Okay, I am familiar with both sites and had no ex parte contacts. Moving along to the public hearing we have a miscellaneous permit consideration of a proposed tattoo and body piercing studio called Memento Rosa on at 305 East Matilija Street. Could we have the staff report on that please?

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.803:58

Yes, I'll have Addison go through the staff report and give a presentation. And then we'll invite the applicant to come up and fill in any blanks that we may have left out. And then we can open it up for public hearing. OK. Obviously you guys can ask questions before we do that.

ElectedJudy MurphyMayorProposedvoiceprint 0.804:15

Thank you.

UnidentifiedUnidentified speaker 3Proposed4:44

The item before you is a request for a miscellaneous permit for the proposed tattoo and body-piercing studio known as Memento Rosa at 305 East Matilija Hall Street in Unit 101B. The applicant is proposing to operate a tattoo and body piercing studio within an existing commercial tenant space of approximately 535 square feet The proposed business would include three tattoo artist stations and one separate body piercing station, with no more than three stations operating simultaneously.

In addition to the tattoo and body piercing, the studio includes retail sales of jewelry and soft good merchandise such as hats, T-shirts, plants, arts and crafts. The project will occupy an existing commercial tenant suite And no expansion of the existing building footprint is proposed. For the background, the previous uses of this tenant space were all general retail uses.

The reason this item is before commission today is because the tattoo and body piercing studios aren't specifically identified as allowable uses within the city's commercial zoning regulations. Pursuant to Section 10-2.303 of the Municipal Code, use not specifically listed may be considered through a similar use determination. Staff evaluated the proposed business and determined the most comparable listing for land use is public services, which is a permitted use in the Commercial Zoning District, the C-1 district.

Personal services includes businesses such as barbershops and beauty salons where our services are provided directly to individual customers. The proposed tattoo and body piercing studio shares similar operational characteristics, particularly the one-on-one nature of services provided. And then there was a some parking Things we were looking at since the previous uses general retail only requires the three parking spaces one for every 250 square feet Where for this space it requires one parking space?

three parking space per Per station for this, so it grew up to nine. These tenant spaces don't have an individual parking lot. They share parking spaces with the rest of the area. There are three nearby parking spaces with a total of 158 spaces. The proposed resolution includes a condition limiting the business to no more than three active stations at any one time just to help limit the parking demand.

Based on the analysis provided in the staff report, staff recommends that the Planning Commission adopt the resolution approving the miscellaneous permit for the proposed Memento Rosa tattoo and body piercing studio subject to findings and conditions of approval in Attachment A. I'll now turn it back over to you.

ElectedJudy MurphyMayorProposedvoiceprint 0.807:49

Thank you. Do you have any questions of staff before we open it to the applicant?

0:08 – 0:139 turns

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.808:25

clearance. Yes There's typically a zoning clearance that identifies consistency with the change over from retail over to personal services In this case, I think it's important to note that within the conditions of approval for this project there are two conditions to note. One is looking for substantial consistency with the site and floor plans on file That's the first one. The second one is the limitation in terms of the number of, so they're identifying the number of stations for this particular use as four in total but they also recognize that they're only going to be using a maximum of three at any point in time. So they're limiting themselves recognizing that they're not necessarily gonna have the staffing for all four but they could have staffing that operates for both the piercing and the tattooing as well.

Okay. So from a next steps process, it would be a zone clearance to identify confirmation regarding what's happened tonight consistent with what the code allows for. Here what you're looking at and you have seen one of these similar in a different zone but similar use within the city this is the second tattoo parlor that is requesting to open up within the city The first one within the downtown area, within the C1.

There was case law that went forward in 2010 which limited the way in which cities are allowed to review and analyze these types of uses so our code actually doesn't have tattoo parlors as an identified use so instead what we had to do is do a similar use determination. That use determination is before this body Knowing that we've already looked at it from a personal services use, similar to barbershops and beauty salons. There is some compatibility between the two in terms of what we've seen in the past. So I think that's kind of what we're looking at here tonight. It's really kind of a use discussion tonight and ensuring that the floor plan is consistent and then recognizing that that floor plan might not be changing Given the the review tonight.

UnidentifiedUnidentified speaker 2Proposed10:46

Okay, so when you're doing the zone clearance do you look at? The original approvals of that building because you know if it's in Disrepair right now like there's panels that used to have tile that don't there's a lot of wood rot There's exposed wood that's not painted for the extra for the exterior. Are you looking at that I

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.8011:11

That could potentially be maintenance. I think the thing that I think the commission needs to be aware of tonight is that we're looking at the interior pieces and not necessarily exterior, so if they are looking to do any sort of exterior changes, that is a separate review process which could come before this body once again. So all they're doing is the interior if there is Items that they're looking to do that are consistent with what's already there. That could be considered maintenance There is a provision in our code that talks about maintenance, but any changes that are inconsistent with what's already there Would have to come before this body

UnidentifiedUnidentified speaker 1Proposed11:51

Lucas question for you for the parking analysis. Are we using three or four? Stations, that's a little unclear to me

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.8012:00

So there's four stations there. There's one that's a piercing station and then two of the tattoo, right? So they have basically identified and this is one of the conditions that states that no more than three of the piercing slash tattooing stations will be used at one time. So there'll always be one that vacant.

UnidentifiedUnidentified speaker 1Proposed12:19

So the parking analysis is done off of that statement? Correct.

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.8012:24

That's why we're looking at nine versus a 12 analysis. And to tear off of what Addison was talking about earlier, this isn't a mixed-use area. So the common area parking lots that you're seeing to the north, to the east, to the west and even on the north side of Mattelaha those are all public maintained spaces As we get into deliberation and conversation, I have some suggestions in terms of conditions approval that we could add and talk about. But I'd hold those till the deliberation stage.

ElectedJudy MurphyMayorProposedvoiceprint 0.8013:05

OK. Thank you. Anyone else? Then we would like to invite the applicant to speak should you so wish.

0:13 – 0:205 turns

UnidentifiedUnidentified speaker 4Proposed13:19

Hi, I'm Robin. So I am the main applicant on there and this is my partner Chance so he is here with me. I have been in Ohio for the last six years raising my daughter. I've been part of a tattoo community From London to Los Angeles for 25 years, and I have just come to really appreciate the art form and also just the community aspect of it. And am really looking to bring that You know, extra body art factor to Ojai. I know there already is some and I'm looking to expand upon that.

I have talked with Hannah. I've gotten tattooed at her shop before and I'm very excited about the prospect of being able to open the shop Just a note in regards to your questions about the exterior. I know that the landlord is currently going through the permitting process to redo the exterior so The I have concerns about missing tiles and such myself from an exterior Position, but we are not That's not our thing to be working on, but I know that he is working on it. Our property manager has spoken specifically about it. They're going to change it all to stucco and my partner here Chance has something that he would like to say.

CommentChance Collegiate RoblesProposedself-stated15:02

So I just wanted to present here. My name is Chance Collegiate Robles. I'm a fifth generational. Can you hear me here? Fifth generation member of this town and am I'm wanting to present this with Robin as an opportunity to show what tattooing has done not only in my life but in my community, how it affects people because it is an art form and it is so intimate and personal.

OI has long been known for its artists and spiritual teachers And it's appreciation for peace, creativity and intentional living. I believe tattooing has a meaningful place in those values. My hope is to create a space where people from all walks of life feel safe, respected and comfortable. Some may come to celebrate an important chapter, remember a loved one, honor their heritage or mark a moment of personal transformation For those who wish, the process can include reflection, prayer and a deeper connection to the meaning behind their tattoo.

