well we just want to say first of all thank you guys for letting us come out tonight. I've been in Moorpark High School in the district for the last 13 years. I'm a social science teacher over at Moorpark High but over the last eight years I've had a really cool opportunity to teach in the AVID program now AVID stands for Advancement Via Individual Determination. It's a nationwide program, we've been at Moorpark High School since the late 90s. This is I think our 27th-28th year and actually Mr. Roy Garcia who is a wrestling coach over at Moorpark High School he serves as our sophomore AVID teacher. He's a former AVID alumni so we help students get ready with their college readiness skills, their life skills.

I am fortunate enough to get to teach the seniors and I want to share a fact that last year we had Right about 34 kids in the program, and there were over 110 college acceptance letters that those kids got. So we help these students out with everything like we said from their collaboration skills to their college readiness skills, their life skills. I tell my students every day I love teaching. I love getting to mentor them.

They come into the school early get there at 730 as a zero period class and it's a pathway. These students take it 9th, 10th, 11th and 12th grade. So we're fortunate to be able to put on Sabor Latino every year. We used to do it as a talent show. This year we're doing it as a festival for the third annual Sabor Latino music and entertainment festival. We're going to have students dancing from the elementary schools here in Moorpark Unified. We got the Mariachi band coming out from the middle school. And we have the Moorpark High School dance program participating. There's gonna be food vendors. It's a great night, it's coming up not this Friday but the next on September 25th. It's 530 to 830 in the quad, $5 for students and children, $8 for adults and family of four we're doing a deal for $20.

All proceeds do go to scholarships, to field trips, we take these students to college visits and things like that so we just want to thank on behalf of Moorpark High School we want to say thank you to the board for honoring us and thank you everybody worked so hard for this beautiful city. I was going to end it like this, vamos Moorpark y gracias! Thank you guys.

I would just like to thank everybody for welcoming me to Moorpark. It has been amazing to be introduced and get to know everybody and feel the support from everyone. And I am, again, just very excited to begin building a lot of ties within the community businesses in reference to our public safety. So thank you.

UnidentifiedUnidentified speaker 5Proposed6:43

Just a few words real quick. We're very fortunate to have Sergeant Torres here in Moorpark. Katie and I worked together in the human trafficking team many, many years ago. She's a very talented investigator but she's also a wonderful deputy. We're very fortunate to have her. She's very skilled. I've no doubt she's going to continue to promote through the ranks so again, we're very fortunate to have her here at Moorpark. Thank you.

UnidentifiedUnidentified speaker 1Proposed7:35

Next is item five, public comment. Do we have any speakers?

UnidentifiedCity ClerkProposed · by role7:38

Yes Mr. Mayor I do have one speaker card for public comment this evening. That individual is Sarah McMullen and as this is public comment you will have three minutes to address the council.

UnidentifiedUnidentified speaker 6Proposed7:55

Good evening thank you for the time. I stand here tonight with a hope that my comments will be the precipice to a greater conversation That involves our city, our school district, teachers, public safety and parents. I first want to thank the city for sharing the cost of the MUSD School Resource Officer. This officer is a vital component to not only safety at our school campuses but as a way for our children have positive engagement with law enforcement. However, our School Resource Officer has four calls to every one of their fellow Moorpark patrol officers, meaning our children and schools are in need of law enforcement four times more often than our regular citizens.

School safety needs to be a paramount issue not just for our school district but our city as well. I have often said that part of the reason we live in Moorpark is I feel that we get a private school experience with a public school price tag. That being said, our family like many others are very fortunate to have the means and ability to move our children to a private school or other district if we wanted to.

This puts Moorpark in a precarious situation. If there were a major school safety incident in MUSD, I could see a major decline in enrollment having a ripple effect on district funding pulling down the educational value of our city, having a negative impact on our home values and moving more sales tax revenue from shopping to the cities where our children would be attending schools.

It is noteworthy that Fillmore Schools has two school resource officers with only six schools to our 10. So an increased officer is not unheard of. The district has expressed to me that our district is in line with other districts in terms of SRO coverage which my response is I don't want to be in line or at the minimum level of anything, especially school safety. In Moorpark we expect greatness.

My ask tonight is that our city engage in real conversations with our school district, teachers, public safety and parents about what can be done to add another school resource officer to our district so that we can protect our children to the greatest level that we can provide. Thank you.

UnidentifiedCity ClerkProposed · by role10:09

And that was the only card that I have for public comment this evening. Thank you.

