and justice for all Thank you. Now the board will go ahead and take up the approval of our minutes of our October 2nd meeting. No changes, we'll have a motion to approve. Motion by Supervisor Wolf, seconded by Supervisor Gray. All those in favor say aye.

Aye. Opposed? Motion carries. Thank you. Alright Mr. Allen I think we have a couple of changes to today's agenda that we're going to need to vote on.

UnidentifiedUnidentified speaker 1Proposed1:29 · ≈ 9:01 AM

Madam Chair, members of the board. First on item A6, this is from Public Works. The request is that the Board consider recommendations regarding the Tahequs Landfill Phase 2 partial final closure construction. This is County Project Number 129913 in the 3rd District and there's a request that this item be continued to your meeting actually on October 16th next week and we have a memo to that effect and you can make that part of your motion on the administrative agenda.

Secondly, on item D3 which was scheduled for later on today. This is from Planning and Development. It's a hearing to consider recommendations regarding the Goolsbee and Goolsbee-K appeals of the Montecito Planning Commission's approval of a Verizon wireless facility At the Montecito switch station located at 512 Santa Angela Lane in Montecito. This is in the first district and there is a request that this item be continued, and we have two speakers or We have one speaker on this item to talk to the continuous request mr.. Shatillo

CommentHalama BeachProposed · by introduction2:47 · ≈ 9:02 AM

All right. We're going to deal with the administrative agenda except for 812 and then we'll deal with that separately and let you know. All right so as far as D3 goes then do we want to go ahead? Do we have to have somebody speak to that now?

UnidentifiedUnidentified speaker 1Proposed3:04 · ≈ 9:03 AM

Yes, Mr. Scintillo has a slip in on Item 3 to talk to the continuance request.

UnidentifiedUnidentified speaker 4Proposed3:13 · ≈ 9:03 AM

Good morning, Madam Chair, members of the board. Mark Shatillo and I just wanted to advise your board that I've been working closely with the Verizon folks to try and find an alternative location and they have agreed to extend the shot clock and support a request for continuance of the hearing. Until November 13th or November 6th, our preference is the 13th.

And so we'd appreciate your board offering us that opportunity to be able to try and work this one out further and find an alternative location for the cell antenna in Montecito.

CommentHalama BeachProposed · by introduction3:48 · ≈ 9:03 AM

Okay thank you. CEO Waller I think that when we talked about this in agenda review you thought that the sixth was better. Is that still your recommendation?

UnidentifiedUnidentified speaker 5Proposed4:00 · ≈ 9:04 AM

Chair Farr, I believe that will be the case. You may recall that there was some discussion on the jail project coming on the 6th but it appears at this time that that will very likely slide to the 13th which will make a very full day for you so currently I would recommend the 6th for that continuance.

CommentHalama BeachProposed · by introduction4:20 · ≈ 9:04 AM

Supervisor Carbajal this is in your district what do you want to do?

CommentJack BoysonProposed · by introduction4:25 · ≈ 9:04 AM

Well, I always like to acquiesce to my constituents when at all possible. I'm just wondering if the other party was so open or flexible to the 6th or the 13th if they didn't really have a preference?

CommentHalama BeachProposed · by introduction4:43 · ≈ 9:04 AM

Well, I think one of the considerations was that if

Agenda Discussionitems moved / continued / pulled, click to expand

we heard it on the 6th there would still be time to continue it to the 13th. And that gives the board a little bit of a cushion depending otherwise if we hear it on the 13th then there really isn't that time cushion.

CommentJack BoysonProposed · by introduction5:01 · ≈ 9:05 AM

Why don't we go with that in light of what CEO Waller said but if that changes or we could accommodate Mr. Shatillo I think it would be good.

CommentJack BoysonProposed · by introduction5:13 · ≈ 9:05 AM

UnidentifiedUnidentified speaker 6Proposed5:36 · ≈ 9:05 AM

yes thank you we have a bit of a problem in the Orcutt area Last I think it was in June, the citizens of Santa Maria, the incorporated area of Santa Maria passed a one quarter cent sales tax increase. So there's so the sales tax went from seven and three quarters to eight cents. Well that took effect I believe it was yesterday. And some of the folks in Orcutt weren't quite clear that they weren't in the city of Santa Maria.

So some of the businesses in the Orcut area, and I don't mean just the small businesses even some of the large businesses are now assessing an eight cent sales tax when in fact they can't. And so I'm trying to get the word out but I'd like for county council to comment on this So that it will sound like I know what I'm talking about. Because I went around to businesses yesterday and some of them were like, who are you to tell us we don't have to pay this sales tax? So I spoke to county council in asking him to comment on if you're in the unincorporated area and if you don't know call the county clerk.

Don't raise your sales tax.

CommentPatricia EscaleraProposed · by introduction6:54 · ≈ 9:06 AM

Madam Chair, the supervisor is correct. The imposition of a sales tax for the City of Santa Maria only affects the incorporated area and would not reach into any unincorporated areas or any other town or city in the county so I think it's important that People be aware of their geographical location, particularly if they're close to a boundary. Eventually the Board of Equalization will be advised of this when they start receiving tax receipts from areas that aren't in the incorporated city of Santa Maria so there'll be quite an unwinding process that will have to occur. So it's wise if those businesses become alert and aware of that sooner than later.

CommentHalama BeachProposed · by introduction7:44 · ≈ 9:07 AM

Is that something that our auditor's office would be involved with?

CommentPatricia EscaleraProposed · by introduction7:48 · ≈ 9:07 AM

No, I believe all of that process would be with the State Board of Equalization who as I recall processes all the sales tax and they have all the requirements and procedures.

Madam Chairwoman, members. President Obama when candidate Obama was asked who is his favorite president he did not say John Kennedy. He didn't say Abraham Lincoln. He said Ronald Reagan. Point. Skull and bones, when it was formed after the stock market crash in 29. George Bush Sr., former President Gerald Ford, I believe Princeton decided no more economic problems for the United States of America protect the system capitalism Mr.

Obama, my cousin, his wife is a Robinson, South Carolina. I don't have to go into a long dissertation about the interrelationship of black families in the United States of America for 400 years but when asked Ask about the ID thing, I see nothing but politics. The fact of the matter is when you register to vote your registration application is sent through a process that's determined whether you are a citizen of the United States of America Whether you are a felon, if you're a felon you can't vote.

And you receive in the mail a voter registration card. Now the whole argument about ID at the polls November 6th is a construct of those within my own party who are somewhat racist The fact of the matter is when the voter goes to the poll, all he needs for identification is his voter registration card unless the folks at the polls are somewhat unaware. Thank you.

Good morning.

PresenterJack BoyceGood Samaritan Shelter as you know the county of Santa Barbara has been under scProposedself-stated11:38 · ≈ 9:11 AM

Good morning, Madam Chair members of the Board of Supervisors. My name is Jack Boyce and I'm here representing Good Samaritan Shelter as you know the county of Santa Barbara has been under scrutiny by the Department of Housing and Urban Development resulting in a temporary freezing of home funds Good Samaritan Shelter is in the middle of construction of a 16-unit apartment building called Casa de Familia in Santa Maria, designed to house the neediest of the needy. Those individuals formerly homeless falling in the lowest of income categories.

Funding for this project is primarily from those home funds that have been frozen. This project is located on our shelter campus, providing supportive services onsite to assist in stabilizing these families and assisting in the ultimate goal of maintaining sobriety and self-sufficiency. In short, this is a very important project serving a population desperately in need of permanent housing.

The irony of this situation is that the Casa de Familia project is the poster child for what these home funds were originally intended for. We have been working closely with your housing and community development staff to solve this issue. I might add that your staff has been nothing but cooperative, and have demonstrated that this is an absolute priority for them and the County of Santa Barbara. We are honored to work with them.

We are here today to request that your board consider emergency funding to allow this important project to continue while the home audit requirements are satisfied. We have been under construction since June and have yet to receive any reimbursements. To date, we have incurred costs totaling $600,000 under the HOME program. Thinking it was going to be resolved in a few days, Good Sam advanced $59,000 to the contractor in early September to keep the job moving. We have been fortunate to be working with an understanding contractor who has seen fit to carry a significant portion of the financial burden.

Additionally he is responsible to numerous subcontractors who are owed significant amounts of money. As an example, one of the subcontractors was notified last week that his material supplier would no longer allow him to purchase on credit until his material bill for the Casa de Familia project is settled. This will have an effect obviously on his ability to perform on his other contracts and will have severe consequences.

If not resolved, we would ask that you consider agendizing an item for your next week's board meeting to consider providing Good Sam with emergency funding until home funds become available. While we are currently owed $600,000, 390,000 would bring us current with the contractor through August 31st and would allow work to continue until this crisis is resolved.

I am here along with Sylvia Bernard, our Executive Director if you have any questions.

Thank you Madam Chair. I guess I'd like to direct the question to our CEO is what kind of timetable are we looking at? Do we know what the timetable is of when these funds might be released?

UnidentifiedUnidentified speaker 5Proposed15:05 · ≈ 9:15 AM

Chair Farr, Supervisor. We have been working very closely with Good Sam and much like they appreciate the cooperation that they've seen from our staff we appreciate their cooperation as well. In fact, we've been able to put together a substantial response to HUD regarding the home funds and specifically Yesterday we forwarded that information to the federal HUD. They were on vacation yesterday, but we are following up with them with a phone call asking them to allow us to walk them through the information And to expedite their review, which would then free the funds. So I think we'll have more information for the board probably after that discussion later this week and will continue to keep your board informed of the progress that we make.