I also hope to support our local artistic community by creating opportunities for artists to share their work, collaborate and contribute to the creative culture that makes Ojai so special. I want Memento Rosa to be a positive addition to our community. Built upon professionalism, artistic integrity, respect and genuine human creation and connection as someone whose family has called this place home for many generations my intention is not to change the character of Ojai but to help carry those qualities forward into the future I believe that tattooing when approached with care and intention can be a beautiful form of art, healing and connection. My hope is that Momento Rosa becomes a place where those values can continue to grow.

And I really appreciate your time, your consideration and the work you're all doing serving our community.

ElectedJudy MurphyMayorProposedvoiceprint 0.8017:25

Thank you. Do you have questions commissioners for the applicants? Not at this time. Okay. Thank you. In that case, we will open the public hearing. And I have cards from Nikitas Ballas maybe?

CommentNikitas BalasProposedself-stated17:50

Hello, my name is Nikitas Balas. I am nervous to speak up here. I'm here tonight to speak in support of CHANCE but more importantly to speak about a young man who was born here and raised here as you said fifth generation. As a young man has worked towards building something for his own right in the heart of the community that helped shape him I think there's something very meaningful about that in a time when there are so many young people leaving communities. He actually wants to invest here, contribute to his downtown and build a future where his art and his business with Robin could flourish.

I also want to speak about the spiritual side of tattooing because I believe there is something we sometimes overlook. Chance's Native American heritage is part of his story. He has actually brought me into that story which I'm grateful for. And across many indigenous cultures, body art markings and symbols have carried deep cultural spiritual and personal significance.

I don't presume to speak for every tradition but I do believe there's something universal in our human desire to express what we hold sacred. I have tattoos of my dead nephews I pass away from cancer, my uncle suicide and my other arm is dedicated to my perseverance through life. I think about the places where people go to connect with something greater than themselves for some it's church for me it's church for others is a tribal gathering a sacred circle meditation space which Ojai is full of and wonderful These spaces can help people find meaning, belonging and healing and connection. And that's what my tattoos mean to me. It's a special place that for a set amount of time I'm able to sit with my feelings and what's going on.

For some people a tattoo can serve as a similar personal purpose it might honor someone they've lost express their faith symbolize the transformation in their life which is what happened to me And I believe that there's room for expression in Ojai, a community that values art individually, individuality and spirituality in many forms. Supporting Chance and Robin means supporting a local artist, a young entrepreneur and someone who wants to build his future right here in the place he calls home.

I still have two minutes. We may not all choose to express ourselves through tattoos and that's okay, and we don't have to share someone's practice or respect their meaning it holds for them. And I hope that you guys can look at this proposal not simply as a tattoo shop but as an opportunity for a young member for his community to bring his craft, his vision, and his spirit to downtown Ojai.

Thanks so much.

ElectedJudy MurphyMayorProposedvoiceprint 0.8020:24

UnidentifiedUnidentified speaker 5Proposed20:57

Hello. When I first got here tonight about 5.30, I met these folks. We chatted. A year or so ago, I was actively involved in an issue that came to the Planning Commission for a studio over on Fox Street. Saw the inside and actively supported it, and I was very pleased that it got permitted. I understand in reading the administrative report, it's interesting that the services provided by this kind of facility is under a Court of Appeal First Amendment protection which I think is kind of exciting.

A bunch of years ago, I used to have my car serviced at Oxnard Honda And on a Friday, if you went, they had a lady who would clean your nails, polish your nails. And she had what I would then call tattoos all over. But I quickly discovered that it's really body art. And so I would ask her about that particular body and she'd tell me. I see this proposal, even though there's piercing involved in it as a Barnea facility, a studio.

And that describes what goes on. A tattoo has all sorts of understandings based on who you were and how long you've lived and such. At my age, it goes back to the movies and such. Some of my family members are now having body art on expressing certainly personal kinds of stories. And I am thinking, my wife's nickname given to her when she was a small child by her dad was Cookie because that's because she liked cookies.

And so maybe someplace on me, I ought to have a cookie. I like this proposal.

ElectedJudy MurphyMayorProposedvoiceprint 0.8023:35

Thank you Bill. Jayden? Parks maybe?

UnidentifiedUnidentified speaker 6Proposed23:48

Hello, my name is Jaden. I'm a second generation resident here in Ojai and I've known Chance for my whole life. We've been friends since childhood and yeah, I speak on behalf of a really close friend and he has been a very very good friend to me throughout my entire life. He cares deeply about his friends, his family his community. So I think that based off of just how I've known him and experienced his deep knowledge and his deep care in love for For me and for all our friends and for his family.

I think that he wants to Extend that out into his community as well so I just yeah, I really think that he can bring a very special gift to Ojai and Yeah, that's all I really want to say

ElectedJudy MurphyMayorProposedvoiceprint 0.8025:02

Thank You Jaden.

UnidentifiedUnidentified speaker 6Proposed25:03

ElectedJudy MurphyMayorProposedvoiceprint 0.8025:05

Next we have Amber Young

UnidentifiedUnidentified speaker 7Proposed25:13

Thank you so much for the work that you do on behalf of our community. I know you guys are all volunteers. I'm not here to talk about the merits of tattoos or body art, which I think are great, or the merits of the applicant, which I also think are great. But my husband and I own the business that operates at 308 East Ojai Avenue. So we are in, we share the back parking lot and even whatever is available on the street.

And I just think that this could not be a better business to go into this space. Um, I think whatever parking requirements they need to have for their business to operate are worth it to have a thriving business in that space. We have been the property, we've been the business owners there since 2000 and We've yet to see a really thriving business that contributes to the plaza in a meaningful way.

Love all of our neighbors there, but we're excited to have somebody really move in and really make that plaza what it can be by what they can bring to our community. So just we're really hoping that you guys are able to pass this and we can welcome them into our neighborhood. Thank you. And I'm going to not because I'm not supporting them. I have to get home to my kid.

Thank you.

I have another card from someone wishing to speak, but there's no name on it. Oh OK. OK.

CommentDr. Susan CollegianProposedself-stated26:51

Hi everybody and thank you. I'm Dr. Susan Collegian, LCSW and I am the Artistic Director also of Ojai Valley Artist Theater Ensemble in town. I've been here 35 years and I partnered into those five generations of Ohians that made that boy over there. So during 2020 and 2021, my son's life changed being a high schooler here at Nordoff and went in a totally different direction. He said mom I don't know what the world is going to do. I don't think I'm going to go to college let me follow my heart and he locked himself up in his room for most of the time that the sequestered couple years that we were in our houses and he drew and he became an amazing fine artist all the while begging for a tattoo gun which I finally gave in to.

So his art, I have seen flourish here. He had a show about a year after just last week he was one of the speakers at Ojai Day and he helped design the mandala. He's very community oriented, very helpful person. I can't say enough about him. I just met Robin, and I can say one thing about what I know about tattooing because I have learned a lot in the last few years which is there are tattoo shops and there are tattoo artists. And these two are tattoo artists which goes into another thing that may you might not have thought about is the mental health component of what tattooing and artists can do for somebody It is not your grandfather's tattoo.

Okay, this is about transformation the way that their approaches especially chance because I have been the recipient of that and also watched it can have a mental health positive effect and and commonly does When people go into shops where there's dedication and a mindfulness that has to do with the connectivity of the person that they're working on when they hold it in a sacred space. Just like Nikitas was saying, these are important. These are our stories.

Times have changed, we have evolved or maybe even gone back to our predecessors that wore tattoos to tell our stories on our bodies. I have a personal request that this is made because I am often the practice canvas and I'd like to have some things done and finished Pretty soon. So another logistic thing is that many tattoo shops don't open at 8 and 9 in the morning, so the parking and the congestion that we have down there it's more towards you know afternoon into the later hours which is what she was saying about her business is that it would tie right into that. So I believe that the revenue Is there anyone else in the audience wishing to speak on this topic? Yes.