Does anyone need to pull anything from consent? Seeing none.

Move on to item seven, announcements, future agenda items, reports and meetings, conferences attended by council members and mayor including library trips. Starting on, let's start on the right hand side with Mr. Barrett. My right, yes.

UnidentifiedUnidentified speaker 7Proposed10:40

On September 3rd, I attended the City of Moorpark employee briefing luncheon at the Peppertree Pavilion. It was great to see the staff and hear all the accolades and things that people have accomplished and some of the longevity of our staff is incredible and to see that recognized was wonderful. On September 3rd, I also attended the Clean Power Alliance board meeting.

On September 9th, I attended the Moorpark Chamber of Commerce board meeting and on September 16th, attended the Marketing Ad Hoc.

UnidentifiedUnidentified speaker 8Proposed11:28

My voice. On September 3rd, I spoke on a panel at the Koneho Simi Moorpark Real Estate Association Leadership Academy about what public service entails Also on the third along with Councilmember Barrett, I attended the employee briefing and luncheon On September 1st, I was in Brooklyn and checked out the library in Greenpoint. It is slightly smaller by about a thousand square feet of what our new library's going to be.

And walking through it made me extremely grateful at how much time we're spending with all the small details especially in the kids section because theirs was very lackluster and I felt very proud of what we're going to be doing with our kids section. On the 10th, I attended the Moorpark Young Professionals Group at California Bun. We meet the second Thursday of every month at different Moorpark restaurants. Also on the 10th, I attended the immigration stakeholders meeting where we learned about volunteer training for UndocuFund.

On the 14th, I had a Ventura County Animal Services Commission meeting. Proud to report that since the new mobile vet clinic started we have provided free spay and neuter services for almost 800 animals and have ramped up the trap, neuter, release cat program as well. On the 15th, I had a chance to speak with Changemakers which is a new great organization started by female leaders throughout Ventura County with the goal of uplifting women in the community. We spoke about public service as well as specifics about Moorpark and what we're doing to engage businesses and having both our businesses and residents stay here.

And today, I had a marketing ad hoc meeting along with Councilmember Barrett about a few projects that we have in the works so thank you. Thank

UnidentifiedUnidentified speaker 1Proposed13:06

you.

UnidentifiedUnidentified speaker 8Proposed13:06

Dr. Castro?

UnidentifiedUnidentified speaker 9Proposed13:07

Yeah, thank you Mr. Mayor. On September 11th attended the FoodShare new facility groundbreaking on the 14th attended the future of the region conference at VCOE and also on that same day participated in a TPW with the mayor. That's all I have, thank you.

UnidentifiedUnidentified speaker 10Proposed13:24

Nothing of note to report at this time

UnidentifiedUnidentified speaker 3Proposed13:25

really

UnidentifiedUnidentified speaker 10Proposed13:26

Well, if you're gonna ask thanks for doing that mayor on the 12th of September I had the pleasure of taking a tour of the University of Southern California Wallace Annenberg building and what they've done in order to bring research and Library science to life in that building as they have digital and AI engaged Interactive displays where one can interact with members of history or important people from history. Some of these are actual interviews, where they've answered thousands of questions. Other ones are coming from text. And the way that they're using technology to bring to life these research projects is something that I think we can do here in our library as we continue to look at programming. So I appreciate you giving me a second chance to answer that question.

UnidentifiedUnidentified speaker 1Proposed14:09

Thank you. So for myself, September, sort of Thursday, September 10th I attended a VCOG meeting and we discussed e-bikes and all the fun around those right now. What other cities are seeing, what kind of issues they're running into. Friday, September 11th I had a VCTC meeting. Monday, September 14th I also attended the TPW meeting with Dr. Castro And then yesterday, Tuesday September 15th I met with a group called Moorpark Moms for Progressive Values about flock cameras.

And now we've got a couple announcements here. Put on your blades or quads and join us for Skate Night on Friday September 18th from 6 to 8 p.m. Enjoy an evening of skating music and games plus fun activities for non-skaters. Mr. Mayor, before we get to that I'd like to announce I'll be recusing myself from this agenda item because the agenda item has an effect on my employer. Thank you.

