Thank you and I have the The inspiration for tonight, so I have a couple of just a couple of topics. I just want to touch on but it'll be will be brief, I believe OK. So while late I just want to wish everyone a happy new year. This is our first meeting of 2026 so we're glad that you're with us here tonight. So the start of this new year invites reflection on where we have been, the renewed commitment to where we're going to go.

I believe Port Hueneme is a city defined by resilience diversity and a strong sense of community Over the past year, we have faced challenges together, celebrated milestones and continued working toward a city that is safe, inclusive and full of promise for all who call it home. In the year ahead, we remain committed to strengthening our neighborhoods, supporting our families and businesses and advancing initiatives that promote equity, sustainability and economic vitality.

Progress is achieved when we listen to one another, when we work collaboratively and remain focused on the common good. And I am grateful for the dedication of our residents – the City staff, first responders, volunteers and community partners who serve Port Hueneme with integrity and pride. Know that your engagement and civic spirit are the foundation of our city City's continued growth and success.

And now I know that we're gonna have a proclamation on today regarding Martin Luther King Jr., but we just celebrated the federal holiday yesterday, so I just wanna say a couple of words about that, about Dr. King and his words that he has left with us. So he reminded us that progress is not inevitable. It is achieved through purpose, unity, and action His call to service challenges us to look beyond our differences and work together to build communities rooted in dignity, equity and opportunity for all.

Advancement as Dr. King taught is not measured solely by individual success but by how we uplift one another and ensure that no one is left behind. Here in Port Hueneme, I see Dr. King's dream reflective in our diversity, our resilience and our shared responsibility to create a city where every resident feels valued, heard and empowered. Our progress is strongest when we choose collaboration over division, compassion over indifference and hope over fear.

As we reflect on Dr. King's legacy, let us recommit ourselves to advancing the ideals he championed – fairness, inclusion and service to humanity. May we continue to move forward together, strengthening our community and shaping a future worthy of the next generation. Let us not only remember Dr. King's words, but live them through our actions, our leadership and our unwavering belief that together we can build more just than a united Port Hueneme.

Hello, hello. Good afternoon, good evening city council members that was great introduction by the mayor. You know I'm mixed black white and Portuguese so you know to be a black business owner you know is something I'm proud of and chasing my dream that we do a lot of that is built into it Because of seeing a girl I'm also Irish, you know some Irish black and Portuguese so I've seen Whether you know my last name should be O'Branon And we're Branons because we couldn't get work because we were dirty Irish. We weren't allowed to get jobs So the work that I do it does stem from that You know knowing what that's like? So that's why we do a lot of inclusion and the work that we do but empowering people Realistically right and giving them realistic expectations at the American dream does still exist, right?

And that's what we should be thriving for and striving for. So today we're here though to invite you to check out that this is our blue carpet premiere. This is something new that we have our new TV show called Coastal Critters As you can see, they put me on a comic book with our coastal critters. Somebody made this for me today so I brought it but we just wanted to invite you. It's going to be at the Chinoa Islands Maritime Museum.

This is an art collaboration of video art and musicians that are local so you have a collaboration of artists working together. We partnered with the Oxnard Unified School District. We have a student here that's from Chinoa Islands with Upward Bound. and three other high schools, and we're giving them job placement. As you can see we have payroll stubs here like where we're in economic I think we have eight staff now know that we've grown from just taking kids out fishing so this particular event is going to showcase all of that the economic development that we have partnering with the Port of Hueneme and their speed program Their first jobs watching kids fill out their first job their first time sheet is something that you have to witness for yourself Just to see that process They're first, you know we offer them a lot of first.

Today I just left the Goodwill and they have a big poster up there one of the kids that we hired from Goodwill Industries that worked for us for a while until his hours ran out and how we're using those partnerships that you're talking about again in the community so this Blue Carpet premiere is going to highlight a bunch of that stuff So at the China Islands Maritime Museum, we have 20 VIP spots that are available. We're almost sold out. We could only fit 100 in there and we only have 11 tickets left. We invited city council members, educators a lot of different people not just kids and their families but they'll be there because the show that we're going to showcase them got to have kids there to make sure it doesn't suck you know what I'm saying if you know it's easy for us adults oh that's great but if the kids are booing it then we know it's not really hidden so Anyway, you're invited to come out.