UnidentifiedUnidentified speaker 8Proposed30:05

Would you give us your name for the record, please? Hi. My name is Maka. Maka. M-A-K-A I've been here almost 20 years. My family's been in Ojai for nearly 100 and I'm a hand poke tattoo artist. Hand poke doesn't use the machine. And what... I'm nervous! What I can say, Chance and I started learning tattooing together while different methods we shared a teacher.

She has since moved out of Ojai but what I can say about the way that Chance and I approach tattooing is that we have a lot of reverence for the fact that we are permanently marking someone and we both approach it in very often a ceremonial way if the recipient chooses to receive in that way. And as a woman who has received tattoos and also given tattoos to a lot of women, I've heard a lot of stories of women feeling uncomfortable and sometimes experiencing really inappropriate interactions with male tattoo artists And I can, as someone who has received and given tattoos with chance, I can wholeheartedly say that it would be such a benefit to our community and just to the tattoo community in general for a respectful young man to be having a practice available, a space available.

to contribute in that way, and I would love a space to tattoo out of too. So I'm in favor! Oh And I'd also like to say that tattooing is the oldest specimen Of tattooed skin that has ever been found is nearly 4,000 years old so humans marking the skin of other humans is ancient and began as Often as an initiation, a rite of passage. So I feel that Chance and I are more in that realm of tattooing, of offering rites of passage and initiation. And I also like to use the word adornment.

We are adorning our bodies with ink and others with ink. Yeah, just some thoughts.

ElectedJudy MurphyMayorProposedvoiceprint 0.8032:40

Thank you. Is there anyone online, Cherry? No. Okay, at this time we will close the public hearing and bring the discussion back to the commissioners. Any questions anybody? I have a question then could you tell me why you have four stations and say you'll only use three

0:33 – 0:3821 turns

UnidentifiedUnidentified speaker 4Proposed33:13

The body piercing portion is most likely going to be sort of a, the piercer that I'm going to be working with is gonna be coming in sort of on a temporary basis. They're not going to be there all the time and they're, I'm going to be learning how to pierce from them myself so my station itself is going to double as two spots. So that's kind of why it can be used as a flex space

CommentChance Collegiate RoblesProposedself-stated33:47

There's also a term within tattooing called guest spotting. So if we have an artist that we know, that's in the industry, they'd like to come, that's visiting and has a clientele here, they will have a booth that they can tattoo at for a very temporary amount of time before they move on to their original shop wherever that may be And I know there are some codes in how long that is, it's usually five days that they can stay. So having an open booth is one of those things where we want to invite artists that share our ideals and our values. And that can bring a very specific style and clientele to the town and to the shop.

So it's more of, it's like a spare bedroom sort of feeling rather than everyone is going to be working all the time sort of thing. And I will say in my professional experience a piercing takes much less time than a tattoo so it will definitely double as Robin was saying primarily two that third being for piercing that fourth being as our spare guest bedroom so to speak metaphorically for another artist

ElectedJudy MurphyMayorProposedvoiceprint 0.8034:59

And could you review for us the hours that you plan to be open?

You want me to go or what?

ElectedJudy MurphyMayorProposedvoiceprint 0.8036:47

If you have a question, this is your...

UnidentifiedUnidentified speaker 2Proposed36:50

Yeah no I'm just, I agree with staff that the tattoo parlor studio fits within the definition of personal services. I think that's the main thing we're here for, right? It's identified as a permitted use in the general commercial zoning district. So it's permitted they can go right in I'm still having a little And this is not for Robin and chance but for the property itself So when there an application comes in change of use, it's a good opportunity for the city to go Okay What's going on with this business? What does it look like outside are they meeting the conditions of approval from their original approval And I would say that on the outside, it is not. It doesn't have the same elevations as it did when it was approved.

It's deteriorated. So I would say, you know, I agree. It's great. And I think it's perfect for the spot and it's consistent with personal services, but I do think somehow we need to address either through conditions which puts the onerous on the applicant which I don't think is fair or code enforcement to go to talk to the property owner to talk about getting that place

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.8038:17

It would be a little odd to do a condition that requires them when it's the property owner that really would need to go through that process. What could happen is a proactive approach from a co-compliance standpoint and address it that way but I'm also hearing From from the applicants that it sounds like they're getting ready to submit something That may be coming before this body, especially if they're making changes to the exterior

UnidentifiedUnidentified speaker 2Proposed38:44

But I think it should be formalized personally. Yeah, like in a letter to the property owner That's my comments

moving on to item three and at this time the chair must recuse herself due to living within the 300 500 foot anyway I live nearby so I will turn The meeting over to the vice chair, Jonathan.

GovCaptain Tyler AbbottPolice ChiefProposedvoiceprint 0.5840:59

All right. Yeah, I'm annoyed. Can we get the staff report, please?

CommentLucas EibertProposedself-stated41:20

Thank you vice chair Good evening commissioners. My name is Lucas Eibert for the record. I'm the community development director here for the city of Ojai The item before you tonight is a request for approval For a tentative parcel map located at 216 Park Avenue the Area in question here is on the north side of Park Avenue. There's an existing residence behind that existing residences where the subdivision, the parcel map is being proposed. It's taking it from one particular individual parcel and subdividing that into three.

On the east side of that if you can go to the next slide. On the east side of that three parcel subdivision, or taking one and turning it into three is the proposal for the extension of Olive Street. And that street is currently a paper street. And those improvements would be a part of this proposal meaning it would have full improvements likely done through a subdivision improvement agreement as a part of this project and Improved upon by the developer and not by the city. The city would then turn around and accept those improvements As they would be required So you can see here the three parcels the one on the very north side they are meeting let's go to the next slide They are meeting the subdivision standards, so anytime that you're looking at doing a subdivision Within any city this city is included there are specific parameters that must be followed and those parameters live within title 10 chapter 3 the subdivisions subdivision regulations The site itself is zoned RO as a single family zoning district.

Those parameters include area, width and do not include a depth minimum requirement so what I've identified here is that each one of those parcels the third parcel or parcel three already has an existing residence on it Parcel 2 and parcel 1 do not those are vacant or would be would be vacant if and when the subdivision was to take place. Those areas are identified as them as minimums and then what is being proposed on the left you're seeing a 16,000 20 square feet the minimum like for instance with parcel one and parcel two it's 12,000 square feet as identified within our ordinance not within title 10 chapter 2 but actually within The residential standards within title 10 chapter 2 Here on the right I'm actually showing one of the particular parcels in question here for the subdivision You can see it highlighted in red Next slide, please And that is it for the presentation, but I would say this.

For this city we don't necessarily see a lot of subdivisions that aren't tied to affordable housing. This is one of the few ones, few that we see here as a proposal that is market rate housing. Well market rate in the sense that they're coming forward with a subdivision that does not include affordability pieces to it. I would also state that any of the the traffic situation. I know there's been some questions that have come up I would invite the applicant to speak to that a little bit and then we can have certainly a conversation as it evolves So with that if the Commission has any questions of staff, I could certainly answer them or we could defer to the applicant in terms of Responding to questions as well

0:45 – 0:5014 turns

UnidentifiedUnidentified speaker 2Proposed45:33

So is the street that they're proposing, is that publicly held right now? Is that City of Ojai owned?