UnidentifiedUnidentified speaker 11Proposed16:52

We're good? Well, good evening Mr. Mayor, council members, members of the public that are here this evening. Tonight's recommendation supports the conclusion of the city's competitive city attorney services process that has taken place over the last few months To provide a little bit of background on how we got here today, Richard Watson Gershon or otherwise known as RWG has served as the city attorney for the past 14 years. And Mr. Kevin Ennis who just left the room has been the city attorney for the past 14 years so done a remarkable job leading our city over the last 14 years with many of you and previous councils before you.

Earlier this year, Mr. Ennis announced that he was going to seek retirement and upon that notification We conferred with the City Council in the city manager at the direction of the City Council there was a direction to produce a competitive selection process what we refer to as an RFP To look at city services for a successor for mr. Ennis I That RFP was issued on April 1st, and we received proposals from six well-qualified firms who put in their submissions. And then the city conducted a rigorous interview process and selection process that included not only yourselves but the executive management team, the city manager, and the department heads.

That process was also further extended to staff to get input on the past 14 years and how we might be able to do things better in the future and provide better efficiencies. One of the key objectives throughout the process of this was understanding what that new proposed model might look like and what BBK would be able to provide. So in the packet this evening, staff's identified what some of the changes would be following an improvement to an agreement with BBK. And my apologies, I referenced BBK but I don't think I used their full name so the full name of the firm is Best Best & Krieger.

Some of the things that they would be doing is additional city council and planning commission attendance of which at this time right now a city attorney is not attending our planning commission meetings and staff identified that that would be something operative that we want moving forward Additionally, we don't currently have on-site hours. That would be something that we would have now that would not only be available to the city council, the city managers but also to the staff behind the scenes that are doing a lot of the work that comes before you and comes before the public for decision making.

Additionally, BBK would be participating in the day-to-day staff and agenda reviews for the items that come before your packet. And then working locally with the staff on any type of development agreements or larger issues that might come before you. BBK has proposed Ms. Isra Shah, who is I believe a city clerk is in the wings should we need her. She's been proposed to be the new city attorney for the city.

Ms. Shah is a partner in BBK's municipal law practice. She has experience in municipal law, open government and ethics, land use and public records acts just to name a few. Following the selection of BBK as a preferred firm, staff conducted negotiations on a proposed agreement. The agreement was reviewed not only by legal counsel but by the joint powers authority insurance organization that provides our risk management services.

The proposed agreement has a five-year initial term with automatic renewals should we not seek some type of amendment or agreement. Those agreements and amendments would always come before you for approval. In addition, we will conduct annual reviews of performance, service levels, retainer utilization and compensation. Regarding what the transition would look like, as I mentioned we've been 14 years with RWG and that's a very long time. And obviously there's a lot of pending matters that are taking place. Earlier this evening I spoke with Mr. Ennis about what that transition would look like. I've also spoken with Ms. Shaw about that transition and should you approve this item tonight?

We're looking to have a transitory transition period of probably 60 days to 60 days to 90 days, and a separate item would come before you at your first meeting in October. They would kind of seal out and codify what we would be doing with RWG, releasing them as our city attorneys and moving forward. Initially in speaking with Mr. Ennis, RWG is going to be sticking around for that transition period working with staff to make that transition smooth. I've already met again with Mr. Ennis this evening. He's already provided me and the City Manager an update on several of the cases I did want to cover the fiscal impact because there is that overlap.

The BBK retainer would be roughly $20,800 per month for up to 80 hours of legal services fees or approximately $249,000 annually. Staff is requesting a $100,000 general fund budget amendment to address the new agreement because currently in your budgeted for the next two years your budget only allocates $100,000 in the main general fund for legal attorney fees. So bringing an agreement before you that's $249,000 there's that discrepancy So we need to be able to not only account for that mid-year in the fiscal cycle, but also account for what we're already paying RWG. So there's that transition.

In closing with that staff is recommending that council take four actions tonight. Consider approving the BBK as the city's legal municipal service provider for effective October 1st Approve the City Attorney Services Agreement and authorize the city manager to make any final corrections. You know, Council Member Delgado did point out earlier that there was a small spelling change that needed to be made so we will go ahead and make that and there's some non-substantive adjustments to the draft agreement that's in your packet.

And then thirdly, appoint Isra Shah as the city attorney effective October 1st. And then fourth, adopt a resolution appropriating the allocation of the funding to cover the additional city services costs. That concludes my presentation for this evening. As I mentioned earlier, Ms. City Clerk has Ms. Shah available virtually if you should have any questions for myself or Ms. Shah regarding the agreement.

