report, Ms. Miyasato? Chair Hartman and board members yes I do thank you very much. I have three announcements the first is just to announce that I'm happy to introduce Jeff Frapwell who joined the county yesterday it was his first day he will be our new ACO over budget operations so where's Jeff? As you know, Tom Alvarez is retiring as our budget director in about two weeks and Jeff is joining us from after almost 30 years of government experience in finance and leadership. Most recently he's been the assistant county administrative officer in Kern County overseeing general services and formerly was that county's budget and finance director for eight years and has been a deputy CAO for 12 years so as we welcome Jeff I also want to express my gratitude to Tom Alvarez He's been an excellent steward of our county funds for the last five years demonstrating the highest level of commitment, ethics and financial acumen.

Tom is here for two more weeks and I have him fully engaged in those two weeks as there is a transition to Jeff so you'll be hearing from both of them in the coming weeks. Secondly, I want to recognize Dr. Alice Gleghorn over the holidays. Dr. Gleghorn was bestowed the 2016 Niswander-Dole Marie Lifetime Achievement Award from the American Association for the Treatment of Opioid Dependence in recognition for her contributions to opioid treatment prior Prior to joining Behavioral Wellness, Dr. Gleghorn worked for San Francisco Department of Public Health for 20 years where she developed innovative programs to improve the health and recovery of people who are opioid dependent. She was instrumental in the expansion of groundbreaking medication-assisted programs for underserved communities while ensuring that uninsured and publicly insured patients in the San Francisco safety net had same day access to medication assisted treatment in multiple venues so congratulations Dr.

Gleghorn. And lastly I just want to invite the public, the staff and members of our board to register for any county e-news updates and public notices sent via email. So we just added this feature if you look on the screen to receive news you just go to our website CountyofSBA.org and click on the orange button called join our mailing list found in the top right of the home page. We don't sell or share our database and so once you click on that you can get e-news delivered to your email box I would like to turn to our administrative agenda

UnidentifiedUnidentified speaker 1Proposed16:16 · ≈ 9:16 AM

Chair Hartman, members of the board item A6 is from community services to consider recommendations regarding a center for sustainable energy consulting agreement.

UnidentifiedUnidentified speaker 5Proposed16:28 · ≈ 9:16 AM

Thank you. Can anybody explain to me what the assets and infrastructure will be leveraging are? I was looking for Mr. Chapton but I couldn't see him.

UnidentifiedUnidentified speaker 6Proposed16:53 · ≈ 9:16 AM

Chairman Hartman, members of the board. Specifically we are talking about the infrastructure that Empower has created in terms of our relationship with local contractors, our relationships with local financial institutions such as Coast Hills and Ventura County Credit Union and our relationships with the local community in general. I think this contract would allow us to sort of leverage some of those assets to promote a statewide financing program, and in addition use that statewide financing program to promote, empower, and expand out some of the services we provide to multifamily and to commercial entities.

UnidentifiedUnidentified speaker 5Proposed17:34 · ≈ 9:17 AM

So you're going to loan the $65,000 out or are you going to use it to take people lunch and see if they can loan money to people for solar panels. How does that all work?

UnidentifiedUnidentified speaker 6Proposed17:48 · ≈ 9:17 AM

So we would be using the $65k for staffing costs specifically to promote the financing that's available so that Businesses as well as residents can have a full picture of the financing that's available through throughout the state for energy efficiency projects.

UnidentifiedUnidentified speaker 5Proposed18:06 · ≈ 9:18 AM

Would you read Item A12 into the record Mr. Allen

UnidentifiedUnidentified speaker 1Proposed18:43 · ≈ 9:18 AM

Chair Hartman, members of the board. Item 812 is brought to the board by the Public Works and comes to the board as the Board of Directors of the Flood Control and Water Conservation District. It's to consider recommendations regarding the Mission Canyon Drainage Master Plan Study and we have Monty Cole to speak on this item. Mr. Cole?

UnidentifiedUnidentified speaker 8Proposed19:03 · ≈ 9:19 AM

Good morning Supervisors, Monty Cole here just to talk about the water capture that could be available from Mission Creek. I know I spoke to some of you before. Just briefly Mission Canyon at the bottom where it exits to the sea produces probably 15,000 acre feet a year. It would be fairly easy to capture 2-3 thousand acre feet from this at flood times and save it in various cisterns And reservoirs placed in county parks and other county properties, thus the county could knock off two to three thousand acre feet off the water bill. So just wanted to bring that up and say that I have some designs for this and I know I've given some to the county so I wanted to just say hello and leave my contact again with that in mind.

Thank you.

CommentSergeant MahurinProposed · by introduction19:56 · ≈ 9:19 AM

Thank you very much. May I have a motion to approve the balance of the administrative agenda? A second? Oh, did you... Sure.

UnidentifiedUnidentified speaker 9Proposed20:07 · ≈ 9:20 AM

I just wanted

CommentSergeant MahurinProposed · by introduction20:07 · ≈ 9:20 AM

to

UnidentifiedUnidentified speaker 9Proposed20:09 · ≈ 9:20 AM

ask based on the public comment if Tom would come up and just had a question. The 2-3 thousand acre feed that claim that's a lot of water. We at this point, other jurisdictions within our jurisdiction are talking about creating plants just for the production of that much water or less. Do you feel that is feasible? Even half of that being feasible would be something

UnidentifiedUnidentified speaker 10Proposed20:48 · ≈ 9:20 AM

to pursue. Chair Hartman, Supervisor Williams. Well first of all, if I understand the speaker was talking about Mission Creek to divert water out of a stream especially that would have steelhead fishery and would first require state water rights and second approval from the National Marine Fisheries. However that said there are opportunities in our storm drain systems that are not in a natural stream system that could be captured. The biggest problem we'll have is storage and where are we going to put the conveyance and where are we going to put it And then treat it. I believe Mr. Cole has produced some concepts that he's shown us where you could actually capture street runoff, put it in a large tank and then feed a park. Obviously the cost of doing that infrastructure would have to be looked at for I think some of the designs he had were for city parks and maybe some county parks.

And then I would just point out that we're hoping to be coming to your board Here shortly with an overall stormwater capture plan that we hope will be funded through the State Proposition 1, that will identify feasibility of different storm water capture because it can run the gamut. Lake Kachuma is a storm water capture project but then on a much smaller scale how can we get other storm water capture? But the biggest problem is where do we put it because when it's raining is not the time you need it typically. That's why reservoirs exist because you have to save it for when you don't need it…when it's not raining.

Thank you.

CommentSergeant MahurinProposed · by introduction22:15 · ≈ 9:22 AM

And I just wanted to add my thanks to Mr. Phelan and Public Works for their heroic efforts during the last rains, I had lots of calls and emails and they were all responded to very quickly and I and others up here are very appreciative of your efforts. Supervisor Adamson?

UnidentifiedUnidentified speaker 5Proposed22:36 · ≈ 9:22 AM

I was going to ask Tom what he thinks that if he has any information on cost of storage for cisterns and the like.

UnidentifiedUnidentified speaker 10Proposed22:48 · ≈ 9:22 AM

Chair Hartman, Supervisor Adam. That's what we hope to be able to categorize the cost and when you start talking about tanks that go into the acre feet that gets to be a pretty big cost because that's a constructed facility but we want to get the information so that we aren't talking in the abstract. We want to understand what these costs are and that's what the goal of our study ultimately would do.