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.8045:41

It is by paper street. Meaning it holds itself from the standpoint of having the opportunity for development but not being developed at this point. It's just a dirt road at this point. Unimproved,

UnidentifiedUnidentified speaker 2Proposed45:55

it's not in the circulation element right identified. I'm not

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.8046:00

seeing it So there are city there are areas that are identified as potential for development or they even identify those areas is not Potential to but for development this one for whatever reason is left out and I'm not I mean, I don't have a crystal ball as to why but

GovCaptain Tyler AbbottPolice ChiefProposedvoiceprint 0.5846:21

Should we hear from the applicant then? Or do you want to ask any

UnidentifiedUnidentified speaker 1Proposed46:24

questions before- Yeah, let's hear from the applicant real quick for me.

UnidentifiedUnidentified speaker 9Proposed46:35

Hi there, sorry I couldn't be there in person today. I'm currently out of town preparing for my wedding this weekend so Tatiana is the primary engineer that is helping me with this project but I can speak to some of the technical concerns. Myself, my sister and my mother who are also listed on Apple. We've all been involved in the broad community for literally generations as this used to be my father's place. As Lynn said it used to be my grandmother's place, Lillian Sayre.

So we're trying to be able to make this area of open weeds that we have to clear out every year, we're trying to make it usable. And I'd love to turn it over to Tatiana to answer technical questions.

Commentthat was Andre SayerProposedself-stated47:37

And for the record, that was Andre Sayer, one of the owners of the property. To answer the question about the road, it is a paper road so that road isn't technically a part of the owner's responsibility right now. The owner is just trying to subdivide these three parcels but Per the conditions of approval, they would be required to actually build the road improvements and then after they've satisfied all of the conditions based on the city engineers requirements Then that would be turned over to the city as a public road And then we do have our traffic engineer ATE on virtual for any of the traffic related questions so Daryl if you could just give a little brief overview of Just the considerations for the traffic analysis. That would be great

UnidentifiedUnidentified speaker 10Proposed48:27

Good evening, this is Darryl Nelson with ATE. We did a traffic analysis for this particular project and it was reviewed by the city and approved by the staff but basically this project in and of itself is going to generate three peak hour trips and five p.m. peak hour trips And when those trips are distributed throughout the community, it's determined at that particular level that it does not have an adverse effect or is inconsistent with general plan policies.

And as part of the CEQA analysis, the project does not trigger CEQAs impacts in terms of vehicle miles traveled. It's below the threshold of 110 daily trips So there isn't a particular issue with CEQA. And there's some general, again, general plan policies that the city has and in that particular area of Ventura County where the project is, again consistent with all the city and county policies with regards to traffic effects.

Commentthat was Andre SayerProposedself-stated49:51

Thank you, Daryl.

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.8049:53

Can I just ask a follow-up question?

UnidentifiedUnidentified speaker 10Proposed49:57

Sure.

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.8049:58

How is this consistent with AQP4? I think you know which policy I'm talking about specifically.

UnidentifiedUnidentified speaker 10Proposed50:03

Okay, that policy says... That particular policy, the project doesn't add any trips southbound and no trips northbound. So that makes it consistent with that policy. The level of traffic is less than one trip. It's not like you're going to have people coming and going down to Ventura every day. Sometimes someone will go down there on Tuesday, and then they might not go back down there until The following week, so on average it's less than one trip. So that keeps it below the policy threshold.

0:50 – 1:0235 turns

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.8050:50

How can I ask a follow up question to that? How did you analyze that? What what method or matrix did you analyze that

UnidentifiedUnidentified speaker 10Proposed51:00

when you say metric, it's just math. It is not like if we have a commuter who goes to work every day OK, then they come in and go on every day down to Ventura. And that one trip would do it. But this particular project, again, in and of itself, it generates.

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.8051:25

Let me be more specific with the question. What technical documents did you use to support your evidence there?

UnidentifiedUnidentified speaker 10Proposed51:34

The technical evidence is the amount of traffic that it generates. It generates three trips in a peak hour, and it generates five during the peak hour. Not everyone's going to go down to Ventura unless that's where their job is. So it's an average of trips they go in a week to and from Ventura. Majority of these trips are going to be local trips. They're gonna stay within Ojai.

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.8052:09

Okay, so you've made a professional determination or opinion or what are we talking about here?

UnidentifiedUnidentified speaker 10Proposed52:15

Well yes and again it's still math if this project generates 100 trips yeah you're gonna get some traffic going down on a daily basis it's three and five We don't expect anyone to be going down there every day. It's going to be local trips focused on Ojai.

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.8052:36

Okay, so my follow-up question of that is you said three and five, three coming in, five going down?

UnidentifiedUnidentified speaker 10Proposed52:45

No, no,

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.8052:46

no. Or the opposite

UnidentifiedUnidentified speaker 10Proposed52:47

of what I just said. In the peak hour it's 3 a.m., 4 p.m. and 5 p.

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.8052:53

m. So those are within the peak periods? Yes,

UnidentifiedUnidentified speaker 10Proposed52:57

yes. Yes.

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.8053:01

Hold on, what does AQP4 state specifically?

UnidentifiedUnidentified speaker 10Proposed53:05

One, you can't send one.

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.8053:07

Less than one but you just stated three and five within peak

UnidentifiedUnidentified speaker 10Proposed53:10

periods. Everyone goes down there and again those are inbounds and outbounds okay and so everyone would have to go down there. Everyone that lives there that moves in there would have to go down there on a daily basis These trips are going to be local to Ojai. So they're gonna be focused and they get up, they go get coffee in town, they come home or they have a job in town because they work in town and then come home.

Unless they all have jobs in Ventura and they commute every day that's the one trip. Again if it generates 100 peak hour trips Some of those would definitely go Monday through Friday. But we're talking about three and five, so we're not going to get people going down there daily. They'll be – they'll go down like I said. They'll go down maybe on a Tuesday. They won't go down there the following week.

UnidentifiedUnidentified speaker 2Proposed54:18

So Daryl, are you familiar with the city's three policies that talk about level of service? And there was a memo to council in 1990 but it's still applicable to our current circulation element because it hasn't changed. And it talks about There was some discussion at council and council came up with a policy that basically said if there's any incremental traffic to any roadway segment on highway 33 unless it was for affordable housing It it would be denied because or you would have to do an EIR at the time for CEQA But are you know that CEQAs changed but our policy in the general plan has not changed So we're still looking at level of service and mitigation so At the time of this I know for years before 1990 was really the critical time because City Council weighed in and said yes, we want to affirm this policy that based on previous traffic analysis And this is to quote this memorandum to council.

We a Two-way residential lot split would cumulatively although minimally add to traffic impacts on Highway 33 So they're basically saying, even though it's minimal, incremental. If a project here in the city of Ojai creates this minimal traffic impact However, small it is to an already impacted roadway segment in the county that we cannot approve it. It would be counter to our general plan policies so a fact for many, many years.

And I think people have forgotten about it because I don't agree that there's no impact to the roadway down Highway 33. Based on all the previous traffic studies we've done on Lot splits and that's just for a lot split not even three parcels. So I Just unless something has changed and there's been no roadway improvements Our population really hasn't changed too much Build-out numbers haven't really changed gone down. So I don't think anything's changed since this policy, so I think on its face this project does not meet this policy.

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.8057:16

The only thing so hold on Darrell if I can respond to the question So the policy itself is from 1990 our general plan then was adopted at least the land use and the circulation was 97 and then there haven't really been any substantial changes that have taken place since then with the exception of The Ventura County general plan which did receive an update in 2020 and more specifically our area plan that did receive an update So I do think that there needs to be some Conversations with Ventura County to see if there was any sort of updates to that particular policy. I mean, obviously it was through City but then obviously there must have been some sort of an agreeance with Ventura County acceptance of that So I would have to go and do a little bit of research to see if that policy from 1990 still has teeth today.