UnidentifiedUnidentified speaker 1Proposed24:23

UnidentifiedUnidentified speaker 1Proposed24:35

Okay. Thank you. We'll go into discussion. Yeah, it was a long process to go through this but Kevin's done a great job toward his tenure here at our city and wish him the best in retirement and as everything we like to go back out and always try to see what other places are out there, what other organizations are so take a fresh look at things and BB&K came up with a pretty good one so I'm looking forward to this.

UnidentifiedUnidentified speaker 8Proposed25:03

I think you did a great job with negotiations, and we got really good overall package of what we're going to receive. And based on what we had received in the past, so I'm really happy moving forward with what we got. Thank you. Anyone else have

Next is presentation action discussion item 10 B. Let's consider adoption of revised City Council policies regarding the teen council tickets and passes disclosure requirements remote participation for Commission and board appointments proclamations and certificates in small business recognition and rescission of resolution number 2026 4 3 7 9 mr. Roy's

UnidentifiedUnidentified speaker 11Proposed26:06

Mr. Mayor, staff brings this item before you to update City Council policies which were recently reviewed by the Administration Finance and Public Safety Committee on both July 1st and also the September 2nd meetings. There are five changes. All of that information has been provided in your packet. What I will do is I will go through each of the sections That have the changes and all references as well, and then I'd be happy to answer any questions at the end. The first section is really the teen council section which is Section 3.7 As we're all aware earlier this year Teen Council was moved from the Parks and Recreation Department to the CMO's office City Manager's Office And a lot of those changes were already, had taken place but we hadn't codified those in your City Council policies.

So we went in and made some updates to that policy to move that through the city manager's office and then really also to update the language in terms of what is the goal and the mission of the team council moving forward? And that's really to provide civic education, leadership development career orientation, share more about public service and then also more about community engagement. So that language has been provided in there and it also allows for the youth to provide more input on many of the items that sometimes come before city council. A great example of that earlier this year was the library artwork and the efforts that are going on at the library.

The second item is an update to the tickets and passes section, in Section 3.3. Sometimes there's a question on it's a little vague what does that really mean? Tickets or passes? And this is for any time someone were to show up at City Hall and provide tickets or passes for admissions to some type of event locally etc. There are certain requirements that the city clerk's office has to go through from the FPPC perspective in disclosing that language, and there were just some minor legislative changes that needed to be made. So there was a revision in the language that's been now made in your City Council policies that aligns with that new FPPC language and therefore also makes it easier should the legislator make changes later down the line we can easily adjust and make those changes.

The third item is earlier, maybe a couple months ago, council had asked staff to go back and look at remote participation for the selection of committee commissioners and boards should they not be able to make it to the interview process in person. Something that's been in place for a very long time. And that is in section... You'll find that in Section 2.2. So staff went back Administration Finance and Public Safety Committee with some recommended language. So that language has now been added in that section 2.2, and that basically allows for any type of legitimate extenuating circumstances such as illness, family emergencies, work or school obligations or significant travel disruptions they can reach out to the city clerk and set that process up so that they can still participate in those interviews should that be needed.

The fourth item in there that's been added is in section 2.13, and that would be regarding language around proclamation certificates and city memorabilia. Apologies. in looking at the Kind of the trend and how things have been done in the past in the city for proclamations and certificates There's nothing in City Council policies or procedures. They're really outlines like how do we give out a proclamation? How do we give out a certificate or how do we recognize whether it's businesses or individuals people in the community that do great things and And looking at that, it's always nice in City Council policies to have something in place that we can go back to and look to when members of the public ask and say how do we select individuals for recognition for certificate or proclamation.

That's exactly what this language does. It goes in there and basically provides a process for how that would work whether it be proclamations for larger events such as, you know, arts and cultural events or Breast Cancer Awareness Month or... As we've seen earlier versus like what it would look like for certificates. That process is essentially through anyone a member of the community, an individual council member, a business member can reach out to either one of you, to a member of staff And then the city manager in coordination with the mayor would review the request and then we would move forward from that point.

But it effectively puts something in your policies, it kind of explains to the public transparently like how we go through that process. And then lastly, the section that was recommended and added by our economic development manager and team is Section 3.8. And that is a new small business recognition program. As we all know, small businesses, businesses in general and Moorpark are really the heart and soul of the economic Hub of what we do here in the city of Moorpark and just being newer to the organization I've just seen over the years how much time and effort We spent in making sure that we honor and recognize those individuals that are doing that So our economic development team did a great job of putting some language together that will help support that.