Good evening Mayor and Council Members. Once again, I'm Johnny Garcia-Vazquez a former tenant of Park Madera Apartments here in Port Hueneme. Who was retaliatory and illegally influenced to move and vacate Park Madera. After I asserted my California tenant rights of reporting uninhabitable living conditions and safety issues to your code enforcement, which could be public record requested.

Like mold, mildew, termites, lights being off for days in the hallways even though the property manager lived in the same building as I. Two doors down who was also harassing me along with other tenants that were her friends and also I reported hate incidents and harassment to your local police department a couple times. I've tried calling them. Incident and call log reports, and yet your police department told me that they did not have the resources to dispatch anyone even though I was being harassed, threatened of physical harm.

There was hate speech used against me multiple times. And then also my ring camera caught the property manager which she's not there anymore. She was transferred to Ventura. to one of their apartment complexes that is managed by Gardner Management Limited. So I just wanted to come here in front of you, to correct some misinformation that was provided at the December meeting from some of you on the dais along with Park Madera Apartments and Gardner Management Limited.

The issue between me and Gardner Management Limited has not been adjudicated. The Civil Rights Department of the State of California which was a forum Formerly the California Department of Housing or Employment Rights has given me two years to sue and a case is still open with the housing rights center. And then if you guys don't have funds because you have a budget deficit, you can't pass an anti-landlord harassment ordinance maybe the city can provide Workshops on the California Ralph Act because there is a difference between hate incidents and hate crimes here in the state of California. I know some of your police officers have also told me that hate speech is protected, but in California if your civil rights are being violated which housing is civil rights it is not protected And then also if you guys can provide free tenant rights workshops and then if you guys would like a presenter for the California Ralph Act You guys can contact the Civil Rights Department They offer free workshops for staff members here on the dais and also the California your Police Department.

Okay, great. Thank you. So we have that recorded? Perfect. So with that let's move on to presentations. Our first presentation is the Martin Luther King committee is here to receive our proclamation and so while you come to the podium we have Council Member Gama is going to read that proclamation.

Thank you, Mayor Lejeune. I just want to say that yesterday was a very enlightening event as it always is and I think 40 years is a long time to stick with something and I really appreciate the fact that the county entire county was there we had people from Thousand Oaks Oxnard Hueneme Ventura elected officials County supervisors Our Council Mayor Pro Tem, Laura Hernandez. Mayor Lejean was in the choir and she knocked it out of the park so unfortunately I couldn't stay for the entire event. I had to get to Westlake for a meeting but I love the march. I love the participation of the kids and you do a fantastic job. So with that I'm going to read a proclamation for Martin Luther King Jr Day.

Whereas on January 15th, 1929 Reverend Dr. Martin Luther King Jr was born in Atlanta Georgia and whereas Dr. King was transformational leader of the American civil rights movement and one of the most influential orators for peace equality and human rights in world history Whereas Dr. King is remembered for dedicating his life to an unyielding faith and passion of justice and racial harmony by championing principles this nation was built upon, and a strong commitment to his belief of freedom, equality, and justice for all. And whereas Dr. King envisioned a society where individuals were not judged by the color of their skin, but by the contact of their character and that's a quote of Dr. King. And whereas Dr. King sacrificed his life to spread a message of universal equality and justice that was displayed by his efforts to end racial segregation and discrimination through civil disobedience and other nonviolent means such as his heroic leadership in the 1955 Montgomery bus boycott.

The 1957 Southern Christian Leadership Conference, the 1963 March on Washington and the Selma to Montgomery marches in 1965. And whereas Dr. King's words continue to resonate with the world today by reminding us of the imperative to continue to fight for justice and equality no matter the opposition because This is another quote, because the measure of a man is not where he stands in moments of comfort and convenience but where he stands at times of challenge and controversy. And whereas people throughout the world continue to be inspired by Dr. King's visions and words his strength of character and compassion and his model for peaceful demonstration and dialogue And whereas in 1983, Dr. King became the first private citizen to be honored with a federal holiday not just to celebrate his memory but also to preserve his legacy one that calls upon us all to exercise our moral authority stand up against injustice and protect our most sacred tenet of democracy Now, therefore be it proclaimed that the City Council of the city of Port Hueneme does hereby proclaim January 19th 2026 as Dr.

