Madam Chair, members of the board. Item A7, 8, 9 and 10 are all from Alcohol, Drug and Mental Health Services. Item A7 is to consider recommendations regarding fiscal year 11-12 agreements for alcohol and drug program services for the period of July 1, 2011 through June 30, 2012 A8 is to consider recommendations regarding agreements for children's mental health services for July 1, 2011 through June 30, 2012. Item A9 is to consider recommendations regarding agreements for adult mental health services for the period of July 1, 2011 through June 30, 2012. Item A10 is to consider recommendations regarding agreements for adult institutions for mental disease for the period of July 1, 2011 through June 30, 2012 And finally for Dr. Jones, item A18 is from planning and development to request that the board receive and file a report on low-to-no cost incentives to encourage landmarking of historic structures.

UnidentifiedClerk of the BoardProposed · by role4:14 · ≈ 9:04 AM

Dr. Jones?

UnidentifiedUnidentified speaker 5Proposed4:16 · ≈ 9:04 AM

Yes Madam Chair I may be feeling better but I have all the same old issues that I'd like to kind of run by this particular board and I want to remind them that I am the person who was discriminated against By this alcohol, drug and mental health department. So I have a bias here, strong bias and I will not stop attacking this department because I see why. And as you dole out millions of dollars to different services, mental health systems, children's services I'm wondering these different contracts, Santa Maria Valley Youth and Family Services.

And I've never been an employee of the Of the alcohol, drug and mental health. And I'm wondering do they do? What do they do if all these contracts are being being melted out every year 340,000 391,000 in 89? I mean what do they actually do then at that department now we know that they've had 50 homeless deaths In the years gone by, and I'm seriously wondering why all these contracts. Are there anyone in that department that does any services whatsoever?

And of course that's a rhetorical question. I would never get an answer to that question. But I want to remind you that five years ago, almost six years ago when I applied for this position and was discriminated against. And I'm going to tell you something, I'm a well-qualified clinical psychologist When I was discriminated against, I didn't know at the time that California, the State of California was called this department. The worst department in California. The Alcohol Drug and Mental Health Department. That's a good reputation for you to, you know, carbohol. This is the worst department in California.

And at that particular time This county from their general fund gave $16 million to that department to prop it up. And that's one of the reasons why we had so much of a budget problem and I've made recommendations, of course they will go unheeded. We need to cut this alcohol drug and mental health department out of the county get rid of it. And I said that you need to Cottage Hospital and draw up a contract because they're the only legitimate and qualified and certified hospital in this county. And why this Board of Supervisors have not went to Cottage Hospital, I believe so much corruption has gone down that Cottage Hospital will, you're tainted so much corruption.

Cottage Hospital probably wouldn't take you. Now, I've heard in the past that you have attempted to make some negotiations with County Hospitals. I don't know what's really going on but that needs to be looked into. We've had too many deaths, we had too many children who go to services for the alcohol drug and don't get served, too many poor people. Now I know one thing and I'm a veteran, veterans Veterans Administration has worked out a deal whereby any veteran can walk into Cottage Hospital and get services.

And then they're referred out to West LA.

UnidentifiedClerk of the BoardProposed · by role8:18 · ≈ 9:08 AM

Dr., just a gentle reminder that you want to talk about 18 also.

UnidentifiedUnidentified speaker 5Proposed8:23 · ≈ 9:08 AM

Yes, thank you. Let me just move to 18 very quickly because this is an issue that I have. The planning department refuses in their landmarking historical when there's a historical structure comes up to be diggings and they refer to that as we have a tribe here called the Chumas Indians And this planning and development refuses to refer to any historical structure that has diggings and markings of Chumash, they refuse to refer to it as Chumash.

There's a historical bias here. I want to tell you something. If that were black historical diggings, I'd turn that over in a second. You would not You would refer to those diggings as African-American black.

UnidentifiedUnidentified speaker 1Proposed9:25 · ≈ 9:09 AM

Yes, we have. Next speaker is going to be Jeffrey Bard and he has requests to speak on item A39 and A40.

UnidentifiedClerk of the BoardProposed · by role9:32 · ≈ 9:09 AM

39 and 40 did you say?

UnidentifiedUnidentified speaker 1Proposed9:33 · ≈ 9:09 AM

Yes.

UnidentifiedClerk of the BoardProposed · by role9:34 · ≈ 9:09 AM

Okay. And

UnidentifiedUnidentified speaker 1Proposed9:34 · ≈ 9:09 AM

I can read those into the record. Item A39 is from the County Executive Office. It's a set of hearing for August 2nd to consider recommendations regarding the community or the recommended community wildfire protection plan. And item A40 also from the county executive office is to hand a set of hearing for August 2nd to consider recommendations regarding the Mission Canyon Community Wildfire Protection Plan.

0:09 – 0:1719 turns

UnidentifiedClerk of the BoardProposed · by role9:54 · ≈ 9:09 AM

Thank you. We'll ask you to speak on both of them.

UnidentifiedUnidentified speaker 6Proposed9:57 · ≈ 9:09 AM

Yes, ma'am. Good morning Madam Chair and members of the board. I'd like to thank you for supporting the community wildfire protection plan and I would urge you to use your powers of persuasion which are formidable to encourage constituent involvement I have attended a number of wildfire and disaster planning events which were under-attended. Chief Dyer came out, I believe to the Wake Center with one of the lieutenants from the Sheriff's Department. There were some people but maybe 15 but there are about 15 people from Red Cross Fire Department and Sheriff's Department staff So I thought maybe the ratio could be improved.

And I attended a disaster planning meeting with a nationally known citizen disaster planning activist at the Carrillo Street Firehouse, and it was on a sunny Friday afternoon with the beach only a few blocks away and so forth that was also dramatically under-attended. But I noticed that this room was packed When the Mission Canyon got a little remodeling after the fire at the Botanical Gardens, and I think they wanted 12 little fundraisers annually.

And you just would have thought somebody was trying to put a Hells Angels You know, regional clubhouse in Mission Canyon Road. Just people just came in here with such a negative bias they actually described the botanical gardens as a public nuisance and that they described it as an attractive nuisance And I don't like to throw around the term NIMBY, not in my backyard. It's kind of an overused expression but I can't think of another way to characterize it. So I would urge the board to challenge your constituents if everybody wants to get out and throw vegetables and put the really very highly qualified staff of the botanical gardens in the village square and pelt them with vegetables, it was rather unseemly in my opinion.

Just the sheer momentum of the negativity that sometimes develops in public forums is a peculiar phenomenon and it's not helpful to policy makers because you are accountable to your constituents and when kind of negative attitudes develop, you know, you have to reckon and account for it But really when you talk to your staff and professional staff, you get this passionate calm rational analysis. You realize a lot of times I don't want to say mob mentality, but just the sheer momentum that develops on negative policy proposals is an ongoing problem throughout history and it's with us on a daily basis. So I would hope that you will challenge your constituents to take the same level of interest in wildfire protection planning that they take in things like squashing noteworthy projects like the botanical gardens And if they're concerned about what's going on in their backyard, they should be.

It's healthy. Well let's get out there and listen to what Chief Dyer has to say because he's very knowledgeable and he's pointed out the Australian experience has demonstrated quite clearly that staying defendant will get people killed. And there's still people out there that want to stay and defend. There are still people out there that have those little muzzle-loading gizmos in their garage, and we don't want a tragic situation. We don't want explosions. We don't want our fire personnel not have properly posted notification.

Similarly... Well, let's just leave it to the planning process Hopefully there will be better support going forward for disaster planning and in all phases. And if I may, regarding the other Item that's quite related is the tobacco control in the parks. It's very important, and there's a lot of naive people that come from L.A., not to pick on L. A., or San Francisco, and they think oh how nice out in the woods let's have smoke. No we don't smoke in our parks. I'm sorry. That's a different agenda item. You know I think you're kind

UnidentifiedClerk of the BoardProposed · by role14:45 · ≈ 9:14 AM

of wandering a

UnidentifiedUnidentified speaker 6Proposed14:45 · ≈ 9:14 AM

bit so thank you. Well it's related to fire but I

UnidentifiedClerk of the BoardProposed · by role14:48 · ≈ 9:14 AM

didn't write the

UnidentifiedUnidentified speaker 6Proposed14:48 · ≈ 9:14 AM

number.

UnidentifiedClerk of the BoardProposed · by role14:49 · ≈ 9:14 AM

Thank you for your comments.

UnidentifiedUnidentified speaker 6Proposed14:50 · ≈ 9:14 AM

No smoking in the

UnidentifiedClerk of the BoardProposed · by role14:50 · ≈ 9:14 AM

park. Mr. Carbajal since we already pulled 18 do you want to give us your thoughts on that?

PresenterMaureen SpencerProposed · by introduction14:57 · ≈ 9:14 AM

Yes, without objection I'd like to ask my colleagues and staff to bring A18 back as a departmental hearing. This is a very important item that deals with incentives to encourage landmarking of historic structures and I think we really need to look at this to see if we might be interested in pursuing short-term or long-term incentives for encouraging folks to pursue land marking in our communities.

I also would appreciate it if the report could come back in a little bit more of a priority order, not just here's everything but rather here are some low-hanging fruit, here are some things that don't cost money, here are some things that are intermediate and what have you. But the reason I think it's important is that this report was a really good report But to not engage in that discussion, I think doesn't do a service to our community and the Historic Landmarks Commission who worked diligently with our staff. So I would appreciate it if this could come back, not necessarily in a week, it could even be two or three weeks, but it come back right and it come back so we can discuss

UnidentifiedClerk of the BoardProposed · by role16:08 · ≈ 9:16 AM

it. That's no problem. So Supervisor, why don't the both of you if you have an opportunity just check with planning and make your suggestions because obviously you're saying something that I don't understand and maybe they don't.

PresenterMaureen SpencerProposed · by introduction16:25 · ≈ 9:16 AM

Madam Chair, since I have learned more and more about making motions to the extent that I can if it's appropriate I'd like to make a motion that this item come back as a departmental item And with a little bit more sense of priorities.

UnidentifiedClerk of the BoardProposed · by role16:37 · ≈ 9:16 AM

And you'll drop by planning and say, these are the things I'd like to see happen?

PresenterMaureen SpencerProposed · by introduction16:40 · ≈ 9:16 AM

Yes.

UnidentifiedClerk of the BoardProposed · by role16:41 · ≈ 9:16 AM

Thank you. Is there a second to that motion? Oh we need a date. Mr. Allen do you want us to do a

PresenterMaureen SpencerProposed · by introduction16:47 · ≈ 9:16 AM

date? I think as long as it comes back in the very near future.