UnidentifiedUnidentified speaker 5Proposed23:11 · ≈ 9:23 AM

And the other cost, if I'm understanding correctly is we're going to put those or the proposal is to put those underground which would be another

UnidentifiedUnidentified speaker 10Proposed23:22 · ≈ 9:23 AM

It could be underground, it could be above ground and in all likelihood could involve a conveyance feature that would move the water to where you would put a central. For instance Laurel Reservoir sits up in the foothills so that's part of the Kachuma project. Could be the recipient of some of this but then you have a conveyance infrastructure project to get the water from where you capture it. And energy as well.

It sounds like a simple idea but it gets very complicated and so therefore we're trying to get a grasp on what the cost of this really is. Right, okay thank you.

0:24 – 0:3013 turns

CommentSergeant MahurinProposed · by introduction24:00 · ≈ 9:24 AM

Okay with that I think we had a motion to approve the balance of the administrative agenda but I don't… oh he did the second. Let's take another motion and second just to make sure we got it. All in favor? Any opposed? The administrative agenda stands approved. Now is the time for public comment for matters that are not on today's departmental agenda. Mr. Allen do we have any speaker slips?

UnidentifiedUnidentified speaker 1Proposed24:37 · ≈ 9:24 AM

Chair Hartman, members of the board we have one request to speak from actually we have two today Ed Kolaski followed by Bob Hart.

CommentYeah E6Proposed · by introduction24:52 · ≈ 9:24 AM

Good morning. The title of my talk today is who's in charge? As you know, last meeting I presented the notes of Ryan which he had presented back in September 2015 before this board and our project was rejected based on the fact that they claim that our second story is located solely over the garage and you can clearly see it is not solely over the garage. So there are a number of things that have come up. Who's in charge, first of all? Who's in charge of SBAR, the Board of Architectural Review? Do you, five members, are you in charge to see that they don't break the law like they broke the law when they kicked this out? Like they broke the law when they erased the first two hours of the meeting on several occasions and we were within that first two hours.

These things happen, I'm told. They take five months to write up the report on our project. Five months! And in that 64-page report they left out this drawing. How is it that they left out the one drawing they're talking about? There's claiming that that second story is located solely over the garage and you can see I've outlined it in red. The garage, the dining room, the kitchen and part of the living room How can you go through five months and 64 pages and not put this one drawing in there? They put the other drawings in.

Why was this one left out? Is it like when the tape was erased for the first two hours? Oh, these things happen! You're talking about the evils of locating your second story solely over the garage. Is that solely over the garage? It doesn't take a person with a degree To figure that out. You know I'd point that out to architects and they would start laughing at me, what are you talking about? That's not solely over the garage!

I haven't found anybody who said it was solely over the garage. Not Anne Almey or any of the seven members downstairs. If you're in charge why aren't there requirements on them? Why aren't they required to obey the laws of California? They're not allowed to kick us out without a single word. Why isn't there a requirement that they look at our drawing? We had four meetings, we had a five-to-two vote in our favor and the meeting would come in and they'd kick us out!

We didn't get to say a single word. They were all prepped. Who prepped them? There were three of them that were prepped, the other four never even saw the drawing. Dylan was told, okay as soon as my architect stands up to ask a question you jump up and start shouting at him. And that went up and down three times. And then Alex goes, you're out of here! To us not to Dylan we never

CommentSergeant MahurinProposed · by introduction27:53 · ≈ 9:27 AM

said a single word.

I've talked to Mr. Kolaski, I know my SBAR representative has, Mr. Russell has. But I think it's important to get a full picture so Dr. Russell if this isn't going to be a conversation back and forth, it is just to provide the board with information. So Mr. Kowalski thank you and you can have a seat and then Mr. Russell.

UnidentifiedUnidentified speaker 13Proposed30:15 · ≈ 9:30 AM

Hello Board and Chair. Dustin Reilich, I'm the Senior Director of Municipal Development for Renovate America's HERO Program. We're a PACE provider. I know PACE has been before you so many times in the past. We hope to have it come back before you again in the future. It's providing clean energy and water efficiency financing for your homeowners Some of the updates are that AB 2693 went through the legislature in the last session, they created a lot of disclosures and a lot of new information around PACE. Luckily recently I met with your CAO CEO Mona at a CSAC event and she's hooked me up with your staff locally George and he's great to work with and I've also been working with Theo Ferrata your auditor controller on the Auditor Controller Placement Agreement So hopefully once Best Best and Krieger gets that out of their inbox on our end, we'll be able to bring that back before you when CPACE comes back before you sometime hopefully in April.

And my ask to the board would be to look at once again residential PACE as an option for your homeowners To make this type of financing available on a voluntary basis for them. Over 90,000 projects have been financed through the HERO program in the state of California over the last five years and that's creating jobs, that's creating the ability for people to save on their energy bills And at the same time helping over 450 communities in California that have made this voluntarily available to them. So I gave you a short little packet there and I don't need to waste any more of your time if you can direct any of your staffs to reach out to me, I'd really appreciate it. Thank you. Have a great day.

CommentBob HartProposedself-stated32:04 · ≈ 9:32 AM

Good morning, I'm Bob Hart. You might know me from the Association of Realtors but today I am here instead as a board member of Coastal Housing Project. Coastal Housing Partnership is celebrating its 30th anniversary. I want to take a quick moment to just recap our services to the community but most importantly give you an update on how valuable this service is to county employees.

Thank you County of Santa Barbara for being a member of Coastal Housing. The Coastal Housing Partnership began 30 years ago to help Santa Barbara County employers deal with the high cost of housing. Local employers would spend time and effort to recruit top talent and not be able to get them to commit due to our housing costs. The ability to retain good employees had the same issue. With the help of local employers like you, Coastal Housing Partnership has been able to help your employees by significantly reducing the closing costs on home purchases and mortgage refinances.

In addition, your employees can benefit from our rental assistance programs and our home buying education programs. Our programs have helped to reduce the cost of recruiting and training new employees. You get to keep your outstanding talent, and they get to benefit from the advantages of home ownership. Your staff doesn't have to spend time looking for new people, and productivity goes up.

Over the last 30 years we have helped over 10,000 local employees become homeowners and our program has now expanded into Ventura County as well. So let's look specifically at the costs and benefits of this program for the county. The cost of participation for Santa Barbara County is just $12,900 per year. The amount of benefit received by county employees averages over $250,000 per year.

Wouldn't it be great if all programs in which you invest had a success rate anywhere near that? We want to acknowledge your Human Resources Department for having the foresight to participate in coastal housing. As you get to upcoming budget hearings, please remember that your small investment in our program of only $12,900 helps with the recruitment and retention of your employees as well as providing your employees with a path to the American dream by providing educational opportunities along with financial assistance of a quarter of a million dollars per year.

Thanks again for being a member we look forward to our continued success together

UnidentifiedUnidentified speaker 14Proposed35:57 · ≈ 9:35 AM

Madam Chair, members of the board. The Office of the Sheriff Coroner requests the Board of Supervisors consider amending section 6-70.01 of chapter six of the Santa Barbara County Code related to outdoor festivals. The amendment will clarify and add dates so that the county ordinance may be in effect during the future Deltopia events As it has been an effective enforcement tool, significantly reducing arrests, citations, medical transports and law enforcement calls for service.

The Deltopia event historically occurs the first Friday, Saturday and Sunday following the first day of instruction of the spring quarter for UCSB. The Sheriff's Office has reviewed the UCSB academic calendar and determined the addition of the proposed dates will make this tool available for deputies to utilize this year and going forward. In 2013 and 2014, the Deltopia event associated with the UCSB's post-spring break period resulted in amassing of huge crowds and significant lawlessness, personal injury, and damage to public and private property in the Isla Vista community.