Good evening! I'm Loretta Ayers Montgomery and with me is Ms. Heidi Gayton. She's a Port Hueneme resident. And so we really thank you for this wonderful proclamation. Yesterday we had a wonderful day celebrating a living legacy cultivating compassion and justice in Ventura County. We appreciate your service, your time, your support throughout the 40 years. It was wonderful.

Martha was singing like a bird. Yeah she was. Laura was there pumping her right on. I know it! I saw you! And we just really are just happy to be here this evening I wasn't able to come last year, but I'm so happy that we're able to come tonight and still celebrate this wonderful occasion. Because you know 40 years is a long time to be having a volunteer organization celebrate something in this county.

And Dr. King is the main event. We thank you. We praise you. Would you like to say anything, Heidi? I

personally don't get to see it. I do the refreshments, but I know that every year we knock it out the park and yesterday was one of them so thank you.

Thank you for all the effort in 40 years. It's a long time to develop a program and it really shined yesterday. Never retire.

Okay, so our next presentation we're going to have a proclamation to recognize the 26th anniversary of the Alaska Flight Memorial flight 261 and our Mayor Pro Temp Hernandez will be reading that.

Thank you, Mayor. I'd like to dedicate tonight's reading to Mr. Prasad Anirudh's father who passed away over the holidays. His services were last weekend and they continue on their memorializing their great-father who was out here every year since the crash and he will be greatly missed. So whereas on January 31st, 2000 at 422 p.m., Alaska Flight 261 crashed in the waters of off Anacapa Island approximately 13 miles from Port Hueneme and Ventura County resulting in the deaths of 88 souls and whereas the accident was the largest loss of life due to a transportation accident in the history of Ventura County and whereas the crash of Alaska Airlines Flights 261 activated an immediate response from over 75 different federal state and local agencies, the military, local non-profit agencies and private organizations.

And whereas the City of Port Hueneme Police and Station 53 who's here tonight of the Ventura County Fire Department were among the local first responders to assist with the immediate response and recovery. And whereas the families of the victims came together to promote commercial aviation safety by working together with Alaska Airlines, the Federal Aviation Agency and the National Transportation Safety Board. And where it is by the work of many that commercial aviation today is safer, by addressing the cause of this accident and working to ensure this information is used for the safety of those who use commercial transportation. And whereas the City of Port Hueneme continues to host the families of the victims each year on the 31st of January to honor the 88 lives lost and provide comfort and compassion to the friends and families of Flight 261, and whereas it is important to see how individuals in our county and the City of Port Hueneme came to embrace the families of Flight 261 by showing and expressing kindness, compassion, and giving spirit.

And whereas it is important to educate the public about this event of historical significance and how members of our community came together and continue to do so to support the family members of Alaska Flight 261 in this tragic loss of life. And whereas as we gather to remember the 26th anniversary of this tragedy, it is the intention of the City Council and staff to remember those who died and always keep our community a welcoming and warm place for Alaska 261 family members to visit, to honor, and remember those killed on January 31st 2000. Now therefore be it proclaimed that the City Council of the city of Port Hueneme does hereby proclaim January 31 As the day we honor the 88 souls who died on January 31st, 2000 and recognize that the kindness of our community members continues 25 years later.

And we will always urge residents of Port Hueneme to exercise compassion in our daily lives for the betterment of our family members, our colleagues and every individual we encounter proclaim this 20th day of January, 2026. Thank you.

Yes um Mission Square I believe is the current vendor are we switching from Mission Square to a new vendor

So, and just for the public following along we're talking about the city's 457 plan which is a benefit we offer to our employees. And so currently we actually have multiple vendors And so Mission Square is one of them. So some people have them, but we actually have more than one and that's part of the issue that we're looking to correct is because we had multiple vendors, we weren't really getting good rates or good deals because we weren't putting all of our assets into one plan to make ourselves more appetizing to vendors.

