Mr. Medina the floor is yours. Good evening council members. My name is Ramiro Medina, I'm a recent graduate of the Oxnard EMS Corps Cohort 3. And proud to be from Oxnard, born and raised here in Oxnard and still currently live here in Oxnard. Growing up in my community I saw firsthand how important emergency medical services are and the positive impact our first responders have on people's lives and this motivated me to pursue a career in EMS.

I came across EMS Corps during my search and it's been the best decision I've ever made Being from Oxnard, you know we have a sense of pride being from the city and having a program like this has been extremely beneficial from the incredible staff. The Oxnard Fire Department and all those involved, and all the valuable knowledge and hands-on skills. And the confidence I've gained through the program has been extremely rewarding. And like I said, I'm from Oxnard and just being someone from Oxnard, I am grateful to have the opportunity to learn from these professionals here from Oxnard and hopefully one day take these skills and hopefully serve the community the same way they do.

And I just want to thank everyone here. That's all I have.

Good evening City Council, staff, members of the audience and people who are listening to this meeting. I'm speaking regarding my opposition to the proposed sales tax. The sales tax is basically a renewal at an appropriate time of measure O. This is a sales tax continuance. Despite the language in this measure, it's still a general sales tax. The city manager will be able to spend the money any way he wants to.

Even though the language specifies that all we're going to use is public safety, we're going to use it for a number of items but at the end of day, it really just comes down to the fact that the city manager can spend the money anyway he wants. A large portion may be going to public safety Public safety we do need, but public safety has headcount percentage of 39% of total head count of city employees.

But public safety still takes 50 percent in the budget. Perhaps a reallocation of funds might make an adjustment more satisfactory to me The fact that a large percentage of general funds being used by public safety and spending use for other things like street repairs and park repair. The continuation of the sales tax should be avoided. The city has had a significant increase in sales tax already, so last proposition and additional sales tax should not be presented. The purpose of Measure O initially was to provide funding for one-time projects such as swimming pool.

The swimming pool has not been built, the other one-time projects have not been built and we have other needs such as the seawalls and there's no funding set aside for seawalls so I suggest that if the City Council wants a sales tax it should be passed by two thirds majority with a specific purpose of that sales tax, not a general sales tax Again, the City Council has this discretionary to say that the budget should not be allocated all by a city manager at his discretion at the budget hearing meeting. The City Council can say look we want our say at their meetings and not give it to the city manager to appropriate any way he wants to.

Perhaps budgets be separated between headcount allocations and general funding allocations for administrative costs and overhead That does not take place in the budget, has not taken place in the budget last 30 years. Perhaps it's time for a change. Again I speak against the sales tax initiative. Thank you very much.

Good evening, my name is Joseph Tabinsky Jr., I'm a resident of Camarillo, I'm also the 805 UndocuFund Rapid Response Organizer for Ventura County and I spend my mornings outside of the ICE field office tracking ICE activity and just this morning I had a far right chud who supports what ICE is doing repeatedly refer to me as the homophobic F-slur. It might've been something I wore today.

The numbers for the last month have been brutal for Oxnard. In the 805 area code, 2,249 people at least have been abducted. Ventura County has seen 1,081 of those at least and in Oxnard we have gone up to 226. The last two months have been particularly hard in Lemonwood, Cuesta, Colonia and other parts throughout Oxnard. Thankfully both rapid response networks are out there every morning uh, making sure ICE is playing by the rules that they're supposed to be playing by and if not making sure that people know about it.

Um what I do want to talk about though are some of the systemic concerns that the undocumented community faces right now and in two very particular ways. Uh one has to do with the DUI checkpoints that are happening right now and the second has to do with fears of calling 911. Uh regarding the DUI checkpoints Everyone knows that ICE is not at those checkpoints. They know that OPD is not working with ICE, that's not the problem. The problem is the system that exists because if anybody does get picked up through a DUI checkpoint they're going to go to jail and the minute they are released from jail ICE will know that they're being released from jail using the public website and they'll probably be picked up I don't have a solution to that problem, but it is a problem out there.