UnidentifiedClerk of the BoardProposed · by role16:49 · ≈ 9:16 AM

Okay come back.

PresenterMaureen SpencerProposed · by introduction16:51 · ≈ 9:16 AM

Motion has been made.

UnidentifiedClerk of the BoardProposed · by role16:52 · ≈ 9:16 AM

Is there a second? All in favor? Aye. Opposed? Okay, thank you Supervisor. Supervisor Farr asked for 12, 17 and 20. Lavinino asked for 30 and Wolfe has asked for 33 so let's go to 12.

0:17 – 0:194 turns

UnidentifiedUnidentified speaker 1Proposed17:07 · ≈ 9:17 AM

Madam Chair, members of the board item 12 is from the County Executive Office the request that the Board approve budget revision requests

UnidentifiedUnidentified speaker 4Proposed17:13 · ≈ 9:17 AM

Supervisor Farr. Thank you, Madam Chair. You know we obviously have a lot of budget revisions here but the department that I wanted to point out specifically was ADMHS. I see Dr. Dietrich here And this kind of goes back to our budget discussions, and one of the restorations that unfortunately we weren't able to make but is I think very important for the community and what we were able to do last year was $300,000 for CARES and the medication.

I just wanted to point out a couple of transfers in

UnidentifiedClerk of the BoardProposed · by role17:51 · ≈ 9:17 AM

particular. Give us the number of the transfers so we all know where

UnidentifiedUnidentified speaker 4Proposed17:53 · ≈ 9:17 AM

you are. Okay, I'm going to work from the back forward 1535, 1446 and particularly 1158 which is on the first page. There's a lot of money being moved around in various ways and I just wanted to express that I am still very concerned about finding To support that, I think that is really important because it's very cost effective. And if we aren't able to take care of people in that way then they are going to end up in the jail and they're still going to be costing us a lot of money and they're not going to be treated in the way that they need to be treated. So I would just charge Dr. Dietrich and the department when they are making all these transfers or they have this large unanticipated revenue, if there is a way that we can start to address this problem, even one part-time psychiatrist.

I think there were two that got cut and find the money to provide some of that care that looks like it's going to be lost for the CARES program. And that's my comment for A12. Did you want me to go ahead to A17 now? Yes. On A-17, I would just like to continue this item to the 5th. I have not had an opportunity to talk to Mr. Roney about this and I have a number of questions which I think can be resolved but I think that there's some more information than we need that we don't have here at this time so if the board is in agreement I'd like to continue this to July 5th

0:19 – 0:2321 turns

UnidentifiedUnidentified speaker 4Proposed19:27 · ≈ 9:19 AM

UnidentifiedUnidentified speaker 7Proposed19:35 · ≈ 9:19 AM

Madam Chair, Supervisor Farr, the current agreement expires on June 30th. This takes effect on July 1st. We could seek a temporary extension but we were hoping for approval.

UnidentifiedUnidentified speaker 4Proposed19:47 · ≈ 9:19 AM

Well, I'm sorry you waited to the last minute. You didn't talk to my office ahead of time because this is talking about going from the homeowners group to a private non-profit. It doesn't give us the audited statements. It doesn't give us the amounts. There's a lot of information I think that's missing here.

UnidentifiedUnidentified speaker 8Proposed20:09 · ≈ 9:20 AM

Chairwoman, Supervisor, I think it's very reasonable to bring it back at our July meeting and in the interim if you can talk with the folks that are subject to the current agreement and see if they wouldn't informally be willing to continue those efforts until we can get back.

UnidentifiedUnidentified speaker 7Proposed20:23 · ≈ 9:20 AM

We'll take care of that.

UnidentifiedClerk of the BoardProposed · by role20:24 · ≈ 9:20 AM

A motion to continue to the fifth? Seconded. All in favor say aye. Aye. And Supervisor Farr did say that could go on the administrative agenda

UnidentifiedUnidentified speaker 4Proposed20:36 · ≈ 9:20 AM

And the

UnidentifiedClerk of the BoardProposed · by role20:36 · ≈ 9:20 AM

next

UnidentifiedUnidentified speaker 4Proposed20:36 · ≈ 9:20 AM

and then my last one is a 20 and I just had a question for planning and development. I know that the situation with this property, I think it's absolutely appropriate at the APAC and P&D would bring this forward for non-renewal. I guess I don't know enough about the Williamson Act though to understand why When it's this kind of a situation, we have to wait the whole 10 years for it to expire. I can understand if the contract holder wants to get out of it but in a case where they are non-compliant why they would be able to continue to get the property tax benefit once the APAC says that they're not following the rules?

Maybe the Ag Commissioner can talk about that too, I don't know. Dr. Russell?

UnidentifiedUnidentified speaker 9Proposed21:23 · ≈ 9:21 AM

Madam Chair, Supervisor Farr. I'm not sure I have all the answers to your questions. The APAC chose to wind it down through the normal cancellation process and you're correct that the tax benefits remain and diminish over a 10-year period. Why they chose not to take a more drastic measure such as cancellation I really can't speak to that, I'm not sure what their authority would be. We can certainly look into that and bring that information back to you or perhaps you might want to contact the Ag Commissioner's office directly because our role is somewhat peripheral in that regard.

UnidentifiedUnidentified speaker 4Proposed22:07 · ≈ 9:22 AM

Okay. But the APAC would have the power to speed up a cancellation process if they thought it was appropriate?

UnidentifiedUnidentified speaker 9Proposed22:13 · ≈ 9:22 AM

I'm afraid that I would give you incomplete or incorrect answers, so I really would need to look into that. So we're asking

UnidentifiedClerk of the BoardProposed · by role22:20 · ≈ 9:22 AM

the wrong person here.

UnidentifiedUnidentified speaker 9Proposed22:21 · ≈ 9:22 AM

That's

UnidentifiedUnidentified speaker 4Proposed22:21 · ≈ 9:22 AM

possibly so. Well, I do think this is a really important issue considering, you know, the importance of the Williamson Act to this county. So I think just from an informational standpoint it would be good if the Board had that information. I certainly would like

UnidentifiedClerk of the BoardProposed · by role22:34 · ≈ 9:22 AM

You know, we could put this to the foot of the calendar and ask an attorney that handles this to come back at the end of the meeting and cover that. Would that be okay with you? Yes, that would

UnidentifiedUnidentified speaker 4Proposed22:44 · ≈ 9:22 AM

be wonderful. Thank you.

UnidentifiedClerk of the BoardProposed · by role22:45 · ≈ 9:22 AM

Item 33, some social services. The request that the Board of Proven Authors and the Chair to execute an agreement with the Family Care Network to provide an independent living program for Child Welfare Services probation youth for July 1-11 through June 30, 2012 at a cost not to exceed $192,000. Supervisor?

CommentExxon MobilProposed · by introduction24:21 · ≈ 9:24 AM

Thank you. I'm just bringing this contract up for review. I sit on the Foster Care Advisory Committee and the issue of independent living programs for foster youth has been discussed in detail, and I think we're extremely fortunate to have Ms. Gallagher who oversees this program, Ms. Gallagher is in the audience. She has mentioned that this particular program is now going to be executed by the Family Care Network and so I had an opportunity to review the contract in detail it's probably one of the more detailed Contracts that I've seen and I think many of the stakeholders that have had issues maybe in the past about what will be done in this program.

The answers are here there's a lot of monitoring that your department will do. I think whenever we do these contracts with outside providers, it's important to have that component and I think it's really well defined in this contract. The one thing that I did not see in this contract Ms. Gallagher I brought this up when we were doing the mental health contract with the Sheriff's Department for the jail. And that has to do with a level of education that these folks are going to be providing, and I didn't see it in the contract. Are they social workers? Are they licensed social workers?

Are they required to have a BA degree? What are the educational requirements?

UnidentifiedClerk of the BoardProposed · by role26:19 · ≈ 9:26 AM

What number on the contract would that

CommentExxon MobilProposed · by introduction26:21 · ≈ 9:26 AM

go under? It's number 33 and it's just, it's not listed. It's not noted so I'm just asking for information purposes because there is so much that's in here. So if you could

UnidentifiedUnidentified speaker 10Proposed26:38 · ≈ 9:26 AM

Ms. Gallagher Thank You Supervisor Wolfe through the chair yeah the independent living contract is one that we are Spending, I would have to say a great deal of staff time in trying to ensure that the youth have very detailed and robust curriculum. And the staff that the Family Care Network will be utilizing will have at least an associate degree with years of experience in working with kids in this type of program. These are not inexperienced people, in fact I think I'm not positive and Deputy Director Nara can correct me if I'm wrong but I believe most of these folks do have BA degrees that will be working with the staff but we do ensure that they have experience some years of experience in working with the youth The program has been with Community Action Commission in the past.

They've done an absolutely fabulous job, but through our RFP process it's transitioning to a new vendor who we also have a great deal of experience with so we have great faith and where the program is headed

CommentExxon MobilProposed · by introduction27:48 · ≈ 9:27 AM

All right, well I have great faith in you and your department in pulling this together. You know another question there's a allocation for rental space and yet they're serving three distinct populations Santa Barbara, Lompoc and Santa Maria is there one office but the case workers go out and meet with the kids in these different locations how does that work?

UnidentifiedUnidentified speaker 10Proposed28:14 · ≈ 9:28 AM

I know that, Supervisor Wolf through the Chair, that Family Care Network has an office in Santa Maria and we do ask for countywide services. We expect countywide services. I'm not sure exactly what that rental is for.

UnidentifiedUnidentified speaker 11Proposed28:27 · ≈ 9:28 AM

Madam Chair, Supervisor Wolf, they will be stationing a coordinator in each of the regions in Lompoc and in Santa Barbara. The part of the rent is we have several contracts with them I'm just wondering if you could share with us.

An adjudication of a case before the California Supreme Court or one of the circuit courts dealing with foster care and foster services and the adequacy of those foster services. And the level service or compensation that needed to be provided, and I didn't see during our budget deliberations that impact in any way shape or form. And I know it's my understanding that it's going to affect us by about 500,000 And I'm just wondering if you could briefly touch on that, and obviously later on come to the board.