As to specifically when we would anticipate resolution, at this point in time we believe we have responded appropriately and fully to HUD's request. However, we can't control their timeframe for response but as I mentioned, we will continue to keep you and good Sam apprised of the progress that we're making.

I believe that we should probably agendize this just in case. If HUD does come through, I think we should put it on the agenda so if we need to discuss the possibility of a bridge loan knowing that it's going to be funded that we at least discuss it and are ready to grant the loan if need be. So what I'd like to see is put it on the agenda. We can always pull it off if HUD comes through.

an unfortunate predicament we're in, but I think as we consider any bridge loan. I think one of the things we ought to be doing is really pressing our U.S. Senators and our congressional delegations so that they could call get HUD's attention to be perhaps as responsive as they can be and not delay any further, any interaction or communication with our office.

But having said that I guess anytime HUD puts the brakes on things, I think our board should also have a better understanding of audit exceptions and all those audit issues that usually draw the attention of HUD And as we have seen, we've had a lot of issues in our county in recent years that warrant some attention. So one I think we need to put some pressure on HUD to be more responsive and I'm glad to facilitate that to the extent that I can to help you Supervisor Lavanino since this is in your district but two I think it would be good for us to understand from HUD what it is that they have identified as exceptions to the audit because we have a responsibility to the taxpayers, as well, to make sure that any loan or expenditure of funds, that it's within keeping within the guidelines and there are audit exceptions that are also addressed which I know that they're attempting to do, as well.

CommentHalama BeachProposed · by introduction18:38 · ≈ 9:18 AM

Thank you and I'd also like to have either Terry or our CEO speak with our federal lobbyists, and this might fall out of a little bit of the scope of what their normal work cycle is. But expediting something through I think would, I'd like to see them involved in this as well so. I think this is something we need to walk through the process. I've dealt with federal government for many years, and these are things that can fall into black holes and take weeks and months if somebody's not babysitting it all the way through the process.

CommentHalama BeachProposed · by introduction19:19 · ≈ 9:19 AM

And I agree, I think what I would be concerned about is if HUD has requested certain information and we have fulfilled all those requirements that we should be done and not be expecting that they're going to come up with a whole new list of things to extend this process. And I think it's really unfortunate that Good Samaritan finds itself in this situation and of the other entities that were also asked to provide documentation They are the only ones that are under construction and really caught in this serious situation. So I'm certainly supportive of having more information and bringing this back.

All right, and I think we have one more public speaker.

And again it's a real honor for me to be able to present or sponsor this resolution proclaiming the week of October 7th through the 13th as National Fire Prevention Week. And as we all know, for many tragedies throughout the world and our country you can never prepare enough. And it's important for families and everybody who is watching and everybody who is here to take a moment to think about whether they have a fire escape plan in their homes that they've talked about it with their children with everybody who lives in the home to make sure that everybody's aware of how to escape during a fire And also to check those batteries in those smoke detectors that many of us have.

And for those that don't have smoke detectors, that they really go out and buy some or get some somehow and put them up in their home to ensure the safety of their families. Mr. Allen if you could read the resolution?

UnidentifiedUnidentified speaker 1Proposed23:06 · ≈ 9:23 AM

Madam Chair, members of the board. This is item A-1. It's a resolution proclaiming the week of October 7th through 13th 2012 as National Fire Prevention Week. Whereas October 7th through 13 has been declared National Fire Prevention Week, a time to reflect on our nation's past fire history remembering the Great Chicago Fire of 1871 and how out of that tragedy a national interest in fire prevention and safety emerged.

And whereas, the reality is that when fire strikes your home could be engulfed in smoke and flames in just a few minutes. And whereas it is important to have a home fire escape plan that prepares your family to think fast and get out quickly when the smoke alarm sounds. And whereas the 2012 National Fire Prevention Week theme Have Two Ways Out focuses on the importance of fire escape planning and practice.

And whereas the Santa Barbara County Fire Department is dedicated to the safety of life and property from all harmful effects of fire. Now therefore, be it hereby ordered and resolved as follows that the week of October 7th through 13th is proclaimed National Fire Prevention Week throughout Santa Barbara County In support of our fire service agencies, we encourage everyone to participate in fire prevention activities at home, work, school and every other place. In addition, we encourage every citizen to set apart Tuesday October 9th 2012 to rededicate themselves to the commitment of practicing fire safety.

And also to make this Fire Prevention Week the beginning of a year-long effort to improve fire safety wherever you are and whomever you are. Passing adopted today by the Board of Supervisors by unanimous vote.

Morning Chief.

UnidentifiedUnidentified speaker 8Proposed24:49 · ≈ 9:24 AM

Good morning Madam Chair, members of the Board. Observed each October National Fire Prevention Week commemorates the great Chicago fire 1871 by promoting fire safety every year a new theme is chosen for Fire Prevention Week this year's theme is have two ways out I also like to call it exit drills in the home or Edith Surprisingly, a recent survey by the National Fire Protection Agency showed that over one third of the American households had never practiced a home fire escape drug.

Let's not let everyone in Santa Barbara County be a part of that statistic. Fire Prevention Week also serves as a good reminder that fire safety and prevention should be practiced all year long. The Santa Barbara County Fire Department offers this simple fire safety checklist Install and maintain a working smoke detector and carbon monoxide detector on every level in the home, in sleeping areas. And remember to change the battery as Supervisor Carbajal said twice a year.

Designate two escape routes from each room in your house and practice them regularly. That may involve getting one of those escape ladders for the second floor if you need to get it. Teach everyone to stop, drop and roll in case clothing catches on fire. Avoid storing unnecessary items in the home or the garage. And we all know what gets stored in the garage.

Teach kids that matches, lighters, candles are tools not toys. Matches and lighters should be stored in a secure drawer or cabinet. And as a service to our citizens, anyone living in the area served by the Santa Barbara County Fire Department can call our headquarters at area code 805-681-5500 or visit our website at www.sbcfire.com to set up a free home inspection by one of our engine companies.

Our firefighters will give you helpful advice for evacuations, fire safety and making sure smoke detectors and carbon monoxide detectors are working properly. Emergencies can happen anytime anywhere while firefighters are critical in firefighting and responding to fires our best tool for preventing fires is an educated public by taking a few simple steps now to get prepared You can keep your family safe for the remaining 51 weeks of the year. Thank you.

Certainly, as a county we do all that we can to be energy efficient and aware ourselves. And I think for all of us with the recent spike in gasoline prices if we weren't thinking about it before we certainly are now. And particularly with the winter months coming on. So for the county, many of you may have heard about our Empower SBC program but even before that the county was working on being more energy efficient ourselves and helping others be more energy efficient as well through our Innovative Building Review Committee.

Madam Chair, members of the board. This is a resolution proclaiming October as Energy Awareness Month in Santa Barbara County. Whereas reliable and affordable energy is critical to Santa Barbara County's prosperity, health and quality of life. And whereas the production and consumption of energy affects our everyday activities and natural resources And whereas, Santa Barbara County has a long tradition of environmental stewardship and has implemented many programs that promote responsible and efficient energy use within county government and among its citizens. Including EmpowerSBC, the Innovative Building Review Program, the Green Business Program Landfill gas collection and conversion, fuel efficient vehicles and county facility energy management and renewable energy installations.

And whereas Santa Barbara County has made clean energy a high priority policy issue in recent years and is committed to efforts that support statewide goals to reduce the impact of traditional energy production and consumption on climate change. And whereas, Santa Barbara County is also home to many proactive organizations and businesses that work diligently to support local energy awareness and conservation efforts.

And whereas, energy efficiency and renewable energy development can offer employment and economic opportunities while contributing to a sustainable Santa Barbara County. And whereas the U.S. Department of Energy has designated October as National Energy Awareness Month to underscore how central energy is to our national prosperity, security and environmental well-being. Now therefore be it ordered unresolved that this Board of Supervisors declares October as Energy Awareness Month in Santa Barbara County and encourages all citizens to commit to improving energy efficiency and conservation efforts in their homes, schools, businesses and communities passed and adopted today.

Madam Chair, members of the board, our esteemed alumnus, Supervisor Gray, Supervisor Lavagnino, thank you for this honor this morning. I've been coming to this opportunity since 1999 first as a 4-h volunteer and the last two years The Santa Barbara County 4-H representative, and my name is Sherry Mills. And I'm just so excited to be part of 4- H. We're really on the go and on the grow. We've got fantastic volunteers in each and every one of your districts helping our youth in the county.

And this is our week every year where we celebrate National 4-h Week. We kicked off the week on Saturday With a National 4-H Youth Science Day event at Foothill School in Santa Barbara. We had over 160 people attend that event and about half of them were non-4-Hers, so it was a great opportunity to reach out into the Santa Barbara community and we have all of our clubs, about 18 clubs right now, a couple new ones. Still in the forming stages and some other ones in the works.

And all of the clubs are celebrating in one way or another this week as well, and we'll end this week with a booth at the Lemon Festival in Goleta where we'll be presenting our Agua Pura 4-H Watershed Education Project. We reached over 4300 people with that last year So that's something we're doing in addition to our clubs and we really appreciate your support of UC Cooperative Extension here in Santa Barbara County, which allows us to have a 4-H youth development program. And our program here in Santa Barbara County is becoming more and more well known up at the state 4-h office. We sent a delegation to our State Leadership Conference this summer. We were one of the largest delegations.