The Deltopia 2014 event deteriorated into a major civil unrest incident, which amounted to a significant number of arrests, citations, medical transports and calls for service. In the 2013 event, the crowds at Deltopia were estimated between 15 and 18,000 people. And in 2014, The crowds were estimated between 20,000 and 25,000. In 2015 your board approved the addition of six dates in April to the county code section 6-70.01 which prohibits outdoor festivals from occurring. The existing dates were for specific dates in October and November for the Halloween events In 2015 and 2016, the Deltopia events resulted in significantly smaller crowds, less lawlessness, fewer personal injuries.

And reduced damage to public and private property in the Isla Vista community which resulted in a dramatic reduction in the number of arrests, citations, medical transportations, and calls for servers. This reduction was due in part to the enhanced tool The Outdoor Festival Ordinance. The crowds at Deltopia 2015 were estimated to be approximately 10,000 people and for 2016 the estimated crowds were about 3500 people.

The Sheriff's Office believes the outdoor festival code section is beneficial and Assists us in controlling the problems that jeopardize public safety, lawlessness, criminal activity including potential riots assaults and fighting during the future Deltopia events as it has been evident in the past two years. I had a couple of questions, Mr. Cole. The first is you have drafted for the Deltopia as narrowly as you can, is that correct? That's correct. For three days and this ordinance is designed primarily to discourage people from outside Isla Vista and UCSB from coming onto the campus into Isla Vista, is that correct?

UnidentifiedUnidentified speaker 14Proposed40:39 · ≈ 9:40 AM

It's drafted to apply to all people, those coming in and so forth. But it's not specific to any specific group. It's our ability to enforce things when they start to get out of control.

CommentSergeant MahurinProposed · by introduction40:54 · ≈ 9:40 AM

And could you describe a little bit about Halloween and why those dates have to be a little broader?

UnidentifiedUnidentified speaker 14Proposed41:01 · ≈ 9:41 AM

Those because Deltopia is not a specific date whereas Halloween is a specific date and it moves within the week in the calendar so it depends on what day of the week it is. So we have to have a broader scope for that so we can cover both weekends depending on where Halloween falls.

CommentSergeant MahurinProposed · by introduction41:21 · ≈ 9:41 AM

Good thank you any other questions? Okay Supervisor Williams

UnidentifiedUnidentified speaker 9Proposed41:27 · ≈ 9:41 AM

I just had a question in terms of how much we're spending on enforcement in the last couple years. Is that varied?

UnidentifiedUnidentified speaker 14Proposed41:37 · ≈ 9:41 AM

I don't have the numbers, but it's been reduced significantly because of our ability to adjust our enforcement numbers or the number of personnel we have out there based upon our activity at that time so if The enforcement isn't needed, then we pull those personnel out so that reduces our cost significantly.

UnidentifiedUnidentified speaker 9Proposed41:58 · ≈ 9:41 AM

Well that would be a significant argument in your favor so it'd be great to see those numbers. I'll provide those to the board.

Chair Hartman and members of the board we have six requests to speak today. We'll start with Jay Freeman followed by Spencer Brandt

PresenterJay Freemanit for numerous reasons incProposedself-stated42:26 · ≈ 9:42 AM

Hello my name is Jay Freeman. I live in Isla Vista, I am now on the board of the Isla Vista Community Services District although I am certainly not representing it for numerous reasons including that it has not met yet and doesn't even technically exist yet. So I was here two weeks ago well in San Maria two weeks ago and I had just managed to see that this was on the agenda a couple hours before and was frantically looking through the law while I will admit I had a horrible headache and I missed something that was very I'd like Any Friday, Saturday or Sunday that occurred during that time. To the extent to which I misinformed anybody, I went and found people who had shared the thing on Facebook, commented on all of those people, made a correction to the event about all of that issue and tried to clean any of that up.

And I'm very thankful also though to see in general that the new version of this that was drafted yesterday is even more narrowly applied than that. However, I will point out for the Halloween whether it was the case in the previous version of this or not. Actually it was a little bit confusing to get the way that the any Friday Saturday or Sunday was during in .1 but then there was a comma connecting to .2.

I couldn't quite tell whether the October 26th through 4th is designed specifically to encompass all days or just the weekends which is what the Sheriff Hooper who was up here just a second ago was saying that the goal is to have the weekends. And now in the new wording, the Friday Saturday or Sunday it's just not there at all. It would be kind of cool to have that I'm not saying clearly it has to be done today.

Generally what I wanted to see happen was just a discussion of the issues in this law and to have an opportunity for people to actually come and make commentary about it. Also for example when I am trying to explain this law to people Due to the way that it is worded, outdoor festivals is defined in section 670 which has a long definition and essentially the exact same definition with two phrases removed is oftentimes difficult to explain to people. Well actually this version does not have those restrictions such as the 500 persons or more restriction.

Also there is confusion in the community about whether this is designed to operate in a function of a noise ordinance or not, in the sense that the way it's worded seems like even if you couldn't hear things that are happening from outside of a building. If that building was not a permanent structure designed specifically in order to house a musical event they would still be considered a problem which I think actually is the goal because the goal was to kind of keep people from coming to Deltopia but all these clauses and Spencer Brandt to be followed by Ethan Bertrand.

PresenterSpencer Brantthem here todayProposedself-stated45:40 · ≈ 9:45 AM

Good morning Chair Hartman and Supervisors. My name is Spencer Brant, Director-Elect on the Isla Vista Community Services District though not representing them here today. I'm here to speak to you today about the proposed amendments to the festival ordinance and since I've been here and we've gotten more information it sounds like Supervisor Hartman had asked the Sheriff's Office to change the amendment Just include the dates that we have previously discussed. The Friday, Saturday and Sunday of this upcoming Deltopia in 2017 and I want to thank and commend you for that Chair Hartman. We stand today only a matter of weeks away from the annual Deltopia celebration which commences during the daytime hours of the first weekend of the spring academic quarter.

The festival ordinance is an integral tool for the Sheriff's Office and other partnering law enforcement agencies to make use of during this weekend. And while it is an imperfect solution, I see no reason why this policy shouldn't be continued this year. The surrounding community should take note at the changing culture in Isla Vista and the leading role that students are playing. Programs like UCSB Associated Student Sponsored UCIV program are invaluable during Deltopia weekend. This is a peer-to-peer volunteer program that passes out water, cookies and condoms to residents during the day and spreads awareness about the festival ordinance to residents as the six o'clock deadline rolls around.

I've had the privilege to participate in the program with Supervisor Hartman and now Congressman Salud Carbajal this past Halloween weekend. And while, as I'm sure everyone can attest to, Halloween attendance was pretty low that Friday night, I think it's fair to say there are going to be more students staying in town for this upcoming Deltopia weekend given that it is the first weekend back from spring break.

This is why it's going to be integral for the Sheriff's Office to keep open lines of communication with the community, with student leaders and with elected leaders to ensure that Deltopia is safe and local. Because Deltopia is by nature an unsanctioned event it's an unpredictable beast in many ways. I would like the county to take up a more proactive enforcement model and begin moving towards a sanctioned and regulated and legal deltopia in the coming years rather than regulating the hours in which music can be played and you know hoping for the best.

Here in 2017, Isla Vista is committed to a safe and local deltopia and I urge you to approve the amendment before you. Thank You.