UnidentifiedUnidentified speaker 10Proposed29:41 · ≈ 9:29 AM

Absolutely. Supervisor Carbajal through the chair. This was a lawsuit filed, class action lawsuit in the state by foster parents, foster home parents protesting the lack of increases over, I think, a period of eight years in their monthly rates. So whenever a child is placed in a foster home there is a monthly rate set according to their age. These rates are typically adjusted annually they have not been adjusted for many years the Foster parents filed a lawsuit against the state of California. They prevailed. That ruling just came down last week during budget hearings, the final ruling. We knew that it was being adjudicated. The final ruling came last week and we did provide CEO Waller and her staff with the estimate which is around $500,000 local funds that would be required annually to pay these increased rates.

The suit really did not address level of care, so the level of care will remain as is. It really was just addressing the rates, the monthly rates that are being paid. Thank

As to Mr. Switzer's property, non-renewal is the most usual course of action. It doesn't preclude any other course of action that we might take. Our other remedy requires litigation and it would be to stop the nonagricultural activities that have caused the non-renewal to be filed and recommended The tax benefits enjoyed are very minimal because the non-agricultural improvements on the property are taxed at full value. I tried to contact the assessor's office to get the exact amount for you, but I was unable to do that.

morning Madam Chair and members of the Board. I would urge you to urge the Legislative Policy Committee of this board, or of the county, to place heightened scrutiny of any legislation affecting electricity generation, Diablo Canyon Power Plant and the Public Utilities Commission activities. There is, I believe July 7th PUC meeting that will be quite pivotal.

I would like to suggest that maybe our lobbyists who are a very capable couple of people that we're fortunate to have although there is an expense associated they could get on some analysis of whether or not we are incurring expenditures for disaster planning or should Incur expenditures for disaster planning as a result of Diablo Canyon Power Plant, but are not participating in property tax revenue. Now we do have a lot of folks in Santa Maria and elsewhere particularly North County who are employed at PG&E and at the various subcontractors at Diablo Canyon Nuclear Power Plant And we're grateful to have the employment, and we want to keep the employment. And as a Labor Democrat I've many times emphasized, I think that nuclear power, as per President Obama's recommendations, and our very capable Steve Chu, Department of Energy, I think yes, we're going to continue to have nuclear power in Diablo Canyon probably unless these 3D seismic studies come up with some surprises.

So keep an open mind, but I think if there are some concerns and questions amongst your constituents you might even want to talk to Dr. Wada about whether or not we have inadequate at least baseline epidemiological study I was in contact with Lois Chaps regarding baseline epidemiological studies after the disaster in the Gulf of Mexico pertaining to oil. And that wasn't the only one that probably encouraged that, but I was part of the pressure and Lois did introduce legislation getting baseline epidemiological studies enabled through the CDC and to look at also funding mechanisms for county public health departments. We need to have baseline epidemiological study Because if we do have some oncology incident developments, if we have differential incidences of oncological pathogenesis, we need to know about it.

And not to be alarmist at all, as you know I'm an anti-cigarette, anti-smoking, anti-tobacco fanatic. I almost get carried away. I think cancer is a serious thing. I'd like to apologize if anyone in the audience was offended by my remarks, pooh-poohing the possibility of cancer cause. I apologize for that. Thank you.

Thank you, Madam Chair. Never before has this county ever had the level of corruption that it has now. I don't know what happened back in the day when we had Sneddon as District Attorney but I'm sure there was a lot of corruption then but I'm talking about let's bring this up to date here now. We have a First District Supervisor who refuses to apologize for racial slur that is the First District Supervisor And elected official Ecevides, Glida. They both perpetrated a racial slur on an ethnic American, an employee of the county and the district attorney's office? No one responded to this. The County Council doesn't respond to this.

Now I want to sort of link some of this corruption to other things that have gone on. If there is no response to this type of corruption, no one apologizes. Then this type of corruption can be linked to other types of issues like the Farr election campaign and when Santa Barbara Sheriff sees reported political corruption, ballot stuffing, Isla Vista and we know that Farr couldn't have won that election And that's the same type of corruption that goes on in the South with black people.

It used to go on, and see so we know that the Democrats in this particular town, and I want to say this Carbo, any Democrat who votes for you and you Farr are racist. See, I can link that to voter ballot stuffing to the South right here to Santa Barbara That's the level of corruption here in this particular county. And it's going on, on a daily basis. Now when the Santa Barbara County Sheriff says, hey you know there's something wrong here and this board overlooks that?

Says anything about it? I'd like to see the grand jury take this in hand and look at the far corruption. You see, I think that the environmentalists are way out of control. You carbohauls giving them so much money They don't know what to do with it. They have so much money that they can involve themselves into election fraud.

Thank you, Madam Chair and Board. This will be a little easier topic for you guys. I live in San Andes. I'm a retired Forest Service Deputy Fire Chief. I have 40 years experience so I do a lot of firefighting and I'm going to talk to you on the emails I sent you about your chance to respond to the EIS that the Forest Service has produced. Okay? It's a draft EIS. We have until June 27th to get our comments in. I talked to Deputy Cheapaw and he's working on it, so that's great. So you must've heard my emails or you guys are on it, so that's good.

I just want to reiterate within this EIS there are fatal flaws in it. One, they includes the entire United States, okay? And there was no one from Southern California consulted. Only one person in California was consulted, okay? So that's too broad of a document. Number two, the alternatives. The first alternative was to restrict all use of aerial fire retardant on our wildland fires. Okay?

And that's in the EIS said there is no impact. Well we all know fires get larger without the retardant there so just erosion and damage and threat to life is going to be huge. That's a bad alternative. Number two alternative, their proposed alternative goes back to the 2000 guidelines and it restricts retardant use in waterways okay? And you can drop them in there with exceptions of life property and resource damage okay so it gives you some restrictions but that's still restricting I believe too much.

Their preferred alternative has more restrictions And it's in waterways, threatened and endangered species and cultural sites with only one exception. You can drop in one of those areas and that's for It doesn't care anything about property. Our infrastructure, homes, that won't make an exception to drop in there. This is big time. So I just want to encourage you, we need to use the retardant. It slows and stops fire progression. We can use it to redirect fires. It buys time to get the firefighters in.

And it's a safety factor for firefighters and the public. We currently have about a 98% success rate on initial attack, and we need to keep that going so my input has been to reduce the area Instead of the United States, let's look at it on a county level. Let's not have any restrictions during initial attacks so we can go get these fires when they're just starting. That's key. Keep them small.

No restrictions on retardant in the interface areas and definitely let's allow use for life property and protection natural resources. And I'm available if you guys need me for anything. Say I'm Air Operations Branch Director on Incident Fire Teams. I'll be available. And thanks again for the opportunity.

UnidentifiedUnidentified speaker 1Proposed1:03:41 · ≈ 10:03 AM

Hi, Madam Chair and members of the Board. Item 1 is from Parks. To hear and consider recommendations regarding ordinance amendments to allow enforcement of Chapter 26 parks and recreation rules and regulation of Chapter 37 tobacco control through the administrative filing process under Chapter 24A.

UnidentifiedClerk of the BoardProposed · by role1:03:56 · ≈ 10:03 AM

Thank you. And Brian I do that all the time. Let's just get to the meat of the item.

UnidentifiedUnidentified speaker 7Proposed1:04:01 · ≈ 10:04 AM

No problem, Madam Chair. The revisions to Chapter 24A we're requesting today would allow us... Chapters 26 and 37 are what our staff enforces in the parks right now. 26 is with regular parks and recreation rules. Chapter 37 deals with tobacco use in day-use parks. 26 and 37 do not allow for any collection of fines or fees by the Parks Department. The current revenue is going to the local Superior Court, and the Parks Department has significant enforcement costs with these actions such as uniform vehicle use, mileage, staff time.

And we are seeking the ability to collect these fines through the Administrative Fine Ordinance which would greatly offset those enforcement costs in the county parks. Proposed amendment seeks to enable the Parks Department to administer the enforcement of 26 and 37 through the administrative fine process, which has been done with some other departments recently.

Staff will be able to use the administrative fine ordinance to ensure compliance with Chapter 26 and Chapter 27 in our parks. And any appeals resulting from the administrative fine process will be heard by the Director of Parks or his or her designee as allowed for in Chapter 24A. We're approving, recommend you approve all three actions on the board letter and consider a final reading on July 5th, 2011. I'm happy to answer any questions.

UnidentifiedUnidentified speaker 7Proposed1:05:46 · ≈ 10:05 AM

Madam Chair, Supervisor Carbajal, yes it is our hope with these offset fines coming to the department that it will afford us to hire additional extra help for enforcement because we have a lot of parks. For example, we recently received a report from Alcohol Drug Mental Health Services of a butt count report which is something they provide to us which tells us where we need to focus our enforcement on tobacco smoking in the parks and they go around to our parks and actually conduct a butt count.

That gives us a target area that we need to focus on, and we just don't have enough staff to do it. So it's our hope that through this process we'll have enough funds to hire additional staff.

PresenterMaureen SpencerProposed · by introduction1:06:19 · ≈ 10:06 AM

UnidentifiedUnidentified speaker 7Proposed1:07:19 · ≈ 10:07 AM

No part of Chapter 24A allows for administrative process that someone receives a citation for say smoking in the park and they feel like they want to appeal it instead of going to court, they would file an appeal with the department and we would have a hearing which is established through 24A. And for example, the Fire Department currently does that. UnidentifiedUnidentified speaker 6Proposed1:08:24 · ≈ 10:08 AM

Madam Chair members of our I'll be brief. I apologize for lapsing into comment on this topic during administrative. I thought this was administrative. As you probably know, anti-tobacco measures. And a lot of people in the community who do smoke are highly resistant, but a lot of people who smoke understand that they're trying to quit and appreciate some help with it.

It's not just the horrible toll of human cancer and human emphysema. The environmental impact to fish and marine mammals is quite a bit more than most people realize. And the cigarette butts in the watershed get washed into the creeks and it ends up in the ocean, and there's been new scientific studies have come out demonstrating quite clearly that there are very, very bad impacts on our fisheries from cigarette butts. There are millions and millions of cigarette butts going into our ocean all the time. They're sequestering toxins of all kinds, and even the composition of a freshly manufactured cigarette butt is a highly difficult problematic thing. If a dolphin or a whale or fish ingests it and gets those poisons in it that harms our fisheries.

And we need to focus more on keeping our fisheries healthy and alive because they've been hit with this MPA process. And that's been very painful to a lot of the people in our fishing communities. So one of the things we can try to give back to them is to sustain the fisheries and health of the marine environment, and that includes the watershed. Some people don't get it. I'm going to try to cut this short but as I was saying earlier, people come from the big city and they say, oh nature, and they light up a cool menthol or they light up a Marlboro.