About 19 people go to that and that's for high school age youth. And we have another big delegation going to a leaders forum at Asilomar in November, and that's for our adult leaders. So you all should be very excited about what we have going on here for the families and youth of our county. We have a task force that was formed last year of youth and adults to work out a five-year strategic plan for Santa Barbara County 4-H, and one of our All Stars, Emily Martinez, was one of the young people that served on that task force. She's here with Tiffany Crane who is our All Star Advisor And three of our four all-stars and all stars are the county ambassadors, the top kids who've reached the highest level they can in the county program of 4-H. We've got Jonna Emrick and Patrick Metzler and Emily Martinez.

And over here, we've got some 4-H'ers from Carpinteria. You can tell they have a little bit different style maybe with their dress. They are in a club that's, yeah, they're the surfing guys, yeah. They're a club that is becoming more and more bilingual, and we're very pleased to see that happening reaching out to the Latino community in Carpinteria with that club And then we have a couple of our volunteers here today, too. Andreas Piper is here and Mrs. Kitt is over there. And would it be all right if they take some photos? Maybe if they could come through this way to get some photos as Emily speaks. So I'd like to introduce you to Emily Martinez now. Thank you.

Planning Commission approved this project on September 5th, the hearing is set 41 days later. This will be the seventh public hearing on this project and they have hired yet a third attorney to file the appeal on this.

The delay has been a specific tactic of a few neighbors on this to delay this project that's consistent with existing zoning. And they succeeded in delaying it 850 days from filing to the Planning Commission hearing and 890 days to the Board of Supervisors hearing, which is extraordinary. Under the state law limits for processing projects with tentative maps. So we request that you set the hearing for October 16th as recommended by the staff. Thank you very much.

Thank you Madam Chair, members of the board. I'm Mark Shutillo for the Channel Islands Chapter of the California Native Plant Society and the San Antonio Creek Homeowners Association. I will withdraw my request for a continuation based on a discussion that I had with County Council where additional authority was identified with respect to the Subdivision Map Act and the requirement that the hearing be scheduled within 30 days. I don't necessarily agree with the authority or concur with it. I haven't done a full analysis but I can appreciate that it's going to be their opinion that this needs to go forward on the 16th.

It certainly does jam me given the amount of information that's involved in this particular project and so, I wanted to ask the board for a bit of dispensation and a courtesy to allow me to submit documents as late as noon on Monday. I know that the ordinary protocol is that you would receive all your documents by noon on Friday, and I will endeavor to get as much and hopefully everything to you by that time. But I have a couple of different experts that I'm working with, and this matter does involve some evidence that I would like to submit and provide to your board that you would have time to consider Before the hearing and I can appreciate it doesn't, it's never easy when you get large volumes of information at the last minute.

And as I said, I will endeavor to get as much as I can to you by the noon Friday deadline. But Madam Chair, I'd like to request that your board consider giving me some direction and authorization to file any other information that I accumulated and put together over the weekend So I can provide you with hopefully a more synthesized set of information that will be a little more easy to work through as opposed to just dumping a large volume of information that I haven't had a chance to organize for the benefit of the board on Friday.

CommentHalama BeachProposed · by introduction43:59 · ≈ 9:43 AM

Thank You Mr. Chateau. Counsel, do you want to comment on that request and how does that work procedurally?

CommentPatricia EscaleraProposed · by introduction44:08 · ≈ 9:44 AM

Madam Chair, under your board procedures your board has the authority by four-fifths vote to accept late filings. Separate and independent from that most likely opponents, appellants would have the ability to submit CEQA documents The difficulty is that the later we receive the documents, the less opportunity staff has to present countervailing evidence. But that can also be factored in on any subsequent judicial proceedings by the court. So you do have the authority to grant late filing and perhaps, and we haven't had a chance to fully review the law in this area but perhaps have the requirement I'm going to go ahead and ask a question.

You know, take a formal action on it. CommentPatricia EscaleraProposed · by introduction45:36 · ≈ 9:45 AM

I think some late filings are not part of a record for subsequent judicial proceeding. If it's a legislative matter, then it's really just part of the information that your board has to consider. This is a quasi-judicial proceeding and the record is the determination... Is the basis upon which judicial review was had as compared to a legislative action.

I don't see how we can determine that right now.

Supervisor Carbajal?

CommentJack BoysonProposed · by introduction46:44 · ≈ 9:46 AM

Thank you. My biggest concern above everything is our inconsistency, even with quasi-judicial land use matters. I could probably go back and find all the times we receive stuff late But my biggest concern is inconsistency. So in whatever we do today, it's precedent setting if we're going to be consistent in the future. I sure hope CEO Waller that you're paying attention here because when we have land use matters We get a barrage of things the whole after 12 o'clock on Friday. They just keep coming in and Monday, and we never have a procedure that says okay this came in after 12 on Friday board Do you want to accept or not? There's-we don't do that procedure on a regular basis. We're inconsistent as you can be So if that's really our procedure, we oughta really have something by where the clerk gives us a packet and says this came afterwards You've got to vote on it because we don't consistently vote on it.

And so having said that, I guess my concern is if we do this fine but then we gotta do it for everyone and if we don' tdo it then we don''t do it for everyone but we gotta be consistent cuz it's not fair To people on both sides, if we don't do it. Certainly one of my guiding principles is that usually I err on the side of the general broader public but again there's good arguments that can be made for every party.

UnidentifiedUnidentified speaker 6Proposed48:27 · ≈ 9:48 AM

Well I'm going to go back to the volume thing and I think we have been consistent I mean, I'm not disagreeing with Supervisor Carpajal. I think we've been pretty consistent. We know that if it doesn't come in at a certain time, we have to vote on it in order to take it and that vote normally revolves around how much is there. Now, I know Mr. Tillo is an attorney and at the court level Five days is five days. And we learn that in law school, and we learn that in practice, and then you learn it, learn it, learn it. So it's not like it's news but I'm assuming he doesn't have a whole bunch and we might be able to... But I don't know so how do you make a decision on what you don't know? And I think consistent is if he wants to turn it in late, he takes the chance that we will or won't accept it.

UnidentifiedUnidentified speaker 4Proposed49:28 · ≈ 9:49 AM

Thank you, Madam Chair. Mr. Labagnino. Yes I am new to the case but the other thing that's unusual about this and I didn't really explain this in my comments is under the, this is a proceeding under the Subdivision Map Act and apparently there's authority there that requires that the hearing be scheduled within 30 days of the filing of the appeal which is by the county's usual process in processing land use appeals very very rapid And so frankly, I was caught unawares when this was going to be scheduled for the 16th. I also have a hearing before the Montecito Water District on the Verizon cell tower at 2 o'clock on the 16 as well. So it's a matter of juggling calendars as well as preparing materials to be able to present to you the information.

So as Mr. Nelson indicated that the community groups have had a couple of different lawyers now with third lawyer involved and That's a contributing cause. I was not involved at the Planning Commission, I think that's a challenge for me and I'm trying to work under the timelines that council feels are applicable which 30 days is... The county has a mediation process that we had to participate in last week. We had a site visit before that. It's been a lot of activity around this case that's limited our ability to really prepare the materials that we want to present to you at your hearing.

ElectedSteve LavagninoSupervisorProposedvoiceprint 0.8150:52 · ≈ 9:50 AM

Collaborating with other agencies serving similar purposes.

Recognizing outstanding programs that serve women and children, and then disseminating information so that we know what is occurring on all parts of the county. Our meetings are public and we remain in contact with our supervisors advising them as is appropriate. Members as Miss Lawson indicated are not able to be here. They are accountability, we do meet once a month in Solvang which is a great halfway point and the building is ADA compliant. Our meetings are open and we encourage attendance also comment so That is how we fulfill our accountability goal.

Our second goal is a customer focus, and we do identify issues that affect our constituents. We invite speakers to come and further our knowledge base of what's going on in the community. We sponsor events that create awareness and also host forums that increase community input. And finally, our third goal is efficiency We are proactive in addressing issues that impact women and children. We present to the Board of Supervisors two times a year, and then we meet individually as needed with each of the supervisors to make certain that we are representing their needs and also communicate information that we've learned.

And those are our goals.

CommentSecond District Commissioner GailProposed · by introduction1:12:10 · ≈ 10:12 AM

Good morning. So this slide, you can take a look over what we've been doing for the last three years. Currently this year we had a fairly exciting year for health. We had two guest speakers come to pass along information and programs that they're doing all county wide. One was the Anti-Defamation League And the other was domestic violence solutions. We continued over for a second year, our interest in transitional foster youth.

This year we did something a little bit different and I think it has to do somewhat with that we're playing a more active role with the Association of California Commissions on Women And they have sort of put us in touch with other commissions and other issues that are going around statewide. So this year we did three things, we wrote a resolution to Governor Brown to support the reinstatement of funds for the California Commission on the status of women which was removed. And I'm happy to report that it has been put back in the state budget for this year.

We wrote a letter in support of Senator Simiton's Bill 1538 regarding breast density notification, and recently that was signed into law. We feel that this will give thousands of women a better chance of early breast cancer detection. We also are supporting a resolution supporting the hosting of the United Nations Fifth World Conference on Women in San Francisco for 2015 This was a request by the San Francisco Commission on the Status of Women.

And I think that is a process that is ongoing for quite awhile and there's countries competing for that, so we'll see how that goes. But it was exciting to get involved with not only county but statewide issues this year. Lastly if you'll notice also in 2009-2010 We did an event which we showed a movie called Little Rock High 50 years later, a screening. And there was a group discussion and we returned to that format for our event this year.

And in Carpinteria, we had a showing of misrepresentation followed by a community forum. It was a wonderful event over 150 people attended. Led to some wonderful discussion. Each year, each district's commissioners meet to discuss a recipient for an award and we try as much as possible to have these awards reflect our current areas of interest. We then proceed by notifying each of the supervisors and then the awards to the recipients.