It could, it very

UnidentifiedUnidentified speaker 2Proposed58:14

well

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.8058:15

could.

UnidentifiedUnidentified speaker 2Proposed58:15

I don't see why it doesn't because our policies are the same.

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.8058:19

Right.

UnidentifiedUnidentified speaker 2Proposed58:20

Our policies

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.8058:21

have not changed.

UnidentifiedUnidentified speaker 2Proposed58:21

Yeah they have not changed unless you know the level of service they may not even have LOS anymore maybe that changes things but You know They still have.

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.8058:35

So we're diving into conversation versus responding to

UnidentifiedUnidentified speaker 2Proposed58:38

questions, but I do appreciate it. Yeah, but I don't think he was aware of this. He might want to see

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.8058:43

it. I was not aware of this until this morning so...

UnidentifiedUnidentified speaker 10Proposed58:46

I'm very aware of that policy and been dealing with that policy since 1997 personally in terms of projects in Ojai and in Ventura County. And what I'm saying is if this project generated 100 trips in a peak hour Without any question, one trip would go down there. That's all it takes. And then yet you're not consistent with county or city of Ojai policy. But we have three.

And of that three, not all three would go down to Ventura on a daily basis. Like I said, they may go down there on a Tuesday but because it doesn't go there Monday through Friday five days a week It does not count as an impact. It would have to do it every single day of the week, and it's one trip. What we normally do is we take 100 trips in a peak hour, and we distribute that throughout the system.

1% is one. But normally if I do 1% of three, I'm not one. If I do 5%, I'm not one. It's just, it's a fractional trip. Then basically if you're not one, either you're one or none and as a fractional trip and I know we've had this conversation with some staff before those fractional trips are random. And that's what I mean by it will go down there once a week but not every single day.

But again, if it's 100 trips yes, you're absolutely right. That's what the policy, there would be no question about it I'd be 100% in agreement with you. And like I said, I've been dealing with this since

UnidentifiedUnidentified speaker 2Proposed1:00:41

1997. Was this traffic study routed to the county transportation for just for comment?

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.801:00:53

For a comment no it was not. But the policy that you're holding before you identifies that that circulation piece should be reviewed and commented on, correct? So it was not. I mean there is an opportunity for them to provide some weighing in on that. And I think through that we would also get some clarification as to that policy. I know Daryl's mentioning that he's very much aware of this.

I was not aware of this policy. I am very much aware of the AQP4 that we have before us, and that is definitely something that we use on the regular to speak to any applicants that come in that have potential for impacts to trips that are coming in and out during peak periods Monday through Friday. Darryl, what I'm having a hard time with in terms of your argument is to say that you're spreading out those three trips or those five trips throughout the week. If I recall correctly the policy itself states Monday through Friday not on weekends it talks about Monday through Friday correct?

UnidentifiedUnidentified speaker 10Proposed1:02:00

Right but it's daily. It's Monday Tuesday Wednesday Thursday Friday. But you don't do it till next week, it doesn't count. And that's been the policy with Ventura County again since 1997 since I've been here.

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.801:02:16

Okay, I'm struggling with doesn't count like how does that where's the analysis for doesn't count?

Commentthat was Andre SayerProposedself-stated1:02:23

Do you mind if I chime into this? Could you? Yeah, thank

UnidentifiedUnidentified speaker 10Proposed1:02:26

you.

1:02 – 1:1413 turns

Commentthat was Andre SayerProposedself-stated1:02:28

One second, Daryl. So basically what he's saying is that these parcels would generate three in the AM peak on a daily basis and then five in the PM peak on a daily basis as local traffic so within the city bounds. So not people who are traveling down Highway 33 3 to 5 times right? It's just this is what happens locally Now, what he's saying is of those three and five because they're local that there's no assumption that all of those are going out down Highway 33 on a daily basis. But he's acknowledging that sometimes the people who would eventually live here would be going down Highway 33 just not daily and the policy is talking about daily impacts to Highway 33.

So with only three or let's call it five right because p.m Is your your peak peak you're at five? so with just five total You cannot assume that all five of those are coming from highway 33 or to Highway 33 on a daily basis but they might go on Tuesday to Ventura or Friday to Ventura or whatever it might be, but they're not going every single day and

UnidentifiedUnidentified speaker 2Proposed1:03:39

He's talking fractions, but so is this policy. The policy is talking fractions like any amount of traffic on impacted segment roadway segment and the air quality one specifically states Edison Curve in Casita Springs. I mean it's already impacted the roadway segments so any additional impact, which is even fractional, is an impact. It's a negative impact. I'm just saying that's how this policy was implemented for years and years and years. And we've seen projects, commercial projects go through because it's reverse peak hour trips.

There's better, you know ways to mitigate easier way I should say easier ways to mitigate trips So commercial subdivisions have happened often here Residential has happened when there's already houses on them and they're just splitting them but vacant land if it's not for affordable housing It's you know this policy is Is it's still in place? I think so. I'm not convinced that that anything has changed unless I hear it from Maybe the county because our general plan policies are directly linked to the county roadway network They specifically talk about state route 33, so unless the county planners are now saying oh yeah, go ahead and develop and add trips to Highway 33. I don't see how it's consistent. So that-

UnidentifiedUnidentified speaker 10Proposed1:05:23

You're absolutely right about that. And these fractional trips, this is not the first time we've dealt with a fractional trip on 33. And like I said, it's either one or none. And they deal with fractional trips you round down. We worked on Starbucks, the new Starbucks on 33 And we somehow got that approved by the county. And that one was dealing with fractional trips.

GovCaptain Tyler AbbottPolice ChiefProposedvoiceprint 0.581:06:04

Yeah, any other questions?

UnidentifiedUnidentified speaker 1Proposed1:06:06

Yeah, I have a few questions and then some thoughts about kind of how to think about this. I guess my first question is how many total structures can go on each lot between what presumably could be a residence, an ADU or JADU? What's the total amount of livable spaces that could be on each one of these lots?

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.801:06:32

It's a question for staff. So you can do a main house, you can do an ADU You can do it junior ADU and you can do a tiny house

UnidentifiedUnidentified speaker 1Proposed1:06:42

Okay, so each lot could carry four living Structures on it correct? Okay so Here's kind of how I'm looking at this a little bit and it's a little bit of a comment to staff as well And just kind of the way that we think and work Analyzing going through things. We we kind of I look at Planning Commission kind of simple We have threshold questions, and we have condition questions Okay, and you're giving an example of a threshold question where there's a threshold The gate that this project has to go through Frankly from my perspective There are so many open threshold questions here I can't even begin to think about what the conditions would be you're bringing up a new one to me But other other threshold questions would be all around. Can Olive Street even be built to fire standards?

We don't know there's some writings about that and some Opinions, but we don't know that. That's a threshold question and in a sequencing question Why on earth would we approve what? We now know could be a potential of at least eight homes Living places between the two at least eight Why would we approve that without knowing if we could build the fire standard so there's a threshold and kind of a sequencing issue and I did hear a comment that you would build and pay for the road. I think I heard that correctly That's great. There's a maintenance question an ongoing upkeep question It also comes right into the area where the Gables is Gables is coming our way soon with some unknown Items around it, so that's just worth noting.

Has a city engineer issued any opinion at all on if this road works or if the grading is correct or all of the CEQA pieces of everything?

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.801:08:45

Well, it's less about the CEQA for the engineer. They're looking at it from a road standard standpoint in terms of all the improvements. As the city engineer would opine they're very interested in a subdivision improvement agreement and that would have all the bells and whistles tied to it in terms of the street width sidewalk tree areas light

UnidentifiedUnidentified speaker 1Proposed1:09:11

Right, but CEQA would come into play on the sewer piece of it which we don't know yet.