The same goes for their unwillingness to call 911. Previously we had been told by other officials that we are actively telling people not to call 911 and that is not the case in either rapid response network. What we are doing is feeding these concerns back to folks because they know if they call 911 and somebody that's involved pops a warrant or does something that requires them to go to jail, they may be picked up the very next day by ICE. And so with those systemic concerns it's never ever going to have the trust put back in law enforcement especially with our folks going to the county jail afterwards and then being picked up because the sheriff has no concern at all with ICE being in there virtually every day to pick people up as they're being released The last thing I'd like to ask the City Council about, it refers to an incident that happened this morning near El Rio out by the Vallarta.

There was a law enforcement training that took place that involved cars speeding through places, folks with automatic weapons and flak jackets. And we did not see it. We saw a sign that was about maybe this big that said police training happening here but nobody knew about it ahead of time. I would ask just for like DUI notifications when you let us know that something like that's happening. We would also like to know about any particular police trainings that are happening in the city so we can curb The fear that people feel in this community and rightfully so. Thank you.

That's a group. It's more than one. Three is more than one. On June 16th, I appeared before the body to comment on the LMD assessments. Recall that for my LMD our assessments increased a whopping 224%. If percentages mean nothing to you The 224% means the assessment more than tripled compared to last year's. And why is this? Why it is, it's beyond me. Notwithstanding following my comments a member of the city staff belittled and denigrated me, my character which I don't appreciate and I believe it's inappropriate for a member of the city staff to do so.

Comments were made that I was either negligent or perhaps even ignorant for not properly researching my property prior to purchase. Well, let's face it, the LMD assessments are nothing like HOA dues when a purchaser of used properties provided a four-inch thick ring binder containing all the CC&Rs have been in HOA. Alternately, the LMD assessments are like a ghost fee that appears on your property tax bill. If you don't look at it, you don't even know what's there.

Realtors don't mention the LMD assessment and I seriously doubt if they even know they exist. My realtor didn't mention it As a matter of fact, I've spoken to several original owners in my community and even they said that the Centex rep, Centext was the builder of that whole community. Never mentioned LMD assessments prior to them purchasing their properties. And other non-original owners in my community don't know what an LMD is either. It was also mentioned that if I knew the property was in an LMD why did I buy it? But just as I mentioned, I did not know.

I had some pictures to show, probably not going to have time now of the area in my LMD maintenance district. There was a median on Bahia that is just filthy, weeds, trash. I got an email here from the Public Works Director saying the irrigation to the median comes from private property, Topper Shopping Center. In the past, the city has not been responsible for routine maintenance for the median landscape in the past.

Now, I find it strange that the landscaping and the bushes and everything in that poppers area are all beautiful, maintained green. And here's this one spot that they don't care about. There's something strange going on there. Then on Caliente, there's no watering. It's been dead for months and months and months according to that email from the public works director. So as a district had a couple of back flows stolen these past few months Thank you.

Previous time I did work with you Mr. Blattell when I was presiding when you had virtual people who signed up to give you their time if we had a large group here who was willing to give you your time we would accept that. Last time I think we gave you five people If you had two additional people to give you time tonight, I can see that but we'll have to revisit as a council what seating time looks like to people. But just to be fair, I'm gonna give you your three minutes that you took so thank you very much.

What a joke this is becoming please play the video Eric Andrus, Public Advocate. Tonight I want to address a pattern the City Attorney's Office giving this Council incorrect advice on public comment and this Council deferring to it even when that advice creates legal exposure for the city. Stephen Fisher has told this Council the public does not get to comment on each agenda item. That is wrong and the proof is in Oxnard's own ordinances. In 2018, this council unanimously adopted the Sunshine Ordinance 2948 and Fisher signed it. Section 2-230C says every action item must give the public a chance to address this body before action is taken. And yet we have watched Fisher passive aggressively reprimand the mayor for allowing exactly that. That is the city attorney contradicting an ordinance he signed.

Measure M goes further, three minutes to comment on any agenda item, not just voting items. Now look at tonight's agenda. It promises comment after each item is announced and Section 2-230E requires staff reports come before comment yet comment on the City Manager's report and the Council reports is shoved into Item G before either report is given. That is not an accident It is the City Attorney's Office using procedure to stop the public from responding to what the city manager and this council actually says in defiance of the agenda's own rules and the ordinance Fisher himself signed. So let me be clear, when this council reports tonight I intend to comment if I am refused the violation I am describing will have happened on camera against the rule printed on your own agenda.