So, and of course we come before here Give these awards in the spring. This year we see if this is where I wanted to be. Did I skip a slide? OK, I'll just go forward here. Every year, I mean this year we continue to be on a coalition with the Santa Barbara Pro-Choice Committee and we help staff and organize the Great American Write In that they do in August. And we help in the January Row event.

We are continuing to go to Harry's Foster Friends which is a community meeting once a month on foster care We are active members of the Association of the California Commission of Women. Okay, I am a little bit no. And this year it was exciting we participated in something that we hadn't before which is called the Mock City and it was in collaboration with the Assistance League. They set up truly a mock city you could go and find out how to get a driver's license or how to open up a bank account and Commissioner Gray, we attended meetings and were there at the day of it. And Commissioner Gray who's an attorney helped out at the judge and lawyer jail sort of area to give the foster children a showing. It was a wonderful event I think there were about 75 foster children there.

Collaboration with other agencies. Every year, we've been very supportive of the Women's Literary Festival and give scholarships to women to attend. Girls Inc., League of Women Voters, Women's Club of Carpentria and the 2012 project were all partners of ours for the Carpentria screening of misrepresentation. We continue to be... What are we doing here? As active members of the ACCW last year, Commissioner Hampton and I attended the in-person meeting in Cambria. And then I went up again to Northern California this June.

And for this year, one year only, I will be serving as secretary to the ACCW. This year Supervisor Cardi and I met with Executive Director Judy Patrick and President Catherine Downing of the California Women's Foundation. And then we later in the year co-sponsored the public briefing in May of their report, Falling Behind the Impact of the Great Recession and the Budget Crisis on Californians' Women and Their Families. And Supervisor Wolf was among the panelists there.

And what else? And of course as I mentioned We've been in contact with the Commission of Status of Women for San Francisco County and City because of their UN resolution. These are some organizations that we're involved in. And now I'm going to turn over the microphone to Commissioner McCarty, thank you.

Gail. 2011-2012 Visibility, well we have a presence on the county website. You can now like us on Facebook page. We have continued to publish revise and republish the Commission for Women Resource Guides. It's revised and updated annually especially important now in these critical economic times when organizations can often close within the course of a year. We have two versions one that serves North County, one that serves South County And you can find these resource guides in libraries, community centers, adult education classrooms, police department cities etc.

We invite guest speakers to speak to areas in which we need to acquire additional information and again this is with regard to serving both sides of the county. We have Richard Kravitz who's the Executive Director of Domestic Violence Solutions And he discussed programs that were available in both ends of the county and where the areas of need were. And the statistics that varied, which was an eye-opener. Anais Borg Marksher is a representative from the Anti-Defamation League, and she presented an anti-bullying curriculum that's used in classrooms Additionally, two of our commissioners participated in a community access television show on Channel 17 entitled The Next Step. It's a talk show hosted by Elden Booth and this one was on women's issues.

And in addition you can find us volunteering in a diverse array of organizations and at events. In terms of future opportunities we will continue our community outreach Looking for great speakers to come and speak with us. And we are planning our event for this year. We're also recruiting friends of the Commission for Women, that's the fundraising arm, the 501C3 for this group. And were using the social media platform to do that in hopes of building a coalition of support increasing the network and having a better means of promoting our events.

Future opportunities continue with our formation of committees. This year we are again focusing on women's health and domestic violence to that end, we had Mary Jane Alomba who is a brand new case worker manager for Calm in the North County. We're also looking at the issues of women aging and becoming vulnerable seniors, Got some critical information on that in the falling behind report briefing at which Supervisor Wolf took a very large role.

Both physically and economically, women are continuing to be vulnerable members of our community so we're looking at ways to support that. Education always was and will remain a priority area for our attention We're looking also at the correlation between education and employment among women. And we will continue our focus on foster care with respect to those youth who are transitional aged, youth that are aging out of the system and really requiring additional resources. We work with My Home at Artisan Court which is a program of the Channel Islands Hawaii Youth and Family Service Branch.

And as Gail mentioned, we continue to work with Harry's foster friends. As far as outreach, our plans are to continue to develop our website page and continue to use social media to promote events. We all contribute content to both of those. Our event this year will be in North County, so we're looking forward to getting that going and will be responsible for the coordination and production of that event. And we'll be looking for partners in the North County area to help us with that.

So in closing, we'd like to again thank commissioners... I'm sorry, we are the commissioners thanking the supervisors. It's so easy to interchange this for this time. And would also like to thank the EEO staff notably Cassandra Lawson Who is brand new to the position and has done a fine job for us this year. Thanks once again, we continue to hope to serve our

Oh thank you Madam Chair and I too want to add my appreciation to the Women's Commission. I think all of the commissioners are outstanding and every time you come before the board It's an education for us to know not only what you're doing, but also the innovations and some of the new things that you're doing. I want to specifically though thank my commissioners Gail Teton-Landis and Gwendolyn who is not here for keeping me in the loop and in touch on issues that are going on.

Some of the things that were mentioned today, Are really important, but one thing that really struck me was your ability to collaborate with other agencies in the county. And I think that's so important because there is not one agency that can do what you do and what your mission is by yourselves. So I think that working together makes us a stronger community and makes the programs quite incredible.

You also mentioned the opportunity to raise funds, and actually, I don't know if you've done that before. This is the first time I've heard of that. And I think that's a really good idea. When I get back to my office, I don't know, what do you say? I'm going to friend you. But I think it's really good and I do think that is an opportunity. I would imagine that you are by the nature of your organization as part of the county a 501c3 so you can accept contributions. The friends of the commission. The friends of the commission. So we as commissioners- It's a separate entity that you have set up as a 501c3, I'm assuming now.

Okay, and is that something new?

It's actually active. It had been formed about five years ago. We used it for our Women in the military event at which lowest caps and solid carbohol spoke. And then we kind of went dormant for a couple of years as commissioners come in and exit. We sort of ebb and flow, and we've decided to resurrect that and make it more viable so that we can do more

UnidentifiedUnidentified speaker 3Proposed1:26:42 · ≈ 10:26 AM

now. I think that's great. And then you have people like me who are just starting to do that. Be involved with Facebook and kind of the older folks now might, you know, just jump on board. I think that's fantastic. The other thing that I was really pleased to see is your legislative advocacy. And I just am not sure if your commission is aware that the County Board of Supervisors has a ledge committee and it might be good that if you have If you're going to be supporting a bill, to let our county ledge committee know about that so that we too can piggyback and write a letter. We've done that before on other particularly women's health issues and so just to bring that to the attention of the Ledge Committee and our Supervisor Carbajal and Supervisor Farr are current representatives.

So that would just add a little bit more and I'm just so pleased that you're taking that on Great work. And I've been to both of your movies, and they have been tremendous successes. Misrepresentation was in Carpinteria, and it brought out as you mentioned 150 people. It was an amazing terrific success. So you're doing a great job. And to all the commissioners, I really thank you for your dedication and volunteering in the community.

And as I was looking at your list, the word family law caught my eye. When I was practicing law one of the very saddest things and there's no soft landing here in many ways whose parents were going through divorces and they were basically in huge fights over who got the children, who got the house. And it was a real ugly situation and this is only... I don't have a solution but it seems like it is a problem and maybe the Women's Commission could discuss a similar CASA kind of approach so that there were people assigned to the courtroom that maybe helped the children whose parents were going through This really bad time in their lives and and we just provide a softer landing for those children that sometimes take the blame Sometimes don't know what's going on and become the brunt of real problems.

So maybe you could discuss that We do and thank you for the suggestion Thank You

Madam Chair and members of the Board, over the years the County of Santa Barbara has considered the implementation of beach parking fees at several beach access points. In May 2011 the board directed staff to develop possible alternatives for beach parking fees at six county beach locations and review those with the commission and return to the board. Today, we would like to provide you with an update on beach parking fees and recommendations from the Park Commission.

Beach parking fees provide an opportunity to create a new revenue stream and support operations and maintenance. Staff has gathered information from various agencies with beach parking fees. We have reviewed their fee structures and their internal management processes. From that, we've created financial models looking at cost and revenue scenarios. Staff has contacted other agencies and evaluated and compared their fees and method of collecting those fees at various facilities.

For example, the City of Santa Barbara manages several beach parking lots. Fees range from $2 per hour to a maximum of $12 per hour. These fees are collected in the city of Santa Barbara by staffed kiosks or honor pay systems or pay on foot which is equivalent to an electronic pay station. The county currently charges $10 for parking at Paloma Beach. The city of Ventura, at one location has a maximum rate of $8 for the day.

Fees at our state beaches are $10 per day for parking. Some facilities charge flat rates for parking and some use a tiered pay system. Here are two different types of parking pricing for consideration. A tiered approach, which has an initial rate for the first hour and then increases every hour thereafter to a maximum rate for the day. Or a flat fee approach, which has a maximum rate that you pay for the day regardless of the time that you park at the beach or park site.

Parking hours and operation could vary based on season and location. Carrie?

CommentHarry's Foster FriendsProposed · by introduction1:34:43 · ≈ 10:34 AM

Staff evaluated both revenue and expenditure impacts of a potential beach parking fee program. Our revenue estimates were conservative, anticipating that patrons would stay for a minimum period of time. These assumptions include adjustments for reduction in park visitation, 90-minute free parking at restaurant locations, and a loss of space related to the Goleta Beach 2.0 project.

Preliminary estimates indicate The potential beach parking fee revenue can range from approximately 1.6 million to 2.5 million annually, depending on the amount of the parking fee and if the fee is collected through a tiered or flat-fee approach. The cost associated with implementing a beach parking fee program for the first year is estimated at approximately $1 million.