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.801:09:21

Correct? The sewer and the water and even the electrical would be a part of the discussion.

UnidentifiedUnidentified speaker 1Proposed1:09:27

Yeah okay so these are kind of threshold questions where I don't actually feel we have the ability to make a decision on anything Until we know some of these threshold questions. Another example of a threshold question would be the current state of the WillServe letter, it's a letter it's not an actual WillServe document you know and so we want to We want to be careful that we have all of, all of that in place. And I've been through that personally so I know there's a difference between a letter saying that and an actual will serve.

But that's kind of where I'm at on this. There are just so many thresholds Questions that I want to make sure we get the sequencing right and Mike, I guess my comment to staff is in Closing on this sorry in closing on this. My question is Sometimes I feel like we need a pre-flight checklist for the people who are the customers of The Planning Commission these people are customers they have something they want to do and And that's great. That's what we're here for, we're here to serve the community but when a customer comes in with several threshold questions unknown undecided unconsidered or unclear and then asks us to lay a bunch of conditions on it I don't think we can serve them or the city well And so to me, there's that pre-flight checklist before you come to the commission.

We have to know some certain things otherwise we're just throwing out conditions one way on one project, one way on another project an exemption here no exemption there and we're opening ourselves up to a process that I think is very difficult to follow. And then, like you said, it's a little bit shocking to me frankly what you relayed today because that's a lights out provision to me and we need to learn more about that so that's another piece of it but that's kind of my thoughts on it but from my perspective I don't have the information to be able to make a decision.

GovCaptain Tyler AbbottPolice ChiefProposedvoiceprint 0.581:11:44

Maybe just to feed off of that I think those are all really good points. So Lucas, can you talk a little bit about, you know, I guess in a way the following question is like why are we seeing this now and not later once? I mean this isn't necessarily maybe the way the process is run and if so why is that the case or is there something we are missing?

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.801:12:09

Right, so the information that you're seeing here has taken them to the point where they are complete for processing. Meaning they have provided all of the necessary tools and documentation for them to get to this point. On top of that the city engineer has reviewed this map and cleared it for so there's two steps to this There's the tentative parcel map And then you as an advisory group are providing a recommendation that then goes to City Council for final consideration And that's the tentative parcel map. There's also a final parcel map that would be analyzed for completion and recordation, and that accompanies a much larger document that is also approved by City Council which is the subdivision Improvement agreement and that has all the bells and whistles of of the subdivision itself so here you're seeing kind of a You're calling a pre-flight checklist, this is the the kind of Hey, this is what they're proposing.

It's it's past the muster on a preliminary standpoint basis But still needs to go forward for additional consideration and there's a lot more detail in Requirements and agreements that come forward that are really for the City Council to consider So, but if I could just pause those statements and that information for a moment. There are pieces that are unclear. I mean you've raised a number of questions tonight that I think deserve a formal response. There are some responses to those but I think a formal response and additional research and then coming back to this body With those responses, on a number of occasions when items have come before this body we've taken that as an opportunity for questions to be raised and then from that standpoint we go back and we answer those questions through additional analysis.

1:14 – 1:1913 turns

Commentthat was Andre SayerProposedself-stated1:14:22

May I answer some of the questions just to hopefully as we leave this that you have that just in the back of your minds. So, we did analyze this for fire access and if you see that grayed area there's a little hammerhead there that meets the minimum code requirements for the County of Ventura Fire truck turning So they will be able to get their engines up this road and then turn them around back and down safely.

And this was run by both City Engineer and Ventura County Fire before this came before you guys, so that's not an open-ended item that was resolved before we came to you guys as one of the call it checklist items that we needed to address. And Lucas already mentioned it, but the city engineer did review all of these Improvements and we got their blessing to bring it forward to you after their Review of it and we went back and forth quite a bit on that. And then as far as the will serve letters I do understand where you're coming from because they are a pain in the butt and But it's a chicken and the egg thing so we could only get the will serve letters at this point The only way to actually get the proper letter. The one that says you really are going to get these Connections is with full plans, and that's the next stage So we can't get to that stage until we get this tentative map approved Then at which time we'll be putting together the full Precise grading plans all the utility plans and those will all be submitted to the different utilities as well for their review and approval As part of that process to then get the the prop.

Well, the more formalized versions of those will serves But without this approval we can't get to that stage

UnidentifiedUnidentified speaker 1Proposed1:15:57

is the applicant planning on developing these lots themselves

Commentthat was Andre SayerProposedself-stated1:16:00

The intent right now is to fully develop it after we get through this process

UnidentifiedUnidentified speaker 1Proposed1:16:04

So these won't be sold to another developer

Commentthat was Andre SayerProposedself-stated1:16:12

And the traffic is based off of one single family residence on each of the two new lots that are vacant right now and then three ADUs, one for each of the three lots. That's what the analysis included.

UnidentifiedUnidentified speaker 1Proposed1:16:32

Yeah, I was just thinking about your answer there a little bit. One simple measure if your answer was we are going to sell these lots. One kind of simple and easy measure for the Planning Commission is would somebody buy this project as it sits on our table today? And would they be able to buy it and in good faith, develop it and build what they need there? It's kind of an interesting measure. No one probably would step in and buy this. There are too many unknowns. And so it's a little bit of a balance for could we approve something that wouldn't be in that state a little bit.

UnidentifiedUnidentified speaker 11Proposed1:17:53

Good evening Ojai needs housing and for all different types. And I understand the traffic and the roads, and after being at the MAC meeting we heard all that. But if they can have three other properties on this one house now by right, correct? If it was affordable or something with their own property. If they don't subdivide it, they can add three more, correct? Junior ADU, ADU and what's the other one?

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.801:18:27

But you're talking about the lot itself without the subdivision. Yes, he can do it

UnidentifiedUnidentified speaker 11Proposed1:18:30

so that and they can do that by right Without taking to effect parking or any of that stuff and they don't have to do the road Which eventually what may have to happen because then you got the gables who may want to be doing something And they're going to want laterals and sewer lines and all that stuff. So I think we should have some sort of plan here to bring in housing there because we need it, not just for affordable but for people who want a downsize from bigger homes to smaller homes.

or people who live here who are renting and they just want to buy because they can afford to, or because somebody's going to help them. I just think we need to be a little bit more proactive in housing for non-affordable, just in general, because how else are our people going to live here? People who want to stay here. They just don't necessarily want to be in a three-story house. They want an apartment house, they want a single family or a duplex or a triplex and here's an opportunity but I understand the traffic issue and that has to be resolved.

Thank you.

UnidentifiedUnidentified speaker 5Proposed1:19:59

Hello. The issues I see with this proposal, and likely the next Olive Street proposal to Gables are... I have current concerns about this proposal as presented It's all about what gets added by the Gables proposal, likely coming up in the next several months. One, the current Olive Street proposal for two new residential lots on Olive Street likely will bring 2 to 3 vehicles each for a total of 4 to 6 new vehicles.

And new to me is the potential siting on each of the two new lots, up to four housing units. Wow! That adds even more vehicles, maybe eight per parcel. Two, there is an accumulative effect here which needs to be considered. In the next several months, the Gables-Ojai project will be on the Commission's agenda likely. For a 10 lot residential development on Olive Street, potential two to three vehicles each.

Now they've heard it can be up to four housing, four on the housing unit. Wow that's a lot! But a minimum of 20-30 new vehicles plus 4-6 for tonight. Residential vehicles is the issue. The 3 Olive Street intersection with Grand Avenue is risky With Signal Grand Curve just west, vehicles traveling east do not expect Olive Street. And there is an acceleration of most vehicles coming from Montgomery Arterial Stop as they go west.

