that was passed a couple of weeks ago.
And I do think it's important to have the exception that was suggested, uh, I believe first by Mr. Council Member Vega and I would hope that there is support for that. Um, I do realize this is a larger issue for the City of Lompoc listening to you all tonight but would like to respectfully request The Bodger Project not be subject to this moratorium. Thank you.
Anybody else? Emily, anybody else?
There is no additional public comment via Teams or phones.
Okay, I see nobody else hearing, nobody else will close public comment. Bring it back to the Council, Councillor Bridge.
I would just like to comment a little bit on Bridge House, because that has come up several times. I'm very supportive of the Bridge House and I've had loved ones there. Having said that... I have on repeated times requested that the proponents of the Bridge House put together a plan and tell us what exactly they want to do. And every time I've asked that it has been promised and not delivered.
So there are rumors, you heard one tonight, 400 houses. There's development going on out there that I don't know we're involved in. And as far as the services, my understanding is we do not service the sewer system and they're having a challenge with that which was one of the reasons I reached out to them to see if we could find a compromise but if they're not willing to put a plan on the table and say exactly what they commit to so that Lompoc can make a decision as to whether we can absorb that level of support, it's very difficult to just sign a carte blanche check.
As I started, I'm very compassionate about the bridge house. I have had loved ones use it and it was very well... It did them well but as a council person, I could never sign a blank check that says We'll give you the utilities. You go do whatever you want because just like Bodger and just like Mission Hills, they're in the valley and that what happens there impacts us and if there's fire at the bridge house we're responding just like will be responding out of Bodger so but I don't want anybody to think that the day is here is not supportive of the homeless or people who
2:26 – 2:3318 turns
Let me try a motion here real fast. So we have an existing MOU, so modify this to accept the existing MOU and then add Vandenberg Air Force Base on there as well in understanding that Three council members down the road can change this ordinance. This is putting a line in the sand to advertise guys, look. Another hurdle they're going to have to go over instead of annexing us as well. So this is what this is about, put this on the table so we can identify what's going on. People can look at it and understand that we're not just going to be the pushovers we've been for multiple decades in. There always was anticipation when we took the sewage lines from people that they were going to be annexed into the city limits and then it's never happened.
That's a motion I'll make. I appreciate what you had to say about the
bridge house. But we won't, until we get a plan or we as council agree on some sort of plan.
That's been my personal opinion
for two years. So I don't have any problem with that. I think it's important for the county to be transparent about their plans because it's our valley right? So I don't have any problem with that but I do think that we should be negotiating and if they need something from us they should be giving us something in return and I agree. I think that should start with a plan but I don' know how we would carve that out or incentivize
Yeah, we've got a motion and second. Let's go to vote. And that passes 3-2 with Councilor Vaguer and Councilor Valle voting no. Okay item number eight has been suspended, postponed
Yes, Mayor. I have a little bit more work to do on item number 8 unfortunately so I'd ask that the Council continue that to the next meeting.
Can we make quick comments on 8 if it doesn't get into depth of zoning or otherwise?
If it doesn't involve anything that any council member has a conflict on, yes.
You heard one that I had earlier today. Do I need to take public comment on this item? If we're going to be making comment.
If you're just asking a question, then you don't need to. Well,
I'm gonna make a question with the recommendation that...
Then yeah, you'd need to take public comment.
Where did it go? Yes, I will. Okay, one of course was the daycare aspect in there to go across all tables And then I think there's another item that's in here, I think it's important. That was being taken out which was the home occupation requiring approval. I still think you should have the administrative use otherwise people are getting home occupancy permits with a BTC without anything, you know? And I think that one should. So I know when it comes back we'll drill in deeper on that one but...
Well just let me comment on that. Okay. As it was described to me, if my memory serves me right, the home occupancy, the person desiring it would come and fill out a piece of paper and would get approved. The paper would get filed. That was the whole process they did. There was no real approval. It was more ministerial. What the ad hoc actually suggested was that they automate that process.
You know, and we kind of went across all AUPs on that. That AUPs are just creating work and there's no real... I'm not denigrating anybody here but there was no real review it was just fill out a piece paper and put it in file and the reason that it was stated was required was so they knew what was going on in the city which seemed fair and that's why the suggestion from the ad hoc was, well why don't you just make it you got to register online your home office. So I don't know if the wording could change to address that but that's a little of the history
so i think that's right. So in my witnessing of the administrative use permit What's happened is they do go down the list, so they understand that you can't have people from out of area coming to your home and conducting business. And the limitations on deliveries, which I think it's key because you don't want to turn residentials into full commercial level just like they did with cottage food permits.
No, I agree with what you're saying in that all they were doing though was handing them a piece of paper sign their name and filing the paper away. So there's not really an education other than reading, and they can do that online.
And then maybe what staff needs to make sure that they're doing is they are communicating with the people for the administrative use permit to do the home occupancy on that so they need to gear it up instead of just passing them through. Otherwise you get in conflicts and people are operating in their homes without the home occupation permits and understanding when you have people coming to the house that, hey I didn't know.
So maybe they need to send time and not just get the BTC which is kind of more over-the-counter aspect right? So anyhow that was one of my concerns that I saw that's a significant change whether they're for doing the full levels of discussion with that or not that's something else but and of course then the other one so those are my two main items in the daycare and the PCD So,
well maybe the answer is Greg when you come in with the ad hoc on the 18th. You provide more detail on what actually happens with the AUP so...