Good morning Madam Chair and members of the board. My name is Ethan Bertrand, I'm a Director-Elect of the Isla Vista Community Services District that are representing myself today. First off I would like to thank Chair Hartman for her request to the Sheriff's Office for narrowing and specifying the dates subject to this updated ordinance and also to thank the Sheriff's Office for their consideration and concurrence with this recommendation.

As the board letter from the Sheriff's Office shows, there has been a significant reduction in arrests, citations and medical transports since 2013. The community is continuing to be appreciative of the safer nature of this event and I would like to thank the county for their continued efforts to ensure that we continue to make this progress every year And I also hope that in the future, the progress that has been made in public safety can lead toward a sanctioned event rather than the unsanctioned nature of Deltopia today.

A well-planned event that can be safe for community residents to enjoy, to take pride in and have a good time. Also, I hope that the enforcement of this updated ordinance is conducive for continuing to build police community relations in Isla Vista. Thank you so much.

UnidentifiedUnidentified speaker 16Proposed51:05 · ≈ 9:51 AM

Hello board, thank you for having me here today. I'm here today to speak in favor of the amended language of the Isla Vista Festival Ordinance. I believe that the amended language is much clearer on what days and which is it enforced and exactly on what year it is enforced. You know, in working with our partners in the Sheriff's Department we can effectively communicate this information to Isla Vista residents through the programs that we have initiated like that UCFV volunteer program which has been very effective in its enforcement. I must stress the fact that this ordinance's effectiveness is not simply in its application through law enforcement but it's communication to residents via programs like the volunteer program so that compliance is possible without the need for citations.

And I cannot stress that helps with the overall atmosphere during that day and then the continuing relationship with the Sheriff's Department is strong and therefore not eroded because of one specific day in which we must all kind of work together to increase public safety. But, I must add that it came to my attention and other people's attention that the ordinance last year did not cover the date of Deltopia on 2016 on April 2nd.

However, it was communicated to me and my associates at UCIV that would in fact be enforced on April 2nd so when then I and so many other students went out there in partnership with the Sheriff's Department to communicate to the residents that the ordinance would be in fact enforced at 6pm we were in fact lying to our residents. Although no citations were given that day for the ordinance violations, which I very much appreciate. And despite this being convenient and beneficial to the public safety during that weekend, I cannot stress that this kind of breach of trust cannot be the way we move forward.

So I ask you all that moving forward, if public safety is our concern in Isla Vista. That our number one concern should be that the trust between the public, the county and law enforcement be as strong as possible. The deltopia wouldn't be safe if people didn't trust law enforcement to do the job they need to do and to keep each other safe. And I asked that moving forward we initiate a very genuine and Strong commitment and investment of our time to building those community relations and strengthening those connections of trust between law enforcement and the community so that we can find better, more innovative ways and effectively apply the laws that we have and the tools that Sheriff's Department needs to get the compliance that they need to keep each other safe.

I cannot stress that programs like UCI Volunteer Program are extremely important, although some people may find them as just nice programs with nice names. In the year 2014 there was two students who potentially could have lost their life because of the fear that their friends who were overdosing might be arrested if they came outside. Our volunteers found them and were able to get the help that they needed so programs like this are not just a fancy name but it's a fancy title To make it look like we're doing something. We are and we're out there to help as much as we can, and we want to work with you as much as we can. Thank you for your time.

Good morning Supervisors and Chair. My name is Batsheva Stoll, I sit on Associated Students Senate. Last week my resolution was passed and so I'm just here to kind of like reiterate the argument of the piece and just kind of clarify. I know that some of the clauses are outdated due to the new narrow dates But the spirit of the resolution still stands. We're in support of the ordinance as long as it's being enforced on the date of Deltopia.

We want to make sure that when it is enforced, it's being enforced fairly and with understanding to the students because a lot of the time there can be kind of miscommunications with students and law enforcement so we urge all of you as reiterated to work with organizations like UCIV that volunteer to help students understand the law and kind of work as sort of a middleman to make sure everything runs smoothly on Deltopia. Thank you.

UnidentifiedUnidentified speaker 9Proposed55:24 · ≈ 9:55 AM

Well I will comment just that in regards to several public speakers mentioned the use of sanctioned events and before people rush to judgment on their effectiveness, I would point out that they have been in recent years a very integral part of the strategy on Halloween. That UCSB has run sanctioned musical events that have taken Maybe the large groups of people out of IV and out of harm's way and into a venue where it is more difficult to have alcohol or other substances, and where it is still possible to listen to music and have fun. So in addition to the rain which we can't really control that has been very effective part of dampening down Halloween recent years but these sanctioned events on Halloween have worked and have helped substantially, so I do think it's a worthwhile idea to explore in the future for Deltopia.

I'm not sure if it's the county's responsibility to get those sanctioned events. It may make sense for a more local entity closer to Isla Vista to do so but I do think we should think of that as part of the overall strategy.

UnidentifiedUnidentified speaker 17Proposed59:02 · ≈ 9:59 AM

Chair Hartman, members of the board. Dennis Buzanich from the County Executive Office here to present this item. On January 24th your board received a report from staff about the next steps necessary to aid in the formation of the Isla Vista Community Services District specifically for your board is authorized to appoint one member of the community To the Isla Vista Community Services District Board of Directors to an initial two-year term.

At that meeting on January 24th, you directed staff to conduct a broad advertising and recruitment campaign to develop an applicant pool for your consideration at today's hearing. And then it was also noted during the course of that hearing on the 24th That the possibility exists for a member of the community living outside of the district could be appointed by your board if a finding of necessity was made and the waiver of government code section 24001. And so today in We did conduct that campaign. We advertised both on the south coast, The Daily Nexus as well as in North and Central County through the Santa Maria Times, the Santa Ynez Valley News, Lawn Polk Record, Santa Barbara News Press, Santa Barbara Independent and then extensive social media outreach as well about this opportunity to serve on the Isla Vista Community Services District Board of Directors.

And in that valiant effort to advertise broadly we I'm able to surface one candidate who may be known to many of you. Mr. Bob Geis, former auditor controller for the County of Santa Barbara has presented himself as a candidate. We left that opportunity open for applicants until this past Friday and even provided the opportunity for candidates to present themselves at this hearing this morning I am not aware if you have any other candidates that are here today but it would be suggested that you could follow recommendations A and B and appoint Mr. Geis or any other member of the community that might present themselves today at this hearing.

With that, I conclude my remarks and open to any questions you might have.

Members of the board, Chairman Hartman welcome back. Supervisor Williams good to see you guys on the dais. You're probably thinking what is he doing? Well you know I'm looking to do something fun and working with special districts kind of, I started there 35 years ago. I started off in Isla Vista lived there for a year enjoyed the place you know cut my teeth in Isla Vista it helped me grow as a person. It's a great place You know, it's a youthful environment. It's a fun place to go. My kids went to school there.

They graduated...my daughter-in-law graduated from there and so I look at the university and I go you know it's a great place. It is a great community but I've lived through the 35 years of the challenges in Isla Vista and I think one of the challenges is its growing. Its getting bigger. Its getting busier and we have to Try a governance structure, which is the idea behind the Community Services District. Is to really grow the governance structure out there and to bring together the county, the university law enforcement, which is some problem both the sheriff services, the district attorney services all those things and so I kind of come from you know a special district environment hopefully in the formation I can help them form that district I love working with the young directors already.