So probably then your next question is then will Mission Square end up being Final plan selected. I don't know that that's been decided. I'll look to, I know Frank's been working with him. Part of the idea here is we're working with a broker who's supposed to negotiate the best deal for us and so I'll let Frank speak to

what specifically that means. So we did go through an RFP process to find a fiduciary who can help us with the financial services and do an RFI for us, to see if we can get a better pricing plan. Mission Square was one of them who did submit their bid but ultimately they were not chosen. They ended up being Empower. That's part of the resolution that's out there tonight.

So did you look at? Performance was performance. I will just say that I've been very pleased with their performance

Performance was reviewed even cost was reviewed as well and from the cost perspective As you might be able to see in the council report Collectively all of our participants participants including our employees and retirees was paying a total annual sum about $86,000 out of their retirement funds which Participants pay out-of-pocket. So it reduces their funds for retirement and for growth That is significantly reducing down to I believe 16 8 Right and and on top of that we will have additional fun financial fiduciary service to fiduciary experts who will be educating and helping us through this transition and

And I think to sort of directly address your question is, I don't think there was an issue of performance. Like it wasn't an unhappiness with any of the current vendors. It was just that when we had taken a look at it initially, the rates that we were being charged, we weren't getting the deal that we should have been getting based on the size of the contract and the assets. So we really tried to renegotiate that and negotiate the best deal really is what it was.

So Councilmember Gama, if you are referring to the performance of your portfolio If that's the question you're posing The new vendor that new records keeper who we're moving to has the same exact lineup And it will be at a much lesser administrative fee

Okay And then when will the transition be taking place?

If it's everything goes fall falls into place we're expecting about a two to four month Process, but it could take longer

it gets to no. No that doesn't stop Okay, there might be a freeze period for about a pay period maybe but nothing throughout the process

Yeah okay so during this transition what is, is there going to be an expected duration that there's a blackout period where They're not going to be able to, they're gonna be locked out of their accounts. And have you kind of talked to Empower about this?

So we don't, we haven't talked directly to Empower but we have talking to fiduciary experts who is working on our behalf and I do believe there's a lockout period if the money is in a certain account. The money, I think it's a cash account where It's held for so many months and so many years, but that you do have access to the account. It just might not be on the new Empower platform. You'll still get correspondences from the old records keeper that your money is still there, but I don't believe there's a...

I have to go look at my records, but I don' think there's

a

complete

blackout. The reason why I ask is, you know, there's market volatility. Yes. Members might want to move their money Thank you very much. And then the other part too, if they want access to that money either in a loan. So make sure you ask those questions.

So yes so that's a good question Councilmember Lopez. We as a city and all four of our plans don't have additional benefits that come with it So each records keeper has a little bit of money of all of our participants. And because the economy of scales has been divided amongst the four, our services haven't been reflective of the total assets we have. So, we don't have any benefits right now. But as we transition to this new vendor, we will have loans available and our employees will have different options with their money that's in

there. Last question is for retirees. There are vulnerable stakeholders ensuring that they're not left behind. You have access? You got records and are they aware of the switch?

So far they are not. But our fiduciary experts, we will be doing a marketing campaign to all of our participants to make sure that they have the information that they need to make an informed decision whether to keep it within the city pool or move out of it.

Just want to make sure that absolutely reaching out. Yes

Yeah, and I hear the feedback is to make sure we're doing outreach and letting people know what happens when and so as of now What we had done was we had created a committee where we tried to have a representative from each department really our Employee group okay? Yeah, you should probably need employee group to be part of it so that they Understand that we're trying to get them the best deal and put more money into their pockets without you know without costing taxpayers anything so That's all we've really communicated with so far. If it's approved tonight, we'll make sure we do outreach and information to all of our affected employees and former employees.

you. So just for clarification, Empower is the replacement company that were that you're asking approval?

That is correct.

And then Fiduciary Experts was just the broker

It's fiduciary services. So they are bound by law to work on the city's best interest, meaning that when there is market volatility or when there is underperforming assets or stock, I'm sorry not stock options but investment lineups, they will be the ones helping us to change those in and out and helping us with the committees.