People need a little teeth in it and say, hey you know what? That's bad. Don't do it. It's killing you and it's killing our oceans. So for the sake of everyone including the smokers themselves I think we need to help people. And I actually very seldom collaborate with the Milpas Community Association but I did speak to their director about tobacco control and I was informed that most likely that their membership would be highly supportive of tobacco control So let's get going with it. The final point is I'd love to see the money go to Guadalupe Road restoration, but my understanding was that if a sheriff's deputy tickets you, the money goes in to the general fund of the money. But if you get ticketed by a fish and game warden and I would presume by a citation authorized parks employee that that ticketing would then go to parks.

No, it would go to ammo for the kids up at Winchester Gun Club and I support that. I think this is a great youth program for teaching kids responsibility with firearms so I'd like to see them have that money. Thank you.

Dr. Jones our final request.

CommentExxon MobilProposed · by introduction1:12:34 · ≈ 10:12 AM

Thank you Madam Chair. Mr. Browning I was just looking on page two of Attachment A, the ordinance. And as you mentioned, that this ordinance was drawn up for fire and planning. And given that I look at subsection B and there's what says the notice of violation shall specify, and then there's five items. So it seems that item number four Where it says that in the event that the violation is not corrected by the expiration of the specified time period, the owner shall be subject to an administrative fine under this chapter.

So I don't... The wording of that Like I said, it sounds like it fits well with fire and planning. But if you're talking about someone who is receiving a citation for smoking that this number four doesn't necessarily fit because you're talking about an owner and that in the event the violation is not corrected. Well there is no correct... If someone is smoking They get the citation.

So I'm wondering if you can explain that?

UnidentifiedUnidentified speaker 7Proposed1:14:03 · ≈ 10:14 AM

Madam Chair, Supervisor Wolff, I'd have to defer to Council on that because it's not clear of the definition of correctable.

UnidentifiedClerk of the BoardProposed · by role1:14:10 · ≈ 10:14 AM

Council?

UnidentifiedUnidentified speaker 3Proposed1:14:12 · ≈ 10:14 AM

Well following the pattern that we have for fire and petroleum there is as I recall a noticing period before citation issues So we could look at that for this particular issue. I don't believe, and it's been a while since I've looked at the statute, I don't believe the statute requires a notice. I think that's been something that in P&D application and fire application had been more reasonable. But on a one-time violation, it may be more reasonable to look at modifying that for instant citation because it's not something that really lends itself to correction.

CommentExxon MobilProposed · by introduction1:14:51 · ≈ 10:14 AM

Yeah, I think that's exactly right. And I'm glad you because what you just pointed out was number two in the subsection about time frame of 30 days from receipt of the notice of violation and again This is different, this is a citation that happens immediately. So it seems to me Madam Chair that this may need to go back and be kind of reformatted a bit to incorporate the parks issue. I want to say that I think this is a really good thing.

It's cleaning up what needs to be done, but I think to make it right we need to send it back and have maybe county council work with you on fixing this ordinance.

UnidentifiedClerk of the BoardProposed · by role1:15:41 · ≈ 10:15 AM

Madam Chair, members of the Board, Item 2 is in Public Works. It comes to the board as the Board of Directors of the Flood Control and Water Conservation District. It's a hearing to consider recommendations regarding the flood control benefit assessment program for fiscal year 2011-12.

UnidentifiedClerk of the BoardProposed · by role1:17:39 · ≈ 10:17 AM

Mr. Fahram, flood control.

UnidentifiedUnidentified speaker 14Proposed1:17:43 · ≈ 10:17 AM

Good morning, Madam Chair, members of the Board. Each year the Flight Control District comes to your board for setting our benefit assessment rates for the coming fiscal year. As I'm sure you recall, the benefit assessment rates for flight control are voter approved assessments and that assessment includes an annual CPI adjustment. The CPI adjustment that's used is the Los Angeles All-Urban All-Consumer CPI which for this year is a 3% increase.

To give an idea of what these assessment rates mean to the average homeowner, this chart shows for the various flood zones throughout the county. It averages from just over $3 per house per year to $21.85 per house per year on the South Coast. Our recommendations to you Madam Chair and members of the Board is to approve items A, 1 & 2 with a first reading in the Ordinance Amendment. We will return to your board on July 5th for the second reading and final adoption Of these assessments and these assessments were also included in the budget for fiscal year 1112. And with that, I'd be happy to answer any questions you have.

Thank you Supervisor Farr. Thank you Madam Chair. Mr. Fairroom what is Santa Ana's number one?

UnidentifiedUnidentified speaker 14Proposed1:19:03 · ≈ 10:19 AM

Madam Chair, Supervisor Farr, San Ynez flood zone number one is the San Ynez flood zone. I'm not sure back at the time in the 60s when these zones were set up they had a number associated with them and I don't know what that number means. They just carry over but some of them have a number and some of them don't.

UnidentifiedUnidentified speaker 14Proposed1:20:16 · ≈ 10:20 AM

Madam Chair, members of the board as a follow-up one thing that our benefit assessment program helps pay for is our annual maintenance plan. This I believe is our 20th year of the annual maintenance planning process which began back in 1991 Our annual plan process includes a comprehensive process starting in March when the rains are just ending, which include creek inspections, development of project descriptions, making those materials available to the public. We have two public workshops of which we had one member of the public attend but their question was on the Lower Mission Creek Project and not on our maintenance program.

And then ultimately ending up here at your board for approval Annual plan, which then would allow us to go seek the necessary state and federal permits. The schedule would have us starting the work in August and we seek to complete all of our maintenance work by December. Just some of the work that goes on throughout the year, removal of large debris plugs, stabilization of various creek banks and restoration of various channels.

This year we have 31 creek segments, 31 creeks with multiple segments in our annual plan. That's on the large, on the upper end of our annual maintenance planning process but that is partially because of the size of the winter that we had last year and also because of the presence of endangered species these facilities would no longer be exempt and require secret review.

A picture of the Haysa Cedar Fire watershed recovery recovering quite well, which we're very happy about. Madam Chair, I'd answer any questions. I have

Madam Chair, unit two is actually a shortened term for what's called there's a West Main Channel and then the extension of the West Main Channel down West Main Street is called Unit Two runs north to the levee and that's what that picture is. A channel that drains a good part of the city of Santa Maria and also some agricultural areas out to the Santa Maria River. And that's what that lower left picture is. Is

did you guess?

CommentGuadalupe RoadProposed · by introduction1:27:26 · ≈ 10:27 AM

Anyways, this is an issue. The Government Accounting Standards Board is a standard-setting body for government accounting policies and sometimes it's the Full Employment Act for government accountants too because they seem to come up with standard after standard and change after change. We've been working on this particular standard for about a year and a half, and so we're bringing it to you kind of at the last minute because we didn't want to complicate the budget hearings with these kinds of changes. So the importance of today...

UnidentifiedClerk of the BoardProposed · by role1:28:03 · ≈ 10:28 AM

CommentGuadalupe RoadProposed · by introduction1:28:44 · ≈ 10:28 AM

I just wanted to brag, you know, I'm the accountant for the Flood Control District. So wherever Tom is, I get a little credit there. Actually, I go way back on the flood control districts and some of those issues and I share Supervisor Wolf's comments on flood control. They've done a wonderful job for a long period of time. And that's a good example about in this fund balance policy about some of their restrictions on fund balance. And so we use that as an example as part of our policy.

UnidentifiedClerk of the BoardProposed · by role1:29:15 · ≈ 10:29 AM

There we go. Okay, got it.

CommentGuadalupe RoadProposed · by introduction1:29:18 · ≈ 10:29 AM

So we're going to break this presentation into about three pieces. One is just a couple of the technical parts of the policy and then one is about adopting a policy for the County of Santa Barbara. Fund balance reporting in government fund types, what does this do? The first thing it does is it clarifies the use of government fund type. So we had to go through our accounting structure and make sure that every activity we had was properly classified into right fund type. And then the other big change is it changes how fund balance is presented. I'm sure you spent a lot of time understanding what designated fund balance is.

Tomorrow that term doesn't exist anymore, so designated fund balance goes away. So let's start with the first one. Clarifying the use of government fund types I'll say that Santa Barbara County has done a really good job using the old standards to not get itself in a position where it had a bunch of uses that we had to change. So the only really significant change was in the, where we had to eliminate service area 32. And that didn't qualify for a special revenue fund because what we were doing is simply tracking the cost of sheriff's patrol using a special revenue fund. We are taking general fund monies transferring it to the service area And then transferring the cost back to the general fund is a tracking mechanism. And that's no longer an appropriate use for under this government accounting standards policy, so we eliminated that in this year's financial activity and we eliminated it in next year's budget.

So that takes care of that piece. So then we want to talk about what is fund balance? It's only applicable to the governmental funds. There are two sides to fund balance. Thank you. On a balance sheet, it's the assets liabilities gives you what your appropriate fund balance is. On the income statement, it's your revenues minus expenditures add or delete from fund balance whatever that surplus or deficit is and so, you know, fund balance works from the income perspective and the budgetary perspective but it's really a balance sheet presentation about at the end of the year what additional sources do you have to fund government?

So, before GASB 54 we typically had reserved fund balance and then unreserved fund balance that is broken into two pieces. Designated fund balance and then unreserved undesignated fund balance so those terms are being replaced by a new set of terminology, and the focus of that terminology is on the extent to which government is bound to honor constraints on specific purposes for which amounts in those funds can be spent.

And I'll tell you right now, it all gets back to you as a legislative body setting those constraints. And so if you say did anything change from the past? No, those same constraints existed in the past and we're just going to look at it a little different. So what is the limitation and who says so about those limitations? So let's try and simplify this. In the old policy we had reserved, unreserved and designated. And so we've kind of said well the new categories non-spendable and restricted are similar to reserved and then committed assigned Committed and assigned are similar to designated.

And then there's this new category of committed, assigned and unassigned are similar to unreserved. So we'll try and provide some clarity there. But what I really wanted you to focus on is how simple this change really is. If you look at that beginning balance column, for the general fund in the old format, the opening balance said you had $27 million in reserves, $61 million in designated and then your contingency at the end rolls to this unreserved and undesignated.

If you go to the new format, it's simply taking those same numbers. The $89 million total does not change and it says now you have 26 million that's unspendable. You have a new category of fund balance restricted which is 7 million and then most of your money is similar to your designations of the past which is 54 million that are now called committed So you need to start talking about where you used to say designations, you now want to say commitments. And the balance of the residual fund balance or unassigned is $643,000. That's again your release at contingency. If you go down, we haven't closed the books for the year so we don't want to show you the closing balances. But soon as we close next week, you'll be able to see what those balances are in the general fund.