I've met with a couple of them and you know they have great vision. You know in my career as Auditor-Controller we hired 75 people from UCSB or Cal Poly, we brought them through our new auditor training and development program. And you go well I learned just as much from them as they learned from me. I mean they brought technology gangbusters into the county and you know so you look at the youth and you say hey they can bring just as much to this community services district as I'll be able to. And hopefully, I'm kind of like the old guy there that still thinks he's 18 And you know, work with the district on formation to put the things in place that we need to get to so that hopefully we can fund the tax and we convince the community that that tax effort is to the beneficiary of everybody.

Maybe we'll have trouble with the longtime residents and and the property owners, but I think that they if we improve the community improve it for all the residents that's a beneficial tax for everybody. So hopefully we can help sell the tax bring the tax back and I can help in that effort at least during their first two years of the formation and that's what I look to do so thanks if you have any questions

CommentJeff FrapwellProposed · by introduction1:05:01 · ≈ 10:05 AM

Thank you Supervisor Wolf. Thank you Madam Chair, thank you Bob for being here. One question I'd like to ask you that has just been very perplexing to me is the fact that the tax didn't pass but the formation of the board did. How would you envision then financially maintaining the board when there's no financial allocation?

UnidentifiedUnidentified speaker 18Proposed1:05:31 · ≈ 10:05 AM

Well you know the first thing was well let's just go ask the county for some money. And that always exists but I've talked to a couple of directors and one of our jobs as a community service is losing votes Bob. But you know

UnidentifiedUnidentified speaker 19Proposed1:05:46 · ≈ 10:05 AM

we,

UnidentifiedUnidentified speaker 18Proposed1:05:47 · ≈ 10:05 AM

there's tangential things that the county does not tangential. We spend a lot of money in Isla Vista and we as a board of directors need to understand where that money is being spent so our job as the board of directors is To you know access those avenues, you know hopefully do the right things that we need to do and leverage the money that exists in Isla Vista. And the same thing with the university you know sometimes I say well we need to go extract money from the university. Well we need to go extract money from maybe the federal government, maybe the state government. You know we look at have to look at all those activities that we do and improve the operations and the infrastructure in Isla Vista. I had a lot of fun with the redevelopment agency, you know?

But that was extracting money from the other entities that existed within those tax rate areas so, you know, we have to look at those efforts and say You know we didn't get the tax passed but we need to make the district be viable and I think there's ways to do that by leveraging other resources, by getting ready to sell the tax again. And you know we're going to have to be a small board of directors that does the staff work in the district. That's what is going to happen, we are going to have a president, we are going to have a treasurer, we're going to have a secretary and somebody is going to be the clerk on the board so there's a lot of things to do there with no money.

Thank you Mr. Chairman and thank you for your comment on both the money and Mr. Geis' health. I've seen Mr. Geis in this building more often than some of us and some county staff so Bob apparently he's still invested in the future of our community's governance and I think that's really commendable, You have a lot to offer. I also want to remind the board that UCSB has committed some funds and has expressed willingness to still use those funds programmatically They have said we don't want to use those funds to cover staffing costs but we would use it for actual work. And the fact that board members and Bob are willing to put time in may facilitate getting some things done either absent staff or defraying staff costs because the real hurdle in the short term is how to get the organization to function without having any staffing costs, but having the potential to actually do work because of the commitment from UCSB.

So I think you are the piece that was missing in how to accomplish that and I have great hope in you, Bob.

UnidentifiedUnidentified speaker 18Proposed1:10:26 · ≈ 10:10 AM

Well, hopefully I'm the bridge from you five board members through the board to UCSB and help to improve the governance structures. Not to replace all of the things that you're responsible for out there or the department heads but maybe help to be a little bridge to get some things done out there. When we ran the redevelopment agency it was a bridge project too and it was so much fun to accomplish things out in Isla Vista and change the infrastructure out there in subtle ways that we don't realize. Hopefully, we can do the same thing with the governance structure and make the governance structure work for the community you know? We've always used to say at the county well we need a mayor out there I think Terry was the mayor at one point And you know it was, but you know we also need the board of directors who lives out there and goes through the day-to-day thing to help for me riding my bike in Talla Vista.

You know I'll be there But hopefully those are the people we have to listen to, to make change out there. They're the ones that are going to see the difference when you add 5,000 more new students into the university's population and how does that affect both IVA and UCSB?

Thank you Madam Chair, well Bob I think it would be a great choice. I just want to let you know expectation wise for me just so everybody knows and I'm sure you already know this that I am not interested in spending additional general fund to go out there and you know so the idea of coming back to the board and having us back fill until a tax passes for me two reasons why I don't want to do that one is we have A lot of other priorities, but number two is I think that totally hamstrings the ability for you to sell a tax in the future.

Supervisor Lanvin if we were ever to come back to the board and ask for money it wouldn't be just the general fund come do this. We would really want to come back to the county and say it's in our best interest the county and everyone else for the county to fund a certain thing out there. You know we sold that in our old days and I didn't sell this, Bill Wallace sold this and he had the vision to form the Isla Vista Redevelopment Agency and they did it for a different purpose but it turned into a whole different thing and it was actually a way to ask the county for funding and so you know whether we come back and say hey would the county ever fund an infrastructure financing district? I don't think we should close the door on that I would just like to say thank you so much for applying.

I wanted to mention as well, in addition UCSB has committed some funding and private funders have committed money to hire interns. The CSD really comes to us through heroic efforts by Supervisor Williams when he was in the Assembly but also many, many studies and grand jury reports. This has been something for decades that we need a governance structure that has locally elected people in Isla Vista and so finally after decades this is being realized so we're expecting great things. Chair Hartman, members of the board. Item 2 is brought to the board by Sheriff's and Probation Department. It's a hearing to consider recommendations regarding an agreement with the California Forensic Medical Group for health services at sheriff and probation detention facilities.

UnidentifiedUnidentified speaker 20Proposed1:16:36 · ≈ 10:16 AM

Chair Hartman and members of the board good morning it's our privilege to bring before you this morning culmination of several months of work in development of a contract with the California Forensic Medical Group. The contract that will be described to you will significantly increase the quality of patient care and significantly reduce the county's liability exposure.

We have developed a series of metrics designed to ensure transparency and accountability with respect to that care, some of those metrics are outlined in your board letter and the remainder are spelled out in exhibits H and I of the contract CFMG will work with Sheriff and Probation staff to evaluate these metrics, and we will work in conjunction with Public Health and Department of Behavioral Wellness to review the results.

We will report to this board on an annual basis the results of those metrics, and at our first annual report, we and the staff of CFMG will outline a plan for achieving accreditation for all of our facilities both Sheriff and Probation, and that plan will be fully executed by the end of year two. As outlined in the presentation, CFMG has a proven track record of service delivery and maintaining a zero vacancy rate with respect to staffing and customer satisfaction.

I'm presenting on behalf of the Sheriff's Office as Lieutenant Shawn Lammer and on behalf of the Probation Department and Chief Deputy Lee Bethel. We have also Chief Wasilewski and Chief Financial Officer Hope Vasquez and myself to answer any questions that you may have.

GuestLieutenant Shawn LammerSheriffProposedself-stated1:18:13 · ≈ 10:18 AM

Good morning Chair Hartman and Board of Supervisors. My name is Lieutenant Shawn Lammer of the Santa Barbara County Sheriff's Office, and I currently oversee the Custody Division's Medical Mental Health and Litigation. With me is Chief Deputy Lee Bethel from the Santa Barbara County Probation Department Chief Bethel and I are here to provide an overview of the health services contract with the California Forensics Medical Group or CFMG for our juvenile and adult populations respectively.