This is not the only barrier. When I submit a video comment, I am told I must appear in person on Zoom or by phone to introduce it. That appears nowhere in the code. Section 2-1.5c says the opposite. Reasonable accommodations shall be made to facilitate videos during public comment. I identified myself, submitted the video, treated my email as my speaker card and provided the written copy. The city attorney's office added a condition the code does not contain. That is not facilitation it is obstruction. This is bigger than me. The Santa Barbara County grand jury just warned that agencies create barriers when they make people believe speaker cards are required before they can speak. Oxnard is doing exactly that and the mayor has been warned about this.

Council members, this is your meeting. Staff advises you staff does not own the public's right to participate when the City Attorney's Office narrows comment blocks videos with unwritten conditions and stops residents from responding to reports that does not protect you it exposes you You may not like my style, but style is not the issue. The issue is whether Oxnard will follow its own open meeting laws. Right now on camera your own ordinances are being hollowed out by the city attorney's office and this council is allowing it. Okay

Because they can't defend his record, are they now trying to weaponize inapplicable election laws? For what? To try and chill free speech? To intimidate everyday neighbors into submission?

Well, that was interesting. Mr. Herrera is sounding more and more desperate and trying to use this council's meetings to run a recall effort but now he's just gone to making things up. Pretending that he's some kind of victim and this is a very convoluted plot that he's concocted. He doxed us in a post on his own Facebook account with 21,000 readers in an angry post about us and shortly after I had a freshly swept driveway and a nail appeared in curious place in my driveway that's never happened before. Luckily I spotted it before I ran over it and destroyed a tire We've had several meritless complaints filed against us. He's only had one, you know and these are all anonymous as well.

AI videos, Aaron has never made an AI video so I don't know why he's connecting Aaron with that. He mentioned an alleged coordinated effort to get him suspended on next door and I don't know what that is either. I argue back with him on next door, that's how I handle him. At the last council meeting he played a video in which it showed a document when Aaron described his personal notes during council meeting as being on a document on his local hard drive not shared with anyone. The video went on to falsely allege, oh well it's probably a Google Doc and he is using it to communicate with Alicia during meeting. False.

Just false. Mr. Herrera has on Facebook and some of the recall proponents are telling people it's Aaron's fault the sports park hasn't been built at the corner of Gonzales and Oxnard Boulevard Falls, that's a 30-year project that has been sitting there for 30 years You know, not being fulfilled to the West Village residents. A promise not fulfilled. When I play games on my phone sitting in council meetings or I text other people Other friends that I have, you know Aaron's not the only person I talked to. Mr. Perrello claimed oh I'm texting Aaron all through the meeting no false false guys. You're making assumptions and flinging accusations based on meritless assumptions so this is what we get.

I think it's really a distraction. I think a lot of people in Oxnard are really getting tired of this sideshow And I think that this use of the recall is inappropriate.

There is an appropriate use of a recall, and basically recalls are just to get rid of bad apples. And Mr. Starr was elected. He was elected by the voters of District 3, and he's been representing them to the best of his ability. He comes prepared. Now people may not like his stance, they may not agree with this philosophy but that's okay I mean i think that's the way our system is supposed to work we're supposed to hash through disagreements to get to the ultimate goal and the ultimate goal is for you all on the dais to legislate in the best interest of the residents And I think it's unfortunate that we've got to go through this process, that I think is very inappropriate.

I think it is led by Mr. Herrera and his hatred of Mr. Starr. It's extremely unfortunate. I think a lot of our time would be better spent dealing with the issues that Oxnard deals with. Now what's achieved by this? He is a minority vote on many votes. You all are getting your way. It's my understanding is actually a sitting council person that's been out with the crew for the recall effort. I know that's inappropriate, and I don't think that's a good look for Oxnard. I think if you have a disagreement with any Councilman or concern go to that Councilman and voice your concerns but don't waste We're going to The way that they at times don't follow the rules, it's actually Mr. Starr who is holding them accountable to do a better job with our money and to give better services.