Vehicles coming down North Signal Street are helped by gravity and boy do some of them whiz fast! That's a problem when it comes to Park Street You don't know it's there unless you already know it's there. I have lived on North Signal Street since 1979 when Cooke and I bought the property, so I know this street and the Grand Signal intersection very well. Whoever designed North Signal Street from Grand did not know how to measure the street widths.

It's 34 feet at Grand and two-thirds north is 24 feet. Poorly designed street. I would suggest this area with a total of 13 new lots will overwhelm those two intersections. Options limited to six lots or place a registration limit on ownership of vehicles, that's against the law. I have a summary please. The better future Gables agenda item, or the future Gables agenda item.

What they need to do is go back to what they did on November 16th in 2022 when they proposed a 21 unit senior housing development Which would be affordable, and that's what we need. So getting in and getting out is a real problem. Those intersections are really seriously difficult. In my opinion, we don't need more market rate housing. We need more senior housing.

Whispering Oaks has years of a waiting list. That's terribly sad commentary on the lives of some of our senior citizens. The Gables program offered in 2022 for seniors is what we need, thank

GovCaptain Tyler AbbottPolice ChiefProposedvoiceprint 0.581:24:03

you. Okay, thank you Bill Next we have Heidi Whitman with some comments

UnidentifiedUnidentified speaker 12Proposed1:24:18

Good evening. I first wanted to thank you for your service It must be an extreme head bashing experience to have to make decisions when the staff reports are So inadequate, I'm here as a homeowner within 500 feet of this project I would like to ask that you postpone or deny this item as it as it seems like the analysis just isn't there and This proposed subdivision depends on a paper street that the city has not committed to build and as I was doing some research today, I found out some cities even do a Do a blanket thing that says if it's a paper Street And you can't they just say no more paper streets if they're not in the circulation element and I can tell you the cities that have done that I believe that the project does add peak hour trips.

I know there's three from my house, and I can't imagine with the cost of properties such as this that anyone could afford to have a house buy a house in Ojai And not leave because we just don't have high-paying jobs here, which is one of the reasons my husband and I have left during the peak hour and come home during the peak hour for more than 30 years. When previous attempts to develop this site had been made there have been a lot of comments about the inability of emergency vehicles to turn around And although we've heard that the city engineer has approved this, frankly we don't even have a city engineer. It's all contracted out and so I didn't see anything in the staff report about the city engineers approval of anything.

And then finally, Monday night I attended the MAC meeting where a big point of contention was whether or not the city of Ojai follows its own development rules. I don't think that we always do. And other communities other members of the community in the Ojai Valley are looking to us to follow our own rules So this clearly does not from what I've read and I think it should never even have come before you so Thanks very much for your consideration

CommentI'm City CouncilProposedself-stated1:26:45

I'm Andrew Whitman. I'm City Council, but I'm not speaking as a council person I'm within that 500 feet married to that lady And my oh, I am NOT going to advocate or anything. I just gonna clarify what happened at Mac Because I was there At issue was that general plan that's shared with the county that exempted, well prohibited development that results in trips on Highway 33.

And they were looking at an exemption Adding an exemption to that general rule that would exempt every commercial lot from any traffic analysis. What was clear from the meeting is that there have been some exemptions, there were three exemptions that have been adopted since the original adoption of that policy One is for affordable housing as required by HCD and all the affordable housing laws.

The other was for a historic property that wanted to add residential units to the historic property And there's a third one that I don't really remember. So the proposal before the MAC will now go to the Planning Commission was let's add a fourth, so I think it's really important that we look at and oh, the last thing I wanted to add is that the MAC members looked at the mayor and said are you enforcing this policy in the city of Ojai?

The implication being they resent having their commercial development potentially curtailed for this concern for traffic. Especially if the city of Ojai isn't engaged in its end of the bargain so Just trying to make the record complete. Thanks

GovCaptain Tyler AbbottPolice ChiefProposedvoiceprint 0.581:29:33

Is there anyone online Sherry

ClerkWeston MontgomeryChief Deputy City ClerkProposed · by role1:29:36

no

GovCaptain Tyler AbbottPolice ChiefProposedvoiceprint 0.581:29:37

Okay, so we will close public comments and move to discussion

UnidentifiedUnidentified speaker 2Proposed1:29:49

Have a question about the I Guess we all know where I stand on the circulation element policy and that but Just questioning. Where did the street? Configuration come from did that come from the city like this is what we want to see if we have a new road

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.801:30:10

Right, so it was taking basically all of extending it up and then through the City Engineer We were working through And I take exception to saying that we don't have a city engineer. We do have a city engineer, it is contracted but it is our city engineer that we use and rely on. They have a stamp that certifies them as a professional so I do take exception to that statement because being in-house versus not in-house does not necessarily matter. The stamp is what were most important in terms of doing the analysis for something like this.

So Sorry, what was your

UnidentifiedUnidentified speaker 2Proposed1:30:51

well? I'm just trying to figure out how did that configuration of the street come about because I don't see real I don't see sidewalks or complete Street kind of items like well

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.801:31:00

there. I mean if you're looking at like for instance parcel one I Do have some questions myself about parcel when I'm when I am looking at it, but it could very well be answered through some of these pieces so For instance, you're seeing dimensions that speak to 18 and 18 and then 7 and 7 on either side. The 18 and 18 are the roadway. The seven is the sidewalk slash landscape area I'm assuming?

Commentthat was Andre SayerProposedself-stated1:31:31

I can speak to it so... Okay On the east side of the road, there's going to be a bioswale that kind of continues down towards Grand Avenue. And so we'd actually be improving that whole area down all the way to Grand with this bioswale. That's kind of matching what's there today. So instead of just adding floating sidewalks that lead to nowhere it kind of goes with the characteristics of the neighborhood already.

On the western side closer to the homes as of right now. That's Basically landscape right now as far as the way it's presented

UnidentifiedUnidentified speaker 2Proposed1:32:06

Okay My input I guess for street, I think the street design even because it's going nowhere. I think we really need to look at that and where the pedestrians go just from what I walked through the Arbolada all the time and there's plenty of room to have Some kind of pathway. I'm not, I'm not a fan of the hard curb gutter sidewalk at all It's not very Ojai But I am very into pedestrian safety and a lot of our streets and even Aliso You know They there's not very good Pedestrian safety zones where you can walk a path from signal to foothill say so When we're looking at new streets of any kind, whether they go nowhere or not, I think we need to be cognizant of that, of the pedestrian experience on the road and accommodate that so it doesn't turn into an arbaleta situation where people plant right to the edge of the road.

You know, we do need to have... The people in the northern parcel need to walk to town So I don't know. I mean, I think it is good to do case by case like you're saying each application is different but I do think that is something that needs to be discussed or at least highlighted and talked about what are we trying to get out of the street?

Commentthat was Andre SayerProposedself-stated1:33:38

We can look into that for sure as far as it would make more sense on the west side where the houses are being proposed. And I know it seems like it leads nowhere, you could treat this as a cul-de-sac is the way that this is essentially functioning so yeah pedestrians would have nowhere to go if we keep going north but that would be the case with like a standard cul- de-sac

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.801:33:57

So I have a question for the engineer that put the plans together. I'm seeing the hammerhead that's there, and then I'm also seeing the cul-de-sac that's there. The line itself would typically identify a raised curb. Is there no raised curb?

Commentthat was Andre SayerProposedself-stated1:34:11

No it would be a rolled curb.