This contract will have no adverse effects on our populations, for the jail the level of service CFMGs provides increases to meet the needs of the Service Level Agreements or SLAs as we will later present in this presentation. This is done through continuous quality improvements, thorough mandatory reporting as well as internal and external oversight. There's a greater service level delivery for the staffing level provided by CFMG for the jail. This includes a built-in relief factor. Additionally there are monetary penalties associated with liabilities to meet accreditation and SLAs We believe this contract provides the greatest risk management mitigation for the county and for those individuals under the care of probations and sheriff's facilities.

UnidentifiedUnidentified speaker 21Proposed1:19:42 · ≈ 10:19 AM

California Forensic Medical Group shall commence performance on April 1st, 2017. Contract ending on March 31st, 2022 or earlier if terminated. The parties may agree to extend the term of the contract At one year increment, but may not exceed three one-year increments. These extensions are not granted without board approval. Furthermore any increase or decrease in monthly average daily population at the jail or juvenile facilities that exceed 15% over the current monthly average daily population May be used to open negotiations in adjusting either up or down our staffing levels in the facilities.

You may have noticed that unlike our previous contract, we have included the ability to decrease staffing based on average daily population.

For North Branch Jail considerations, we have the ability to go out for RFP or work diligently with CFMG for contract renewal which provides health services for both Main Jail and the North Branch Jail. Within 12 months of the start of this contract, CFMG will provide the Sheriff's Office an action plan which will allow us to be medical and mental health accredited by the National Commission on Correctional Health Care or NCCHC.

No later than two years from the contract start date. Sheriff's health care is currently not accredited progress toward accreditation goals shall be reported and discussed as a standard agenda item at each monthly medical advisory committee meeting known as MAC. For NCCH standards, the facilities have to follow NCCHE standards for a year before you can submit an application for review Therefore, the plan will be completed on time or earlier to reach the two-year goal of being NCCHC accredited. And no one else in California is currently NCCCHC accredited.

UnidentifiedUnidentified speaker 21Proposed1:22:03 · ≈ 10:22 AM

The Juvenile Hall and Los Perros Boys Camp are currently accredited through the State of California's Institute of Medical Quality. Within twelve months of this agreement start date, CFMG will submit to probation a plan outlining requirements for accreditation through NCCHC. Probation will make an assessment at that time and direct CFMD to either maintain IMQ accreditation or implement activities for accreditation through NCCHC.

Progress towards accreditation goals shall be reported and discussed as a standard agenda item at each MAC meeting. In the event CFMG fails to achieve or maintain the Sheriff's or Probation's accreditation, they will be considered in breach of contract and are subject to one-time penalty of $100,000 per facility.

Chair Hartman, members of the board, we have three requests to speak. Suzanne Riordan. Followed by Lynn Gibbs and then Roy Stoffer.

UnidentifiedUnidentified speaker 22Proposed1:32:33 · ≈ 10:32 AM

Good morning, Chair Hartman and Supervisors. I'm suffering from a mild version of PTSD after having spent several days reading accounts in the news of how inmates in various jails around our state that were contracting with California Forensic Medical Group died I came to the conclusion frankly after reading for days and days that it would be far best if we did not put some of these people in jail to begin with.

Many of them were there on fairly minor charges and they died very soon after they got into the jail. So given that fact, I wanted to just remind you that in 2015 Families Act proposed the idea to your board of creating a Jail Health Grievance Coordinator position and we were very grateful that your board I think unanimously decided to do this And Sheriff Brown hired Lieutenant Mark Meaghern to fill this position and there was some concern that Meaghern was from within the jail system and might not be the best person. But in retrospect he turned out to be a very good person to hold this position, and we're grateful that the sheriff decided to create a stakeholders committee to work with the grievance coordinator.

And I think that we've been working very well together because Families Act and NAMI and other groups are represented on this group. So, I've heard that our county is the only one in our state to have such a oversight group and that kind of a coordinator position and we definitely need it and I hope that other counties take the lead from what we've done and do the same in their county.

In addition to this, with the Sheriff's blessing Families Act had the idea to create a jail visitors project and volunteers have been staffing a table outside of the jail. on the weekends during visiting hours to interface with family members and with friends that are visiting their loved ones in the jail. And we have a form that these people can fill out if they have a concern about an unmet medical need, and I've heard that so far our volunteers have collected 50 such forms and provided them to the jail medical contractor.

Now, these concerns have not always been addressed in a timely fashion. And that is your time. So there's room for improvement. Thank you so much.

Honorable Supervisors, my name is Lynn Gibbs and I serve on the Community Corrections Input Group. And well, I'm not qualified to speak on the choice of contractor that's kind I'm not familiar with the selection process and that's appropriate. But, I did want to speak to the standard of care which I think is very important and I know that the Sheriff's Department looked very carefully at that in composing the RFPs.

Working with family members of persons with serious mental illness in the jail, I know how important psychiatric care is and how important it is to have a full-time psychiatrist on staff. So I was glad to see that included as well as an upgrade that the department's already made an intake in charge of intake, and that's helped a lot in getting people back on their medications when they get to the jail or enabling them to continue the medications they've been on. And the sooner people can get stabilized then the better off we all are and the sooner they can get out of the jail.

So I think that's really important and I'm glad to see so much attention was paid to it. As well, it seems really important to track performance and the measures that were defined look like good ones to me and I expect that the community corrections input group will Madam Chair and members of the board, I'm Roy Stauffer a board member of Families Act.

I congratulate you on having selected a new jail health care provider, California Furnace Medical Group. We must remember however that they are not a public agency but a private for-profit group and as such must be closely monitored to see that they provide the care we expect. The monitoring occurs in part through a county employee The Grievance Oversight Coordinator who inspects all grievances filed in the jail, attempts fixes, reports any problems independent of the sheriff. A very good program!

Attachment A of your board letter covers safety sales and ways to minimize the time that an inmate stays in one. Safety cell inmates are unable to file a grievance, so there is no external monitoring of this program to see that it is complied with. Mental health personnel are required to file a safety cell step-down form when anyone has been in the safety cell for more than 12 hours.

I suggest that the grievance oversight coordinator be allowed to monitor these safety cell step down forms as well as grievances. This would extend outside monitoring into another area of the jail medical care One where the inmate cannot defend himself. Thank you for listening to my suggestion.

CommentJeff FrapwellProposed · by introduction1:40:23 · ≈ 10:40 AM

Supervisor Wolf. Well thank you Madam Chair and thank you to those who spoke today. Many of you know that when I came onto this board 10 years ago, this issue of privatizing mental health services in the jail was a concern to me. That's when it came to the board and I was opposed to it at that time. But we worked with our provider. We worked with our Sheriff's Department and I think it was approximately two years ago when there was more information. We had our provider at that time come to the Board of Supervisors and give us updates, and we also had our stakeholders come. And I think because of that input that we were getting from our provider, the sheriff was very responsive. I want to thank you Sheriff Brown I think the grievance coordinator has done an excellent job in working with our stakeholders and I'm pleased to hear about this new program that you have outside the jail.

But the fact that there were 50 requests apparently, I think that information should also be included in the grievance coordinator report when we hear from Sergeant Mahurin. Because that's something new, a new protocol. So it would be good to include that. When we were going out for an RFP I was hoping that we would have public health and behavioral wellness be able to bid on the RFP so that we might be able to bring back our departments into the fold. We have behavioral wellness working in probation. So that was my hope but I understand that might have been too much at this time for our departments to take on.