Some of you remember this because I put it on the record back in April. On Easter Sunday at six in the morning Councilman Bert Perello took the special use permit letter I had sent to this council and forwarded it to City Manager Alex Nguyen, to City Attorneys Stephen Fischer and Kenneth Rozelle, to a Planning Commissioner who would later have to rule on it, and to neighbors who he knew could be problematic.

A permit application gift wrapped for known problem causers before the city had even responded to it. I thought that was a one-time stunt, it wasn't. It looks like it's a habit for him to be seen taking down people who hold the city accountable. On January 23rd at 6.16 in the morning, Perello took a post I had written on Nextdoor, a neighborhood social media website and forwarded it to Jeff Pingilly copying Kenneth Rozelle, Stephen Fisher, Ashley Golden and Alex Nguyen.

Here is what that post was. I was asking my neighbors whether anyone knew a draftsperson who could help me because the person who drew my blueprints had flaked out and helped delay my permit over 800 days. I wrote that I was hemorrhaging money and going broke. I was a resident asking other residents for help. I wasn't asking the city for anything. And before 630 that morning, a sitting councilman had packaged it up and delivered it to people he knows choose to make my life more difficult. Not helped me, none of them lifted a finger.

Apparently Burt Parello had time at 6 in the morning to take a resident's social media post and route it to known provocateurs. But no time to actually help that resident. He wasn't doing his job, he was building a file on me. He's never once contacted me to talk about my side of things. All he does is try to stir up trouble, and I'm calling for him to be dismissed from his position. How much more is this city required to put up from him?

Bert Perella won't tell you about this himself so I will. I found out through a public record request, which is where I'm unearthing a treasure trove of scandal and corruption in the city. Which explains exactly why they want to shut me up with an illegal communication plan that the City Council knew nothing about and didn't approve. But this is the kind of high school gossip on the part of Bert Pirello that is not acceptable for a sitting councilman. He needs to be removed and at the very least reprimanded. Consider this my official complaint, City Manager."

And the last comment that I'll be making is that I will be reaching out to all of our neighborhood council chairs in District 6 to kick off our quarterly meetings again. I know that was something that many of the chairs are interested in and it's just a great way to connect What's happening at the council level with what's happening right in the district, in the neighborhoods. The individual making the presentation does an excellent job of bombarding our staff claiming we're going after them. He didn't tell the city that his contractor is the one that ate him up And he didn't explain that he had stated falsehoods, that it was our staff.

First of all, I'd just like to, on a personal note, I would like to say thank you to my awesome wife for bringing iced tea to the meeting. Apparently the caller's mistaken. She's not my mother. My mother is 89 years old and living in Mission Viejo and she has never participated in a council meeting at all. I also attended the groundbreaking ceremony for Campus Park, 30 years in the making.

Very thankful for the grants we received to make this possible. So we have some really competent staff who's been able to pull that off and I'm appreciative that the local taxpayers are not having to pay for them. I attended the La Colonia Neighborhood Council meeting. At that time there was a Sunkist Project Community Workshop presentation And I believe that at no fault of the city or the neighborhood council, by the way. The agreed upon venue was yanked at the last minute so the meeting was moved to an outdoor location without microphones. It wasn't conducive to hearing a presentation. I think staff in good faith tried to come up with something that would work and while the intentions were good it just didn't work out I think. People felt they were being disrespected I don't blame them for drawing that inference.

As a city, I felt like we disappointed folks and I'm certain that this will be handled better at a future workshop which the applicant has agreed to be part of. I do request that we provide an indoor facility to handle this Perhaps even in the council chambers, so that way the large number of people that wanted to make statements and hear what the project was all about can participate. Not in a baseball stadium in the cold without any sound system or interpreters. It just did not work.

One last thing, I guess there's a real avid pickleball community out there because I was approached by one gentleman who was complaining that there are no pickleball courts in Oxnard. We have lots of tennis courts and he is suggesting that perhaps we should look into converting a tennis court into a pickleball court or two. You know, I don't know anything about pickleball myself. I've never played it but apparently there's some real avid participants in the sport so perhaps the staff can look into that.