This is at the highest level and then below this summary level, you'll see the individual accounts that add up to those summary totals. So I'm going to read from the board letter and just talk about what these categories are. So non-spendable includes amounts that are not in spendable form, so if on your balance sheet you had inventory, you can't spend that inventory or find your balance sheet you have the teeter tax loss Accounts receivable, that's money you advance for the TETR program which is the biggest source of our non-spendable money. You can't spend that money until you collect those delinquent taxes. So that's an example of non-spendable and this most significant non-spendable piece of fund balance we have is the TETR tax losses reserved.

When we get over to restricted These include amounts that can be spent only for specific purposes stipulated by an external source, the government code, enabling legislation or a legal restriction. And let me, you know, DARE would be one of them. People give you donations for DARE all the sudden you have restrictions on that and you have to spend it for the DARE program.

Now let me give you an example of a really clear restriction we just got done talking about flood control. So flood control has a district in 10 zones. There are restricted fund balance in those ten zones that says you can only spend fund balance on the project in those zones. But your board has discretion to say, well which projects in those zones are we going to spend that deferred maintenance money on? And Tom gave you a good example of if that funding is coming from release of restricted fund balance.

You get the choice of which projects you spend it on but it does come with a level of restriction that's different than your next category. So the next category is committed and an example of this is where your board has committed money to a litigation designation. This is where most of our Fund balance in the general fund resides and there are literally probably 50 different commitments that your board has made over a period of time. You're the highest level making body, you made the commitment and the only way to get rid of the commitment is for your board to take the same action that generated the commitment.

The next category is assigned and it's used when the highest level of decision-making body delegates the authority to determine the use in this category. Because of requirements on county government imposed by the California County Budget Act, at this time we don't believe that this is a category that we'll see show up in our general fund. We believe it's very limited, other states have the authority where they delegate it to the auditor to determine everything they want to do with fund balance.

So in government funds other than the general fund Then it gets a little confusing. Assigned fund balance represents that amount that is not restricted or committed, since any amounts in that fund are intended for the purpose of that fund. So you will see in the other funds of the county they may have assigned fund balances. If we have residual money, it'll end up in the general fund in this unassigned category.

What we have been able to do is we took the financial accounting system, Chair.

PresenterMaureen SpencerProposed · by introduction1:38:36 · ≈ 10:38 AM

There's a question? Mr. Guy, so can we go back to that slide real quick? Sure. So where would our reserve be? Our general reserve, non-assigned. Your strategic reserve? Yes.

CommentGuadalupe RoadProposed · by introduction1:38:47 · ≈ 10:38 AM

So that's going to be what we're... If you adopt the policy we've suggested for the strategic reserve, as we specifically pointed out, strategic reserves, rainy day funds, stabilization arrangements, as long as your board adopts a set of parameters to use those reserves then it will be classified as committed. If you don't put that policy in place, it ends up in unassigned.

And so that's very important for like the rating agency purposes that if we're going to have that stabilization account or the strategic reserve, we want a set of significant policies that say

PresenterMaureen SpencerProposed · by introduction1:39:28 · ≈ 10:39 AM

how are you going to use that? I'm just seeing how it plays out with this new Gadsby approach. Some people are used to seeing the strategic reserve as, at least in the old traditional thinking of we'll use it but only if we need to for a rainy day event or emergency But you're saying you need to commit it for

CommentGuadalupe RoadProposed · by introduction1:39:49 · ≈ 10:39 AM

that. If you have a set of policies, it can be classified as committed or if there's a law around the rainy day fund, that could eventually get to be restricted but we don't have a law in the California books that say you must have a strategic reserve. It's really by your board policy.

PresenterMaureen SpencerProposed · by introduction1:40:08 · ≈ 10:40 AM

I'm just trying to understand the value of having an unassigned and should we ever want to use it with the protocol for just having an ordinance that rescinds it in making the action? For me, it just sounds the old traditional thinking and it may not be a good way.

1:40 – 1:4712 turns

CommentGuadalupe RoadProposed · by introduction1:40:23 · ≈ 10:40 AM

So I think the biggest benefit of this strategic reserve is that you're generating money in the general fund that you're using for significant events and people like the rating agencies like to see you have that strategic reserve It's always in your board. If you get to the end of this policy we're adopting, your board can undo this policy at any point in time and it's really that action you use to establish the strategic reserve, you can take an opposite action to get rid of that strategic

PresenterMaureen SpencerProposed · by introduction1:41:00 · ≈ 10:41 AM

reserve. Thank you. I guess I just wanted to make sure I understood it because then it comes down to accounting semantics. I still want to be able to say to my constituents look we have Reserves strategic reserve you can call it whatever you want, but it is a strategic reserve for a rainy day Or an emergency that's correct

UnidentifiedClerk of the BoardProposed · by role1:41:22 · ≈ 10:41 AM

I think the most help if you want to look at his scope if you leave that slide there and supervisor go back to slide six And it kind of then I'm

CommentGuadalupe RoadProposed · by introduction1:41:36 · ≈ 10:41 AM

going to show you on the next slide where it is too so. So one of the things that is a positive thing that I think we accomplished through implementation of this policy is Our FIN system let us remap all the designations and reserves to new accounts. So we took a significant amount of time in terms of working with the departments to reclassify these accounts to new accounts, and we also took the time Really go after the titles and try to make them more intuitive for your board and the users of the accounts. And so we're looking for your feedback if you ever think we can improve more, you know? We'd like to improve the titles so that they're intuitive. But you can see here, it starts off with if you look at the top thing of the non-spendable.

Like we said, the biggest amount there is for receivables and the Teeter Tax Loss Reserve which are all related to the Teeter program. And so those are unspendable reserve. We've advanced money to the taxing agencies and then we have this tax loss reserve in case something doesn't sell that will Something wouldn't sell at auction in a tax sale that we would take it out of this account. But the benefit of those non-spendable reserves is remember, we're entitled to all the penalties and interest that come off of that TETR program.

The next set of categories are all the restricted monies and you can see by those titles the various restrictions that are either legal Or mandated, you know like the sheriff's grants are some of the biggest. You know those are grant-related restricted dollars for those particular grants. P&D offsite mitigation fees another big category so you get an idea of what the restrictions are your board can make decisions related to those restrictions but it has to be spent on the restriction.

Next category is we have all the committed fund balances and there you can see our biggest is the strategic reserve. And so each and every one of those, these are almost just like the designation accounts except the designation accounts used to have some of those restricted accounts. So you're getting a difference there. Then you get down to where we do not have any assigned fund balance and we have a residual fund balance which will eventually be the contingency account.

So any questions related to that piece? So we've been through the special revenue funds, we've been through the reclassifications of the fund balance. Let me tell you how this is going to work. We're closing the books with the old fund balance categories. On July 1st, we will open the books with the new fund balance categories and if you were looking into our FIN financial systems Both categories are mapped and we're tracking both of those. So, we were going to come to you back in December and we said, you know, we're not very prepared to do this. It's not going to be very visible to the board. And then we came up with this idea of remapping. And it's gonna work really well for the county that we're keeping track of in both ways. We're gonna do the magic conversion on July 1st.

UnidentifiedClerk of the BoardProposed · by role1:45:22 · ≈ 10:45 AM

PresenterMaureen SpencerProposed · by introduction1:45:24 · ≈ 10:45 AM

At this point in time, you're going to have. That's $62 million in fund equity, and that's before we record all our receivables. So I'm going to surmise as we come to close the books that that amount will be maybe somewhere probably about $80 million. And so you're going to meet your 15% benchmark.

PresenterMaureen SpencerProposed · by introduction1:46:18 · ≈ 10:46 AM

The GASB requirement for strategic reserve?

CommentGuadalupe RoadProposed · by introduction1:46:20 · ≈ 10:46 AM

You're going to meet our requirement Working capital, which we're setting at 15% of county revenues. And then part of that working capital is the strategic reserve, which we're setting at a preliminary goal of 8% of revenues. Do you think we'll hit that mark? I believe you will be within those marks and our plan is to come to you as part of the financial statement presentation. We report those in the county's financial statements and we'll come back to you with annual report on fund balance. Thank you.

CommentExxon MobilProposed · by introduction1:46:55 · ≈ 10:46 AM

Supervisor Wolk. So if you just looked at our old, if you just looked at strategic reserve by itself that doesn't meet the threshold, that doesn't meet the working capital threshold.

CommentGuadalupe RoadProposed · by introduction1:47:14 · ≈ 10:47 AM

That would be correct.

CommentExxon MobilProposed · by introduction1:47:15 · ≈ 10:47 AM

Right so what Supervisor Carbajal is saying that the only way you meet it is by looking at the fund balance committed,

1:47 – 1:5315 turns

CommentGuadalupe RoadProposed · by introduction1:47:26 · ≈ 10:47 AM

All of these. You get to use the committed, the assigned and the unassigned in getting at that 15%. And so right now there's $65 million in that committed and I think 15% of fund balance is about...15% of revenues is about $50 million.

CommentExxon MobilProposed · by introduction1:47:45 · ≈ 10:47 AM

So I mean, in one way it's good to tell the public yes we've met this criteria but we're really adding more into the pot to meet it.

CommentGuadalupe RoadProposed · by introduction1:47:59 · ≈ 10:47 AM

OK. Thank you. We had Supervisor Carbajal and Supervisor Lavinino. Supervisor Lavinino? OK.

CommentGuadalupe RoadProposed · by introduction1:48:56 · ≈ 10:48 AM

Okay, so now we're going to switch gears a little bit and what we're requesting your board to do is to adopt a comprehensive fund balance policy which is a recommendation by the Government Accounting Standards Board and the GFOA. It's just a good policy practice if you look in the budget book for last year and this year we have a lot of those budget policies already in place. We have a pretty informal policy on the strategic reserve that we've had all these years. And so what we're trying to do is just formalize those policies. I just want to bring up one issue, the special revenue fund departments would like to have some more input on this policy and so as we move forward before you adopt you may want to consider that You adopt the policy if you agree with the policies, with the exclusion that will come back on this special revenue fund piece of the policy.

And we could probably do that as part of the first quarter report or maybe as we look at the policy and we've implemented it, we might want to make some other tweaks and bring back the whole policy in total. So the purpose of a fund balance policy is to provide guidance for the management of the governmental fund balance, which represents the net assets or financial position of the county and providing for a financial cushion against unanticipated events. You know over the last four years this economy has not been kind to us so those you know, reserves or commitments are nice to have to help give us a cushion and get us through that.