2:33 – 2:3915 turns
Okay? Anybody else have anything else to comment or question about? On that one? See now we'll open it up for public comment. That's public comment on the item that we're primarily tabling for the future but any hot topics on this item? Do we have anybody on Teams there?
There is no public comment via Teams or phone.
Okay, this is item number eight.
I want to make a comment on this and I am a citizen resident of the town. I've lived inside Lompoc since August 2024 Because the County of Santa Barbara started suing my family outside of town, over our property in 2020. In case number 20CV02746 and we lost the ranch. So I've lived in town for two years, over two years now. And I will live here until I die.
So, business licenses. We need business licenses to do business and we're supposed to have them Mr. Ball. Home occupancy permits when we're running businesses out of our house and bringing people into our house that we charge the money and we claim it on our taxes. Many people have asked you many times about this And I'm just finding out about it today. And after the things that you've said on this dais about Councilman Bridge, I am shocked. Can you keep it on item
number
eight? Yeah but we were talking about business licenses and home occupancy permits so I'm just reminded of the things I'm thinking about that are fresh in my mind. Thank you.
Anybody else? Item number eight. See nobody else and nobody over there, we'll go and close that and understand it's tabled and coming back. City Attorney, when is it coming
back? We'll bring it back at the next meeting.
Very good, thank you. Item number nine, that's the approval of second amendment long-term to ground lease operating agreement with conditional option for disposition and project development with Pale Blue Dot Ventures Incorporated relating to a proposed development of a space center project on approximately 82 acres of city owned land including the adjacent Kid Adam Park. APN 095070008. You again, City Attorney.
This is the Pale Blue Dot Ventures project on Canadam Park. We are currently in a lease disposition development agreement with Pale Blue Dot that has certain milestones that they're required to meet by deadlines, and if they meet those milestones by the deadlines, they then have the opportunity to purchase the property and begin getting building permits to construct their project.
The pending deadline right now under the leased EDA is for Pale Blue Dot to submit by December 5th of this year a project description sufficient for environmental review and to submit their draft applications for any general plan and zone changes that are needed for the project. Again, the deadline for that is December 5th or else the agreement expires. And on September 11th, the city received a letter from Steve Frank of Pale Blue Dot requesting that that deadline be extended to December 5th, 2027.
Steve is in the audience tonight and he says he has a presentation to give about this request immediately after my staff report if the council would like. And the staff report is also set up for the city to, because it was requested at the last meeting, to consider either a one-year or two-year extension. Whichever one you would like to choose, or no extension tonight at the council meeting.
So that concludes the staff report.
Any questions of the City Attorney?
No questions? I have a question. Jeff, so we're in an impasse right now where as you stated the project description and CEQA environmental review is necessary for them otherwise they need an extension for that okay one of my questions is that I've been asked, and maybe we can ask Steve too is, can they get it done in one year? And what can the people expect because it's us granting the extension but people want to know what we're going to get in return. And in reality, what can they do so that we're not here again asking for another extension for the same part of this environmental plan.
I think I'm going to have to leave that up to Steve Frank to answer as to what he thinks he can do in the next year.
Yeah, because I think that one of the biggest questions I've been asked is where are they at? Where are they going? Not just to give a bunch of timeout without having some sort of benchmark so thank you.
I think he has a presentation that might answer some of that.
2:39 – 2:491 turns
Thank you mayor and council members for the time. I'm Steve Frank, the founder and CEO of Pale Boudin Ventures. How do I advance this slide? Okay just a quick summary Basically, you've seen this before. This is what we're showing to investors. But Complex Alpha's Think of Kennedy Space Center. That's the history of space. We want to talk about the future of space exploration here on the West Coast. Camp Odyssey is basically a space camp. Can't use that name. It's trademarked. Space Works is one to two. Is basically an industrial maker space.
That's actually pretty important. About 12 plots of we think 1,000 to 30,000 square feet. We can put industrial educational facilities in there and then themed lodging is a 75 key hotel that's based on space. So what we're creating is a space innovation and education hub with an entertainment hook. The entertainment piece is actually quite important because that's cash flow generative.
The workforce development piece is also key. So far we've raised about $2 million, $2.1 million. Since the lease DDA was recorded in 2024 we've raised about half a million, $510,000. Recently we engaged for March of 2026 a middle market investment bank. The way this works is you have to basically get all your documents lined up and legally reviewed in due diligence so that they will, you can put them in front of investors. So that takes about four months. So starting in August or so, we sent out, or they sent out, it's not us, it was them, about 80-100 two page No name teaser, so our name wasn't on there. They might have been able to figure it out who it was.
They got about 30 investors expressed interest. They told us that's actually pretty unusual and they only had one decline. They also said that's pretty unusual. We've had 15 meetings. These are all Zoom or Teams meetings and there's 14 more of these scheduled. about 150 to 180 two-page no-name teasers going out. So there's another 50 to 80 of these no-name teasers that'll go out to their investor base.
We didn't want to put all our eggs in one basket, so we started our own effort using AI and a dedicated intern who helped us scrape the information. about 45 investors on our own. These are high net worth developers, corporates in the entertainment space, people that have invested in entertainment and hospitality and real estate. And we've reached out to them directly.