The cost of ongoing operations after the first year is estimated at approximately 800,000

The Community Services Department held three public workshops in conjunction with our Park Commission. Workshops were held in the North County, South County and one particular workshop was held in the evening hours to gather greater public participation in the process. The Park Commission received strong opposition to beach parking fees. The main reason for the opposition was affordability for low-income families, impacts to the surrounding communities impedes coastal access and concerns regarding the impacts to restaurants on the beaches.

There were a total of 86 speakers during the three workshops, none were in support of beach parking fees. The Park Commission voted unanimously to oppose beach parking fees and did not recommend a fee structure. Today we would like Board to receive this update on beach parking fees and provide staff direction regarding continued exploration of beach parking fees at our county beach locations. This concludes our staff presentation, we'd be happy to answer any questions the board may have.

UnidentifiedUnidentified speaker 3Proposed1:38:04 · ≈ 10:38 AM

Well I know that we do have some public speakers here but this issue is one that has consistently been a big issue for me whenever this has come up in the past as it has I have consistently voiced my concern about beach parking fees at other times we were talking about park parking fees I don't believe that this county nor my constituents take either of those lightly, and I have always been opposed to implementing those fees.

Now at our May meeting which was just mentioned on the board we had the Parks Commission come to us and ask the board to allow them to go forward to get information from staff and to hear from the public. And this board agreed to allow and bless the Parks Commission to move forward. Well, they did that. And the outpouring of angst and I don't want to say anger but I think incredible disappointment that we would be considering this was incredibly evident Everything that I saw from those meetings, all of my emails and people that I have talked to. I think there was one email out of at least 100 that was in favor of beach parking fees.

There was also an online survey that was conducted. And when I looked at the folks who responded to that online survey, approximately 75% of those people attended or said that they frequented beaches in the second district, Arroyo Borough or Goleta Beach and extremely high concerns about beach parking. And I just want to say that some of the things that were brought up as concerns located and or they have a tremendous impact on the neighborhoods. Goleta Beach, for instance does not currently have a bus drop-off point although that is expected and it's been talked about in Goleta Beach 2.0 It does not have an area for people to park adjacent to the beach there is no parking available at Goleta Beach other than the parking that we have there At Arroyo Burro Beach, constituents on Allen Road have complained even without beach parking that their streets are highly impacted.

And I'm speaking of one road. It's not like downtown Santa Barbara where you have a lot of streets. There is essentially no place other than Allen Road for people to park. We talk a lot about public access to our beaches. Yes, there might be other cities that do charge parking fees. But I strongly believe that public access to our beaches is really one of the foundations of what makes Santa Barbara County as special and as unique as it is. You

know what? We kind of have a policy. No cheering and no booing.

UnidentifiedUnidentified speaker 3Proposed1:42:04 · ≈ 10:42 AM

I know that it's been said and anyone who has gone to Goleta Beach or Royal Borough Beach can see the amount of people who use that beach as recreation for their families, for parties, for retirement parties. The notion of charging beach parking fees is something I think would impact the fabric of our community. We have in Goleta, we have the one public beach. We have Goleta Beach and we know that there's, you know, the numbers have been 1.5 million visitors a year to that beach.

And there's also been the research that was done with the beach fees that if you implement beach fees The number of people that will go to those beaches will drop. And while some of us may think $4 a day or $8 a day is insignificant, to many people that is a lot of money and they won't go to the beach. I think that's disgraceful. In particular, our beaches in the second district of Royal Borough Beach and Goleta Beach have two of the greatest restaurants in the county.

And I had my staff go back and look at the amount of revenue that those restaurants bring in. And in the last two months it's over $150,000. 86% of the revenue comes from those two restaurants. I worked with the restaurants in order to make the facilities a little bit better. You know, we always talk about working with our businesses and that's what we as a county have been trying to do.

And I fear that by imposing beach fees it's going to hurt those restaurants. Now I'm just saying that as a person who is sitting here but I have seen from the comments That both of the owners of those restaurants have commented on against beach fees. Some people may bring up Goleta Beach because we're going through a process, Goleta Beach 2.0 and I just feel that issue of Goleta Beach 2.O is not what we're talking about today. We are talking about beach fees and we have talked about it before and I hope that after today's meeting We will come together and just take it off of our radar. And say we will not look to our residents to pay this fee, to provide the county with $800,000 that we don't even know where that money's going to go.

My hope is that after we hear from the public, that my colleagues will agree that we're done with this process. We're not going to move forward with beach fees. And we're going to have a strategic workshop to look at other forms of revenue sources, which I think is an important facet that we have to deal with. But once and for all just say we're done with this idea. Thank you Madam Chair.

CommentHalama BeachProposed · by introduction1:45:35 · ≈ 10:45 AM

Supervisor Wolf since you've made your comments now I'm going to see if the rest of the board wants to make some comments now.

UnidentifiedUnidentified speaker 6Proposed1:45:42 · ≈ 10:45 AM

Supervisor Gray. I don't have a comment, but I have a question. I'd like to hold my comments until after the public, but I do have a question for Mr Parker when the Parks Commission discussed the beach parking fees. Did they separate out? Because one of the beaches that happens to be huge problem is the Goleta Beach because of the 2.0 and all the money that's going to have to be spent to save that beach And did they separate that out and say, maybe we could have temporary fees at the Goleta Beach because it might need help?

Or did they just talk over that? I don't know.

UnidentifiedUnidentified speaker 16Proposed1:46:25 · ≈ 10:46 AM

Supervisor Gray, members of the board. No it was not separated out we did look at the reduction of the potential for loss of parking stones there as a result of proposed improvements to Goleta Beach but it was looked at all of the parking was looked at together as one unit.

UnidentifiedUnidentified speaker 6Proposed1:46:44 · ≈ 10:46 AM

So that so the possibility that the funds could be raised to record to fix Goleta Beach, there was no discussion as to whether or not that could come from the people that use the beach in the parking fees.

UnidentifiedUnidentified speaker 16Proposed1:46:58 · ≈ 10:46 AM

That's correct.

UnidentifiedUnidentified speaker 6Proposed1:46:59 · ≈ 10:46 AM

And then one other question, Supervisor Wolf indicated that $150,000 revenue from the restaurants and I wasn't sure if that was for the last month and if you could separate those out so that we could because I remember getting some numbers before where Beachside, that's the one at Goleta Beach basically was a pretty good size revenue generator And so can we separate those out and tell me over what period of time those figures are for?

Thank You Madam Chair well first of all I want to thank the Parks Commission for conducting the workshops it's always good to have a conversation with our public to see how they feel on various issues and certainly the public spoke loud and clear that this was unacceptable And it's obvious that the impact that beach fees would have, would be most a significant burden on the low income.

Above all in some of the surrounding neighborhoods like Lookout Park and Summerland and what have you. This has been a very difficult economy and I certainly understand why staff Have been looking at any and all options for revenue. Obviously, this one is one that is counter to the values here that we have had in Santa Barbara County. But I'm trying really, really hard to identify alternative revenues that are appropriate not like this one.

And my voting record is very clear on really pushing hard On other revenue so that we never have to revisit these types of proposals again. But something has to give and I'm trying my hardest to look at all the other revenues, so that we never have to have these types of discussions on important issues like beach fees. But I certainly understand why staff has brought us any and all ideas but certainly this one is one that's not in keeping with what we strive for here in Santa Barbara County.

CommentHalama BeachProposed · by introduction1:49:47 · ≈ 10:49 AM

Thank you. Supervisor Lavagnino, did you want to make any comments at this time?

ElectedSteve LavagninoSupervisorProposedvoiceprint 0.811:49:51 · ≈ 10:49 AM

I guess I might as well. You know, calling it disgraceful is a little bit over the top. I think it's our responsibility to investigate thoroughly every chance, every choice that we have to increase revenue right now. What I think is disgraceful is the position that our parks department finds itself in right now for everybody out there that's holding a sign, I hope you're here next year when we get to the budget process and we're cutting this parks department down to the bone last year. I hope you were here when Not the cherry on top. We were cutting guys who were out mowing the lawns at Kachuma. We were out cutting the guy that fixes the boat at Kachuma Lake. We are out cutting people that went out and worked on the restrooms to make sure they were still working so when you went to the beach, you had an enjoyable experience.

We keep talking about the quality of life in Santa Barbara County and I totally agree with that. The last thing I want to do would be put in beach parking fees. But at the same time, when you go to the beach, you want a nice enjoyable Santa Barbara experience. You want to go to the restroom and make sure that it flushes. When it breaks, you want to make sure that somebody was there to replace it.

So I heard some very compelling stories in emails. A lot of them really touched my heart. It's a bad economy and I totally understand that. I think it's interesting that the only place we charge right now is at Halauma Beach in the North County. Once we get through this process, if we're all in agreement that beach parking fees are so evil and we need to get rid of them and we don't want to approve them in the South County, I'm all for making a motion that we get rid of them at Halauma Beach.

I also find it disturbing that when business owners come forward and I think we've heard this over the last few months, we had a gentleman here water for less. Mr. Carranza is still in the back of my mind. He was upset with the county because Our weights and measures department to come out and look at his machine, and it charged him about $125. And when he said that that was a lot of money, and it was imposition on his small business in a tough economy, the board was pretty much like sorry, that's the fee structure. It's too bad we're doing full cost recovery so you're going to have to eat it.

