we'll move on to item number six, new business consideration of a resolution appointing nominees to the offices of council member for District 1 short term, District 3 and District 4 And canceling the November 23rd, 2026 general municipal election pursuant to California Elections Code Section 10229 due to not having more candidates than offices to be elected.

Ana?

UnidentifiedCity ClerkProposed · by role5:07

Hello, Mayor and Council. As you may recall earlier this year around May we adopted a resolution calling the election for November and today we're actually here to cancel the election So I'm just gonna provide you with a little bit of the background on why we are here today. The City of Fillmore scheduled, like I said, the general municipal election for November 3rd, 2026 to elect council member for District 1 who was the short-term, District 3 which was a full term and District 4 which was also a full term.

The nomination period ran from July 13th to August 7th of this year of 2026 Only the eligible incumbents submitted nomination paperwork, no additional candidates or ballot measures qualified. If the number of candidates does not exceed the number of offices to be filled there is no measures for the ballot for the City Council which would mean we can adopt Appoint the nominated candidates to office or proceed with the scheduled election.

The appointment must occur no later than 75 days prior to the election, which that would be tomorrow, August 20th, 2026, which is the reason we are here today a day prior to that to make sure that we're choosing We have a list of districts- either to appoint or to continue with the election by tomorrow- this would be- our three districts that we had. A district one which is a short term who we currently have Mario Rodriguez and- per our resolution it would be appointing Mario Rodriguez- we would have district three a full term Which would be Kerry Brody.

Staff recommendation is to appoint. And so adopt the resolution to appoint the nominated candidates and cancel the election or option two is direct. To direct the election process as scheduled and continue with the election by tomorrow. The fiscal impact of canceling the election will result in cost saving for the city of the election, which is usually estimated from $20,000 to $30,000 an election.

We wouldn't know the exact saving because we do get the bill after. But it's an estimated of around that amount and then. The recommendation action today is to adopt resolution 264127 to adopt the nominated candidates and cancel the November 3rd, 2026 general municipal election for Uncontested offices and then this action will align with the City Council's core values. And then the next step, this next step is if appointed are made Candidates will be sworn in later on this year and then If no action was taken by August 20th which would be tomorrow the election will continue as scheduled Any questions?

UnidentifiedUnidentified speaker 2Proposed9:05

Yes, so I just would like to make sure that we clarify. So I had a constituent ask me, so what does it mean that we're cancelling the election? You know they sounded very... They were concerned in a very negative light because they took it as oh you're canceling the election so they're not going to have... so the city is not going to hold an election at all And I had to clarify, no.

What's happening is the election will go on because the state constitution and federal law requires us to have an election on November 3rd. It just we will as a city will not have any measures on the ballot if we go forward with this. So I just want to make sure we clarify that because If this person misunderstood and thought we were literally canceling the entire election, that is very different than what the action is we're taking now. Which is a cost saving measure to save the city money because if we choose not to put names, a single name for each of the different positions then we save money by not having those names present on the ballot.

But the election will still happen. There will still be state measures, there will still be things of it's still a federal and state election. It just we are canceling the city's portion of that election so I just want to clarify that because again as I said if one person misunderstood what the agenda said and this was not a person that you know was not educated they were they were educated they were paying attention then clearly you know we need to make sure we're very clear about What we're doing here, we are not canceling the overall election. We're just removing the city's portion from the ballot.

UnidentifiedCity ClerkProposed · by role10:52

That

UnidentifiedUnidentified speaker 2Proposed10:52

is correct if this City Council decides to go in that direction. So I just want to clarify that so not really a question to you Ana but just a point of clarification.

UnidentifiedUnidentified speaker 4Proposed11:04

Yeah, thank you very much. Thank you for your presentation Anna and John for that clarification And I just wanted to add to it that I believe May be wrong that in our region It is true that this that if we do adopt this measure there will be no Fillmore City Council election however in our area of Fillmore and Piru, I believe there are candidates for the For the school board yes The Fillmore Piru Veterans Memorial District I think has several candidates up for election. So, I just wanted to clarify that there will be still local candidates here impacting our community that will be on the ballot. Potentially county measures, I'm not quite sure and definitely state and federal. Okay thank you.

UnidentifiedCity ClerkProposed · by role11:56

Yeah. And just to clarify, yeah like you said we are going based off the California election code section 10229 which indicates specifically two individual boards right? So and councils where it states specifically You can adopt the nomination candidates if there is no one going against them, which is our case here today. Not everybody has the same case, which would mean that that is a reason why we still have the state general election going on the ballot.

UnidentifiedUnidentified speaker 1Proposed12:37

Thank you. Any more questions? No? Is there a motion on table?

UnidentifiedUnidentified speaker 4Proposed12:48

I'll make that motion. I would like to make a motion. Go ahead, I'll let Carrie do

UnidentifiedCity ClerkProposed · by roll call12:53

it. I'd like to make a motion to adopt resolution appointing the nominated candidates to the offices of Councilmember District 1 short term, Councilmember District 3, Councilmember District 4 and cancelling the November 3rd 2026 general municipal election.

UnidentifiedUnidentified speaker 1Proposed13:10

Okay we got a motion is there a second? I'll second. And a motion and a second all in favor? Aye. Any opposed? Motion passes unanimously. Thank you. Thank you, Council Member Brogy. Okay, so

moving on to item seven, City Council reports, recommendations and comments. Anybody have any reports or comments?

UnidentifiedUnidentified speaker 4Proposed13:34

I'll just make one comment. I'm going to speak more at our next regular council meeting that yesterday the Ventura County Board of Supervisors met and voted regarding the future of Santa Paula Hospital, and the vote was to Three years from now, the hospital remains open until the end of December 2029. But the Ventura County Healthcare Agency voted to no longer not to build or reconstruct Santa Paula Hospital once that closure up on the hill happens but to instead go with building or Medical office buildings and expanded access to care. So an urgent care, so Santa Paula Hospital including the emergency room department per the county's current plans as adopted yesterday will no longer be in service after starting in January 1st 2030. And I'll have I think more to say synthesize my thoughts a bit more on our next meeting.

Thank you.