This gentleman suggested that Rio Lindo Park has a tennis court. I think it's one of four parks that have tennis courts in our city and he thinks that would be an appropriate one to convert into pickleball courts so that's something hopefully that staff can look into and think about. Especially folks who many times feel silenced by their circumstances, so she's been outstanding with being responsive and working with the tenants there who have had concerns. All right, thank you all very much. Just some quick updates here. I want to thank our Public Works team for hosting the Oxnard Youth Academy last week. They were able to tour three facilities and see firsthand what some of our public works employees do and how they make this sometimes unseen piece of the parts of the city run and run well. So thank you Mr. Wolfe and my thanks to your team for hosting And I also attended the Colonial Neighborhood Council slash community workshop last week. And thank you, Councillor Starr for your comments. I would echo those as far as the logistics for the evening.

I also don't believe there was any malintent in that but it's just something that it didn't work. And we fell short on that. And I appreciate that Mr. Pangeli's team has recognized that and is looking forward to having the next meeting be much more productive in something that will be productive for the community workshop. So thank you for that. And I also attended the Campus Park groundbreaking, and I appreciate all of the work that went into putting that morning together from our Again, from our public works folks and our communications team city manager's office as well.

And it was a momentous occasion and it was great to see so many members of the public there. And for anyone who wasn't able to be there. I did. Ask people, raise your hand if you attended this school when it was a high school. And it was so great to see so many hands go up and see so many folks who have fond memories of walking through those hallways and generations of folks went through that school and now generations of folks will enjoy as a park upon its completion. So thank you again to all of our team who worked to put those grants together and the community members who worked with them and the Friends of Campus Park in everyone's role in that.

I also attended the Polluter's Pay Town Hall hosted by Seafrog. I thank them for choosing Oxnard as one of their venues in their statewide tour, and my last item here is just a reminder for everyone that this Friday, July 3rd, the mayor and the city is hosting a family night event. It will be Star Stripes & Sounds at Plaza Park, and you can come out, hear some music, get some food, be able to have some fun activities for youth And it'll just be a great community event. So that'll be from 3 p.m. to 9 p. m. on that. Am I correct on that for our team? It's not nine thirty, right? Three to nine.

If you come at nine thirty and nobody is there then I was right. All right. The following morning July 4th we will have a speaking event at Plaza Park similar to the Veterans Day and Memorial Day in the same location. We will have three speakers starting at 11 a.m.. And we will have three generations of speakers of Oxnard residents. Someone who recently graduated from high school, somebody who is in the middle of their career and then somebody who is a retired veteran. They'll be sharing about their experiences in growing up in Oxnard, their family coming here or they coming here with their families and the opportunities that were afforded to them by this community and by this nation. And so I hope that everyone will come out to hear those great stories and folks who are from differing ages and generations but I'm sure Any of us can see ourselves or people we know in any of those stories.

To me that's a no brainer But I know that a lot of times we look at the worst outcomes, like why do we need school resource officers and that. So I just want to speak from my heart a little bit. When I was in school, I was a wild child and I was out of control We did not have school resource officers. They had campus staff that would do their best to kind of regulate us, and the amount of time that they spent talking to me was just incredible.

And the little bit I know about school resource officers, it is way more than just the what if of something drastic happening. It is the input and the impression that these officers make on young people. Relationships that are built. And it is safety, it is nice to know that someone has your back and years ago when EO Green happened the police department was so vital in the way they handled that.

So I'm just saying all this because I hope we don't micromanage here And we really look at how important our young people are, how important our teachers are, how important our community is because these relationships that these officers build and the time they put in goes way beyond what you might imagine. So please consider that.

I was reading on page 57 talking about what the eligible service population is for the meals that are concrete meals and those that are delivered. Older individuals with LEP, I think that's limited English proficiency, and older individuals residing in rural areas. It's just strange to me that the federal government is dictating that we I guess decide who gets a meal based on the color of their skin. I did a little bit of research on this based on what we have is we have responded to schools 719 times during the last school year. That being said, the Oxnard High School districts they all have a full-time officer that works at each high school and then we have two for the Oxnard School District and one full time for the Wene'mu Elementary School District. A significant portion of the school resource officers work involves relationship building, mentoring, problem solving threat assessment and early intervention with students, staff and families. Much of that work is preventative in nature and often results in issues being resolved before they escalate into police incidents.