When business owners came to us and said they had a problem with the scanner, that was going to be an imposition on them. It was going to be too much money. We said you know what? Full cost recovery, we're sorry. Fees, I'm the last person who wants to see fees and taxes increased but we have to have some sort of consistency up here. You want to put a convenience store in Goleta, you pay $600,000 in fees for traffic mitigation The reason I'm going to oppose this measure and I'm not voting for it is because I don't like the business model.

Personally, I don't understand how it costs us $800,000 to collect a million six. I offered that I would do it for 700,000 but nobody seemed to be wanting to be a taker. So I don' think the business model is what I would like to see. I went and checked with the Santa Barbara City Harbor, and they actually collect almost $2.2 million in revenue and spend a little over $900,000, a much better ratio.

So you know, I understand your passion. I agree with you. Up in North County, one of the things I'm trying to do with the bad economy right now is we just opened a bunch of...we're working with Santa Maria Valley Open Space. We're trying to open new trails there so people can go out. I was a single dad at one time. Had two kids. I was looking for low cost, NIP-free costs, no cost places take my kids.

And so I understand going to the beach is one of those last places you can go that's free. And so we're trying to get those places up in North County where you can go out and recreate with your kids, and it doesn't cost anything. I get that. But I hope you are just as passionate next year when the budget comes around that you're all here fighting for our parks and trying to find a way. And I think it does have to do with increased revenue probably in our Parks Department putting more cabins at Kachuma Lake, putting more yurts at Kachuma Lake.

I love our restaurants that we have out on the beaches and trying to find out different ways to increase that. And I would've loved to receive support when somebody here that's not a big tax increaser asked for support up on the board to increase the TOT so that people coming from out of, for when we travel to their areas, we pay a higher rate than when they traveled to Santa Barbara so some of that money could flow back to our parks department.

So I have heard you loud and clear. I got all the emails. I appreciate where you're coming from. I'm opposing it for a different reason, but I'm glad to see you're connected and I just hope you stay connected. Thank

wanted to answer one of the Issues that Supervisor Gray brought up about Goleta Beach. And I'm looking right now at our May 15, 2012 agenda item where we talked about the environmental report for Goleta Beach And in there, there is a statement that the cost for this, the construction of the project would be approximately $3 million. And I just want to remind you that we have already received 1.5 million in a CIAP grant and I know that staff is continuing to look for money for the rest of that project.

In some ways, as I said in my opening comments, I don't think that we should combine these two issues. There have been other projects that we've done in other areas in the county and we have not just focused on a particular project and so that the people that use a particular area are the ones that are going to pay for it. This is a county-wide proposal. That's what was brought to us And that was what was discussed at the Parks Commission and, um.

And the parks commission seemed to have listened and got it and Supervisor Lavagnino. I'm glad that you understand my passion. I, since I've lived here for over 30 years or even more than that going being a UCSB student and having the opportunity to go to the beaches without having to pay and raising my kids in this community and not having to pay. And going to events at the beaches and not having to pay for parking. I think that's what makes It makes our county incredibly special. I don't have a dog, but I know so many people who go down to Henry's Beach. It's their opportunity to go and walk their dogs. I'm glad to hear that you're doing what you're doing as far as hiking trails. I think whenever we can provide recreation for our community at no cost, that's what this is all about.

And I do want to say that, um well, I think I'm going to stop there. Thank you. Supervisor Grant.

UnidentifiedUnidentified speaker 6Proposed1:57:56 · ≈ 10:57 AM

Thank you. I'd like to address passion for just a moment because I know Supervisor Wolf is passionate and about what's going on. But I'd like to point out to you and you'll go Oh, you're right that the constituents from Lompoc have to pay to go to their beaches. They pay to go to Hallama they pay to go to the state beaches because they're the closest ones. And that doesn't make it right, wrong or indifferent but let's just try and try and balance this and I think I'm getting off the subject because the issue here is do we charge Parking fees at the beaches. And unfortunately, I don't see a way that we can do this because of the low income folks that will be hit at Ocean and Guadalupe Surf is there but it's never any good and it's always being patrolled.

So I know we have a problem and I just think that passion goes north as well as south, and I hear you but it's one of those issues that we're going to be discussing and talking about and thinking about.

UnidentifiedUnidentified speaker 3Proposed1:59:08 · ≈ 10:59 AM

And I would just like to respond when we, as I mentioned in my opening statement this issue has come before the board before and Halama Beach was brought up the reason And I don't necessarily agree with this, but the reason Halama Beach and I think Kachuma were brought up was because those were always considered camping beaches. And so it was different than our beaches, the other beaches that you mentioned in North County and the ones down here.

I would not be opposed to opening it up and not charging a fee for people who want to go to Halama Beach for day use. Definitely in keeping with a policy that we have, I think though that the people who go there to camp it's a different segment. So I would be in favor of looking at that.

CommentHalama BeachProposed · by introduction2:00:03 · ≈ 11:00 AM

Thank you, Supervisor Wolf. Just before we turn to the public, I just wanted to say that when I first got involved with county government sitting where you are as a community activist and then I was on the County Planning Commission and I know how difficult it is to get people educated and involved in issues like this. And so when I see This volume, this enormous volume of public comment both in the form of emails and in the tremendous response of testimony at these three different parks commission hearings throughout the county. And to hear the public speak so loudly and with one voice from both north to south that's something that I as elected official really take to heart and pay very close attention to.

So with that, we're going to turn to the public. I think we have about 20 public speakers. You can have up to three minutes if you can say it more quickly than that, we would appreciate it. You've certainly heard the sentiments of the board on this issue and I do want to remind you that the board has noticed today not to take action on adopting any fees. But just to receive and file the report, and to provide direction to staff. So if you could remember that in your comments as well. All right, Mr. Allen?

Hello everybody from Santa Maria. I'm Joe Armandariz representing Santa Barbara County Taxpayers Association Well, I mean, I kind of feel frankly that my comments at this point are a little irrelevant in light of the fact that it's very clear what decision is going to be made with respect to this issue. I was going to say that the process, as Supervisor Carbajal pointed out, has been quite thorough in terms of going out and inviting public comment through the Park Commission process. And it's been overwhelming and unanimous that the people don't want to pay parking fees.

I would remind the staff of the county that the beaches belong to the people. Indeed even in the Coastal Act it's very clear That the coastal resources belong to the people of California. They don't belong to these huge corporations called the state and the county. They belong to the people, and they should be accessed by the people in our view free of charge. The Taxpayers Association would oppose any fees for parking with respect to those assets. Now let me just say one more thing with respect Supervisor Lavinino's comments. I would invite a new dialogue between the 5th District Supervisors Office and the Taxpayers Association on the issue of the TOT going forward because I think Supervisor Lavinino is making a very important point, and that is these issues are not going to be resolved today by a 5-0 vote on parking fees.

We're indeed going to continue to have to find ways to raise revenue for the county The TOT I believe is one option. However, we just have a little bit of a difference of opinion in terms of how we might be able to spend those revenues in order that they would generate larger revenue. So I don't think that we're very far apart on that issue Steve. I think we just want to make sure that we have a more tactical approach to how we reinvest those TOTs in the future and then finally it wouldn't be a Joe Armendariz speech if I didn't point out the other obvious elephant in the room and that is our onshore oil gas resources in Santa Barbara County You know, you don't have to look further than North Dakota to see what's happening when governments are taking advantage of the shale gas revolution.

We could be doing that in Santa Barbara County and that would not only raise revenue, that would put a lot of people to work particularly up here in the north county which is no small matter. Thank you.

Hello. I'm representing so many people, families that aren't able to be here today. And saying that the ocean and nature is my religion it's my spirituality my connection with The infinite. A huge part of raising my family is to bring my children to the beach a lot. We spend a lot of time there connecting, touching the ocean as touching the infinite. To me I'm 100% serious. I never go to the beaches with fees. Never! Always the free ones.

Lookout Park in particular would impact me and my family It's just not right. And so I just wanted to let you all know that I'm representing so many people and that it's a religious thing for me, and they didn't bring that up in some of the public impact. It's actually a spiritual and religious thing, and it's very serious for us. So I am supporting you guys in your vote, and thank you very much.

CommentBruce RaffProposedself-stated2:06:18 · ≈ 11:06 AM

Hi, I'm Bruce Raff. Steve, I like your suggestion about getting rid of beach fees at Halama as well as Janet Wolfe's. I think that's a move in the right direction. I go to several different beaches here in Santa Barbara County and Ventura County and I tend to avoid any of the beaches that have fees. I avoid Halama Beach Unfortunately, because of the fees. At one time, Halama Beach you could park along the road and then they started putting up no parking signs so it had zero effect on the county whatsoever that surfers would go out there and park along the road but someone saw that it'd be a good way to raise in revenue by ticketing everybody the park there And so that's what started happening last year. The state parks got into a little bit of a fiscal revenue problem, so they had Caltrans go to El Capitan and Refugio beaches and put up no parking signs all along the frontage road there where people used to park and walk in So the fact that people would park outside of these areas and walk in is a pretty good indication of their willingness not to pay a fee.

They are willing to walk half a mile to get to the beach. I think that the enforcement of it would be an issue. I think that some people would not pay, and so as a result they would be ticketed. And then they might not even pay their ticket, and as a result now they're in some type of a legal problem. I think it's opening up a whole can of worms that doesn't need to be opened up. And, uh, I think that the fact that we have beaches we can go to now without a fee is very much in our favor and I think that they're low income people Would not go to the beach as a result of the fees. And those are the people that probably need to be able to go to someplace that doesn't cost in the first place.

So I'm adamantly opposed to it, and I am very much in favor of lifting these that are existing at the county beaches that we have.