That language and the process behind that is in your council policies. It's really looking to recognize and honor businesses that have one to nine employee, I'm sorry not one to nine but ten and under employees because one of the things we've looked at when they were putting this together Is it 80 to 85% of small businesses in America? That's the number of employees that they have. And that came directly from the Small Business Administration.

I know there's been some conversation as to, you know, could we adjust that number? That's absolutely within your discretion if you feel that that number should be adjusted. Staff can go ahead and make that adjustment. Businesses could again, as well as the certificates and proclamations, be nominated by an individual member of the public, council members, city staff And then that process would work through the city manager Particularly in coordination with the mayor. There's an email address that people can email specifically for that it's a little bit more conditions on the business one because we want to make sure that it's The same businesses don't get the recognition every year, but That that's been codified and shared in your packet as well So in closing, minor fiscal impact related to any of these changes.

Those have been shared I think the biggest costs are associated with the proclamations and certificates essentially which have been pretty much absorbed at this point So the recommendation this evening is for council, should you wish to approve or agree with all of these adopt the revised city council policies and rescind resolution number 2626-4379. Additionally council has options and I'm happy to ask any questions you might have.

Thank

UnidentifiedUnidentified speaker 1Proposed33:59

you. Are there any questions of staff?

UnidentifiedUnidentified speaker 8Proposed34:02

Go ahead. I see that there's criteria here for how a business qualifies for the recognition program But if there were to be multiple nominations, is there some type of since this is being determined by the city manager? Will there be some type of kind of transparent? List of what he goes through to decide who gets it

UnidentifiedUnidentified speaker 11Proposed34:27

Councilmember, that's an excellent question. It hasn't been spelled out in the process like where that recognition would be shared but I mean we could certainly create some type of a page or something that you know recognizes or shows who was honored or who was recognized and one thing that I can say is that the staff here do an excellent job of retaining records on all the different certificates and proclamations and who has been recognized and who hasn't If you would like it to be more transparent and public facing, I could work with our Public Information Officer.

UnidentifiedUnidentified speaker 8Proposed35:03

No, I just wanted to make sure that any businesses who are being nominated will feel like... You know, will just understand what the process was for someone else to have been chosen. That's all.

we have any speakers?

UnidentifiedCity ClerkProposed · by role35:25

No, Mr. Mayor I have no speaker cards on this item.

UnidentifiedUnidentified speaker 1Proposed35:27

OK. Moving to discussion. One thing that I noticed on this, the small business, it's not and hasn't really been a problem in the past really but it's good to have these things written out. But if it's for recognizing small businesses then I think the requirement should fit within what a small business is. So I think employ 10 or fewer people, that's a very, very, very small business.

I think the guidelines should be more so just falling within the guidelines of small business, which is obviously if you look at the definitions it's roughly like under 100 or 1 to 100 employees. But some industries it's even higher than that. So I wouldn't want to have a really good business that was 12 people and now they're cut out of this because they revolutionized something in town.

I think it's really more of just a guideline anyways. Also, I would like to try to highlight newer places that come into town. You know, newer businesses that are just getting up and bringing something new to the city. That way it kind of takes away some of the issues of why didn't I get picked? And why didn't this guy get picked in the past? So I think that can happen sometimes. What are your thoughts? Mr. Barrett.

UnidentifiedUnidentified speaker 7Proposed36:50

Yeah, I had similar concerns on on pinpointing a specific number. And I was thinking we could even do language such as qualify as locally owned or operated small business based on factors including ownership structure, number of employees, number of locations and overall scale of operations. Something like that gives the discretion within those confines without saying 12 and now it's a 13 issue right?

CommentKevin EnnisProposed · by introduction37:22

Right.

UnidentifiedUnidentified speaker 7Proposed37:23

I guess my

UnidentifiedUnidentified speaker 1Proposed37:23

other question was, didn't that fall within what we've been doing for ever anyways? Because those have all been small businesses that would fit within those guidelines so...I guess we wrote it down but procedurally it's not much of a difference

UnidentifiedUnidentified speaker 11Proposed37:40

I was going to, your point earlier Mayor I think was a good point in making a distinction between the new businesses that come in and the recognition. One we do work with the Chamber of Commerce closely so when new businesses are identified through the Chamber of Commerce for ribbon cutting we will provide a certificate And that's really independent of the small business recognition.