So we went through this RFP process and I think it was very extensive, we had an outside consultant work with us and all of the folks who were involved in that process I want to thank you again because I think it was very well done You have incorporated within the contract, and we saw today that behavioral wellness and public health will be involved to some degree.

And I was also really pleased to see that within the contract even though I didn't see it initially you folks pointed it out to me that it's in the contract and you mentioned it today but the Board of Supervisors will get an annual review making sure That they are meeting the standards that we set out. And the standards, I think are very well thought out. I think they address the concerns that we've had as a board regarding medication, making sure that folks who come into the jail to the extent possible are given the same formularies when they're outside of the jail and medications ASAP so I mean there's a timeline for all of this and I think it is very helpful.

There is also the issue of trying to think of what the de-escalation piece that we had actually instituted I think it was maybe a year ago, continues to be part of this contract. I think that together this Board of Supervisors and the Sheriff's Department, the CEO's office and the stakeholders has done a really good job in bringing us this contract. At any point in the hearing, it might be good to hear from Correctional Health Services. I'd like to hear from one of you about What you foresee in the future working with the county.

And I want you to know that it's very important that you understand, which I'm sure you do from all of the meetings with our staff how important this issue is to the Board of Supervisors. Mental health services in the jail, medical services in the jail is of utmost importance. to us and to the community and to the inmate. So we want to make sure that those services are provided in a in the quickest and most appropriate way as possible. And so we will be monitoring the progress that you're all making, and I thank you for being here.

Under Sheriff Malekian, thank you very much. I just want to thank you personally for your work on this, and of course to all Folks who are working in the jail day in and day out, I know that it's not an easy task. And there, I'm just going to go back to the contract again because there is some, there are some statements in there about custody working directly with you folks. So I hope that cooperation and commitment remains.

And to probation. You guys, what you have right now is terrific. I've seen the mental health, well the health services that are going on in probation both at the hall and at Los Prados and I think it's exceptional so I want to thank you for all of the work that you're doing in probation. Thank you. Thank you Madam Chair.

On the cost and on the points mentioned by speakers though, one of the long term issues this brings to the fore is whether it really is appropriate for us to have as high of a misdemeanor arrest percentage in this county we have One of the highest or the highest and in the state, one wonders is that really appropriate? And we don't completely know where those folks are coming from. We don't know if it's sheriff's arrests or if that's city police arrests.

But for most of the mentally ill that are being arrested on misdemeanors, there are better places for them and cheaper places for them than the jail. And I, for one, just want to say my patience with this is not going Long lived. This is not the way we should be handling this population.

Sheriff Brown attended with me and others a stepping up initiative Diversion for folks who are committing misdemeanors, and I should mention Dr. Glycorn as well.

Moving them rather than bringing them to jail as the first option is getting assistance through our crisis stabilization unit. So I think your comments are well taken and I believe that there is an effort in this county with all of the partners The public safety partners, mental health, probation working together to address the issues that you're bringing up.

And thank you Supervisor Lavagnino for comments. Supervisor Wolf would you like to make a motion? PresenterKip HallmancompanyProposedself-stated1:52:46 · ≈ 10:52 AM

Sure. Supervisors Chair, I am Kip Hallman and CEO of the company. I'm here because we also care about this. I heard the speakers and I don't disagree with much of anything that they said. This is what we do, it's very important work and we are passionate about it. We currently serve 29 of the 58 counties in the state. Santa Barbara will be our 30th. And we have served that population in those counties for an average of about 15 years. So we have very, very long relationships with our county customers, with the people we serve.

And the reason for that is because we do what we say we're gonna do and this starts with I think from me all the way through to folks who work at the front lines of our company. We care about what we do. We care about the people we serve. We care about the inmates we take care of. And the people that work with us, our employees have an average employee level that's much like our customers. They're with us decades and because they care about this work. The most important thing we can do to change the quality of care provided in your jail is make sure that every day Everybody who was supposed to be there providing care is there. That's the first thing that we do and we take that very seriously I think across the state, the number of people that aren't at a post today There are a number of unfilled posts if there are any I could count them on one hand We just don't leave positions vacant first important thing second thing is the people we bring in to serve this population We are very careful about who we hire, and we take that seriously.

We pay people well and make sure that we have people who when they show up every day, they're excited to be there. They care, they're not just there to fill the hours and punch a clock. That's what's allowed us to continue to do what we do and why we serve now 30 hopefully today, 30 counties in this state because of that. And so you know we will be available from my level down. My business card if somebody calls the number on my business card it rings my cell phone I'm very accessible, I'm here today for that reason. So we appreciate what you guys are doing, we appreciate what Sheriff Brown is doing and his department is doing.

Interestingly, I was also at Stepping Up. We actually helped fund Stepping Up in California. We think this is a very important thing and so we also agree that trying to take people who shouldn't be in jail if we can help move those people into other places, that's a wonderful thing. Our job is to take care of the people that are in the jails we serve. And we do that, we do that well but we're certainly supportive of this population so at the same time thank you.

I'm sorry Supervisor Wolf just one other thing I just wanted to tell the board for full disclosure and that is that the speaker spoke to it when the presentation so this is for the existing South County Jail When it comes time for the Northern Branch Jail, we have an ability to work with a contractor but just to remind you also in the numbers that we have and for the operating fund we've included services. We included some escalation but I don't believe we included escalation that would cover these types of costs so we'll be reviewing that and coming back to the board when we look at the operating cost for the Northern Branch Jail.

UnidentifiedUnidentified speaker 1Proposed2:12:11 · ≈ 11:12 AM

Chair Hartman and members of the Board, Item 3 is from Behavioral Wellness. It's a hearing to consider recommendations regarding the Alcohol and Drug Programs Drug Medi-Cal Organized Delivery System Demonstration Waiver Implementation Plan Overview.

CommentSergeant MahurinProposed · by introduction2:12:26 · ≈ 11:12 AM

Okay Dr. Greg Hart.

UnidentifiedUnidentified speaker 24Proposed2:12:29 · ≈ 11:12 AM

Good morning Chair Hartman, members of the board. I am coming before you today to follow up on a presentation in May of 2016 on the opportunity for drug Medi-Cal expansion through the organized delivery system 1115 waiver and I'm going to walk you through some of the details of our planning process and the plan that we will submit to the state I'm happy to go into more details, but I do not anticipate that it's going to take the hour and a half that we agendized for this. So that is my goal for today.

So on May 3rd, 2016 we introduced the Drug Medi-Cal Organized Delivery System affectionately known as ODS to the Board of Supervisors. We were asked to return with an outline of our plan before submitting the plan to the State Department of Health Care Services for approval. The Drug Medi-Cal ODS system will improve the quality and availability of substance use disorder services for California, and Santa Barbara specifically, beneficiaries. It will expand and enhance the existing Drug Medi-Cal covered benefits.

It will give county officials more authority to select qualified providers and create a consumer focused and evidence based system of care. Critical elements of the ODS include a continuum of care modeled after the American Society of Addiction Medicine, known as ASAM criteria. Increased local control and accountability for our providers and services. Greater administrative oversight.

Utilization controls to improve care and manage our resources. Evidence based practices as a requirement, coordination with other system of care and expanded benefits. So this is a very brief sketch of some of the current Drug Medi-Cal benefits and some of the expanded benefits that the organized delivery system will allow us to include within different modalities of services.