And we've got at least 30 more of those targets identified. We've also hired a PAO who's here in the audience, an IT guy and a tech analyst as consultants. And we're looking to recruit an interim CFO with a real estate experience, and also we're looking for a grant writer. On the community side, we've actually in the last couple weeks submitted a couple Space Vandenberg Innovation Fund applications. One which is I think quite important is to do a study on making that footprint up there an aerospace technician training center. So this is very much like Our Disney guys had done for Airbus in Alabama and Workforce Alabama. So that's something that we think is very topical, it's very topical with reach so if you know anyone up there please put in a good word for us.
We also asked for some funding on an earth observation education platform. We've supported the Lompoc Valley Chamber of Commerce with tables at Friday nights and There's a lot of effort on launch viewing the base and REACHER, evaluating different locations. For legal reasons we can't really do much about that so it's separate from us. Look, big ideas take a lot of time and then they really pay off. So the Sphere which was a billion dollar build was two years late but now it's a big hit and they had 300,000 or sorry 3.6 million guests and 450 million in revenue. We're not talking about doing anything close to that but there's other examples you know Epic Universe in Orlando took six years to open.
Cosm who we've talked to are the guys who built I'm here to talk Sony, another example is the Dorrance Dome in Arizona. Kennedy, you know gets 1.7 million visitors a year and Meo Wolf which is pretty unusual small city project unproven immersive art attraction they got 400,000 visitors in their first year twice what they expected so the message out of this slide is that pioneering these destinations takes longer than expected but they do deliver The launch coasts, California and Florida are drawing investment. We're getting $800 million of new investment up here in Vandenberg.
Down in Florida, a developer announced a 720,000 square foot five building class A industrial park of about 46 acres. Our plot's 82 and that was announced in Cocoa, Florida so things are going on. I think Florida is way ahead of us but we're a little bit behind but Vandenberg of course has now approved for 100 Falcon launches a year. So things, big ideas take time. We got a big idea, okay? So we're committing and I think the question from Mr. Vega was what are we committing to? So we'll come back and report in 12 months if you want us to come back sooner than that we can certainly do that.
We'll file the project description, the draft general plan. That's the first thing that's due in December of this year. We'll do that before the extension ends The project description is a pretty heavy lift. It's about 300, 400 pages. It's about 70% complete. We just want to refresh everything, all the technology in there and we'll keep the community involved so public support and launch viewing those kind of things. Any kind of grant outcomes out of, we'll make sure the council knows those decisions are out of reach. We expect that in December.
What the city keeps on the right side is there's no cost to the city. We reimburse everything for city staff. Kanata Park stays open, the rent continues, all the other lease DDA issues remain binding but you've got a developer that's in place and ready to go once capital closes. And the impact from this is one time 100 million on construction and 730 jobs. You can see the numbers up there and then ongoing is about 50 million impacts So last slide, so our path to entitlement is by the extended deadline we'll get funded by the capital raise and that will allow us to complete these three things there which includes a zoning general plan.
That hurdle isn't huge but we need money to do that and then you also need the capital to do remaining CEQA civil engineering traffic studies and get everything through final commission planning commission approval So our momentum, we've got 30 investors that have expressed interest. We had 15 meetings of hell. We've got 14 more scheduled. That's on the investment banking side and on the other side a separate outreach side we've got 45 people we've reached out to. We'd welcome the two-year option or the one year option.
The project description is 70% complete but The point I want to make is that you've got to stay within 10%, plus or minus 10% on the project description. So, you really need to lock down the program because if you fall outside 10%, you've got to start everything all over again and of course we don't want to do that so getting everything sorted out now ahead of time is the right way to go. That's it for us. Any questions?
2:49 – 2:5513 turns
Councilor Vega.
Hello Steve, how you doing? Hey the project is wonderful but on a business level maybe you can just be forthright with us for this extension because it looks like it extends all the parameters of this agreement from what I'm reading for one year unless I'm misreading it but it sounds like it stretches it for one year for all the parameters that were in the contract What do you expect to have done within the one-year extension that you guys have the funding for right now so that people can... I think half of what happens here is if we're just straightforward with each other, you know. So we know where we're going and I understand you have to obtain more funding and it's been difficult But what can the city expect or the public can expect from you guys as far as the context concern for this first wave
here? Right. So, so the question is does it extend, does everything extend one year, incremental one year and the answer to that is yes. That's the way it's written up. I don't have a big problem if we change some of those numbers, I don't think. We were pretty careful about when we put together the MOU or the agreement with SDA when we started that we kind of timed those things in the right order.
But yeah, that's the way it is structured. We think – look, we're looking for – let me – I guess I didn't have the numbers in the presentation but The total project is roughly 150, 160 million. You need roughly 50 million of equity and part of that can be solved or satisfied with STEM grants. We think there's actually quite a lot of money in Washington but let's say it's 40 million and 10 million of STEM grants. I know people that have tried this before try to get grants and there was nothing they could find.
But let's say it's $50 million. Right now, we're looking for $5 million as the first tranche on the 50. That $5 million gets us all the way through project planning.