The focus of the fund balance policy will be on committed assigned and unassigned fund balance. That's where your board has some discretion. The essential elements for our policy are what's the appropriate level of fund balance? So we're adopting a minimum amount or a range We're putting in some policies for circumstances for spending down, and then we're trying to put in a policy for replenishment which seems hard to fathom at the current stage of the economy. And that's the pressure to draw down but things someday will get better. We're all hoping.

UnidentifiedClerk of the BoardProposed · by role1:51:20 · ≈ 10:51 AM

Mr. Grice I would have never asked this if we were pushed for time so But I'm curious, in situations like the cities that were Bell and those kinds of things. Do they have the same kind of accounting responsibility? And do they just not do it? How does something like that happen? It seems like we're being so careful to make sure everything is accounted for

CommentGuadalupe RoadProposed · by introduction1:51:50 · ≈ 10:51 AM

Well, I can tell you that for counties we have a pretty strong set of accounting standards policies and procedures that flow out of the state controller's office. And that's been very good guidance like the County Budget Act right now to implement GASB 54 There is a bill that currently the legislature has signed to forward to Governor Brown that incorporates these policy changes for 54. And so, for counties you know those legislative changes our county's auditors association has something, well state controller has something called a 10 person committee. That 10 person committee is comprised of county auditors CEOs and a couple of board of supervisors And they actually go over these technical policies for all the counties and then make legislative changes from that 10-person committee.

The cities don't have a similar structure. They have some of the same financial requirements, let's do financial statements, let's forward those financial statements on to the state controller but they don't have that same formal set of accounting policies that we have for counties, which is kind of interesting. And the controller or state controllers trying to address that to say, oh why don't we have those similar accounting policies for cities? And I'm not sure in the history of cities and counties why that hasn't occurred.

UnidentifiedClerk of the BoardProposed · by role1:53:26 · ≈ 10:53 AM

Thank you.

1:53 – 2:0328 turns

CommentGuadalupe RoadProposed · by introduction1:53:29 · ≈ 10:53 AM

So then we did talk about, we've already talked about the importance of having this stabilization arrangement or rainy day or what we call our strategic reserve. And the strategic reserve will be classified as committed fund balance if the following two requirements are included in the policy. Sufficiently specific stated purpose and non-routine transactions. They're saying if you're going to use this on a routine basis that you're going to go in there for your budget you know, use it for operations every year. They're saying you're going to put that in unassigned fund balance because it's not really a strategic reserve. So they want some parameters around it.

Again without a policy the strategic reserve will be classified as unassigned fund balance for financial statement reporting purposes. So theoretically you could have a strategic reserve in your budget document but for financial statement reporting purposes we wouldn't allow without a sufficient policy to classify it that way And CEO Waller was very astute to say, oh the rating agencies wouldn't like that. You know they really like to see the stabilization arrangements and a healthy general fund along with the rest of your fund balances.

So our targeted funding level, the committed strategic reserve fund balance shall be an amount equivalent to 8% of operating revenue which is approximately 30 days of working capital for the general fund. I calculated for last year it's around $50 million. The purposes that we laid forward, this is kind of what our practice has been. Number one, to mitigate economic downturns that reduce county general fund revenue Mitigate state or federal budget actions that may reduce county revenue.

Maintain core service levels essential to the public health, safety and welfare. Front fund or completely fund disaster costs associated with emergencies. And number five, absorb liability settlements in excess of available resources in the litigation designation or in your internal service funds. We say the strategic reserve should only be used to support the operating budget when general revenues increases less than 3% from the prior fiscal year. So this is the kind of policy where we're saying, hey if it's 3% or more You should be looking to rebuild your strategic reserve or hold it steady. And so this is that element that says, you know, put some impetus in there to build us back into what our target level is.

And with that we would take any questions.

UnidentifiedClerk of the BoardProposed · by role1:56:18 · ≈ 10:56 AM

CommentExxon MobilProposed · by introduction1:57:26 · ≈ 10:57 AM

Thank you, Madam Chair. I keep thinking back to our budget and we had that one page in the budget book with all the designation and fund balances. And I know, so you've got in here the strategic reserve and contingencies and litigation fund. But some of the things that I'm recalling that aren't, that I can't find in here is the roads fund. Like for instance we allocated $500,000 to that capital and deferred maintenance.

So are those in the committed? Are they designated in

UnidentifiedUnidentified speaker 2Proposed1:58:01 · ≈ 10:58 AM

some

CommentExxon MobilProposed · by introduction1:58:03 · ≈ 10:58 AM

other way?

not transcribed≈7s of audible speech the AI couldn’t make out▸ listen
CommentGuadalupe RoadProposed · by introduction1:58:07 · ≈ 10:58 AM

So that gets a little bit tricky. Some of those are operating transfers that you've made to another fund like for the road fund and then for Deferred maintenance, that should be a reserve but it's in the capital fund. And we're only showing you the commitments and the restrictions in the general fund. So then there is another host of commitments in all the other funds and so you don't have quite comprehensive picture.

And what Jason has done in the budget book is he's really getting you, your board to focus on those big designations where you had a lot of discretionary authority and he was helping you focus your decision making onto those.

CommentExxon MobilProposed · by introduction1:59:03 · ≈ 10:59 AM

Okay so that So that's a different exercise. So you could theoretically pull these things out, the bigger items and make a chart similar to what Jason did but not restricted based on this?

CommentGuadalupe RoadProposed · by introduction1:59:20 · ≈ 10:59 AM

Right. And so he did that. Some of that is done because if you mix in all these restricted amounts of money that you really don't have Discretion on it makes it kind of confusing about what kind of discretion do you have. So that's one of the good things about, you know, this standard is it gives you some more... You know, it starts to measure your level of decision-making authority and segregates some of those commitments out that will make it clearer to your board about what level of discretionary authority do you have?

CommentExxon MobilProposed · by introduction1:59:56 · ≈ 10:59 AM

But I don't see anything. So you've got everything in here under committed, but I don't see anything that's... Do you have anything that's assigned or unassigned?

CommentGuadalupe RoadProposed · by introduction2:00:06 · ≈ 11:00 AM

We don't have anything in the general fund that's assigned or unassigned. Now remember these are the status of the accounts as we close the books. It's not the status of the accounts as you open the books and load next year's budget. And a couple of other things we did this year is we did develop two new reports that I think we can bring back to you as part of our fund, what's Fund Balance look like. We can demonstrate those Fund Balance reports that I think will help your board reconcile the budget back to actual.

CommentExxon MobilProposed · by introduction2:00:45 · ≈ 11:00 AM

Why wouldn't you have thought of putting contingencies as unassigned?

CommentGuadalupe RoadProposed · by introduction2:00:55 · ≈ 11:00 AM

Well, contingency during the year is committed for contingencies. When we close the books it will go to unassigned. So we closed that commitment to unassigned.

CommentExxon MobilProposed · by introduction2:01:08 · ≈ 11:01 AM

It's

CommentGuadalupe RoadProposed · by introduction2:01:11 · ≈ 11:01 AM

committed to

CommentExxon MobilProposed · by introduction2:01:12 · ≈ 11:01 AM

its fund, basically.

CommentGuadalupe RoadProposed · by introduction2:01:15 · ≈ 11:01 AM

It's committed to its fund or it's committed for those things that could happen during the year. You know, it's a reasonable placeholder that something is going to happen in the general fund that you want to use those contingencies for. But you could also go and use the other commitments.

CommentExxon MobilProposed · by introduction2:01:32 · ≈ 11:01 AM

Why wouldn't we have a policy for the contingency fund?

CommentGuadalupe RoadProposed · by introduction2:01:36 · ≈ 11:01 AM

Well, your policy is generally just to set a reasonable amount aside for those unforeseen circumstances. Your policy has been generally less than a million.

CommentExxon MobilProposed · by introduction2:01:50 · ≈ 11:01 AM

That's why it seems like... Okay. Like it wouldn't necessarily be

CommentGuadalupe RoadProposed · by introduction2:01:54 · ≈ 11:01 AM

committed. Well you might have a point that as we take this standard forward and watch what other organizations do, we may come back and say oh we think contingency is better off and categorized as assigned. And so we're still open to that. You know, the standard is not quite clear on how to use those assigned and it's debatable. And so we may come back with future changes. Well,

CommentExxon MobilProposed · by introduction2:02:25 · ≈ 11:02 AM

Thank you, Madam Chair. I'm speaking in support of Mr. Geis' motion and recognizing that he did acknowledge that we need a little bit more time to work with his office on the special revenue fund piece which is not addressed in the board letter but rather in the attachment. The Special Revenue Fund Departments haven't had an opportunity to examine the processes, the business processes and procedures. We're concerned about workload impacts at this time when we've had revenue reductions and layoffs and cutbacks in our departments.

So we would recommend accepting what Mr. Geist proposed is give us a little bit more time to work on the Special Revenue Fund issues And clarifying in the case of social services speaking just for my department, we are highly regulated. Highly specified in law in regard to local match issues as well as our quarterly claim issues. Madam Chair, members of the board this is item A1 it's a resolution honoring the Santa Barbara Wildlife Care Network. Whereas the residents of Santa Barbara County have long recognized the important relationship between our community, wildlife and our environment. And whereas the Santa Barbara Wildlife Care Network was established in 1988 and has provided appropriate treatment and care to injured, orphaned and otherwise distressed wild birds and animals and continues to provide skilled care to approximately 4,000 rescued wildlife each year And whereas, the Santa Barbara Wildlife Care Network works under permits from the California Department of Fish and Game and the U.S. Fish and Wildlife Service and has more than 400 volunteers including local veterinarians who donate their services.

And whereas, the Santa Barbara Wildlife Care Network provides wildlife education to our schools, youth clubs, retirement centers, service clubs, and community groups free of charge. And whereas the Santa Barbara Wildlife Care Network works to gather information regarding wildlife treatment and rehabilitation that's shared with individuals, researchers and other wildlife agencies.

And whereas the mission of the Santa Barbara Wildlife Care Network is accomplished through the dedication and support of its countless volunteers, individual donors Foundations, local businesses and professionals who donate their time and expertise to care for injured wildlife. Now therefore be it and it is hereby ordered and resolved that this Board of Supervisors honors and commends the Santa Barbara Wildlife Care Network for its commitment to protecting injured wildlife and for working to educate our community on the importance of preserving and protecting local wildlife and habitat passed and adopted today.