So once that transition takes place then the fiduciary service experts will So just a question

about any negative impacts with having the four go into one. So not really I think The range of services that Empire provides is everything that encompasses that what we currently have so we are sort of a Unique case where our city has a 401k account which typically are reserved for private entities We have that. We have a four oh four fifty seven B account, which is Targeted directly at public entities, but we have both of them. So both the services will be going along and We do have retirement health savings plan under there But that will be a separate discussion on what we're gonna do with that We're planning to move that over because of the economy of skills, but that's just a separate discussion

If I can just quickly answer, because I think the biggest negative... I think Frank's a little more optimistic than me. So for me the biggest negative is change is hard and you know it means people are gonna have to change their plans and even I told Frank initially I said I don't want to tell you which vendor I have because I don't want to sway you guys but if you don't pick the one I have I'm not going to be happy! And then he didn't pick the one that I have so So even for myself, I don't really want to deal with the change. But when we look and I think the group felt this way too, the employee committee that was working on it is when they looked at the dollar difference that it could make over time by the reduction of fees that are there being charged.

It's worth it. It just it's going to it's the pain to change it but after that we don't anticipate any other real negative. It should all be positive.

So yes from there on it should be a long term commitment until we come to a certain point where we believe Services or the cost of services outweigh at the time changing to a different vendor. But having four different vendors in an agency like ours is a lot, and unfortunately over the years we have lost probably all the administrative fees that we could've probably collected it and used it more positively for our employees and retirees but we're at this juncture and we are trying to clean it up now.

I Appreciate the effort because You know you take those cost savings time value of money It's a it's a big move and I really appreciate that looking out for us because it is the fees and it's very difficult to understand the fees And then I have one further question, which is slipping my mind right now. Hopefully all get to it but oh I'm sorry, I misplaced that thought.

So we, because I looked into it, we didn't have the ability to borrow against our assets. I think that's what you're talking about,

correct? Yeah, we did not have those services

from our current providers. Right and so then this is a really great alternative for our employees because now you get to, correct me if I'm wrong, you can borrow against your assets and you'll pay 6% and then it goes into your account.

Yes, so once we have everything established, we'll have those services solidified with a new vendor in terms of how we're going to administer them. It's kind of a hard process where we either do it through payroll or through personal accounts but we will be having those services added as well.

Right, and I think that's a great addition. So when you take the lowering the cost of this new benefit...

It's a very positive change. And just to kind of give you some perspective in this industry, in the government 457 world, the two big players are either Mission Square or Empower. So they're one of the two biggest providers of financial retirement contribution services.

Great this is the adoption of a resolution granting special use permit number 26-1 for the City of Port Hueneme Color Run walk 5k and kids 1k event and ancillary health care educational booth children activity area refreshment vendors and entertainment will staff please present the report

Good evening members, members of the public, city staff. So agenda item number six pertains to a public hearing that will allow the council to consider the adoption of a resolution for special permit 26-1. The special use permit would allow for the 2026 Sea Splash Color Dash event to be held on Saturday March 21st The event, which would be co-sponsored with the Port of Hueneme, would include a 5K Color Run and Walk, a Kids 1K Event, and a Health & Wellness Fair.

It's anticipated that the 5K race would have approximately 600 people, and that the 1K event would have up to 150 participants. The wellness fair, which will be located in Lot C, would include health care vendors, children's activity area, photo booth, a DJ, and various vendors. As the council may recall, this would be the third year that the city has held this type of event down at the beach.

Special use permit is required because the event is hosted down at Hueneme Beach including the promenade and adjacent streets. The event is considered exempt from CEQA because it's a minor temporary use which does not entail an environmental impact. Anna Hanley, the city's Recreation and Community Services Manager is going to walk us through some of the event details including the race route which is really the primary change from last year's event. So with that I'll turn it over to Anna.

Thank you, good evening. In terms of the race details this year we're proposing a revised route that removes the Surfside Drive series of barricade switchbacks which in turn reduces labor and equipment rental costs. In order to still achieve the distance needed, participants will be routed northbound on Ventura Road to Seaview Street. Only the south shoulder of Seaview Street will be utilized and the estimated total time of impact will be 25 minutes.

That impact will keep the residents in place for the Surfside 1 complex, Surfside 4, Anacapa View Beach Homes and the Anacapa Beach View condominium complexes. This change though, it also offers variety for the participants that have been in our previous events and so that's sort of a nice change as well. That route can become a little mundane and so we're offering a new view of our city with this proposal.