So $5 million is what you're hoping to put together correct? And that'll get you to what stage of this? We're asking for it. It's either one year or two years, but can you get it all done in the one year with the extension all across the board? Because you asked initially for the one-year and somehow the two-year came out to make it a little easier I guess so maybe you could at least refer to that.
Well if I had five million today we could make a very big effort but I don't think we could make the December deadline. You really, we really need to have about a quarter to go back and refresh the creative that we've done because some of the technology has moved on actually quite a bit since we started. So we want to spend about two or three hundred thousand dollars to kind of get that part of it sorted out so but five you know fifty million is the bogey for equity of which the first tranche is five million which gets us through and a lot of people said to me Like don't ask for five, go ask for 50. And so that's kind of what we've changed our approach. It's not a lot
of people who can write a $50 million check. But you know excuse me but if you got the one year extension are you comfortable with that?
Yeah.
You're moving forward because...
Yes I mean I've got people that have told me when you get done with this meeting call me and let me know what happened because They've got people they want to get this in front of. But I can guarantee you the answer, there'll be no investment if we don't get this extension.
Yeah, I just want to ask for the difference between one year and two years because I know we've spoken your initial ask was one year okay? Right. So I just want to know what you can pull off so that we can be honest with the public.
Yeah, look I would love to have two years. actually gives us a lot more flexibility and a lot more negotiating power. If we've got something close, I don't want to have to come back here in a year's time and then ask for another year again. The two-year obviates that.
Yeah, I just think that some people have lost a little bit of faith and wondering if we're going to put this together. Okay? So that's why I'm asking those questions. Some people are thinking we went through this once before and yes, are we going through the same thing again?
Well, I would say you've never gotten as close as you are now right? And so we've put in At least six, seven, eight years. And we've come a long ways. But we're talking about building something that kind of looks like Disney on the West Coast. It's a pretty ambitious project and I've had a lot of people say to me why don't you just scale it back and make it much smaller? Then you have much more likely probability of success.
Our view is we have to open pretty strong that if we have something Thank you for the presentation.
2:55 – 3:0312 turns
As you know, I've been a, you know, I've supported this. I thought it was a really good idea. I still think it is but I am part of that group that's starting to wander and so again, I'm not going to be too harsh with you but you mentioned seven or eight years on this project and I think your number was two million? Two point something million dollars raised You and I know that the last five, six years there's been tremendous wealth accumulation especially in the stock market.
A lot of people can now write $50 million checks they couldn't do that before and so I guess I'm the outlier here putting on the pressure a little bit. You engaged the investment bank in March Could you come back in six months and let us know if that was a good move, and if there is light at the end of that tunnel? For me, they might give you two years. And then you might come back with an update that says X, Y, and Z takes a long time. This is the moving parts. We're waiting for this. Here's other places that have done it.
But we're still sitting without getting closer to the end goal. So as I'm playing devil's advocate on this Why should we keep extending when you've only gotten the $2 million raised on something that's going to cost way more than that?
Yeah. I think, I think we're fishing in the wrong pond. I think this capital... You're right there are people that can write some of those kind of checks they are... We have to get in front of them and we haven't done We haven't gotten in front of them. We are starting to now, we are starting to get in front of people that are institutional investors that can write those kind of checks.
So you know, we've fished locally and a little bit of outside and all the way to the East Coast but I think that probably I wouldn't want six months, I'd want at least a year I think that's a fair number.
But I've got kids that started when they're five years old and they're 13 now, and are they gonna be 20 or 25 by the time we maybe get to somewhere? That's where I wanna be that person to put a little bit more pressure on you. So I'll be the outlier here. I'd support something for six months to have an update. And then at that point, I feel like you could give us additional information on potential, and we could extend from that point. I think that would be my position on this.
Council Member Bridge. Well obviously everybody's concerned about how long it takes. I want to kind of get a clearer picture as to, you said eight years but when was the election? November 2024. Okay so 24 and that's when we started in earnest to get The agreement, you call it a DDA or something?
It was basically approved by the county and recorded in December of 2024 after the election. I guess that's a good point until a lot of people said go get the land locked up and then come back and talk to me. And all that time until the election, that's what we had to do. And until we got through the election,
that wasn't... And so now you're probably took a little break but now you're starting and putting a project plan and meeting the essentially get to the EIR and get all the designs complete. Right. And you've been working on that for a couple years? Right. I don't know Dean, You've probably had multiple EIRs come through the system. I know the Tobes project has been going on for what, 20 years?
This is California. It takes a long time to get things done. You said the project plan is essentially 70% complete. That's what I heard.
Yeah, the submission that we have to do with the project description it's called the project description which under CEQA goes to basically everyone, state, federal, FAA, military. Which kind of is a benchmark of what you're going to build is about 70% complete.
And once that's completed then you go into an EIR?
Yeah once that's completed we submit it to the city And also, there's a couple other things which are general plan amendments that we don't think that's that big of deal. But we submit it to the city. They have to review it and tell us it's deemed complete and then we can start the
EIR process. Complete
to go to the EIR? Yeah.
And I think we just... I may have the timing a little off but I think Bodger is going into an EIR and aren't they projecting a year or something along that scale? Two years for their EIR. The election itself probably ate you guys alive, and then to get all the ducks in a row so you could get going forward on your description. I'm not opposed to coming back in six months and telling us where you are but from my perspective your one year is aggressive, to say the least.