Ms. Burroughs? Thank you so much, Chairwoman Gray, Supervisor Carbajal and members of the Board. My name is Sue Burroughs and Leslie Nixon-Schlonser and I are co-presidents of the Wildlife Care Network. The Wildlife Care Network appreciates your recognition. We're in the middle of baby season, our busiest season. And both our Intake Center and the Macaw Center are busy with just about every kind of baby bird and small animals.

We recently had 15 pelicans hatch on Anacapa Island. The babies flew to our beaches looking for food. Our volunteers rescued the pelicans, fed them, cared for them, and they're ready for release. It is important to note also that in addition to our care for wildlife, we are busy in the community speaking to the Boys and Girls Clubs, the various schools and various clubs such as Rotary and numbers of other organizations. Thousands of people a year hear our message.

Many families are so busy putting food on the table that they simply do not have the time or energy to teach our children to respect our wildlife. We are happy to fill in that gap We have followed your budget process and it's been a difficult task for you and for the community. Wildlife Care Network receives no governmental funding, however approximately 40% of our calls come from governmental agencies From the CHP, the Sheriff, the Police Departments, Animal Control, Harbor Patrol and others. We are happy to make this contribution to our community.

We appreciate all of our donors but I would like to recognize Exxon Mobil and Beneco who have been there for us year after year sharing our work and our vision. Thank you so much! I would also like to offer you a tour of our facilities at any time please give us a call. Thank you so much.

Madam Chair and members of the board this is item A2 it's a resolution honoring Terry Dressler upon his retirement from the Santa Barbara County Air Pollution Control District whereas Terry Dressler has worked in the air pollution control field since 1978 having served the Santa Barbara County Air Pollution Control District since 1987 including serving as the APCD control officer since 2004 And whereas, throughout his career Terry has demonstrated leadership and vision in working to identify and implement strategies to improve air quality and ensure Santa Barbara County is in compliance with frequent changes in regulatory requirements.

And whereas, Terry helped establish the APCD Community Advisory Council whose duties include providing advice to the APCD Control Officer and Board of Directors in matters related to planning and achieving clean air standards required by federal clean air plans and rules. And whereas, in 2009 Terry served as president of the California Air Pollution Control Officers Association where he worked to guide the association through the complex task of implementing the California Air Resources Board Enhanced Vapor Recovery Program and he worked with ARB staff to improve implementation of the Portable Equipment Registration Program.

And whereas, Terry has provided his technical expertise, local experience and keen insight in efforts to meet and exceed Santa Barbara County's compliance with federal and state air quality regulations. His work includes streamlining reporting requirements for local, state and federal government agencies who meet the criteria for Exceptional Events Rule which waives penalties for exceeding federal air quality standards due to natural disasters and other one-time uncontrollable events.

And working with the National Association of Counties to advocate that the EPA, that's the U.S. EPA enhanced regulations on marine shipping emissions which are considered one of the greatest sources of air pollution in Santa Barbara County. And whereas over the years of the district, the ponytail disappeared and was replaced by the fedora in the business suit. Well, thank you all so much. This really does mean a lot to me but I have to say that Any success that I've had, I have to attribute mostly to other people. And specifically in this forum, I want to thank my partners in the County of Santa Barbara. They have been great partners. We work very closely with the fire department and they have been great partners. We've worked very closely with P&D. They have been great partners throughout this whole process and really helped us. And General Services who's our landlord.

And have been great partners through that relationship as well. And so, you know nobody is successful all by themselves and I really want to thank the staff of the Air Pollution Control District whose dedication to excellence and really dedication to the mission has really made me successful. I want to thank you all for recognizing me today it's been a wonderful career.

You all sit on my board of directors and you provided me with one of the greatest Career experiences anybody could have thank you again.

Supervisor far a3 Thank you, Madam Chair. Well it's certainly my honor today to be able to sponsor a resolution of commendation celebrating the City of Solvang's fourth successful year posting the Amgen Tour and receiving is going to be Carol Peterson and Max Hanberg. And I just can't say enough about the work that they've done if you want to come up to the podium now, Carol and Max. They have co-chaired the local organizing committee and this is a tremendous task that they have taken on a number of times now Because you know when the Amgen Tour comes to town, the world comes to Solvang.

And Solvang is a town of 6,000 in the valley and not that many more. Max and Carol took on the challenge of organizing the community in the city and dealing with a myriad of issues whether it was concerns about the neighbors all the way from The requirements of international media coming to town, but they pulled it off over and over again. And had a very successful event and brought at least the time before this $1 million of economic impact to the county and a very, very fun event for all ages. So we really appreciate all the time and effort that the two of you have put in and by extension, all of the volunteers in the community that did this work. So Mr. Clerk, you would read the resolution please.

UnidentifiedUnidentified speaker 1Proposed2:19:55 · ≈ 11:19 AM

Madam Chair and members of the Board this is a resolution celebrating the 2011 Amgen Tour return to Solvang. Whereas the City of Solvag was chosen for the fourth time to host the Amgen Tour of California, the largest professional bicycling race in the United States on May 20th, 2011. And whereas, Solvang hosted the Amgen Tour of California in 2007, 2008 and 2009 and drew thousands of spectators and worldwide publicity to the city of Solvang and to the San Ynez Valley.

And whereas, the Amgen tour has generated significant beneficial economic impacts to the area which has become a premier biking destination And whereas, this year's the eight-day race it's only time trial scheduled for stage six and the first ever Women's International Time Trial Challenge took place in Solvang. And whereas, the Solvang Local Organization Committee chaired by Carol Peterson and Max Hamburg and many volunteers successfully promoted the race securing housing for the cyclists local sponsors for today's events and coordinating with the Amgen organization and media.

And whereas with partnering organizations, local organization committee organized the Race of Truth for amateur cyclists. A fundraiser for break away from cancer outreach activities in the schools including bicycle safety clinics and opportunities to meet the race participants and a lifestyle festival promoting health and fitness. Now therefore be it ordered and resolved that the Board of Supervisors hereby celebrates the City of Solvang's fourth successful year hosting the Amgen Tour of California passed and adopted today.

And on her days off she basically works with schools and community groups and takes them on hikes through Aurora Hondo Natural Preserve. And it says that she's guided over 1,000 people through that preserve so that's pretty remarkable feat.

Glenn Zook is an Auditor-Appraiser with the County Assessor. He's responsible for property assessment, and on days off during income tax season he participates as an IRS volunteer, and he helps programs through United Way and with local families and helps folks that need help preparing their taxes. Just like to recognize volunteers, Glenn and Lisa because that's what we all have to do now is to volunteer more. So thank you very much.

As you can see here, the Risk Management Division manages three internal service funds commonly known as ISFs. These funds are overseen by the risk management evaluation team that is comprised of the CEO, auditor controller, accounting counsel, general services director and risk manager. And or a representative from each of those departments. I might say here lately Auditor-Controller Bob Geis, Theo Filotti and Jennifer Christensen have been exceptionally helpful As you may recall, the county elected to move the workers' compensation program from a self-insured fund to a primary program beginning on July 1, 2010.

Which means that all claims occurring on and after that date are paid for through the primary work comp. There are currently 488 open claims that occurred prior to July 1, 2010 also known as tail claims. The future liability associated with those tail claims remains the county's responsibility which includes the administration of those claims. In part, our claims administration involves the review of medical bills to ensure that the amount paid does not exceed the standard fee schedule or other negotiated rate with medical service providers. This unique service has been provided by outside bill review specialists for over 18 years to ensure the lowest possible cost is paid for medical services.

Beginning on July 1, 2010 through May 31st 2011 the medical bills received for all OpenTel claims totaled $8,380,000 plus. StrataCare's process of reducing our medical costs resulted in a savings of $4,382,000 leaving the county's total medical cost for claims that we paid out to just over $4 million. Now for the purposes of comparison, let me apply Corvell's projected 70% reduction rate to the same pool of bills.

And I will explain why I'm using 70% in a moment. If I apply the 70% reduction rate we would actually generate a higher net savings The county would have seen a reduction in the medical bill cost by $4.9 million, $4,927,000. I apologize this slide reflects 5.8 million but that should be 4.9 million dollars. Again comparing the savings $4,382,000 to the $4.927,000 we see an additional savings in billing costs of $545,000. Now why did I use a 70% reduction rate? Well, Corvall's historic savings for its clients in California is 82%.

Additionally, I received a bill review savings report from Corvell showing two other similar cities or public entities in Southern California that also had savings of over 70% for both of those entities for the same time period. Moreover, In order to test the market, to determine if Corvell really could live up to that standard on May 1st we had Corvell review 227 medical bills totaling $1 million.

Corvell was able to reduce the medical costs by $763,365 or 76.1 percent, which means the amount of medical bills actually paid out were $240,294. So Corvell is an approved third-party claims administrator by CSAC Excess Insurance Authority, and they also do the medical bill reviews for that organization. They handle all the claims administration functions as I said the bill review services for that program.

Now beginning this next fiscal year, 2011-2012. We begin the year with 488 open workers' compensation tell claims and based on that number the actuary derived the expected number of claims that would be open at the beginning of each subsequent fiscal year. The adjacent numbers To the right of the number of open claims, you'll see the number of examiners required.

And as the caseload decreases, you'll see the number of examiners required to handle the caseload also decreases. And this is based on a CSAC excess insurance authority and other industry standards. And then to the right of that column is the approximate salary and benefits, benefit costs associated to fund those positions. As the county now purchases primary work comp coverage, the number of open-tail claims will decrease as will the number of employees needed to manage the claims.

You will note that the table shows the number of employees required to handle the claims for fiscal year 11-12 is three, but in fact we only have two risk analysts managing the claims. The reason for this situation is a couple months ago one of the workers' compensation analysts left the county's employment to take a job at Corvell and rather than replace the analyst, we contracted with Corvell to manage about 200 of those claims.

This event led to further discussions and negotiations with the county, and an offer by Corvell to assume all future claims handling for all the tail claims for a one-time service charge of $302,204.00 with the condition that the county also agree to use the medical bill review service. You observe by the projected annual salary and benefit costs that the one-time payment to Corvell of about $302,000 will be offset in the first year by salary and benefit cost savings.

Plus, Corvell is also as I mentioned a third party claims administrator for the primary work comp program which means that if this contract is approved, Corvell will be handling the tail claims as well as all the new claims which paves the way to an easier transition. So as you saw in the earlier slide, the salary and benefit savings offset in the first year. And as the years go out there will be continued savings of that.

ultimately continue, we'll have sent out all the tail claims for $302,000 forever. All the claims and for that one time amount so there are several savings. That we will benefit from, as you can see that are associated with that. And rather than go through each one individually, the total figure not counting the salary and benefits savings is about $50,000.