Morning Board of Supervisors and Chairwoman Farr. I am what you call a car guy And one aspect of being a car guy is I notice cars. So, I've been going to Henry's Beach for around 20 years and I just kind of noticed what cars were there and I'm gonna give you some percentages which are really rough but I'll just put them out anyway. There was about 10% of the cars that I would call high-end cars.

Mercedes Benz, Jaguars, BMWs Then about 50% of the cars. Our cars like what I drive, which would be a Honda or Ford or Chevy something like that and about 40% of the cars. Are kind of beat up cars? Meaning that the people don't have a whole lot of money to be fixing their cars to where maybe I do. The 10% of The 10% of the cars and the 50% of the cars. Owners will be affected very much by the parking fees because they can afford to pay the fees.

The the group that I want to be the voice for this morning is 40% the drive, the beat up cars. And I have seen in Henry's the last 20 years that I've been going there. These are the people who will be negatively affected by instituting a parking fee. The 10% of Having a parking fee initiated wouldn't affect their lives one bit. The 50%, yeah, they might get a little upset that they have to pay a fee but it's not going to dramatically affect their lives.

The 40% they're just scraping by and to be imposing more fees on them might make them go you know what we can't go to the beach anymore. Our one place that we can go and bring our kids or our dog or whatever, it's free? We're not going to be able to do that either. So thank you for listening to me and especially Ms. Wolfe. Thank you.

Good afternoon, or morning still. My name is Heather Tiddens, thank you for hearing us today and I just want to say that I am adamantly opposed to beach parking fees for all the reasons that have been stated by a lot of people over the last couple months. It's my understanding that any of these fees would go directly into the general fund and I'm not sure how that's going to keep the toilet flushing at Rincon.

I don't think a lot of us go to the beach to admire the bathrooms or to make sure that, you know, we have a nice white line on our parking space. We go for the sand and the ocean and the sunsets. And so I think that this type of a proposal will create a fundamental shift in the basic flavor of our community. And I mean imagine saying to your family no We can't go to the beach today because we've already gone over our budget this month.

And that we would actually have to pause and consider whether it was worth it to go to the beach, because we'd be paying for parking and for a lot of people that's $2 to $8 a day to go to the beach. It's just not possible. So I'd like to just put that out there that it's really a fundamental shift in the flavor of who we are as a community Make sure that we're all in agreement that we're opposed to this proposal. We don't have to do this again for beaches. Thanks.

All right, thanks. Fourth time I got my name right this time and that's great so thank you. My name is Tony DeGroote. I was born in Summerland and I now have a home in Goleta and I have two children one who's back there and another four-year-old who's at school today. I've grown up on these beaches. I was here when Rincon was nothing but a dirt spot to go parking for free.

Now it has a parking lot. It's still free but that's in jeopardy? I don't think so after A lot of you are returning my emails, which I've been adamant about. I just wanted to mention in the Pledge of Allegiance that you say every morning for liberty and justice for all. And what can be more important for a beachgoer than the liberty to go to the beach without making a budgetary analysis if it's possible?

I pay property taxes, sales tax, DMV tax, etc., etc. I kind of feel like I've paid a lot already. I think I've paid enough. We're not customers to the county, we are its citizens. It's voting citizens and this is the most important thing that I could vote on because I'm an Adam Beachgoer and I go far too often to the beach. These last few beaches that remain without parking meters are our last simple freedom.

They're a freedom that our servicemen have been putting their lives on It's not a liberty that you can go about and just change arbitrarily. I think it's something that's deeply in the fabric of this community. This proposal is not very profitable, the end profit is going to be a very small amount. It's not practical, it's a pain to all those who go to the beach.

It's not popular no matter...and nobody likes this idea Even amongst your people that work for you at all levels. The lowest level, your parks department people that work in the parks, all the way up to the highest levels that I've talked to personally are against this. So we're all against this. That's a fact. I'm also a businessman and I understand budgets.

You know, I've talked to Salud personally. I know that he's made some work and some effort in working on the TOT tax, working on some other gas oil tax. And I would say that You know, as a beach goer we didn't pay too much attention in the past to these things because you know we're working. We have our families and things were fine but this has touched us personally, those who've gone on the beach so we're now aware. We're now involved. We've read the articles. We watched the budgets. We've seen the battles that have been going on and we're now aware I think we will be aware of these things coming in the future and down the road. We've been developing websites, we're on Facebook, we're pretty united. We can get to a lot of people quickly and there's some things that should be looked at again.

Definitely the TOTX which is just a small thing.

The only thing I can add to any of this is consider adding an agenda item to get rid of all parking fees, all camping fees. The beach is our right. It's why we live here. The reservation system takes care of all the crowding problems we have at the beach.

We should not have to pay any fees to be at our beach. Those parking areas, those campsites that's a right-of-way it's inherent for hundreds of years it's our right away to the beach. We don't need white lines and restrooms and all that we can take care of ourselves. And as far as the budget goes It's time to get responsible about that. To work with what you've got, to work with the tax dollars you have. That's what we have to do.

We're citizens. We live here. I don't get a budget increase just because money is tight. I have to work with what I have and we expect you guys to do that too. So thanks for your decision today it's the correct one and think about working with what you've got instead of looking for new sources of revenue. We're all tired of it. We really are. Thanks.

Hi good morning my name is Patricia Escalera. And well, I'm just going to reiterate and one of the gentlemen said earlier is. I'm one of the 10% that owns a Mercedes and frequent Henry's Beach. However, the impact of parking fees would be hard for me because of an accident that I was in four years ago and like I don't have as much money anymore so but I still have my car and it would be difficult for I do go to Henry's Beach on a daily basis. It's because I can take my dogs there, let them run loose and not have to worry too much about falling and things like that because I can't walk as well as I used to.

And I also want to say that we all spoke and commented against the parking fees at the Coastal Commission meeting. And hopefully you all saw in the taped recording I just wanted to make a quick note of that session because there were a lot of constructive, well-educated suggestions made for alternatives to raise funds rather than charging for parking. CommentHenry's BeachProposed · by introduction2:22:32 · ≈ 11:22 AM

Madam Chair and the Board, good morning. I want to speak about something I feel very passionate about And I believe you all do too, as I've heard. America was founded on the very tenets of the deep belief that our citizens here have a right to life, liberty and the pursuit of happiness. So it's really a violation of our rights and our trust in government if you pass a beach parking fee that we have to pay to get to our beach.

So let's all vote against that, because it's not a good idea. Now I realize the revenue is down because it's a hard economy and we're all feeling the pinch. So why don't we look at the places where the money actually is today? Now if you look at the Santa Barbara News Press, it mentions that the Parks Department hid $20 million of our money And so I would think that would be the first place you might want to look at to fund bathroom repairs or street pavings in the beach parking lot.

CommentHalama BeachProposed · by introduction2:23:46 · ≈ 11:23 AM

Actually, that was the state parks not county parks.

CommentHenry's BeachProposed · by introduction2:23:50 · ≈ 11:23 AM

Well it's still $20 million so we could request some of that money from them. So yeah and I agree with you It is disgraceful that we have hidden money. We should be looking at all of these sources of money first before we ask the burden of our citizens here because it is a burden and if you go to any of the places that charge an entrance fee, for example I went down to Oxnard Beach And it was a beautiful day. There were families out at the beach, everyone enjoying a good time. There were two cars that had paid for parking. Everyone else had parked somewhere far away and they walked to the beach to avoid paying the tax which I call a taxi. You might call it a fee because it's easier to devote that in.

And we have our own Goleta Beach as you mentioned and that's our hidden gem Let's keep our gems in our county and let's keep the beaches free for everyone so that we can all enjoy our life, liberty and the pursuit of happiness.

He'd love to speak but I'll speak for him, he can't talk yet. Madam Chair and members of the boards thank you for this opportunity and I've really enjoyed the discussion so far this morning it's been fascinating. I'm a stay-at-home mom of two little kids and we struggle every month to make ends meet. I don't necessarily consider myself a low income family yet it's very hard Close our budget at the end of every month and make sure that we don't end up in the red. Beach is what we love, is where we love to go to spend a lot of time. We like to raise our kids there and we would be one of the unnamed casualties of this proposal when you're saying that up to 40% reduction in cars going to the beach. For example for Goleta Beach, we would be one of those people that will not be able to go back to the beach.

And as far as addressing the beach experience that was discussed a little bit earlier on this morning, I'd like to say that I grew up by the beach and I spent a lot of time by the beach as a kid. All we had was a dirt parking lot and to this day it's still a dirt parking lot with no facilities whatsoever. What do we remember from that time is the time we spent on the beach not the time that we spent in the parking lot. It's all the activities, the time we spend with our families, our friends That's what is valuable to the community.

So I really appreciate your support for not voting in favor of that proposal, and I do like the idea of reconsidering the parking fees at Halama. I haven't been to Halama, I think I've been once in the last ten years, I believe. One of the reasons is obviously it's a little bit further than a lot of the other local beaches but the fee is pretty much prohibitive for my family to go there and spend two hours. Thank you.

Madam Chair, members of the board. I'm Andy Caldwell representing COLAB. You know, Supervisor Wolf used the word disgraceful. What I think is disgraceful is having discussions like this out of context. I think it's disgraceful that the Parks Department when they were having these hearings didn't speak about the fact that you had to raid CREF funds to rebuild their restrooms at Arroyo Borough Beach And or that you're trying to pin some of the Goleta Beach retreat on the utilities, and making them pay for the managed retreat. The fact that we didn't fight the Coastal Commission on the boulders at Goleta Beach but were actually going to spend millions to watch half of the beach wash away. I think that context needs to be driven home.