I think more reasonably it would be two years so we're not revisiting this but that doesn't mean reporting milestones are not reasonable so I would support a six-month cycle you're back here telling us where you're at and what you've done. I certainly would expect the project description to be all complete by the first six months and probably the EIR started And then we as a community can follow the EIR development.
My personal opinion is if you're successful, and I've been through four of these now. So you've come further than any of them. I remember the one with Andrea Seastrand. They worked on it for five years and didn't get to where you're at. So you should be commended. It's really easy for us up here saying hey how come it's not done? Which I would love to be able to say it's done.
But, you know, and I have to get the council's support. But I would support six-month reporting periods with a two year extension. Let me get public comment. Yeah well I'm just saying what I would support. Okay sure. Can
3:03 – 3:1719 turns
you remind me what you said a little bit earlier. You said you need, so you said the term $50 million and then you said you needed $5 million to complete something important. Can you remind me
of that? Yeah, so the financing big picture is about 160 million total, right? And of which we think of that as made up of, and I had this slide and I cut it OK, so does this have a laser thing? OK. So you can see where we've done roughly 2 million of friends and family in seed. Those yellow numbers add up to about 50 million. The 5 million... Oh, OK, thank you.
So this 5 million first tranche gets us through entitlement, OK? And before I was asking for 5 million, and I've had basically people say don't ask for five. Go ask for 50 of which the first tranche is five. That five million gets us through entitlement. That's the project description. That's the CEQA EIR. That' the planning commission. That schematic design which is very important and then begin our virtual development. So there's a whole bunch of software that in gaming, and that's one of the guys I got a call tonight who said hey look I may have someone for you. It depends on what your meeting goes.
We think that takes 12 to 18 months to complete that. And by the way I think the CEQA EIR isn't due until year three. That's event three. We're talking about event one that we're modifying and moving. That part EIR submission is event three in the document, which is in the papers which you guys were given. And then we think we need another $10 million to get the shovel ready a construction package. So a construction package, we finish schematic design, design development. We finish construction documents, we finish the ride-and-show thematic design that's also quite an important piece and that again takes us another 12 to 18, a total of 12 to 18 to 24 months total including this part here. And then the third tranche is we have a whole bunch of ride deposits we'd have to put down and then we go through bidding and draw permits I was on a call last week.
There is plenty of money for good ideas for loans, construction loans. So I'm not that worried about that. I also have another guy I'm calling tonight who can help me with EB-5 financing and there's $100 million we've got to do there. He thinks he can do roughly $40 million or so. And once you get all that done, you're fully funded and actually We couldn't buy the land until we basically get to opening day, so that happens pretty far down the road.
So
that's how it
all stacks
up.
So can I ask you a question? So I appreciate that. I have no problem with that. I guess where I'm coming from is if this group wants to give you a year, maybe two-year extension and then all you got to hopefully was that you raised $5 million and still have all that excess to raise. We know inflation is happening now, cost is probably gonna go a little bit higher than it is right now at least what you're projecting.
To me I feel like in a year or six months after talking to all of these investors that you now say hey we've actually got the right people, we're meeting on making calls if in a year or six months you don't have insight that you're going even get close to the five million dollars That, to me, creates a lot of hesitancy where if we can't even get to that place and it's taking you years and years and years just to get to the $5 million, how many years would it take us to get to the $35 million? And then the $100 million which probably turned into $150 million by then.
You hear where I'm coming from. When should we put some pressure on you to say hey, you should know at some point whether investors are going to buy this idea or not Well, you're putting pressure on me
now already.
But
I'm one of five. And that's fine. But anyone who is going to potentially invest in this project will go back and look at all these videos when I stood up here and talked about this project. And that would be part of their due diligence. And they will also do due diligence the City Council. Are they really supportive of something this aggressive? So I already feel the pressure.
With our given resources, you know this is not infinite. I don't have infinite time and if I tell my wife quite honestly do I tell my wife if I wasn't doing this I'd be in Ukraine sourcing reconstruction deals and I'm not joking because I've been there three times so this is an opportunity we spent a lot of time on And we think it's pretty unique. Things like this are hard to do, and it takes patience and vision, right? And I hope you're going to be there opening day. We'll probably employ one of your sons or daughters at our location as well as a bunch of other people. So
I don't know about my kids what they're going to do but patience and vision yes the third thing is money yeah And unless this council is able to say, okay well this is a good sign we're headed in the right direction. Then I feel like we're going to set up and no offense it's at some point council has to say hey we're gonna plant a flag you're either gonna meet this expectation or not. And so again we've gone through multiple extensions. I get that the vote happened in 2024. I was very supportive of that.
We're still sitting after all this time now I mean you had us engaging on this 2018-2019? Yeah,
that was pre-COVID. I understand. So we had extensions during COVID because no one could do anything during COVID, right? So we've come a long way. We're talking to the right people. They may say you know we're not interested. I watched that last City Council meeting and you know what I'm concerned that there just isn't the political support. So anyway, you know, we're doing this because we think it's a great idea.
This is a for-profit business. I've had people say to me drop all that Disney stuff and do something much smaller. You'll probably get something built, something done. That Disney stuff is actually what generates the revenue that pays the salaries, that pays the debt, that helps build the park. That brings 300,000 people here that have never been here before.