And I think even prior to being on the council have had the opportunity to enter the Juvenile Justice Center here in Oxnard and have witnessed and interacted in seeing young people. And in that facility for a variety of different reasons. And I've also, I appreciate the comment that was made I'm referencing EO Green Junior High because I also was a student there when that shooting took place.

So, I know a lot of that comes to mind for me in making a decision like this but I think for me I will be voting no tonight just because I think there are other opportunities and I know that there are many communities out there right now looking at other I know the city has done a great job. I want to give credit to a lot of the staff that continues to do that mentorship, to just keep young people in opportunities that are going to allow them to explore leadership and career opportunities. And that's exactly the kind of model and approach that I have from a values-wise. So it's not to say especially as somebody who experienced gun violence and shootings within our community I just think about the young 5 to 10-year-olds and above who will have, you know.

I think that there's other alternatives in place and other models that work very well. And so tonight just wanted to be very transparent with the dais that I'll be voting no on this item.

So currently the Capital Improvement Program project is looking at 18 months or 24 months per fire station for construction. And so the current plan right now as proposed is that facility would be used in series, one of the fire stations whichever one goes first, let's say number two goes first, that temporary facilities would be used and then they would move back into the new facility and then the other fire station number three Okay, and do we have a ballpark estimate as to the cost of replacing the fire station or is that just something that we don't know at this time?

So our current estimate for one fire station is about 30 to $35 million per fire station. And inside that cost are those kinds of soft costs or those kinds of logistical costs associated with temporary housing, construction management permitting so all those costs are currently folded into that current estimate. There also isn't contingency because we're so far out from I mean We've only got so far through the design phase that we typically include, you know a 25% construction contingency on the numbers now because we don't have the details yet.

But all those costs are included in that estimate. Okay

that? This is somewhat unusual but because the city is the applicant I'll be doing part of the presentation and then Jeff Katz from the architectural firm will be doing the second half. Diego if we can have the slides Very briefly, we will keep this under 15 minutes but I just wanted to acknowledge that this is a land use item before you for Fire Station 3. Ultimately there's two fire stations moving forward in parallel and just because over the last 2024 we did a lot of neighbourhood councils for the areas that were going to benefit from the reconstruction of these fire stations And so I just wanted to touch on Fire Station 2 very briefly, but this presentation is primarily on Fire Station 3.

So I just wanted to start out showing you the spread of our fires, the geographic spread of our fire stations. Both Stations 2 or Station 3 sort of in the centre of the city, Station 2 is in the south. Those different colours represent Essentially the residents of those stations serve, it's sort of a loose boundary because we use closest resource to determine who is going to go to the call.

But very briefly Fire Station 2 was built in 1965 at a time when Oxnard had a population of around 40,000 people. That station now serves approximately 35,000 people to give you a little bit of context. So Station 2 and again that's not the agenda item today before you but Station 2, essentially we're going to take it from where it currently has one and a half apparatus bays. It will expand to three apparatus bays. It'll be a two-story station that can go from housing, currently can house four personnel and after reconstruction, it can accommodate 10 personnel so it'd be a much larger station.

All of these slides came from the neighbourhood neighbourhood council presentations that we did throughout 2024. But you can see there how our population has grown in the city and because we're sort of hemmed in, in terms of boundaries, we will likely only need one more fire station in the foreseeable future. Really what we need now is to build the capacity to be able to host more resources in our existing stations And so that's part of the goal here is to be able to host more resources where we have existing stations.

So Fire Station 3, this is what the item that's before you tonight. Built in 1954 it's the oldest station that we have in Oxnard. I don't know this for a fact but I'm almost certain it's also the smallest station in the county at around 3200 square feet. Again, you can see here similar to Station 2 we're going to take it from two apparatus bays to three. So again, we can have more response equipment functioning out of that station and will also be able to host more personnel in that station.