So although the TEL claims will ultimately diminish, as will the need for staff. I don't want to gloss over the fact that the decision to contract out this service will result in an earlier than expected displacement of two wonderful longtime employees with the county And I regret that the stress these decisions cause all involved, but it appears to me to be the right decision.

In summary, if the Board of Supervisors passes this item we expect to save over a half million dollars in the coming fiscal year that will help bolster the stability of the work comp fund. Thank you.

Do we have questions? Supervisor Wolf.

CommentExxon MobilProposed · by introduction2:34:34 · ≈ 11:34 AM

In your board letter It says that we have a current vendor who does our bill review service, Straticare. Correct. So if they're doing Are they doing the same thing as you expect from Corvell? I'm not sure why you anticipate losing employees if we already are contracting

UnidentifiedUnidentified speaker 19Proposed2:35:01 · ≈ 11:35 AM

out. The medical bill review savings is not where I anticipate losing staff for medical bill review. Corvell will simply be replacing Straticare and continue on as we always have.

CommentExxon MobilProposed · by introduction2:35:19 · ≈ 11:35 AM

So it's not so much that we are, that we have an outside source that's doing this. It's I think isn't it more that we went into the season into that? Well, you know, we have the tail claims that are now ultimately going to come due and so we're really not changing or now moving into an outsourcing type of system because we've already, we were doing that right now.

UnidentifiedUnidentified speaker 18Proposed2:35:46 · ≈ 11:35 AM

Madam Chair, Supervisor Wolk. There's two parts to the contract proposed. One part is the medical review, which is really a separate action from the decision to move to primary workers comp. The second action that deals with the tail claims is somewhat related to the decision that was made last year in that going forward starting July 1st, 2010. The decision was made that we would be in the primary worker compensation pool. What that left was all these tail claims and given that going to the primary worker comp, we would be using Corvell As Mr. Aromatorio said, it started to make sense to have conversations with them. What would it take for you guys to administer our tail claims as those slowly go from 418 down to zero over time? And that portion of the contract is 302,000 one-time and that's the part that is allowing us to save money and displace two workers.

CommentExxon MobilProposed · by introduction2:36:41 · ≈ 11:36 AM

Who is currently administering the tail claims?

UnidentifiedUnidentified speaker 18Proposed2:36:45 · ≈ 11:36 AM

Madam Chair and Supervisor Wolf, we have two employees who are doing two-thirds of them. And as Mr. Aromatorio said a portion of them has already been shifted to Corvell because an employee left on their own last year and actually was hired by

CommentExxon MobilProposed · by introduction2:37:01 · ≈ 11:37 AM

Corvell. What does Stratacare

UnidentifiedUnidentified speaker 19Proposed2:37:03 · ≈ 11:37 AM

do? Stratacare does the medical bill review service. Bills come in from medical companies, from medical care providers similar to when we go to the hospital and you'll get a bill and Blue Shield.

CommentExxon MobilProposed · by introduction2:37:22 · ≈ 11:37 AM

I'm just trying to understand the difference between Straticare and Corville. Is it that Stratak here is doing the new ones and Corbell's doing the tail? What's the difference?

UnidentifiedUnidentified speaker 19Proposed2:37:35 · ≈ 11:37 AM

They both do bill review. They both do, Madam Chair, Supervisor Wolff, yes they both do, they will be both doing Medical bill review service. The difference is that we think that Corvell can do it less expensively and they can do it more efficiently, and they also include in their service a third party claims administration for the handling of the workers' compensation claims.

CommentExxon MobilProposed · by introduction2:38:04 · ≈ 11:38 AM

Okay. Now I got it. So they're going to be doing the administration piece, but I thought that's what CSAC was going to be doing when we... For the

UnidentifiedUnidentified speaker 19Proposed2:38:12 · ≈ 11:38 AM

CSAC, excuse me Madam Chair, Supervisor Wolff, CSAC does do the primary program all the claims that occurred after July 1, 2010. But CSAC does not administrate the claims that tell claims that occurred before July 1, 2009.

CommentExxon MobilProposed · by introduction2:38:37 · ≈ 11:38 AM

Thank you. So let me just ask the final, so we're losing two employees to move into this system and so aside from the money that we're going to be seeing as a savings on the medical piece, you think we're going to be saving money on the administration piece? And is there any reason why you think that? What's the documentation there?

UnidentifiedUnidentified speaker 18Proposed2:39:04 · ≈ 11:39 AM

Madam Chair, Supervisor Wolf. The reason we believe that is that the contract that's before you is a one-time cost of $302,000 to administer those tail claims forever until they're settled paid out and closed. And our estimate is that if we administered those claims in-house over the next 5, 10, 15 years. The amount of time it takes to finally settle all claims and some of these claims can carry on for quite a while.

The staffing it would take over those years would be substantially more than the one time 302,000 as indicated Two and a half employees for one year with salaries and benefits is around $300,000. So the break-even point is essentially after one year.

CommentExxon MobilProposed · by introduction2:39:55 · ≈ 11:39 AM

So why does the contract summary say the original contract amount is a million dollars?

2:40 – 2:4522 turns

UnidentifiedUnidentified speaker 18Proposed2:40:04 · ≈ 11:40 AM

Madam Chair, Supervisor Wolf. The contract has two pieces so there's the 302 one-time payment to administer TAIL claims and then the second piece is the medical review. So we're proposing that Corvell replace Straticare for this service and they...that contract is on a contingency where we pay them 16% of all savings up to a maximum of 700. So the maximum amount of the contract for both pieces of services is $300,000 for the administration and up to $700,000 for the medical bill review.

CommentExxon MobilProposed · by introduction2:40:39 · ≈ 11:40 AM

What happens if a year or year and a half from now Corbell goes away? What happens to those tail claims? What's our legal responsibility?

UnidentifiedUnidentified speaker 19Proposed2:41:29 · ≈ 11:41 AM

UnidentifiedUnidentified speaker 3Proposed2:43:10 · ≈ 11:43 AM

Yes, I've had an opportunity Look at the administrative fine ordinance in its entirety, and Mr. Bruni is absolutely correct. There is provision in a part of the ordinance that was not before your board today specifically section 24A5B which provides that in the event that an action results in a quote one time violation which cannot be corrected or cured pursuant to the other sections that we talked about.

Then the director may impose fines under the immediate notice of determination of fines up to the specified amount. In this case, this section is $1,000. Our approach to this fine for the ones at issue had been to advise that they begin at the $100 level as provided for in the statute. The language in Subdivision B that I just recited is legally operative to accomplish the goal that Parks wishes to accomplish. I think we'll continue to monitor this language with the department and if it becomes an issue, we may come back to set up a different subdivision that might make it a little clearer.

But for purposes of this ordinance, we believe it's legally sufficient to go forward as it is right now.

Thank you Madam Chair. Yes, just briefly I did attend a Solvang Chamber event. It's always fun to get to chat with particularly the small business owners and see how innovative and creative they are even despite these challenging economic times. We did have that visit from the Prince Consort of Denmark. Unfortunately I wasn't able to be there but I understand it was a great day and we celebrated his birthday and there were a lot of people in attendance at I also went to the Santa Barbara Airport Gala and the ribbon cutting on Sunday. It is a very beautiful building, and whenever you have the chance to go there, I know that you're going to be very impressed with all of the wonderful public art and some of the pieces from the courthouse that have been integrated into that.

And then the last thing is, as Supervisor Wolf said, UCSB did graduate But not just that, but UCSB and IV moved out which is always an enormous event if you want to think about perhaps most of the Santa Ana Valley all moving on the same day. You get the idea what impact is and I understand everything went very smoothly Marburg did the yeoman service there and they had their trucks up and down constantly all day for many days. And then a lot of items were picked up for what's called the gift sale every year where All these items are donated and then there's a big sale over the weekend, and the proceeds go to fund the nonprofits in the Ivy community. So it's really a wonderful way to have not so many things end up in the landfill, and we're still working to make that a better ratio.

Thank you.

Thank you. I just wanted to recognize the Turducken Dinner that's put on for the benefit of the of the Lompoc Library. It's by a group of just families that got together to raise money for the library, and they must have raised a lot of money because the place was really crowded. It was held at Clo Pepe's and it was a beautiful event, lots raised. I think we're going to all have to be looking forward to that this next year because there's just a whole lot of stuff That we're not able to do, and so we're going to have to do fundraisers. And we're going to be adjourning in honor of Supervisor Farr. Did you want to go first?

Yes. Thank you. Betty Williams who is a longtime resident of the Santa Anas Valley passed away yesterday and I'd like to read something briefly that Cheryl O'Neill from the Santa Barbara County Vintners Association wrote. Our community mourns the passing of Betty Williams age 92 who left us yesterday If you were fortunate enough to know Betty, you know that she was a truly remarkable woman. A woman of vision, strength, character conviction and generosity of spirit. Betty became an indelible presence in San Inez Valley life 43 years ago when she purchased Buttonwood Farm. Although her initial endeavor was raising thoroughbred horses, in 1983 Betty became one of the first local ranchers to convert ranch land into vineyards and eventually built an estate winery on the plateau overlooking Alamo-Pentado Basin A true visionary, Betty promoted sustainable agriculture before it became popular.

Adopting the role of land steward in her vineyard as well as the organic fruit and vegetable farm she developed. Betty's life was not limited to activity at Buttonwood. In her early years here in Santa Barbara County, Betty was instrumental in forming the Land Trust for Santa Barbara County as well as becoming involved in early Santa Anaz Valley planning initiatives. She will be remembered as a positive influence by many, and I'm sure that they will take this opportunity to raise a glass and say thank you Betty for everything you've done.

I would like to adjourn this meeting in honor of Toby Parisi, a 36-year resident of Goleta. Toby was a dear friend of mine. I know many people in the community will know Toby as a dear friend And as an educator, she taught in adult education. She taught needlework. She made the most beautiful needlework things that were just amazing to me and I always was so impressed by her but I think what she did in education extended past what she did in the classroom. It was really her education to her friends and her philosophy on life.

She, I want to say suffered but that's not really a word for her. She had breast cancer for 21 years but you would never know it. She was the most optimistic, upbeat, incredible woman and she recently passed away so I think our entire community mourns the loss of Toby and we wish the best for her loving family and her very special husband