So I get your frustration and I wish I had a better story to tell. I think we can convert some of these people, some of these investors. I may stand up here in six months and say, I'm sorry, I couldn't find anyone. They just don't like the location, they don't think it's you got the political support those kind of things. I don't think that's the case. I think it takes a lot of guts to actually walk the plank with us but if you think I'm going to be here in two years without any capital without that green thing being bigger that's not gonna happen
I appreciate that. You hear my perspective, but I still think the project is great. I just am surprised there hasn't been a clamoring considering how cool I think the project is. I'm just surprised that so many things are happening out there. People are investing in so many different things, but on this one which seems so great it's not there yet.
Well, I mean that's a fair point and part of it is what business are you in? So if you have investors When you invest in a mutual fund, that mutual fund has basically rules about what it can invest in. If it's a telecom fund, it can do telecom and that's it. We're kind of in hospitality and entertainment. We're in verticals. We'r ein basically space infrastructure, space innovation, and education. All sitting on 82 acres of land. So there's not that many people that are in five different vertical, so if you're a commercial real estate guy, if I was trying to do multi-family homes up on that property, I wouldn't have any problem getting this financed but we're trying to do some education, a lot of entertainment, some hospitality and that's where the issue is.
Finding someone who does all three of those We're So I'm not saying no. There's a lot of people with a lot of money looking to get it into safe places, and California land and entertainment is probably pretty safe. So I haven't broached that yet. I haven't gone there yet, but maybe I should. By the way, sorry, there was one last thing. wants to come in and finance this and buy the company, right? Us.
They have to come to you. It's in the documents but they basically have to come to you and get approval so you still have a vote and basically can cancel a transaction like that. So I can't just bring anyone in here that says they want to finance this. You've got to be acceptable to yourselves and their person has to stand up here and kind of sell you guys that they can finance a project like this.
We're not close to that, but that may come.
Steve, I appreciate your being honest about where you're at and the difficulty in collecting funding. Personally, I think six months is too soon for an update. Right here we're at this date. Your December 5th is actually your contract date, your deadline. It seems like if he were asked to come back in a year should the extension go through at least for one year You could probably be better prepared to give us an update on whether you were able to complete this or where you're at. I'm not sure what you feel about that, instead of a six month update it would be more like a year.
Yeah, especially if the contract date is the 5th. If it's extended from the fifth to a year out or two years, whatever it is. I'm just not sure what you're comfortable with because I think we need an update and it sounds like you have some choices to make also by that time so it's not going to go on for infinity. Right.
It's not going to go on for infinity.
No, and we need to know something You know, they're trusting us to do something with that land and we want you to do it. But hey, never know what's going to happen here. So that's kind of my thing. Maybe the council can think about whether give them a year for an update if you want one in six months I don't think it's enough time from where he's at right now.
Thank you. Councilor Ridge?
I think six month updates would be good. I think the part of the challenge we're facing is for whatever reason that team gets busy and we don't know as a community where's the app? What's going on? So I'm not saying he has to have the milestone, you know, the extension tied to the six months. But I personally would like to hear every six months how this project is going.
Most corporations have quarterly reports so it's twice that. And again, I'm a proponent for not kidding ourselves and giving two years for the next phase because I think that's what it's going to take. But that's just my 2 cents worth. So
I can – I have to write – every quarterly I should be writing investor updates and so I can send that to – I mean, I should be doing that in any case due course. I'd be happy to send that to the proper, they have a lot of confidential information in them but I could clean it up a bit and send it to whoever, the city manager or whoever you think so.

Let me get public comment then we'll see where we go from there. Public comment on this item?
Good evening again, Jan Keller, Lompoc resident. First of all I have to apologize to Ms. Hallenstein for not knowing she moved into the city. I did not know that. So when I first moved to Lompoc in 1988, I looked at all the flatland and said to myself this town needs something how about an amusement park? I did say that. And then as I got more used to Lompoc, I'm saying that would be an awful idea. Absolutely awful idea. Now we're back to the awful idea. Sorry Mr. Frank.
This project started off as an education project now we're pure Disneyland. Twenty-five years ago when I sat on the City Council, right there, an entity kept coming before us. Every, you know, it seemed like every meeting but it probably wasn't that often asking for an extension to do certain things they promised they would do. Extension after extension after extension ended up costing the city $500,000 or more.
We're not out any money. Supposedly the staff's being paid for their time, but I think having six months reviews is essential, but I really don't think you should give this project more extensions. I mean especially this was proposed as a year extension and now we're up to maybe two years extension. Mr. Frank when he pushed to get this measure on the ballot and the council approved putting it on He said that as soon as he can access that land, he'll get the money.
We haven't seen it yet. I don't know if we're going to see it in six months. I don't know whether we're going to see it in a year or two years. I wish him luck. Also, he says there's a bank, middle market investment bank. We don't know the name of that bank and I think if the city is dealing with somebody you need to know where all the chips are. That's my comment.
Anybody else? This item.
Hello, everybody. My name is Joe Matthew. I am a homeowner here in Lompoc. I am also a business owner. My business is located in Solvang. I'm also serving as the marketing director for this project. I started working on it I'm Here in Lompoc, with what is going on in this project. Where are we at? What are we doing? What is the next step? Because I'm a big supporter of it. I have two young stepchildren, one of them who's autistic and who I think is gonna benefit from this facility greatly.