And we did that really on purpose. The idea was to make sure that we were continuing to recognize new businesses that come in and support them, but then how do we also recognize and honor businesses that have been around for a while? And they're never going to have that opportunity again possibly to get recognized. So we are keeping both. Did I get your point or did

UnidentifiedUnidentified speaker 7Proposed38:30

I well, I mean yeah a couple things. I see this as We do like the mayor's business appreciation lunch once a year and we recognize the largest Taxpayers and things you know and have that this is kind of the complement to that right recognizing the smaller businesses that also have a dramatic impact on on Moorpark and in our economy here But I think just taking out a number and having a generic statement of small business allows flexibility for that decision process by, you know, the mayor and city manager it sounds like is who's tasked with kind of choosing this.

Right? So I think if we just take out the limit that becomes a non-issue.

UnidentifiedUnidentified speaker 11Proposed39:27

And just to clarify, the limit related to the number. Employee number. Oh yeah and the employee number you just want to remove it completely? Yeah

UnidentifiedUnidentified speaker 2Proposed39:35

so if I understand the recommendation is in policy 3.8 there was subsection 1 which said excuse me subsection 2 employ 10 or fewer employees at the time of selection. You'd like to replace that with the language that Council Member Barrett I think articulated which provided a variety of factors Including being locally based. And you take into account a variety of factors. So we can incorporate that language if that's your direction.

UnidentifiedUnidentified speaker 12Proposed40:06

Yeah, I would agree so. Dr. Cashman what do you

UnidentifiedUnidentified speaker 1Proposed40:09

think? We're in the same meeting with that one and

UnidentifiedUnidentified speaker 9Proposed40:12

maybe talk about it

UnidentifiedUnidentified speaker 1Proposed40:12

too much.

UnidentifiedUnidentified speaker 9Proposed40:13

I was in favor of the idea of broadening the concept so that way you're going to be working in partnership with the city manager to make that determination anyway capturing the spirit of what a small business is. And then while I'm talking I wanted to thank staff for being responsive to the feedback in the committee And I just wanted to bring special attention to what I also appreciate about this structure is we have an informal process of recognizing people who generally passed but made a contribution to Moorpark. And I like the fact that there's something codified to be able to give their family or their relatives some sort of certificate of recognition for that as well, and that's something that we haven't had before.

0:40 – 0:4312 turns

UnidentifiedUnidentified speaker 10Proposed40:54

Any other feedback? I'm in agreement, especially on that 10 number. Because what is a 10? A full-time equivalent employee if I have two part timers? Is that one? If they work 12 hours do I add them? So I think having a little more broad definition and the SBA, I do know the 10 and under number. I also know the SBA advocacy says 500 employees in that under. Right. So small business. I think at mayor and city manager discretion we can dial it in so good job to the committee and the city staff.

UnidentifiedUnidentified speaker 1Proposed41:26

Well, would you like to make the motion as amended?

UnidentifiedUnidentified speaker 11Proposed41:31

If I might Council Member before you do that. I did want to provide one point of clarification my mistake here. I did mention that the City Manager and Mayor make that selection as it's written right now in the policy It would just be the city manager, but it sounds like the direction to be consistent with the other processes of certificates, proclamations, et cetera would be in consultation with the mayor.

So if you're okay with that I'd add the language, the city manager and the mayor in consultation. Sure.

UnidentifiedUnidentified speaker 10Proposed42:03

Do we need to note that if the mayor is unavailable the Mayor Pro Tem has the authority to be able to do such things?

UnidentifiedUnidentified speaker 1Proposed42:08

And as the mayor I want to know from all you anyways so that's something that I want opinions on.

UnidentifiedUnidentified speaker 11Proposed42:14

Okay. Apologies, council member. You may proceed. No

UnidentifiedUnidentified speaker 7Proposed42:17

worries. I'll move to approve staff recommendation with the amendment to the limited to 10 numbers and substitute some language similar to what we've discussed that captures the spirit of small business in the community Include the mayor in that is decision-making. That's election second.

Next is a presentation action discussion item 10 C as consider the establishment of a City Council ad hoc committee to negotiate the new development agreements for the Lapeyre project and amendments to existing development agreement for the vistas at Moorpark, Pacific Arroyo, North Ranch and Hitch Ranch projects. Mr. Burse

0:43 – 0:4811 turns

CommentGene BurseProposedself-stated43:29

Thank you, Mayor. Good evening, Honorable Mayor and members of the City Council. My name is Gene Burse, Deputy Community Development Director, and tonight I'll be presenting on Item 10C which requests the establishment of city ad hoc committees. These committees will be tasked with negotiating a new development agreement for the Lapeyre project alongside development agreement amendments for four other projects. This is at Moorpark, Pacific Arroyo, North Ranch, and Hitch Ranch.