These are just some of the photos of the current condition of the station. You can see there we actually have exercise equipment beside where our engines are parked That is not a best practice for the health and safety of our firefighters. Firefighters are more likely to be diagnosed with cancer and more likely to die from cancer. One of the reasons for that is the diesel engines, these engines that is a standard in the fire service. A couple other issues we have with this station being so old you can see there they've had seismic retrofitting done to try and make them safer The front of the station is not big enough to pull the apparatus out in front to do testing and those kinds of things, it ends up blocking the sidewalk. So there's some of the things we're looking to address as a part of this process.

See there where back in the Northridge quake there were issues around apparatus getting out of the stations to go to respond to calls Other photos from inside the station you can see there, our personal protective equipment is not adequately protected. So one of the things that in this new design, the personal protective equipment actually would live in a separate room when it's not being used and when it's not being placed on the rig.

And then other issues that we have in this station is all our personnel sleep behind So they all sleep in a common space, which there is some level of camaraderie with being able to listen to the noises that your co-workers make in the middle of the night. But I would tell you that it's not adequate for modern fire service and so being able to get adequate sleep when they can is critically important. And then obviously being able to modernise some of their facilities that you can see And so these, again, are just images of the small cramp space. So where the captain will do reports after incidents, where folks study or answer emails, watch TV and eat dinner are all in that same one space which again is very communal living and I spent a lot of time working at this station earlier in my career and loved it but it really isn't up to modern standards.

So really the goal behind the reconstruction of Fire Station 3 is to ensure that we have a station that can meet requirements and the needs of our community in terms of being able to add additional response resources. Right now, if we wanted to add resources, we couldn't because we just don't have the space. The other thing too is this station will be designed in such a way that if in the future all electric fire engines, the technology gets to a point where we'd like to take a look at doing that there'll be room for that infrastructure within the design of the station.

Additionally, that station is so old we've had to do electrical upgrades over the years but we're increasingly seeing that fire departments have been having fires in their fire stations that are generally electrical in nature because the electrical draw on modern fire equipment is so extensive for older infrastructure. So that's one of the other things we're looking to address.

In addition obviously the modern earthquake standards which we already talked about And then perhaps most importantly at all, to better protect the health and well-being of our workforce that we are working to diversify. So with that I'd like to pass the microphone over to Jeff Katz and he can just discuss the design a little bit further.

We've been working Quite a while now with city staff and fire department on the design of these stations. So excited to be here tonight to present this to you as chief said, we're primarily here tonight talk about station three just very quickly with station two. We are progressing that design as well can see much larger station taking up much more of the site to accommodate both staff parking as well Station requirements. This is a three-day drive through station.

Most of the design has been focused around operational improvements for the department in terms of responsiveness, as well as health and wellness for the firefighters who are living and working out at this station. So this is a two story station, clear separation of living and work functions within the design. So moving on to station three, again very small station currently sitting on a portion of the site that runs between the alley and Hill Street.

Here you see the proposed design much larger station and as well as accommodating the parking here we've done extensive studies to make sure that fire apparatus can make the turn from the alley into the site to have that drive-through capability Two of the bays will be drive-through with one of the bays being back in bay. Again, the station is designed as a two story facility on the plan left side you see that turnouts that personal protective equipment that Chief mentioned earlier and area for decontamination of that equipment when they return from a call. The right side plan right side is the living quarters the station and then on the second floor We have all of the bunk rooms and restrooms to support staff with access directly down to the ground floor to allow them to respond promptly out to the apparatus bay.

So, the station incorporates a variety of materials from cast-in-place concrete for the apparatus bay, stucco and then some accent tile elements on the station as well. And this is a representation of some of the colors and materials that are being used in the station. So with that, I'm here to answer any additional questions you may have about the design of the project.

I am in favor of this proposal especially when considering that we're allowing allocation and room for future growth for ALS and BLS services. I'm happy that the staff talked about Fire Station 2 to a certain extent how again they are going to have ALS and BLS services in that potential area This project was presented to you by our Community Development Department, not by Fire Department.