That being said, it has to move forward and I hear what you're saying Jeremy and I hear the other concerns on the council But since I've started on this project, we made leaps and bounds movement towards getting the investment. Not only as Steve mentioned, we started working with an investment bank. We've worked with an intern who has gotten us a bunch of folks that we have been reaching out to that I've been helping reaching out to. And I'm confident that we can get this moving forward. Now, as far as the timeline when we could raise money, I can't speak to any of that. What I can speak to is being here in Lompoc and being a person Folks in this town can come to and ask questions about what's going on with this project. And that's what I'm committed to doing, is being the local liaison representative, whatever it is of this project so that folks can find out what's going on and we can provide updates.
We're gonna still be working with the chamber to table at any events we can in the future. We just tabled at the Future for Lompoc Youth event a couple weeks ago. Again, a lot of people coming up and asking questions but mostly positive feedback coming from the community. Just, what are you doing? We need to know what's going on. And so I do ask that you grant the extension. I understand that, you know, having more than just a yearly review period is good.
I don't see any cause for that to be a problem. But what I would love to do is work closely with you all and the folks here to make sure that people are better informed on what's going on and they know where we're at in this project because I do believe it's gonna make a huge change here in the city of Lompoc. Thank you.
3:22 – 3:287 turns
Good evening. I didn't plan on speaking on this, but I was a prior Air Force officer. I spent most of my career in space and weapons systems. I worked on rockets so you won't find a bigger proponent of space than me. We've spent years talking about economic development, attracting tourism, creating jobs and expanding our tax base. You have a project before you that could do all four in one.
Is it ambitious? Absolutely. Will it take time? Definitely. But the question is, what are the downsides to the city? The park remains open. The city's being reimbursed for its expenses. So overall, the city doesn't have any liability and as far as I understand there's no one else, you know, no other projects lined up for the park that we could sell it to or have any other businesses come in so really, you know, the extension kind of to me is a no-brainer A one-year time limit seems reasonable based on my experience in business. I do like the idea of a six month update just to get a status of where everything is and where they are but the one year actual extension, to give them time to go to these investors to raise some money, to have some confidence that the city's willing to work with them to make this happen.
I don't think there's any downside to the city by giving the one year extension. Thank you.
I support this extension for this project. There's no other place in California that will establish a place like this, it belongs here and for us to have a similar to Epcot Center something in our purview is really going to help the economic advantages to our town but The reason why I got up to say this is because I believe that it will also impact our possibility to get our bridge across the Santa Ynez River connecting Highway 246 to Central, which we should have. If we have this project, I believe that will impact and cause momentum for the state to stop neglecting us.
Thank you.
Anybody else? Anybody on Teams, phones?
There is no public comment via phones or teams.
Seeing nobody else rise we'll close that and bring it back to the council. So understanding some of the complexities and we've got projects in the town kudos they've been 40 years in the making and they're finally happening and sometimes it takes longer. We've seen the roller coaster ride. In fact, we got a skate park that's on what six years Thank you. Understanding what it takes to kind of drive this kind of money to the table and the revenue.
And being able to tell investors that we do support this issue, and it's not easy to go out and raise five or ten million bucks let alone what he's trying to do at the level here. It's been a roller coaster ride economy, you know that? Even after COVID it was still, dollars are still recovering I think it's important to gain confidence with him, with his investors. You can only imagine you go out and you've got three months left and some guy says how much money do you have?
This is not an easy sell with that. I'm willing to make the motion, and you guys all talked quite a bit here that we do two years with six-month updates and align everything accordingly with this so we can get this thing going. So that's the motion I'll make. Made by me and seconded by Bridge. And you guys want to debate, comment or vote?
I have a comment. Comment, yes. Steve, I hope you understand this. I'm definitely outnumbered here. I am going to be a protest vote here But I still love this project and you can change my vote next time if the money shows up. I feel like it's time for the city to, hey, I know it's tough but the 1%, the top 1% in our country have seen their wealth grow by 30% over the last five years. I think that's a stat I saw on financial news.
So there is a lot of money out there and I know it's hard. I know it's a vertical. I know you've got lots of challenges but if you really connected with this bank and they're investors lined up Five million dollars is not a lot of money, from my perspective. I think that's fair to ask and hold your feet to the fire a little bit. I'd love to see it happen,
really would. So even in Fantasyland five million dollars is still a lot of money so... It's a good vote. And that passes 4-1 with Council Member Ball voting no. This is just a follow-up on item number seven, which the

Mayor made a motion, and I wasn't sure what was included in the exceptions because I couldn't hear. And I wasn't sure the MOU with Bodger was included in the exceptions. Was that part of the motion? Because that wasn't clear from where I was sitting. Okay. If it's in there, fine.
Good evening, my final comments for the night. I don't want to sound like a broken record but a lot of people ask why I continue to criticize Mr. Ball. The answer is simple. I live in District 4 and he's my elected representative When I initially went through his form 700s, his first year he had a business called Creative Humanity Incorporated. The next year he listed no business interest and the year after he listed bottle branding. So then I started researching why the change, what the two different companies were.