The event also includes the color run feature as it did last year, and the setup as far as that element is concerned will remain the same. And I'm not sure if anyone had the opportunity to see it but it was visually stunning. It was these vibrant colors that were all lining the sidewalk flanked by palm trees It was an incredible photo opportunity. So as soon as the public's done taking advantage of that aspect of the event, Public Works has offered to clean up the area immediately and restore it to its original condition.

As far as the road closures that I just mentioned, Market Street will be closed north of Anacapa View Beach Homes entrance. The southbound Ventura Road will be closed south of Seaview Street. Excuse me actually it'll be north of Seaview Street. Surfside Drive will be closed west of Surfside 2 entrance through to Market Street. And as far as resident access, the residents of Surfside 1, Surfside 4, Anacapa Beach View condominiums and Anacapa View beach homes may have a brief traffic delays as I described. I walked the route and as I mentioned it was just all told I would imagine 25 minutes at most. It took me 15 minutes to walk this portion of the race route In advance of the race and event, the recreation team intends to go door-to-door with flyer distribution to engage community members as far as this impact and encourage cooperation.

We do have a way to mitigate that if emergencies do arise. We're working with the police department as far as the traffic plan is concerned and we'll be able to manage anything that comes our way However, we figured the most information that we could provide in advance as far as that 25-minute impact, we will do so. We'll also be utilizing traffic message boards, social media and engaging all of the homeowners associations in that immediate area.

Here we have the proposed event site plan. This is the same as last year, so I'm certain that people are familiar with this. This is the area that has the longest impact because it will be where we focus our efforts on the wellness and health fair. We're also providing for your opportunity to view is the race, the new proposed race route which takes participants northbound on Ventura Road and across that shoulder on the southbound side of Seaview Street down to market. And then continue the race route as we've offered in the past.

The second heat and element to this event includes the Kids 1K, so the route will remain the same. And the benefit of this particular image is that it shows the opt-out path for those that do not want to participate in the color run feature of this race, and that's highlighted in the blue that'll take participants through Lot B. As far as the fiscal impact, the event budget approximately is $20,000. That includes the timing service medals, marketing materials barricades, photo booth DJ race T-shirt signage and staff costs. The Board of Hueneme is contributing $10,000 to this event As mentioned, we're co-hosting the event with the port.

Registration fees this year are proposed to be $25 for each 5K participant, $10 for the kids 1K and that will cover the remaining event costs which include... And every participant receives a race T-shirt and a medal. This cost as we are increasing it is still kept lower than neighboring events by a significant amount and that's to encourage local participation.

Beach parking revenues will not be collected for A, B, C, E or F nor along Ocean View and Surfside drives

And to wrap up the presentation, just wanted to let the Council know that the Citizen Advisory Commission did review this and made an advisory recommendation that the Council support the event and approve the Special Use Permit. Therefore it is our recommendation that the Council adopt the resolution approving the Special Use Permit number 26-1 and find the project to be categorically exempt from CEQA.

Yes, last year and the two previous years did we have any negative feedback from the community?

I believe in prior years there was a complaint related to sound coming from a DJ. So we are very intentional now with the placement of speakers facing away from residents in Surfside 2 complex, now is intentionally directed towards the ocean and east or west and never north towards the condominiums We also had utilized the secondary DJ to keep the route engaging and people, you know, sort of pumped as they're going along the race. And that volume two had reached a level in which it needed to be turned down so we're cognizant of that and will start off those events with the lower sound this time.

Also, one lesson learned last year was the trophies age groups didn't match the award that was being presented. It was weird.

Yeah there is I think there was a mix-up with the trophies so we're gonna work on that where last year we yeah like the trophies would say like 35 to 45 but the age group for them that we measured was 40 to 50 you know or something like that So we're going to watch that and then we're open. We also were making sure to have recognition for the kids race as well I think that was another lesson. Yeah, and then I just wanted to confirm yeah with the complaint the first year about sound, I will know last year we actually had several residents come out on their balcony And we received zero complaints so I actually think it was really a community event. Yeah, if we're even the neighbors were supportive of it and so hopefully you know the concern we have I think it's it is a good approach I think with the feedback on the course in kind of cut back, switch back was like the one thing that people didn't really like that much.