As a brief refresher, Development Agreements or DAs for short are authorized by the California Government Code to provide certainty for both the City and developers regarding a project's timing, terms and conditions. They typically cover project phasing, public improvements, fees and infrastructure Pursuant to the local Moorpark Municipal Code, these agreements are negotiated by an ad hoc committee consisting of two council members and city staff.

This committee works to establish negotiating parameters and draft the terms before bringing a final agreement to the full City Council for consideration. And oftentimes these development agreements run alongside the entitlement process for projects. Staff is requesting that the City Council appoint two City Council members to serve on separate ad hoc committees for each of the following five projects.

The Lapeyre project. This project requires a brand new development agreement for a proposed development consisting of 52 single family residential homes and 60 duplexes located along Walnut Canyon Road. This is a Moorpark project, this project requires a new committee to address a proposed DA amendment for a proposed 346 unit project as the applicant is seeking to entitle a new development on a site governed by an original DA that's over 20 years old.

The Pacific Arroyo Project. This project requires a new committee to negotiate proposed amendments related to items such as the formation of a community facilities district and improvements along Los Angeles Avenue And then also North Ranch Project and the Hitch Ranch projects. And I'm highlighting these two projects together because they're interdependent based upon some of the proposed ideas that the developer has between the two projects and some of the unique dynamics for them.

Finally, please note that forming these committees is not subject to the California Environmental Quality Act, also known as CEQA. And therefore, and also that there is no financial impact associated with taking an action to seat five ad hoc committees. Given the aforementioned, staff recommends that the city council take the following actions. One, select two members of the city council to participate on the ad hoc committee to negotiate the terms of a development agreement for the Lapeyre project.

2. Select two members of the City Council to participate on the Ad Hoc Committee to negotiate the terms of a Development Agreement Amendment for the Vistas at Moorpark project 3. Select two members of the City Council to participate on the Ad Hoc Committee to negotiate the terms of a Development Agreement Amendment for the North Ranch Project. Four, select two members of the City Council to participate on the Ad Hoc Committee to negotiate the terms of a Development Agreement Amendment for the Hitch Ranch Project. And five, select two members of the City Council to participate on the Ad Hoc Committee to negotiate the terms of a Development Agreement Amendment for the Pacific Arroyo project. This concludes staff's presentation and staff is available for questions.

Thank you, are there any questions of

CommentGene BurseProposedself-stated47:11

staff?

UnidentifiedUnidentified speaker 9Proposed47:14

Mr. Bursey had said that there's some sort of like interconnectedness or interdependence between the North Ranch and Hitch Ranch projects. Is that a soft recommendation that the ad hoc committees be the same for both so that way there's alignments there?

CommentGene BurseProposedself-stated47:31

Yes Okay.

UnidentifiedUnidentified speaker 1Proposed47:37

Do we have any speakers?

UnidentifiedCity ClerkProposed · by role47:40

No, Mr. Mayor I've received no speaker cards on this item.

UnidentifiedUnidentified speaker 1Proposed47:43

Thank you. All right we'll go into discussion. We'll start off with the Lapeyre property which I have a recusal for. I'll be recusing myself from the appointment of members to the ad hoc committee for the Lapeyre development agreement because my residence is located near the Lapeyre property. Thank you. Dr. Castro you're in charge now.

UnidentifiedUnidentified speaker 9Proposed48:20

Okay. Does anyone want to volunteer for Lapeyre?

UnidentifiedUnidentified speaker 7Proposed48:24

I would love to be on it. Okay.

UnidentifiedUnidentified speaker 8Proposed48:28

He's looking at me for real estate. But I'm happy to do it, but I do want to be on another one so... Okay. ...I think that would be my limit if I take on Lapeyre.

UnidentifiedUnidentified speaker 9Proposed48:47

And Mr. Burst, do you want us to take action on these and then that way the mayor can come back?

CommentGene BurseProposedself-stated48:54

Yes. Please take action on each specific request one at a time. Thank

UnidentifiedUnidentified speaker 10Proposed48:58

you. So then do you want me to... I will move that we form an ad hoc committee for a little perch project with Council Members Delgado and Council Member Barrett.