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.801:34:13

Okay so rolled

Commentthat was Andre SayerProposedself-stated1:34:14

curb. And DG in the areas that are not specifically paved with asphalt.

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.801:34:19

Okay, so the seven feet that we're seeing there is the DG that we're talking about?

UnidentifiedUnidentified speaker 2Proposed1:34:23

Well, that's good. Because if it's a rolled curb and then seven feet of DG That's a safety zone as long as it's not planted

Commentthat was Andre SayerProposedself-stated1:34:36

Well actually right now the whole area is yeah either landscape or but it would not be like flowerbeds or things anything like that or DG alternatively If that's something that would be preferred We haven't gotten into that level of detail. We're just at the tentative map stage, but absolutely something that can be considered and that could be a condition of approval as well.

UnidentifiedUnidentified speaker 2Proposed1:35:00

And then also this may be for staff. Do we have an undergrounding policy? For new for Because this is a subdivision correct. There's a nexus

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.801:35:10

there is it yes, there's absolutely a subdivision Nexus for it and on top of that it is already written into our code bill. It's 10 title 10 Chapter 8 that specifically talks about all utilities being undergrounded

UnidentifiedUnidentified speaker 2Proposed1:35:26

Across the frontage, not just inside.

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.801:35:30

Correct. So it's including each of those parcels having undergrounding and then in addition to that you're looking at a right-of-way improvement and all of that being undergrounded as well? Correct.

Commentthat was Andre SayerProposedself-stated1:35:41

No overhead lines would be proposed.

1:35 – 1:4027 turns

UnidentifiedUnidentified speaker 1Proposed1:35:45

Have you all met with the neighbors and if so what's been the context of that conversation?

Commentthat was Andre SayerProposedself-stated1:35:51

No we have not met with the neighbors as far as this project goes.

UnidentifiedUnidentified speaker 1Proposed1:35:55

And then a couple of comments, the comment was made in the public comment portion that we need housing. And I would just point out that many people live here for the small town character of Ojai, and probably that statement would be pushed back on by as many people who would support it. And then I was just kind of looking at the numbers you know when you look at the numbers the question is who do we need housing for really in the end? That's an affordability issue But vacancy in the county in Ojai is 8.7, we're actually the highest vacancy in the county right now 5.9 is what Ventura County is showing and You know to me whether we need housing or not isn't the test here. The test here is code community and context.

We know there's some code issues it appears there hasn't been much on the community directly affecting it. The neighbors outreach we receive public comments from them they deserve to be heard Context pieces, we know now there can be up to four housing units on the road here. That's an important piece of the context to me.

GovCaptain Tyler AbbottPolice ChiefProposedvoiceprint 0.581:37:30

Well, it seems like from the discussion Lucas that we need more information

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.801:37:38

It seems that way so here's the Here's you could almost treat this like a concept review. It's it's not uncommon especially for projects That have a bigger impact to the community That there be an opportunity for questions to be raised We've done that for a number of affordable housing projects The questions are raised Staff goes back responds to those questions either we've responded to portions of them or there needs to be additional clarification Provided and then responded to in writing And then we bring that before you at a future meeting

UnidentifiedUnidentified speaker 2Proposed1:38:15

And one is an update to the traffic impact analysis. Or was it... Is that what it's called?

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.801:38:23

I think it was a traffic analysis that was prepared, not a...

UnidentifiedUnidentified speaker 2Proposed1:38:27

Not an impact analysis but it does the same thing because we really need to see... It said... I was looking at the distribution and it said 50% Going down grand and 50% down signal or something like that, but it didn't where are those trips going? So we need the regional distribution to look at and Then that I would like to go to the county transportation division for comment

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.801:39:00

Understood So I would ask for a motion.

GovCaptain Tyler AbbottPolice ChiefProposedvoiceprint 0.581:39:11

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.801:39:57

If we could do a date certain, that would be helpful. And I would push it to the first meeting in December which would give us enough time to... Okay, future agenda items. Is there a report?

GovLucas SeibertCommunity Development DirectorProposedvoiceprint 0.801:42:19

Yeah, so if you turn your attention to our future agenda items we have We do have items scheduled for November 4th, which we are next regularly scheduled Planning Commission as well as the 18th And then it is likely that we just heard that there would be another item scheduled for the second. So we'll likely have a planning commission meeting on December 2nd as well looking forward So I'm not asking for any meetings in the near term to be canceled. Instead we've got items, we've got work to do here so it's exciting to work through some of these pieces and get more detail. The December 4th meeting you're seeing a DRP at 923 East Ojai which is the Wildflower Hotel You've already seen that as a concept review. You're going to see that in more formal fashion, and then you'll also see the return of Ojai Roots as we've been working with both the property, the business owner, as well as the surrounding community.

So we'll have a report out for that and then looking forward to that conversation. The third one that I'm seeing here is a DRP for 402 Bryant Street, which is Humane Society. I just spoke to them this morning. They are not going to be ready until the 18th so that item is actually more formalized for the 18th versus the 4th. Which then has if we turn our attention to the 18 Two items for consideration one is it's referred to as a DE but really it's being pushed to this body for Consideration so it really kind of functions more as a DRP or design review permit for 905 Country Club Road It's the Ojai Valley Inn and Spa And then you're looking also at 325 Bryant Street, a 38 unit residential apartment on a vacant lot. It is a concept review so we're looking for comments from this body and it is in the M1 Manufacturing Zoning District.

That's as far as I can go on that. There'll be more information on that when it comes forward as a concept review. No decisions with the concept review, just public input and then comments.

So everybody's logging in and you can certainly ask questions as it relates to it so it's going to be a wonderful opportunity We've had conversations regarding ABC rules and regulations.

I recently attended the APA conference, and there was a couple of seminars that spoke to ABC rules and regulations and how they can either help or hurt communities. So it was kind of an interesting dialogue. I think you can expect something very similar because these representatives are coming out of Riverside, and Riverside certainly has some very unique ways in which to handle ABC regulations.

So that will be heard before City Council in the near term and Then the second one was one that just came in today and that is an appeal for 312 Aliso which is the cottages so that was that phasing piece that just came in today So that will also be forwarded to City Council for final determination

I had to leave before the meeting was finished, so I'm not sure where they landed on the AutoZone but in terms of permitting and use and everything there was really no real issue there. A lot of community comments on how they wanted the project to evolve which was around signage A little bit around parking, drainage, people working in the parking lot on their cars and things like that. But in general it's a C1 zone and two sides of the table. People wanted the 12 jobs that it would bring to town or people felt like it would be an eyesore because of the size of the exterior sign.

Thank you, Brad. Okay and next we have our City Council liaison report with Mr. Whitman

ElectedAndrew WhitmanCouncilmemberProposedvoiceprint 0.781:49:28

I was going to just report about the MAC and then I did it during your item. So, I will add to what Mr. Stewart said as far as what happened in front of the MAC because the additional issue above and beyond whether the AutoZone was appropriate for that location and how it should be adopted was the fact that They did not, they had difficulty complying with a peak hour traffic calculation for 7am to 9am in the morning.

And so their solution It was brought forward by the AutoZone as opposed to the county Was to propose an amendment to that general plan Concept To just exempt commercial properties. There are something like 200 Lots throughout the unincorporated area that would now be subject to a much lower consideration of how traffic would impact the area. I made the comment as a resident, not as a city council member that People in the city of Ojai have a very heightened concern that when we have a fire and we are attempting to evacuate, and we're operating under orders of the county as to how we do that.

That we're not gonna be allowed to leave because there's too much traffic creating a dangerous situation. So one of the phases of the evacuation Process is they have the discretion to say there's too many cars on the road. It's creating a danger Shelter in place get in your house lock up your house and wait for further instructions