The context of letting prisoners out of jail early because we can't afford more prison guards. The fact that we almost closed a fire station in Goleta, the things that Supervisor Lavinino brought up as far as this parks department being woefully underfunded right now and more cuts being on the way. Having said that, we never ever suggested that you jack up fees countywide. We did talk about temporary fees at Goleta Beach to pay for what we consider an ill-conceived Goleta Beach 2.0, temporary fees. We did ask to consider fees at Arroyo Burro Beach because it's in the city of Santa Barbara and the city of Santa Barbara charges fees.

Now the elephant in the room is you're the only entity that doesn't charge fees. You know me I've been here for 21 years fighting fees and taxes But I understand that you're a billion dollars short on your pension fund. I understand that you're scrapping to provide basic public safety, we've had murders at beaches and yet we're cutting cops. We're not keeping people in jail and the state isn't keeping people in prison.

We are in a crisis here. And that crisis is lost when we do keyhole budgeting. When we just say, well, who wants to pay fees at beaches? Nobody does. We've got 7 kids. We don't want to pay a fee for parking, but I can tell you in the North County of Santa Barbara and even in San Luis there are no And so the reality of this fiscal reality is the state is going to be closing beaches that they even charge for parking at.

We're in a crisis and it is dishonest to not tell the people what is really going on. It's easy to appear to be a hero in October, and be a skunk in July or June when the budget hearings come out. People need honesty. You know me and CoLab we are against fees But we are in the middle of a crisis and you're not being honest and forthright with the condition, the fiscal condition of Santa Barbara County. Thank

My name is Brian Zabelsky, I wrote a letter to the board August 16th read it at the Parks Commission meeting that day strongly opposing the beach fees and listed some of the reasons for my opposition I won't. I've submitted that to the record, so I won't reread it.

I read an article in a local newspaper on the 23rd of August that says the beach fee is dead in the water. I was very optimistic that decision could be made but I figured I'd come here and just verify and support the opposition But I decided to take a little different tact on this letter and just recall from the Parks Commission meeting, some of the passion of the people that spoke against the fees for some of the reasons they did.

And I'll recall some of their voices here. I was really impressed by the UCSB graduate, a mother with two young children tugging at her dress and that they were a young family and she's a stay-at-home mom to give her children a loving upbringing. And they lived in an apartment with no yard and that the beach was their backyard and she brings her children there every day to play. Money is tight, the beach is free.

I'm sure if you will forget was a lady on Social Security who lives in the most run down trailer park, you'll ever see in Galita. She rides her bike to the beach so she wasn't asking herself for free ride. But her disabled daughter lives there who needs to exercise for, to improve her disability. She goes to the beach every day in her beat up car and a fee would make that prohibitive.

The next speaker I think who caught everybody by surprise when he walked in that day was wearing a t-shirt, surf trunks and flip flops. He introduced himself as the recently discharged veteran of the military. He had a simple question. What would be the character of a person who would decide to charge a fee for something that should be free? That sort of got to me and I've been thinking about it for awhile. And I think the point he isolated is and what he is saying is that freedom of this country is a birthright One that needs to be protected. If you take the R out of free, you know what you end up with? A fee.

Today is a day like no other for another young family in Santa Barbara where a child was born this morning. The odds are the child was not born into a family well at this moment, the child has a birthright, a free access by car to local beaches and kids love the beach Thank you, sir. Thank you, sir, your time is up. Sir? Your time is up.

No, everybody's everybody has been really open and had so much great stuff to say. I just wanted to say that you know from this process we actually have seen a really tight knit beach community come together. I mean from all the hearings all the times that I've stood up here before really attended most of the Planning Commission hearings it was incredible. I wish everybody was here. I mean this place would have been full with people scenes with signs So this is the kind of process that makes me proud to be a Santa Barbara homeowner and resident. And as some other speakers have said, Wolf said it best that the public beach access is a foundation that makes Santa Barbara unique and special. We are not Los Angeles, we're not Southern California, and it's obvious these beach fees would be counter to the Santa Barbara values that we have.

I know you guys have heard loud and clear from your constituents holding up signs, Thank you. I'd like to

some of the testimony with an observation that I've made throughout this process. And I want to recognize our park staff for all of their efforts in putting together what has been a substantial amount of information, developing options for the commission, our public and yourselves to consider. I also want to thank them for their complete desire for transparency, for public input and participation even when many times that participation resulted in personal attacks upon their own integrity. And I don't know how many of you attended some The events that were put on. But in fact, there were public attacks on their own personal integrity and they did not take offense at that. They continued to maintain their composure. They continued to be professionals And I certainly want to recognize that.

And I also want to share with your board and with our residents what I am certain will be the continued and dedicated efforts of all of your park staff, all of your community service development staff to provide the services that our communities want and need in the most effective and efficient way possible. And I just felt that it was important to conclude our testimony today with that information to you.

CommentHalama BeachProposed · by introduction2:39:26 · ≈ 11:39 AM

Thank you, CEO Waller. And we certainly all appreciate the work of your department, Herman and all of the parks commissioners as well going through all those meetings. So we'll bring it back to the board for some final comments. Supervisor Wolf?

UnidentifiedUnidentified speaker 3Proposed2:39:43 · ≈ 11:39 AM

Thank you Madam Chair. I appreciate the public who is here today and for making sure that the Board of Supervisors heard you. And I believe that we did. I just want to make a couple of comments because Goleta Beach came up Make the statement that with Goleta Beach 2.0, the notion that Goleta Beach will wash away is not going to happen at least from the experts that we have. We have an environmental process that's going on right now.

The notion of the county being in desperate financial straits, and you know that is something that this board has been dealing with in a responsible manner. I think as a board When you implement something like this that has such an impact on the community That it is. It's like one of those things you take that step forward and you will never pull it back. And so to make that step, we have to reach a very high bar and I don't believe that we have met Revenue generating sources like I would assume that we're going to bring some of these back for the board's full consideration.

I also think it's important for people to know, we had some speakers from Goleta. They may or may not be in the CSA3 area but Aside from just paying their property taxes, they also pay into CSA 3. $600,000 of what our citizens pay goes to the Parks Department to maintain open space. So our community is not only paying our property taxes but we're paying an extra fee to the parks department so it just adds insult to injury to ask constituents to pay To go to the beach.

Um, I appreciate CEO Waller's comments about our park staff. I think they are doing an incredible job at eight o'clock in the morning when Tucker's Grove Park opens there. There is a Working there, I saw him yesterday with a new lawnmower. I saw him today raking the leaves. The park looks great. Our parks folks have been working really hard at Goleta Beach to make it look beautiful, and it is a beautiful park. And we will keep it a beautiful park. And the same with Henry's Beach. And I also think that the folks who run the restaurants are doing an incredible job. It's one of those things. We have the boathouse on the beach side.

You know, it's one of those places that our residents go and our tourists go. To me, there are little landmarks in our community and they're on county beaches. And by the way a Royal Borough Beach is not Is not a city beach, it's county owned property. There is a part of Henry's Beach that is the city beach but not all of it by any means. So I think that and I hope that, I have one more thing to say and that is revenue generating issues. And I talked about the restaurants but we can't forget some of the innovative things that Parks Department has done. Which is bringing the doggy wash to Henry's Beach and also a new concessionaire, the kayak concessionaire at Goleta Beach.

So it's not like everyone is just sitting on their laurels. I think that they're looking for other revenue generating sources. We understand that, we know what's important but we also know what our community expects and wants from this, from our county. Thank you Madam Chair.

CommentHalama BeachProposed · by introduction2:44:07 · ≈ 11:44 AM

Thank you Supervisor Wolff. Are there comments from the board at this time?

UnidentifiedUnidentified speaker 3Proposed2:44:12 · ≈ 11:44 AM

I'll go ahead and make a motion if there's

CommentHalama BeachProposed · by introduction2:44:13 · ≈ 11:44 AM

no comments. Actually, you know, I just want to make one comment. I think that the issue of revenue generation for the county is very serious. And to those of you, somebody said we just need to work within what we have. Well, we always do that and to do that, we've had to cut and cut and cut. Unless you are here during budget, you don't realize that we always do need to and do prioritize public safety.

Sheriff and Fire and District Attorney. And so the other county departments, like Parks, like Planning and Development, like General Services, and other county departments have taken a disproportionate hit during this last time. And I think for most of the work of those departments, the public doesn't notice it. When we get to an issue like this, obviously this is something that really resonates with the public.

I think that for me, it's not just the need to raise revenue but who and how we're going to raise that revenue. And I think it's interesting that the board gave this direction to go out and explore this issue in May of 2011. And since then, a number of things have happened including the fact that the board considered an oil severance tax which I supported but there was not enough support on the board to take that to the public to decide.

We also discussed a raise in the TOT tax, which I supported but there was not enough support on the board to put that on the ballot as well. Because I think that if we're going to raise revenue, the first place we should be raising it first is on oil companies and then on out of town tourists. And so I think that for me, beach parking fees are a last choice and not a first choice. And if the public had been given those options first and that had not been enough or not been successful then I think that I would have been more interested in looking at this issue. So and also I have to say representing now Guadalupe Beach, I certainly appreciated Supervisor Gray's comments on their you know they haven't had a beach. They didn't have a road to the beach and to finally get the road open to the beach there for a community that is very low income and then to say well now guess what we're going to charge you to use the road to get to the beach it's just too difficult for me So with that, what we have is a receive and file of the updates of the meetings and also to provide staff direction.

And I'm assuming Supervisor Wolf then that your direction to staff is going to be that we discontinue considering beach fees at this time.

UnidentifiedUnidentified speaker 3Proposed2:46:55 · ≈ 11:46 AM

That is exactly my motion. So moved.