So currently we're able to provide group counseling, individual sessions for assessment, individual crisis sessions outpatient treatment plan review sessions, and discharge planning individual sessions. The expansion would include non-perinatal residential treatment services, case management services, recovery support groups and or individual sessions for aftercare services, withdrawal management and regular individual sessions in addition to the currently covered sessions.

So highlights of the Santa Barbara implementation plan include a fully collaborative planning process that was conducted in the last year, provision of all of the required service benefits, inclusion of some optional benefits including medication assisted treatment services. Possible inclusion of medical detoxification and recovery residents, also known as sober living services if we're able to expand those.

Emphasis on quality control and quality management, extensive training and technical assistance, and a competitive provider selection process. So we will be required to provide under the ODS early intervention, outpatient services that would include intensive outpatient treatment and naltrexone services. Residential treatment, currently we're limited to perinatal residential. This will add residential treatment for all other populations.

Narcotic treatment programs which exist currently, withdrawal management at least one level. Recovery services, case management and physician consultation. Our county responsibilities in implementing the organized delivery system include conducting a selective provider contracting process. It also includes access, specific selection criteria, a contract denial and appeal process and specific provider requirements.

Just for clarification, currently under the existing Drug Medic Health System any provider can become drug medic health certified at the state. This will allow us to conduct RFPs where we select specific providers. We do not have to contract with all providers under the ODS. Additional county responsibilities will include authorization for residential treatment, a beneficiary access number which is open 24-7 and is toll free.

Beneficiary informing upon the first contact with the individual, care coordination, quality improvement utilization management and accounting implementation plan and contract with the state. So what is our timeline for this? We plan once this is approved by your board to submit the final version of our plan to Department of Health Care Services by May 1. The approval process for CMS, the federal government and DHCS will probably take somewhere between June and July to obtain.

If that is granted successfully we expect our negotiation of rates for these services to happen in September and November. With final approval of the plan and rates in November 2017. We would then come back to this board with the intergovernmental agreement with CMS and DHCS in December. And this says to begin the provider selection process in January 2018, although we can begin conducting RFPs for our existing services sooner than that and for the new services follow up with RFPs at that time frame.

And then finally begin delivering the organized delivery system services in fiscal year 18-19. So some of these items will depend on how quickly DHCS and CMS respond, but that's our initial time frame. I'm happy to answer any questions by the board and there's plenty more details in the letter but I was trying to limit myself to the slides allowed Do

CommentSergeant MahurinProposed · by introduction2:20:05 · ≈ 11:20 AM

any Supervisors have any questions for Dr. Glacorn before we go to public comment? Okay Mr. Allen do you have any members of the public who would like to comment?

Chair Hartman, Members of the Board one request today from Suzanne Riordan.

2:20 – 2:2717 turns

UnidentifiedUnidentified speaker 22Proposed2:20:32 · ≈ 11:20 AM

I thought there'd be a lot more detail, and I haven't really followed closely what the department is planning to do. But it's obvious that the whole question of substance use is terribly important in many different areas that our county government deals with including the jail. It's terribly, terribly important. And one of the things that I realized as I was reviewing the news stories about inmates who died under the care of this group that we've just contracted with It appeared that the vast majority had a substance use problem and made them very vulnerable physically, emotionally and mentally on all levels when they entered the jail. So it's critically important. Historically our county has really not done enough to serve this population.

I mean the name of our mental health department was Alcohol Drug And mental health services. But the alcohol-drug side of the equation has really been underfunded for so, so long and it's just terribly important that we correct this. That we redress the balance. I guess that's all I can say right now. I'd like to work more closely with Dr. Gleghorn and see if we can do something. Residential treatment, we've been saying for 11 years since we've been standing here. Families Act has been saying its critically important and severely lacking in our county And you know, one of the problems that we all have to deal with is that people who are sometimes needing a tremendous amount of help don't always volunteer for it.

So that's why our organization has an interest in the proposal that Dr. Leghorn has put to the Community Corrections Partnership to create a locked facility using the facility of the old juvenile hall. For people that are considered incompetent to stand trial and probably a broader population, but so many of them are going to need treatment in a locked facility that's not a jail. So I think that idea has potential but we'll have to take a very close look at it and The supervisors will be following closely the plan.

And I do appreciate what Supervisor Williams pointed out about the misdemeanor arrest rates in our county, it's deplorable and we've got to do something about that and somehow we have to meet with the police department you know the city and the County Sheriff's Department and the probation department and turn that one around And one thing that I'll mention since there's a couple more seconds, the drug laws in our state have changed drastically in the last few years. But one area that they haven't really affected is probation violations and if you look closely at what's going on With someone who's caught up in that revolving door cycle, who is under the supervision of probation. They constantly get rearrested for drug use and in many cases no help is coming to them and it's a complex thing to resolve.

Thank you. Thank you. Supervisor Adam?

UnidentifiedUnidentified speaker 5Proposed2:23:38 · ≈ 11:23 AM

What I'm not hearing about here Dr. Blaghorn is how we are going to be measuring success as defined by moving people through the system as part of this. Is there such a thing and I missed it?

UnidentifiedUnidentified speaker 24Proposed2:23:53 · ≈ 11:23 AM

Supervisor Adam, through the Chair. Yes I could actually probably find the page for you but the nice thing about the organized delivery system statewide is that as part of participation we are required to provide data to UCLA who is going to be conducting a broad outcome study of all the counties that participate so that is a requirement and County alcohol and drug systems participate actively in the, it's called CalOMS, the California Outcome Measurement System. So every client that enters into a treatment program is assessed at baseline and then at prescribed periods for follow-up and at discharge so this contract with UCLA will give them access to pull that data and analyze that data for specific outcomes Broad sense across the state so we will be part of that and it's part of the obligation if you look at the plan there is a section on that.

UnidentifiedUnidentified speaker 5Proposed2:24:59 · ≈ 11:24 AM

So when did that start? CalOMS.

UnidentifiedUnidentified speaker 24Proposed2:25:03 · ≈ 11:25 AM

Oh, CalOMs has been in existence for I'm going to say a dozen years. It's been about a dozen years.

UnidentifiedUnidentified speaker 5Proposed2:25:13 · ≈ 11:25 AM

Remember we talked about this for a long time and we ended up being able The only thing that we could do, I'd never heard about this before. It's the first time I've heard of this and we were going to start with the cans and the mowers

UnidentifiedUnidentified speaker 24Proposed2:25:29 · ≈ 11:25 AM

So those are measurements on the mental health side of the house. The system on the substance abuse side is different. Mental health does not have a parallel quality outcome measurement system that's directed by the state and so that's why we've implemented those measures locally. They have something that's very basic called CSI, I don't even remember what that stands for but it's essentially demographic information But the substance abuse system does have a much more robust, it's not perfect but CalOMS does give you this level of information at baseline and at discharge and at intervals along if you're in more than 90 days. So we do have that ability on the substance abuse side. So

UnidentifiedUnidentified speaker 5Proposed2:26:13 · ≈ 11:26 AM

Wow

UnidentifiedUnidentified speaker 24Proposed2:26:19 · ≈ 11:26 AM

With varying levels of accuracy and completeness from the different providers but it does give us something to work with. The items in CALOMS are based on an abbreviated version of the Addiction Severity Index, the ASI which is a recognized tool across the country for looking at substance abuse conditions

UnidentifiedUnidentified speaker 5Proposed2:26:40 · ≈ 11:26 AM

You know I would love to have us come back and have a report on where we are today and where we started out historically. And to see what the trends are on that.