The Community Development Department received fees for Fire Station 9. Those fees were served or paid for the development of East Village and West Village. The City received money charged by Development Services for Fire Station 9. We heard earlier in this presentation that there's going to be a need for another fire station There's been no discussion on the construction of Fire Station 9, even though it is part of the 10-year strategic plan introduced in 2005. When Fire Station 9 was presented Before City Council, the fire department said we'll have adequate safety for our houses. And that's correct. Our houses become more safe but we still have people living in those houses and need to have ALS and BLS services.

This East Village of Bushville are not receiving the same level of ADL and BL services the rest of the city receives. So as we consider this item and going to approve Fire Station 3, I'd like you to bring back as a future agenda item as a status and funding for Fire Station 9 because the people in East Village and West Village have not been adequately served. Supposedly we have one more fire station, one more personnel person for a fire station that addresses the area but not new fire station.

Fire station 12, I'm sorry fire station 8 costs initially $12 million to the lease program eventually costing us $24 million. These fire stations are going to cost a whole lot more so again as we approve this project I'd like to hear some sort of discussion this fall as the construction of fire station 9 thank you very much for your time.

As Mr. Steinwell knows, and he and I have had this discussion quite often, Easton West Village, a fire chief at that time made a determination because the homes would be constructed with indoor sprinklers that there was no need for the fire station. That came from the fire chief at the time. What was never addressed and is in the record still of the planning commissions of that meeting was the fact if the emergency response times were not adequate for individual having a heart attack in those neighborhoods, what would be the issue with respect to the city?

And Mr. Stein you and I have gone around about this back and forth. The proposal for Fire Station 9 in some other area that has come up. That's and I appreciate you bringing that up. I also appreciate you bringing up the fact of how the money went from Fire Station 8 increased and the expectation that this will also increase, which gets back to my issue about whether an individual has a belief that a bond should always go to a vote of the people.

The individual has that belief and he can follow through with that belief. My point in an earlier part of this discussion was that individual pushed the issue to the courts and he lost But he cost and injured the residents of this city a tremendous amount because of the loss of money, because of the interest rates we could have taken. The individual fellow councilman does not want to see that.

I'm somewhat concerned by the fact that staff disclosed all the information necessary to auditors, to perform an audit because this is new auditing. For example, over two months ago, I submitted a public record request to see two schedules. One schedule I asked for was to see the listing of properties available for resale The second listing of schedules I asked for was to see a listing of unfunded liabilities.

I made these requests approximately two months ago. Prior to me going to the hospital for a matter of two weeks, those documents had not been provided. So I'm wondering what other documents that the city has failed to provide the auditors? In the past, I've made public record requests to see balance sheets and detailed trial balances. In the past, under our current city manager, those documents were not provided.

I've made multiple requests at a period of about three or four years ago to see balance sheets and detailed trial balances. Only last year after spending two months of communication with City Attorney's Office, I started seeing detailed trial balances. Again, I'm somewhat concerned as to what information Our city staff is withheld from the auditors. Because the city staff has withheld public documents from me as a private citizen, what public documents are they withholding from our auditors?

So SB 707 requires one eligible legislative bodies which are defined as legislative bodies in cities in our case where the population exceeds 30 000 To one, allow for a two-way communication for our meetings. Not in person, i.e., Zoom. For us we've been doing that since COVID.

And then two, in the event of disruption of that system to take a brief recess and then attempt to restore the system and if that can't be done within an hour to come back out and make the requisite findings that hey we tried to restore the system it didn't happen. And then make a statement before the record about what those efforts are And then to continue on with the meeting. If the service disruption is dealt with within the hour, then you can come out and proceed with the meeting. That's just a brief overview. You all had a real world example of that at the last council meeting where you kind of just instinctively did it stopped paused fix the issue and came back out.

707 requires a specific process to be followed and certain findings to be made, and certain things to be put into the record by the clerk when that occurs. The time that the recess occurred, when you all came back down and reconvene as well as the efforts taken to deal with that disruption. Okay,

They can view it on their Frontier or Spectrum channels, or they can view it on YouTube, or they can join on Zoom and watch it and raise their hand using that function.

So if people are still watching from home then that's, you can continue. If there's a YouTube disruption where people couldn't watch from home but could still participate via Zoom certainly as a matter of policy you could still pause and try to deal with the issue but the legislation only pertains to a disruption as to that Zoom platform.