Later found out they were one in the same. He was operating under a fictitious business license that had since expired with the county so I started digging. For six weeks, I've raised concerns to him about his business licensing and financial disclosures. Yet Mr. Ball has not made any public questions or answers to these questions. We regularly hear about our fire department and other city services struggling for funding yet we appear to have a sitting council member running for mayor whose apparent lack of business licensing raises questions about whether he's paying his fair share to the city.
And this isn't simply an administrative oversight Under Lompoc municipal codes, operating without a required license is unlawful and can constitute a misdemeanor offense. Mr. Ball is here tonight and can answer the four simple questions. Whether his business has an active license and has been licensed since 2011 with the city? Does he have a home use permit?
Did he amend his form 700 as required? And has he renewed his fictitious business registration that appears to have expired in 2022 at the county? If you've complied, show us. If you've corrected the issues tell us but you cannot demand accountability from other elected officials who are refusing to answer questions of your own conduct. Accountability isn't something you get to demand from others while it's something yourself.
Okay earlier in this meeting We were discussing possibly providing utility services to the base. Well, first of all, Vandenberg Space Force Base is a U.S. military institution facility. It's going to be autonomous. It is not going to depend on outside utilities. It is going to remain autonomous But we have Explore Lompoc and Visit Lompoc, which are essentially run by the Patel family.
Why is the city allowing the Patels to run point on the base? Like why isn't the city taking control of the relationship that the city has with the base? Why are they allowing the Patels to get in between that is my question. I don't think that's healthy, and I also don't think it's healthy that our city attorney represented Gilda Cordova personally while he was the city attorney.
I think that is a conflict of interest. So this issue that is being brought up about Jeremy not having business license and no home occupancy permit It just is blowing my mind. How could you be such a hypocrite?
Anybody else? Teams, whatever.
There's no public comment via phones or teams.
I'd
like to thank everybody for paying attention here. Please go out and vote, it's important for Lompoc. There are lots of people out here that say get rid of all the old guys and all the experience but the experience is what's keeping Thank you. Good night.
3:34 – 3:3912 turns
I got to join the mayor at the EDA celebration. That was really fun. We got to pick some winners there for the tablescapes and it just blew my mind, we had a couple of employees that crossed working for the city 45 years No offense, I was two years old when they got hired at City of Lompoc. That's crazy to me so congratulations to all those that have worked so hard to get that. I thought that was a pretty awesome event and then just a reminder the storm is coming in tomorrow it's going to be a little bit interesting over the next few months with El Nino perhaps so just a reminder if you haven't done it sign up for ReadySBCAlerts I don't have any
I did want to cede my time to Councilman Ball if he wanted to address the online post and the business license in Lompoc and secure and support a full transparency. Maybe you can provide an
explanation? I'd love to make a statement. First of all, I found out and thank you for bringing it up that my fictitious name was expired. Had no idea, got no notice so we're going to work on that. I also found out that I did not have a business license. I work from home, my wife and I work at our house, we work on our laptops. I'm a photographer, I go on location, I come back, I edit photos.
I don't have people coming to my house, I don' t do business but I made a mistake so it's on me to fix that. So I have applied for a youth permit and I'm going to sign up for a business license and I'm going to look to pay back taxes You mentioned thousands of dollars. Unfortunately, my wife and I aren't rich. We've made Collectively about $140,000 to $150,000 a year.
So my back taxes if I do owe that and the city finds that I'm liable, I'm happy to pay that and come current. I think what's very different is you are the utility commissioner for a sitting City Council person that is facing criminal charges and I just question a little bit of why you demand and expect me to have a multitude of answers for all of the questions you've asked But I've heard you ask no questions of a person actually facing charges. So let's say this, get my DBA updated.
There's no criminal charges for that if I don't have a business license and I catch up. No criminal charges for that. Integrity is correcting your mistake. The difference between a mistake and what Mr. Bridge is facing I think you're smart enough to know the difference between those things. So, I'm going to make right whatever I need to and be transparent about that. I'm happy to do that and I thank you for spending so much time to figure out everything about me. And I think that's great.
No problem. But let's be very clear. There is only one person up on this dais facing criminal charges and a lot of you have decided to say nothing about that Interesting. So, if you have any other questions I'd be happy to talk with anyone in person but doing the right thing is catching up and making it right and I'm committed to doing that. Thank you.
Councilor Starbuck?
Well lonesome no reports
So in my report I attended the Lompoc Planning Commission, Parks Commission, Utility Commission. I was hoping we had a utility commissioner? You said so.
I've got
one if you don't... He
attended and he's nervous about the
way it's going. Alright. I did also attend the employee appreciation You should almost have that every year. They had too much fun over there and the food was great, too. I also represent the city for SB CAG sub-regional meeting. I didn't make the APCD and CAG meeting. Councilman Stober couldn't make it but I did via Zoom attend the Fish & Game, California State Fish & Game Commission meeting which We did get a 5-0 vote from the commissioners to move forward to the next steps, getting our beach open out there. So woohoo! That's a big movement towards seven years. Been on that battle for seven years. Just to point out
that action actually started in 22 with the prior council
but congratulations. Actually no it started in 19. The updated later came after 2019 just let you know. With all that, we will adjourn to November 17 at 6.30 p.m.