UnidentifiedUnidentified speaker 9Proposed49:07

Okay, and I'll second.

UnidentifiedCity ClerkProposed · by role49:10

And a voice vote will be sufficient for this.

Brilliantly done Mr. Mayor. Brilliantly done.

there a second? I'll second. Okay, we have a motion and a second. All in favor? Aye. Aye. Alright. All set. All right, next is presentation action discussion item 10d. Let's consider approval of the annual review of the City of Moorpark's investment policy for fiscal year 26-27. Ms. Staver?

0:53 – 1:004 turns

UnidentifiedUnidentified speaker 13Proposed53:44

Good evening Mayor and city council members Tonight we cover annual review of the investment policy and recommended policy changes for fiscal year 2026 and 27. I would like to begin with a quick summary of the investment policy. Our investment policy is established with primary objectives of preservation and safety of principle, liquidity and yield. The city's investment strategy is made based on analysis of liquidity needs and investment return that maximize earnings while carefully selecting investment options to safeguard the city's funds.

Our policy allows us to invest in a variety of investment installments, including U.S. agency securities, supranational securities, municipal obligations, certificate of deposit, money market, venture accounting pool, RAFE and corporate notes and other authorized investments. Current maximum allocation includes 30% to supranationals, certificate of deposit and corporate notes. And 25% for money market. The maximum length of maturity is five years.

The guideline for maximum allocation is listed in each government code section identified in this matrix The city increased the maximum allocation of the money market account to 25% for fiscal year 2025-26, to accommodate major capital improvement project expenditures and due to concentrated maturity levels made several years ago. The city has been maintaining higher level of liquidity use in the money market account, VC pool and the RAFE.

As of December 2024 total liquidity was approximately 48 million. As of June 2026 total liquidity had decreased to approximately 36.8 million this includes 8.5 million or 5.7% of total investment portfolio held in money market account. The city's investment allocation has also been influenced by changes in Market interest rate. I apologize. The Wells Fargo Money Market Fund provided relatively high yield through December 2024, and remained generally comparable with VC Poor and LEIF through September 2025.

Since then the yield on the money market fund has declined relatively lower to VC Poor and LEIF After seeing change in the yield, staff moved excess funds to other investment options to maximise the return. In addition to maintaining liquid investment, the city continued to use maturity ladder to provide predictable cash flow and support anticipated liquidity requirements Currently estimated maturity for the remainder of 2026 is 4.5 million, with an additional 10.8 million scheduled to mature from January through June 2027.

In summary, the city increased the money market allocation from 20% to 25% for fiscal year 2025-2026 to provide additional flexibility for major capital improvements. Excuse me. Major capital improvement expenditures and concentrated maturity levels, the city has since seen to total liquidity decrease from approximately 48 million in December 2024 to approximately 36.8 million as of June 2026 by investing excess funds to other investment options due to change in interest rates.

However, the city continues to maintain adequate liquidity through the money market account, VC pool and LEIF, and its maturity ladder. Based on our current liquidity positions, projected cash flow needs, and scheduled maturities, staff is confident that the city's liquidity requirement can be met without maintaining the higher 25% allocation. Therefore, staff recommends reducing the maximum money market fund allocation from 25% to 20% for fiscal year 2026-27.

This will continue to provide the cities with adequate liquidity while allowing staff to manage the portfolio efficiently across the city's available investment options. This concludes my presentations and I'm available for any questions you may have.

questions of staff? You mentioned that our liquidity is adequate, is there a specific target number that you're looking for throughout this next year while we're having library construction?

UnidentifiedUnidentified speaker 13Proposed1:00:09

Thank you for the question. As of end of June 2026, end of fiscal year 25-26, we have approximately $38-39 million left on the capital improvement project. With considering not everything is going to complete within this current fiscal year, I would estimate possibly I would have $30 million to keep in liquidity for next 12 months.

Yep. Seems like a good idea. Makes sense. Any other comments or questions?

UnidentifiedUnidentified speaker 10Proposed1:01:15

I just think when considering our investment policy statement, the objectives are important. It's safety number one and it's liquidity number two. It's yield number three in a personal account in another venture that might not be the order of objectives but as long as we're the stewards of taxpayer money, safety, liquidity and yield in that order make sense? Absolutely.

I'll move to approve staff recommendation. Okay, I'll second.
